The Child Care Development Block Grant (CCDBG) Act of 2014 sought to make child care safer by ensuring that the adults working with or in proximity to children have not committed violent crimes, child abuse, or sexual offenses. The new federal laws require Wisconsin to establish and manage a system of background checks that will apply to all regulated child care providers. DCF currently conducts background checks on all applicants for a child care license and any household members.

While In-Home Care Organizations (HCOs) have had few laws and regulations over the years, they have become increasingly regulated the state of California with the implementation of the Home Care Services Consumer Protection Act of 2013 (AB 1217). An ideal background check accomplishes two goals: identifying the preferred candidate for the job while reducing an employer's potential legal liability. Studies suggest that somewhere between 75 and 90 percent of employers perform some type of background check on job applicants or current employees. Some companies do so because they are legally obligated under federal or state laws (see e.g., the Wisconsin Caregiver Law, which requires that background checks be performed on certain healthcare workers). Most often, however, employers run background checks to verify that applicants have been truthful on their employment application and/or to ensure that applicants do not have something in their history that would render them ill-suited for the job. Given the trust and dollars that organizations invest in employees, this makes good sense.
