परिहार व्यवस्था
Remission-
Remissions shall be of the following types
(a) Ordinary remission.
(b) Special remission.
(c) Remissions awarded by general or special orders of the State Government.
Cases in which no remission is earned-
No remission shall be earned on the portion of a sentence undergone by a prisoner while released conditionally or on probation under the ‘U.P. Prisoners’ Release on Probation Act,1938 (Act no. VIII of1938) or on suspension of sentence under the orders of the State Government.
No ordinary remission shall be earned in the following cases-
(i) in respect of any sentence of rigorous imprisonment for a period of less than two Months
(ii) in respect of any sentence of simple imprisonment, except for any continuous period, not being less than one month, during which the convict labours voluntarily,
(iii) In respect of any sentence passed in default of payment of fine only which is not annexed to a term of substantive sentence for which the prisoner is otherwise eligible for remission.
(iv) prisoners who are admitted in hospital as indoor patients owing to self-inflicted injuries for such period as would be decided by the Superintendent.
(v) prisoners who have been specifically debarred from remission under any statute or rule or judicial order.
NOTE:
If a convict’s sentence is reduced on appeal to that of less than two months’ imprisonment, he shall cease to be eligible for ordinary remissions under these rules, and any remission that he may have earned prior to the reduction of his sentence shall be forfeited.
परिहार व्यवस्था
परिहार :
परिहार निम्नलिखित प्रकार के होंगे-
(क) साधारण परिहार
(ख) विशेष परिहार
(ग) राज्य सरकार के सामान्य या विशेष आदेशों द्वारा दिये गये परिहार
ऐसे मामले जिनमें कोई परिहार अर्जित नहीं होता है-
यू0पी0 प्रिजनर्स रिलीज आन प्रोबोशन एक्ट 1938 (एक्ट सं0 आठ 1938) के अधीन सशर्त या परिवीक्षा पर विमुक्ति पर या राज्य सरकार के आदेशें के अधीन सजा के निलम्बन पर किसी बंदी द्वारा भुगते जा चुके सजा के अंश पर कोई परिहार अर्जित नहीं होगा
निम्नलिखित मामलों में कोई सामानय परिहार अर्जित नहीं होगा :
(एक) दो माह से कम अवधि की सश्रम कारावास की सजा के सम्बन्ध में।
(दो) साधारण कारावास की किसी सजा के सम्बन्ध में किसी निरंतर अवधि जो एक माह से कम न हो जिसके दौरान सिद्धदोषी स्वेच्छया परिश्रम करें को छोड़कर ।
(तीन) जुर्माना का भुगतान मात्र न करने मात्र के कारण पािरत किसी सजा के सम्बन्ध में जिसे मूल सजा की अवधि में जिसके लिए बंदी अन्यथा रूप से परिहार का पात्र था जोड़ा नहीं गया है।
(चार) ऐसे बंदी, जो अपने से लगायी गयी चोटों के कारण अन्तः रोगियों के रूप में अस्पताल में ऐसी अवधि के लिए भर्ती हो जैसा कि अधीक्षक द्वारा विनिश्चित किया जाय।
(पॉच) ऐस बंदी, जिन्हें किसी संविधि या नियम या न्यायिक आदेश के अधीन परिहार से विशेष रूप से वंचित किया गया हो।
टिप्पणी :
यदि अपील करने पर किसी सिद्धदोषी की सजा को घटाकर दो माह के कारावास से कम किया जाता है तो वह इन नियमों के अधीन सामान्य परिहार के योग्य नहीं रह जायेगा और कोई परिहार जिसे अपनी सजा को कम करने के पूर्व उसने अर्जित किया रहा हो, जब्त हो जायेगा।
If a convict is sentenced for an offence committed after his admission to jail, under sections 147, 148, 152, 224, 302, 304, 304-A, 306, 307, 308, 323, 324, 325, 326, 332, 333, 352, 353 or 377 of the Indian Penal Code, 1860 (Act no.45 of 1860) or for an assault committed after his admission to jail on a warder or any other officer, the Director General (Prisons) may order the whole or part of any remissions earned by the convict up to the date of the said conviction.
परिहार का जब्त किया जाना
यदि कोई सिद्धदोषी, भारतीय दण्ड संहिता 1860 (अधिनियम संख्या 45 सन् 1860) की धाराओं 147, 148,152, 224, 302, 304, 304ए, 306, 307, 308, 323, 324, 325, 326, 332, 333, 352 अथवा 357 के अधीन जेल में प्रविष्टि के पश्चात कृत किसी अपराध या जेल में प्रविष्टि के पश्चात किसी वार्डर या किसी अन्य अधिकारी पर कृत प्रहार के लिए दण्डित किया जाता है तो महानिदेशक कारागार उक्त सिद्धदोषी के दिनांक तक सिद्धदोषी द्वारा अर्जित सम्पूर्ण परिहार या उसके किसी भाग को जब्त करने का आदेश दे सकता है।
The Superintendent may, with the previous sanction of the Director General (Prisons) re-admit to the remission system any convict who has been removed there from under the rules contained in Chapter XXX. Such convict shall begin to earn remissions from the commencement of the calendar month following the date of such re-admission.
परिहार व्यवस्था में पुनः प्रवेश
महानिदेशक कारागार की पूर्वानुमति से अधीक्षक किसी सिद्धदोषी को जिसे अध्याय तीस में दिये गये नियमों के अधीन परिहार व्यवस्था से हटा दिया गया हो इस व्यवस्था में पुनः प्रवेश दे सकता है। ऐसा सिद्धदोषी इस प्रकार पुनः प्रवेश के दिनांक से अगले कैलेण्डर माह के प्रारम्भ से परिहार अर्जित करना शुरू कर देगा।
Ordinary remissions shall be awarded on the following scale :
(a) Three days per month for thoroughly good conduct and scrupulous attention to all prison regulations.
