According to a survey by the Society of Human Resource Management, nearly half of employers conduct credit checks as part of background hiring investigations. To be sure, credit history is not the be-all and end-all of hiring. In fact, according to the survey, nearly all of the organizations that conduct credit background checks reported hiring a job candidate whose credit report contained information that "reflected negatively on his or her financial situation." The survey also found that credit checks are typically used at the end of the hiring process, with 91% being conducted "after a contingent job offer or job interview" and just 2% initiated before an interview occurs.

It turns out that when it comes to job hunting, a bad credit score might not be the red flag many had feared. Even though more employers are relying on credit scores to check the desirability of job candidates, evidence is scant that a checkered credit history actually hurts people in the job market, according to a new study from economists at Princeton University, University of Chicago, the Federal Reserve Bank of New York and the Social Security Administration. Using credit scores for hiring has become an increasingly hot-button issue with lawmakers and public policy advocates. Critics have argued that the widespread trend of checking applicants’ credit scores creates unfair obstacles to Americans who are trying to get back on track.

Recently, there have been increased enforcement actions, scrutiny and lawsuits brought by the Equal Employment Opportunity Commission (EEOC) challenging the use of credit and criminal history background checks. In addition, there has been an increase in lawsuits surrounding the Fair Credit Reporting Act (FCRA), including costly challenges related to obtaining proper consent to conduct such checks. There have also been "ban the box" initiatives at the state level that restrict whether an employer can ask about prior convictions. And, some states and municipalities even restrict an employer's use of credit reports. With so many rules and regulations, in addition to recent changes to the FCRA, here is some guidance on how to interpret it all. Changes to the Fair Credit Reporting Act The FCRA requires employers and consumer reporting agencies to provide additional information and disclosures to job applicants and employees prior to obtaining a consumer report, which includes credit reports and background checks, for employment purposes. Employers are also required to provide additional disclosures to applicants and employees both before and after taking any adverse action based, in whole or in part, on the information contained in this report.
Background checks, particularly those that exclude applicants based on criminal history, are at the forefront of the EEOC’s priority to eliminate barriers in recruitment and hiring. Despite suffering a recent embarrassing defeat in the U.S. Court of Appeals for the Fourth Circuit, the EEOC likely will continue to closely scrutinize policies and practices that exclude applicants based on criminal and credit history, even if such policies are facially neutral.
