METHOD OF EVALUATION

Students will be evaluated based on the following: a take-home midterm assignment (30%); two short writing assignments (10% per assignment); and a final exam (50%).  The final exam will be open book.



COURSE DESCRIPTION

How should or can a legal wrong be remedied?  Despite its overriding importance, the question of remedy is often an afterthought. This course asks what a successful litigant is entitled to and why.  Our primary focus will be civil judicial remedies in private law disputes.  We will also consider constitutional and administrative law cases and the concept of public law remedies.


Topics will include: damages, punitive damages, specific performance, injunctive relief, and restitution.
