๐ Use checklist to document and inspect the evaluation report to ensure MN Eligibility Criteria has been met; determine whether your district will accept the evaluation and determination of eligibility.ย
๐ Inspect and implement the current or stay-put IEP until an initial evaluation or IEP is completed.ย
๐ Can you determine that your district is able to implement the IEP without significant changes?
๐ YES: Contact the parents to share the service plan (this is not an official IEP meeting unless the parents request).ย This contact should be documented in the PWN.ย
๐ NO:ย Hold an IEP meeting immediately if you determine the IEP cannot be implemented as written and discuss changes to the IEP. If you make only โsignificant changesโ and do not write an entire new IEP, send amended IEP with changes indicated, Prior Written Notice/Parental Consent form to parents. You do NOT change the Annual IEP date.ย
๐ Send the current, new, or amended IEP, Prior Written Notice/Parental Consent to parents. If writing a new IEP, you now have a new Annual IEP date. This process must be completed in a reasonable amount of time.
๐ If placement is questionable, serve under current or stay-put IEP and refer for evaluation immediately. Follow all rules for evaluation procedures. According to MDE, this is an initial evaluation, and an Out-of-State Student must meet initial Minnesota criteria.ย
No Records for MN or Out-of-State Students
๐ Ask if parents have records; OR
๐ Call previous district; district must provide in 10 working days.ย
๐ Document that district has sought records.
๐ If verbal confirmation of special education service are obtained from the previous district or parents, but no paperwork arrives, hold an intake/parent meeting:
๐ If parents or pupil supply information about previous services and programming, provide general education interventions and accommodations until records can be obtained or an initial evaluation is completed.
๐ If records do not arrive, refer the pupil to problem solving/child find team; this team will then follow the pre-referral intervention process.