(b) Three days per month for industry and the due performance of the prescribed daily task.
Explanation- A convict who is unable to labour through causes beyond his control such as his being in Court, in transit from one jail to another, in hospital or in an infirm gang, shall be granted remission under the following clauses :-
(a) on the scale earned by him during the previous month, if his conduct prior to and during the period in question has been such as to entitle him to the grant of such remission convict shall also be entitled to the grant of remission under clause.
(b) on the scale earned by him during the previous month, if he was working during that period. If not, remission shall be awarded to him at the rate of three days per month :
Provided that if his absence from work is due to his own misconduct in jail, no remission under clause (b) shall be awarded to him for the period of such absence:
Provided further that if he is in a hospital or in an invalid gang, no remission under clause Shall be granted unless the Medical Officer certifies that the convict’s absence from labour is due to causes beyond his control and is in no ways caused by any action of the convict himself with a view to escape work or to get into or to remain in hospital.
Prisoners sentenced by Court martial shall be granted ordinary remission of the period they pass in transit, or in military custody, before their admission in prison on the same scale as laid down in these rules.
सामान्य परिहार का मापदण्ड
सामान्य परिहार निम्नलिखित मापदण्ड पर प्रदान किये जायेंगे :-
(क) पूरी तरह से अच्छे व्यवहार और सभी कारागार विनियमों के प्रति निष्ठा से ध्यान देने के लिए प्रतिमाह तीन दिन।
(ख) उद्यम और निर्धारित काया्रें के सम्य्कनिष्पादन के लिए प्रतिमाह तीन दिन।
स्पष्टीकरण-कोई सिद्धदोषी ऐसे कारणों से जो उसके नियंत्रण से बाहर हो जैसे उसके न्यायालय में होने एक जेल से दूसरे जेल में जाने, अस्पताल में अथवा किसी कमजोर टोली में होने से श्रम करने में अयोग्य हो तो उसे निम्नलिखित खण्डों के अधीन परिहार स्वीकृत किया जायेगा -
(क) पूर्व माह के दौरान उसके द्वारा अर्जित मापदण्ड पर यदि उसका आचारण इससे पहले और प्रश्नगत अवधि के दौरान उसका आचरण ऐसा रहा हो जिससे वह ऐसा परिहार स्वीकृत करने का हकदार हो तो वह इस खण्ड के अधीन भी परिहार अर्जित करने का हकदार हो जायेगा।
(ख) यदि वह उस अवधि में करता रहा हो तो पूर्व माह में उसके द्वारा अर्जित मापदण्ड पर दिया जायेगा। यदि नहीं कर रहा हो तो प्रतिमाह तीन दिन की दर से परिहार प्रदान किया जायेगा।
प्रतिबंध यह है कि यदि कार्य से उसकी अनुपस्थिति जेल में उसके अपने कदाचार के कारण हो तो उसे ऐसी अनुपस्थिति की अवधि के लिए खण्ड (दो) के अधीन कोई परिहार नहीं दिया जायेगा।
अग्रतर प्रतिबंध यह है कि यदि वह अस्पताल में है या किसी अवैध टोली में है तो खण्ड (एक) के अधीन कोई परिहार नहीं स्वीकृत किया जायेगा जब तक कि चिकित्सा अधिकारी प्रमाणित न कर दे कि सिद्धदोषी की कार्य से अनुपस्थिति ऐसे कारणों से है जो उसके नियंत्रण के बाहर है और कार्य से बचने अथवा अस्पताल में जाने या वहां बने रहने की की दृष्टि से सिद्धदोषी की स्वंय की किसी गतिविधि के कारण हुई है।
सेना न्यायालय द्वारा दण्डित बंदियों को जेल में उनके प्रवेश से पूर्व गमनागमन में व्यतीत की गयी अवधि अथवा सेना की अभिरक्षा की अवधि का सामान्य परिहार उसी मापदण्ड पर स्वीकृत किया जायेगा जैसा इन नियमों में निर्धारित है।
In lieu of the remission allowed under the preceding paragraph, convict warders shall receive ten days of ordinary remission per month, convict overseers eight days per month and convict night watchmen seven days per month. Convict overseers employed on duty on the main walls or outside the barracks at night shall receive two days’ ordinary remission per month in addition to the remission granted under this rule. The grant of this remission shall be subject to thoroughly good conduct, scrupulous attention to all prison regulations and the due performance of duty on the part of the convict officers.
बंदी अधिकारियों के लिए सामान्य परिहार का मापदण्ड
पूर्ववर्ती प्रस्तर में अनुमन्य किये गये परिहार के बदले में बंदी वार्डर प्रतिमाह दस दिन का परिहार प्राप्त करेंगे। बंदी ओवर सीयर प्रति माह आठ दिन और बंदी रात्रि प्रहरी प्रतिमाह सात दिन का परिहार प्राप्त करेंगे। बंदी ओवर सीयर जो मुख्य दीवार या बैरकों के बाहर रात्रि में ड्यूटी पर तैनात किये गये हैं इस नियम के अधीन स्वीकृत परिहार के अतिरिक्त दो दिन का सामान्य परिहार प्राप्त करेंगे। इस के अधीन स्वीकृत किये जाने वाला यह परिहार पूरी तरह से अच्छा व्यवहर और सभी कारागार विनियमों के प्रति निष्ठा से ध्यान देने और बंदी अधिकारियों द्वार कर्तव्यों के सम्य्क निर्वहन के अध्यधीन होगा।
Subject to good work and conduct in jail, convicts of the scavenger class working as scavengers in jails, or convicts whom on administrative grounds it is not found expedient to promote to the grades of convict officers, shall, though they may not be appointed convict officers, be entitled to receive ordinary remissions at the scales sanctioned in the preceding paragraph for convict night watchmen and convict overseers, respectively, with effect from the first day of the month following the one on which they would, but for this rule, be eligible for promotion to those grades.
