One of the founders, Joey Rocco, sent a statement that read,"...the dictionary definition for 'graphic' includes 'detailed' and Instant Checkmate does believe the reports are detailed." When asked about the accuracy of the reports, he said,"...the website stresses that the information may not be 100% accurate as it relies on public records (which may not always be complete or accurate)." The Federal Trade Commission filed charges against Instant Checkmate in March and said the site offered itself as a way to do background checks for jobs and renters without taking reasonable steps to make sure that they were accurate. Documents showed the company settled the case last month, with the FTC asking for a fine of about $500,000 and for the company to follow the law.

"Is your neighbor a sex offender? Is your boyfriend violent? Are you dating a cheater? You could be letting someone dangerous into your life, and you don't even know it," that's an ad all over social media right now for a new online background check website. It's for a background check website called Instant Checkmate. Go to the site - it says you can get "shocking" and "sensitive information to satisfy your curiosity, protect your family and find the truth." But can you trust it?
Instant Checkmate, Inc. was hit with a deceptive marketing class action lawsuit alleging the background checks it sells only provide some of the information that it advertises, forcing customers to pay additional fees for more information. The Instant Checkmate class action lawsuit was filed by plaintiff Milo Illich on Dec. 31, 2014 in a California federal court. The background checks at issue are sold through the website www.instantcheckmate.com, which claims that that it sells background checks to consumers who want to learn more about their “family and friends.” According to ads on the website, the company says that the reports include “REAL police records (driving citations, speeding tickets, felonies, misdemeanors, sexual offenses, mugshots, etc), background reports, marriage/divorce history, address information, phone numbers, a history of lawsuits and much more.”
Instant Checkmate and InfoTrack sell public record information about consumers. According to the FTC’s complaints, both companies operated as consumer reporting agencies under the law but failed to abide by the FCRA. The FTC charged, among other things, that in many instances InfoTrack provided inaccurate information suggesting that job applicants potentially were registered sex offenders, possibly causing employers to reject their job application. According to the complaint against Instant Checkmate, that company failed to require that users of its reports identify themselves or certify the purpose for which they were seeking consumers’ information.