मेहतर झाडू बहारू के कार्य में लगे सिद्धदोषियों को परिहार
जेल में अच्छे कार्य और आचारण के अध्यधीन जेल में मेहतर श्रेणी के सिद्धदोषी अथवा जिन्हें प्रशासनिक आधारों पर बंदी अधिकारी की कोटि में प्रोन्नत किया जाना समीचीन नहीं पाया गया हो यद्यपि उन्हें बंदी अधिकारी नियुक्त नहीं किया जा सकता है, भी उस माह के जिसमें वे इस नियम के अधीन उन कोटियों में प्रोन्नति के लिए अर्ह हुए होते, अगले माह के प्रथम दिवस से क्रमशः सिद्धदोषी रात्रि प्रहरी और सिद्धदोषी ओवर सीयर के लिए पूर्ववर्ती प्रस्तर में स्वीकृत किये सामान्य परिहार प्राप्त करने के हकदार होंगे।
Convicts who become experts in any industry may be granted remissions admissible under rule 158 in lieu of promotion to the post of convict officers. Special remissions at double rates shall be granted to convict employed of wool carding.
किसी उद्यम में प्रवीणता या रूई धुनाई में योजित सिद्धदोषियों का परिहार
ऐसे सिद्धदोषी जो किसी उद्यम में प्रवीण हो जाते हैं, को बंदी अधिकारी के पद पर प्रोन्नति के बदले में नियम 158 के अधीन अनुमन्य परिहार स्वीकृत किया जा सकता है। रूई धुनने के कार्य में नियेजित सिद्धदोषियों को दुगने दर पर विशेष परिहार स्वीकृत किया जायेगा।
Subject to the provisions of rule 156 ordinary remissions under rule 157 shall be a calculated from the first day of the calendar month next following the date on which the convict is committed to jail, or, if he was in jail as an under-trial prisoner on the date of sentence, the date of such sentence. Any convict who, because of his having been released on bail or of his sentence having been temporarily suspended, is afterwards re-admitted to jail, shall be brought under the remission system on the first day of the calendar month next following such re-admission, but shall be credited with any remission which he may have earned as a convict previous to his release on bail or the suspension of his sentence. Remissions under rule 158 shall be calculated from the first day of the calendar month following the appointment of the convict as a convict warder, convict overseer or convict night watchman.
परिहार का आरम्भ
नियम 156 के उपबंधों के अध्यधीन रहते हुए नियम 157 के अधीन सामान्य परिहार की गणना जिस दिनांक को बंदी को जेल में सुपुर्द किया गया हो उसके आगामी कैलेण्डर माह के प्रथम दिनांक से की जायेगी अथवा यदि वह दण्ड के दिनांक को विचाराधीन कैदी के रूप में जेल में था तो दण्ड के ऐसे दिनांक से की जायेगी। कोई सिद्धदोषी जिसे जमानत पर मुक्त किये जाने या उसके दण्ड के अस्थायी निलम्बन के कारण बाहर रहा हो और बाद में पुनः जेल में प्रवेश दिया गया है तो उसे परिहार व्यवस्था में ऐसे पुनः प्रवेश के दिनांक के अगले कैलेण्डर माह के प्रथम दिनांक से लाया जायेगा, परन्तु उसके जमानत पर मुक्ति अथवा दण्ड के निलम्बन से पूर्व सिद्धदोषी के रूप में जो परिहार उसने अर्जित किया रहा होता वह परिहार उसके परिहार लेखा में जमा किया जायेगा। नियम 158 के अधीन परिहार की गणना सिद्धदोषी के बंदी वार्डर, बंदी ओवरसीयर या बंदी रात्रि प्रहरी के रूप में नियुक्त दिनांक के आगामी माह में प्रथम दिनांक से की जायेगी।
Convicts employed on prison services, such as cooks, scavengers, store-keepers, lamp cleaners, hospital attendants, and barbers etc., who ordinarily work on sundays and other jail holidays, may be awarded one day’s ordinary remission for each complete calendar month during which they have been so employed, in addition to any other remission earned under these rules.
Convict warders and convict overseers shall, however, not be eligible for remissions under this rule.
अवकाश के दिनों में कार्य करने वाले बंदियों को परिहार
कारागार सेवाओं जैसे रसोईया, मेहतर, भण्डारपाल, लैम्प सफाईकर्मी, अस्पताल परिचर और नाई में योजित बंदियों, जो रविवार या अन्य जेल अवकाश के दिनों में सामान्यतः कार्य करते हैं, को प्रत्येक पूर्व कैलेण्डर माह जिसके दौरान वे इस प्रकार योजित रहे हों, के लिए एक दिन का सामान्य परिहार इन नियमों के अधीन किसी अन्य परिहार के अतिरिक्त दिया जायेगा।
तथापि बंदी वार्डर तथा बंदी ओवरसीयर इस नियम के अधीन परिहार के लिए अर्ह नहीं होंगे।
Any convict, eligible for remission under these rules, who, for a continuous period of one year or more reckoned from the first day of the month following the date of his sentence or his commitment or re-commitment to jail after conviction or the date on which he was last punished for a prison offence, has received no punishment other than a formal warning for any prison offence, shall be awarded fifteen days’ ordinary remission in addition to any other remissions earned under these rules for each such completed year.
When a convict has been well-behaved and has not been punished except by a formal warning, and has devoted, himself diligently to the performance of the prescribed daily task, for three consecutive years, he shall, in addition to the ‘fifteen days' remission for each of the first two years be awarded a remission of two months at the end of the third year.
बिना सजा के निरन्तर कार्य करने वाले बंदियों को परिहार
इन नियमों के अधीन परिहार के लिए पात्र किसी सिद्धदोषी जिसने दोषसिद्ध के पश्चात सजा या कारागार में अपनी सुपुर्दगी या पुनः सुपुर्दगी के दिनांक के अनुवर्ती माह के प्रथम दिवस अथवा उस दिनांक जब उसे किसी कारागार अपराध के लिए अंतिम बार दण्डित किया गया था या किसी कारागार अपराध के लिए औपचारिक चेतावनी के सिवाय कोई अन्य दण्ड प्राप्त न किया हो से निरन्तर एक वर्ष या एक से अधिक वर्ष की अवधि तक के लिए इस नियमावली के अधीन अर्जित किसी अन्य परिहार के अतिरिक्त प्रत्येक वर्ष के लिए पन्द्रह दिन का सामान्य परिहार प्रदान किया जायेगा।
जब कोई सिद्धदोषी आचरणशील रहा हो और उसे औपचारिक चेतावनी के सिवाय दण्डित न किया गया हो और निर्धारित दैनिक कार्य केनिष्पादन में अपने को तत्परतापूर्वक तीन वर्षों तक समर्पित किया हो तो उसके पूर्व के प्रत्येक दो वर्ष के लिए दिये गये पन्द्रह-पन्द्रह दिनों के परिहार के अतिरिक्त तीसरे वर्ष की समाप्ति पर दो माह का परिहार प्रदान किया जायेगा।
Ordinary remissions shall be awarded by the Superintendent or, subject to his control and supervision and according to the provisions of the rule 165, by the Jailor, Deputy Jailor, or any other officer specially empowered by him in this behalf.
सामान्य छूट प्रदान करने के लिए प्राधिकृत अधिकारी
सामान्य परिहार अधीक्षक द्वारा अथवा उसके नियंत्रण और पर्यवेक्षण के अध्यधीन तथा नियम 164 के उपबंधों के अनुसार जेलर, डिप्टी जेलर या किसी ऐसे अधिकारिी जिसे इसके लिए उसके द्वारा विशेष रूप से सशक्त किया गया हो द्वारा प्रदान की जायेगी।
The award of ordinary remissions shall be made as nearly as possible on January 1, April 1, July 1, and October 1.
An officer awarding ordinary remissions shall, before making the award consult the convicts history ticket on which every offence proved against the convict must be carefully recorded. If a convict has not been punished during the quarter otherwise than by a formal warning, he shall be awarded the full ordinary remission earned by him for that quarter under rule 157.
If a convict has been punished during the quarter otherwise than by a formal warning, the case shall be placed before the Superintendent, who after considering the punishment or punishments awarded to him, shall decide the amount of remission to be granted to him.
All remissions awarded to a convict shall be intimated to him and recorded as soon as possible on his history ticket.
They shall also be entered every quarter on the remission sheet.
परिहार प्रदान करने के लिए प्रक्रिया
सामान्य परिहार जहॉ तक संभव हो 1 जनवरी , 1 अप्रैल, 1 जुलाई और 1 अक्टूबर के निकट प्रदान की जायेंगी।
सामान्य परिहार प्रदान करने वाले अधिकारी इसे प्रदान करने के पूर्व इतिवृत्त पत्रक पर विचार करेगा। जिस पर सिद्धदोषी पर साबित अपराध सावधानी पूर्वक अवश्य अभिलिखिखत किया जाना चाहिए। यदि किसी सिद्धदोषी को तिमारी के दौरान सिवाय औपचारिक चेतावनी के दण्डित नहीं किया गया हो तो उसे उसके द्वारा नियम 156 के अधीन अर्जित पूरा सामान्य परिहार प्रदान किया जायेगा।
यदि सिद्धदोषी को तिमाही के दौरान औपचारिक चेतावनी से भिन्न की सजा दी गयी हो तो मामले को अधीक्षक के समक्ष प्रस्तुत किया जायेगा जो उसके दिये गये दण्ड या दण्डों पर विचार करने के पश्चात दिये जाने वाले परिहार की मात्रा का निर्णय करेगा।
किसी सिद्धदोषी को दिये गये सभी परिहारों को उसे सूचित किया जायेगा और यथा संभव शीघ्र उसके इतिवृत्त पत्रक पर अभिलिखित किया जायेगा।
इन्हें परिहार पत्रक पर भी प्रत्येक तिमारी अंकित किया जायेगा।
No convict shall receive ordinary remission in respect of the calendar month in which he is released.
Note :
If in calculating the final date of release it is found that the grant of the full amount of remission for any month would bring the convicts date of release within the very month, remission just sufficient to admit of his being released on the 1st day of the following month should be given.
मुक्ति के माह के लिए कोई परिहार नहीं दिया जाना
कोई भी सिद्धदोषी उस कैलेण्डर माह के सम्बन्ध में जिसमें उसे मुक्त किया जाता है परिहार नहीं प्राप्त करेगा।
टिप्पणीः
यदि मुक्ति के निश्चित दिनांक की गणना करते समय यह पाया जाय कि किसी माह के लिए परिहार पूरी मात्रा में स्वीकृत करने से सिद्धदोषी की मुक्ति का दिनांक उसी माह में पड़ जायेगा तो आगामी माह के प्रथम दिवस को उसके परिहार को स्वीकार करने के लिए पर्याप्त होगा मानकर परिहार दिया जाना चाहिए।
Unless specifically debarred under rule 154 (iv, v and vi), special remission may be given to any convict, whether entitled to ordinary remission or not, for special services, such as-
(i) marked diligence in teaching to read and write;
(ii) special proficiency in learning to read and write;
(iii) marked success in teaching handicraft and vocational training;
(iv) special excellence in work or greatly increased out-turns of work of good quality;
(v) protecting a person inside the prison from attack;
(vi) special assistance to an officer of the prison in case of an outbreak of fire or other similar emergency;
(vii) assisting in detecting or preventing breaches of prison discipline or regulations;
(viii) preventing escape or riot by prisoners, apprehending prisoners attempting to escape or riot, or giving information about any plan or attempt by a prisoner or group of prisoners, to escape or riot;
(ix) outstanding contribution in cultural activities;
(x) special work in industry, agriculture or any other work programme;
(xi) passing a Board or a University examination with 70% or more marks while in the prison;
विशेष परिहार
जब तक कि नियम 154 (चार, पांच और छह) में विशेष रूप से विवर्जित किया गया हो किसी सिद्धदोषी को चाहे वह सामान्य परिहार पाने का हकदार हो या न हो, विशेष सेवाओं के लिए विशेष परिहार दिया जा सकता है जैसा कि :-
(i) पढ़ने या लिखने हेतु अध्यापन में उल्लेखनीय परिश्रम।
(ii) पढ़ने, लिखने और सीखने में विशेष प्रवीणता।
(iii) हस्ताक्षरित और व्यवसायिक प्रशिक्षण में उल्लेखनीय सफलता।
(iv) कार्य में विशेष उत्कृष्टता या अच्छी गुणवत्ता का कार्य अधिक मात्रा में करना।
(v)जेल के अन्दर किसी व्यक्ति को हमले से बचाना।
(vi) आग लगने या ऐसी ही किसी अन्य आपातकालीन स्थिति में किसी अधिकारी को विशेष सहायता।
(vii) जेल के विनियमों या अनुशासन को भंग होने से रोकने या पता लगाने में सहायता।
(viii) बन्दियों को भागने या दंगा करने से रोकना, भगाने या दंगा का प्रयास कर रहे बंदियों को पकड़वाना या किसी बंदी का बंदियों के समूह द्वारा भागने या दंगा करने की योजना या प्रयास के बारे में जानकारी देना।
(ix) सांस्कृतिक कार्यकलापों में उत्कृष्ट योगदान।
(x) उद्यम, कृषि या किसी अन्य कार्ययोजना में विशेष कार्य।
(xi) जेल में रहते हुए 70 प्रतिशत या उससे अधिक अंकों के साथ किसी बोर्ड या विद्गवविशलय की परीक्षा उत्तीर्ण करना।
Special remission may be awarded-
(i) by the Superintendent, to an amount not exceeding three days for every completed calendar month;
(ii) by the Deputy Inspector General, to an amount not exceeding six days for every completed calendar month;
(iii) by the Director General, to an amount not exceeding nine days for every completed calendar month.
Note :
Special remissions under rule 166 will be awarded by the Superintendent after obtaining a report on the spot-check of the work of a prisoner and in the case of an industrial worker for whom a labour ticket is maintained in terms of rule 846 such remissions should also be noted by the Superintendent in the labour ticket as well.
Special remissions under rule 166 will be awarded by the Superintendent in the month of January, April, July and October each year for the previous quarter only. These could also be granted at the time of release for the quarter in which the release falls due. But the special remissions would not be granted for the calendar month for which they have not been granted, when due.
Reasons for special remissions awarded under rule 166 should be specially mentioned in the history tickets.
विशेष परिहार की सीमा
निम्नलिखित द्वारा विशेष परिहार प्रदान किया जायेगा :-
(i) अधीक्षक द्वारा प्रत्येक पूर्ण कैलेण्डर माह के लिए तीन दिनों से अनाधिक अवधि के लिए।
(ii) उप महानिरीक्षक प्रत्येक पूर्ण कैलेण्डर माह के लिए छह दिनों से अनाधिक अवधि के लिए।
(iii) महानिदेशक प्रत्येक पूर्ण कैलेण्डर माह के लिए नौ दिनों से अनाधिक अवधि के लिए।
टिप्पणी :-
नियम 166 के अन्तर्गत परिहार अधीक्षक द्वारा किसी बंदी के कार्य की स्थलीय जांच रिपोर्ट प्राप्त करने के बाद प्रदान की जायेगी और किसी उद्यमी श्रमिक के मामले में जिसके लिए नियम 846 के अनुसार श्रम पत्रक रखा जाता है ऐसे परिहारों को अधीक्षक द्वारा श्रम पत्रक में भी लिया जाना चाहिए।
नियम 166 के अन्तर्गत विशेष परिहार अधीक्षक द्वारा प्रत्येक वर्ष जनवरी, अप्रैल, जुलाई और अक्टूबर के माह में केवल पिछली तिमाही के लिए दिया जायेगा। यह परिहार उस तिमाही के लिए जिसमें मुक्ति पड़ती हो, परन्तु विशेष परिहार उस कैलेण्डर माह के लिए नहीं दिया जायेगा जिसमें वह देय थी परन्तु स्वीकृत नहीं की गयी थी।
नियम 166 के अन्तर्गत विशेष परिहार देने के कारणों को भी इतिवृत्त पत्रक में विशेष रूप से उल्लेख कर देना चाहिए।
An award of special remission shall be entered on the history ticket of the convict as soon as possible after it is made, and when such remission has been awarded by the Superintendent, brief reasons for such award shall also be recorded thereon.
इतिवृत्त पत्रक पर विशेष परिहार की प्रविष्टि
विशेष परिहार दिये जाने को इसके दिये जाने बाद यथा संभव शीघ्र बंदी की इतिववृत्त पत्रक पर अंकित कर दिया जायेगा और जब ऐसा परिहार अधीक्षक द्वारा प्रदान किया गया हो तो ऐसे परिहाार प्रदान करने के संक्षिप्त कारणों को भी पत्रक पर अभिलिखित किया जायेगा।
The total remission awarded to a convict under ordinary and special remissions, as defined under rule 167, shall not without the special sanction of the State Government, exceed one-third part of his sentence undergone.
Remission granted by Government under special order shall not come under in this limit.
सामान्य और विशेष परिहार की सीमा
नियम 160 में यथा परिभाषित सामान्य और विशेष परिहार के अन्तर्गत किसी बंदी को प्रदान किया गया कुल परिहार राज्य सरकार की विशेष अनुमति के बिना उसके द्वारा कुल काटी गयी सजा के एक तिहाई भाग से अधिक नहीं होगा।
In calculating the date of release of a convict the number of days of remission earned shall be converted into months and days at the rate of thirty days to a month.
मुक्ति के दिनांक की गणना में परिहार के दिनों को महीनों और दिनों में बदलने की रीति
किसी सिद्धदोषी की मुक्ति के दिनांक की गणना में कुल अर्जित परिहार के दिनों की संख्या को प्रत्येक माह में तीस दिन के दर पर महीने और दिनों में बदला जायेगा।
When a convict, other than a life-convict, has earned such remission as entitles him to release, the Superintendent shall release him unconditionally :
Provided that when the premature release of a convict has been ordered by the State Government, whether on the recommendation of the revising board or under the fourteen-year rule or otherwise, such conditions as may have been imposed by the State Government shall be complied with.
परिहार अर्जित करने पर बंदी की मुक्ति
जब आजीवन बंदी से भिन्न कोई बंदी ऐसा परिहार अर्जित करता है जिससे वह मुक्ति का हकदार हो जाता है तो अधीक्षक उसे बिना शर्त मुक्त कर देगा।
प्रतिबन्ध यह है कि जब राज्य सरकार द्वारा किसी बंदी की समयपूर्व मुक्ति का आदेश दिया गया हो चाहे वह पुनरीक्षण बोर्ड की संस्तुति पर या चौदह वर्ष के नियम के अन्तर्गत या अन्यथा रूप में ऐसी शर्तों जैसी राज्य सरकार द्वारा लगायी जा सकती हो, का अनुपालन किया जायेगा।
No life convict and no convict in whose case the State Government may have passed an order forbidding his release without reference to it, shall be released conditionally or unconditionally without the special orders of the State Government and all such cases shall be reported at the proper time by the Superintendent for the orders of the State Government through the Director General (Prisons).
किसी भी आजीवन बंदी को राज्य सरकार के आदेश के बिना मुक्त नहीं किया जायेगा
किसी आजीवन बंदी या किसी बंदी को जिसके मामले में राज्य सरकार के बिना इस पर निर्देश के उसकी मुक्ति को रोकने का आदेश परित कर सकती हो राज्य सरकार के विशेष आदेश के बिना सशर्त या बिना शर्त के मुक्त नहीं किया जायेगा और ऐसे सभी मामलों को अधीक्षक द्वारा उचित समय पर राज्य सरकार के आदेशों के लिए महानिदेशक (कारागार) के माध्यम से रिपोर्ट किया जायेगा।
When a convict is released without reference to the State Government, the total amount of remission earned by him shall be endorsed on his warrant and the endorsement shall be signed by the Superintendent.
मुक्ति पर सभी परिहारों को वारण्ट पर पृष्ठांकित करना
जब किसी सिद्धदोषी को राज्य सरकार को सन्दर्भ किये बिना मुक्त किया जाता है तो परिहार की कुल संख्या जो उसने अर्जित की है को उसके वारण्ट पर पृष्ठांकित किया जायेगा और इन पृष्ठांकनों पर अधीक्षक द्वार हस्ताक्षर किये जायेंगे।
When a convict is transferred to another jail, the total amount of remission earned by him up to the end of the previous month shall be endorsed on his warrant and entered on his history ticket, the entries being signed by the Superintendent and the remission sheet shall be sent with the convict along with other documents.
The receiving jail shall be responsible for seeing that the above information is duly obtained.
Every jail in which a convict serves a portion of his sentence shall be responsible for the correct calculation of the remission earned by him in that jail.
स्थानान्तरण पर किसी बंदी के इतिवृत्त पत्रक और उसके वारण्ट पर परिहार के अंकित करना
जब किसी सिद्धदोषी को किसी दूसरे जेल में स्थानांतरित किया जाय तो पूर्ववर्ती माह के अंत तक उसके द्वारा अर्जित किये गये परिहार की कुल संख्या को उसके वारण्ट पर पृष्ठांकित किया जायेगा और उसके इतिवृत्त पत्रक पर प्रविष्टि की जायेगी, इन प्रविष्टियों पर अधीक्षक द्वारा हस्ताक्षर किया जायेगा और परिहार पत्रक को अन्य दस्तावेज के साथ सिद्धदोषी के साथ भेजा जायेगा।
बंदी को प्राप्त करने वाला जेल यह देखने के लिए उत्तरदायी होगा कि उपरोक्त सूचनाएं सम्य्क रूप से प्राप्त हो गयी हैं।
प्रत्येक जेल, जिसमें बंदी ने अपनी सजा का कुछ भाग बिताया हो, अपनी जेल में बंदी द्वारा अर्जित परिहार की सही-सही गणना के लिए उत्तरदायी होगा।
The remission sheet of a convict shall be retained in the jail for a period of one year after his release.
मुक्त किये गये बंदियों का परिहार पत्रक
किसी सिद्धदोषी के परिहार पत्रक को उसकी मुक्ति के एक वर्ष तक जेल में ही रखा जायेगा।
When a convict is sent to a jail under a sentence of imprisonment, for term or terms exceeding in the aggregate fourteen years on conviction for a “heinous offence” the Court shall furnish information on the following points to the Superintendent of the Jail concerned :
(i) whether the convict is a professional, hereditary, or specially dangerous criminal or not.
(ii)whether the offence of which he was convicted was an “organised crime” or not.
जघन्य अपराध के दोषसिद्ध बंदी के मामले में न्यायालय द्वारा भेजी जाने वाली सूचना
जब किसी सिद्धदोषी को कारावास के दण्ड के जघन्य अपराध के लिए दोषसिद्ध होने पर कुल मिलाकर चौदह वर्ष की अवधि या अवधियों के लिए जेल में भेज जाता है तो न्यायालय निम्नलिखित बिन्दुओं पर सम्बन्धित जेल अधीक्षक को सूचना प्रस्तुत करेगा :-
(i) क्या सिद्धदोषी पेशेवर, अनुवांशिक या विशेष खतरनाक अपराधी है या नहीं।
(ii) क्या वह अपराध जिसके लिए वह दोषसिद्ध हुआ है संगठित अपराध था या नहीं।

The Remission System
(The Remission System and Premature Release of Prisoners Rules, 1977)
Jail Manual PARA 171. Cases in which no remission is earned
(a) No remission shall be earned in respect of any sentence of transportation or imprisonment under section 2 of the Frontier Murderous Outrages Regulation, 1901 (Act IV of 1901), passed on a person above the age of 15 years.
(b) No remission shall be earned on the portion of a sentence undergone by a prisoner while release conditionally or on probation under the United Provinces Prisoners’ Release on Probation Act, 1938 (Act VIII of 1938) or on parole under the orders of the State Government.
(c) No ordinary remission shall be earned in the following cases –
(i) in respect of any sentence of rigorous imprisonment for a period of less than three months;
(ii) in respect of any sentence of simple imprisonment, except for any continuous period, not being less than one month during which convict labours voluntarily, if the imprisonment is for a period of less than three months.
(iii) in respect of a sentence of death commuted into imprisonment for life.
Note – If a convict’s sentence is reduced on reduced to appeal to one of less than three months imprisonment, he shall cease to be eligible for ordinary remissions under these rule, and any remission that he may have earned prior to the reduction of his sentence shall be forfeited. Similarly, when a sentence of less than three months has, by subsequent conviction or convictions or otherwise, been raised to a sentenced of three months or more, the convict shall be credited with ordinary remissions from the first day of the calendar month following the month in which he was admitted to jail on his first or original conviction.
Jail Manual PARA 172. Forfeiture of remissions –
If a convict is sentenced for an offence committed after his admission to jail, under sections 147, 148, 152, 224, 302, 304, 304A, 306, 304, 308, 323, 324, 325, 326, 332, 333, 352, 353 or 377 of the Indian Penal Code or for an assault committed after his admission to jail on a warder or other officer, the Inspector General may order the whole or part of any remissions earned by the convict upto the date of the said conviction to be cancelled.
Jail Manual PARA 173. Readmission to the remission system-
The Superintendent may, with the previous sanction of the Inspector General, readmit to the remission system any convict who has been removed therefrom under the rule contained in Chapter XXX. Such convict shall begin to earn remission from the commencement of the calendar month following the date of such readmission.
Jail Manual PARA 174. Scale of ordinary remissions –
Ordinary remission shall be awarded on the following scale:
(a) three days per month for thoroughly good conduct and scrupulous attention to all prison regulations;
(b) three days per month for industry and the due performance of the prescribed daily task.
Explanation – A convict who is unable to labour through causes beyond his control such as his being in court, in transit from one jail to another, in hospital or in an invalid gang, shall be granted remission under clause (a) on the scale earned by hem during the previous months if his conduct prior to and during the period in question has been such as to entitle him to the grant of such remission.
Such convict shall also be entitled to the grant of remission under clause (b) on the scale earned by him during the previous month, if he was working during that period. If not, remission shall be awarded to him at the rate of three days per month, provided that if his absence from work is due to his own misconduct in jail, no remission under clause (b) shall be awarded to him for the period of such absence:
Provided also that if he is in a hospital or in an invalid gang, no remission under clause (b) shall be granted unless the Medical Officer certifies that the convict’s absence from labour is due to causes beyond his control and is in no way caused by any action of the convict himself with a view to escape work or to get into or to remain in hospital.
Jail Manual PARA 175. Scale of ordinary remission for convict officers
In lieu of the remission allowed under the preceding paragraph, convict warders shall receive ten days of ordinary remission per month, convict overseers eight days per month and convict night watchmen seven days per month. Convict overseers employed on duty on main walls or outside the barracks at night shall receive two days’ ordinary remission per month in addition to the remission granted under this rule.
The grant of this remission shall be subjected to thoroughly good conduct, scrupulous attention to all prison regulation and the due performance of duty on the part of the convict officers.
Jail Manual PARA 176. Remission to convicts on scavenging duty
Subject to good work and conduct in jail, convicts of the scavenger class working as scavengers in jails, or convicts to whom on administrative grounds it is not found expedient to promote to the grades of convict officers, shall, though they may not be appointed as convict officer, be entitled to receive ordinary remissions at the scales sanctioned in the preceding paragraph for convict night watchmen and convict overseers respectively, with effect from the first day of the month following the one on which they would, but for this rule, be eligible for promotion to those grades. They shall, however, not be eligible for remission at the scale prescribed for the convict warders.
Jail Manual PARA 177. Remission to convicts expert in any industry or employed on wool carding
Convicts who become experts in any industry may be granted remissions admissible under paragraph 175 in lieu of promotion to the post of convict officers. Special remissions at double rates shall be granted to convicts employed on wool carding.
Jail Manual PARA 178. Commencement of remissions
Subject to the provision of paragraph 173 ordinary remissions under paragraph 174 shall be calculated from the first day of the calendar month next following the date on which the convict is committed to jail, or, if he was in jail as an under trial prisoner on the date of sentence, the date of such sentence. Any convict who, because of his having been released on bail or of his sentence having been temporarily suspended, is afterwards readmitted to jail, shall be brought under the remission system on the first day of the calendar month next following such readmission, but shall be credited with any remission which he may have earned as a convict previous to his release on bail or the suspension of his sentence. Remissions under paragraph 175 shall be calculated from the first day of the calendar month following the appointment of the convict as a convict warder, convict overseer or convict night watchman.
Jail Manual PARA 179. Remission to convicts working on holiday
Convicts employed on prison services such as cooks, scavengers, store keepers, lamp cleaners, hospital attendants, and barbers etc., who ordinarily work on Sundays and other jail holidays, may be awarded one day’s ordinary remission for each complete calendar month during which they have been so employed, in addition to any other remission earned under these rules.
Convict warders and convict overseers shall, however, not be eligible for remissions under this rule.
Jail Manual PARA 180. Remission for continuous period of no punishment
(a) Any convict, eligible for remission under these rules, who, for a continuous period of one year or more reckoned from the first day of the month following the date of his sentence or his commitment or recommitment to jail after conviction or the date on which he was last punished for a prison offence, has received no punishment other than a formal warning for any prison offence, shall be awarded fifteen days’ ordinary remission in addition to any other remissions earned under these rules for each such completed year.
(b) When a convict has been well behaved and has not been punished except by a formal warning, and has devoted himself diligently to the performance of the prescribed daily task, for three consecutive years, he shall, in addition to the fifteen days’ remission for each of the first two years be awarded a remission of two months at the end of the third year.
Jail Manual PARA 181. Officers authorized to award ordinary remission
Ordinary remission shall be awarded by the Superintendent or, subject to his control and supervision and according to the provisions of the next following paragraph, by the Deputy Superintendent, Jailor, Deputy Jailor or any other officer specially empowered by him in this behalf.
Jail Manual PARA 182. Procedure for the award of remission
The award of ordinary remissions shall be made as nearly as possible on January 1, April 1, July 1 and October 1.
An officer awarding ordinary remissions shall, before making the award, consult the convict’s history ticket on which every offence proved against the convict must be carefully recorded.
If a convict has not been punished during the quarter otherwise than by a formal warning, he shall be awarded the full ordinary remission earned by him for that quarter under paragraph 174.
If a convict has been punished during the quarter otherwise than by a formal warning, the case shall be placed before the Superintendent who, after considering the punishment or punishments awarded to him, shall decide the amount of remission to be granted to him.
All remissions awarded to a convict shall be intimated to him and recorded, as soon as possible, on his history ticket.
They shall also be entered every quarter on the remission sheet.
Jail Manual PARA 183. No remission for the month of release
No convict shall receive ordinary remission in respect of the calendar month in which he is released.
Note- If in calculating the final date of release it is found that the grant of the full amount of remission for any month would bring the convict’s date of release within the very month, remission just sufficient to admit of his being released on the first day of the following month should be given.
Jail Manual PARA 184. Special remission
Special remission may be given to any convict, whether entitled to ordinary remission or not, other than a convict undergoing a sentence referred to in paragraph 171(a), for special services, such as –
(1) marked diligence in teaching to read and write;
(2) special proficiency in learning to read and write or passing an examination with credit;
(3) marked success in teaching handicraft;
(4) special excellence in work, or greatly increased out turn of work of good quality;
(5) protecting an officer of the prison from attack;
(6) special assistance to an officer of the prison in case of an outbreak or fire or other similar emergency;
(7) special economy in wearing clothes;
(8) assisting in detecting or preventing breaches of prison discipline or regulations.
Jail Manual PARA 185. Extent of special remission
Special remission may be awarded
(a) by the Superintendent, to an amount not exceeding three days for every completed calendar month;
(b) by the Inspector General, to an amount not exceeding six days for every completed calendar month.
Notes –
(1) Special remissions under paragraph 184 (3) will be awarded by the Superintendent after obtaining a report on the spot check of the work of a prisoner and in the case of an industrial worker for whom a labour ticket is maintained in terms of paragraph 895(a) such remissions should also be noted by the Superintendent in the labour ticket as well.
(2) Special remissions under paragraph 184(4) will be awarded by the Superintendent in the month of January, April, July and October each year for the previous quarter only. These should also be granted at the time of release for the quarter in which the release falls due. But the special remissions would not be granted for the calendar month for which they have not been granted, when due.
(3) Reasons for special remissions awarded under paragraph 184(4) should specially mention in the history ticket.
Jail Manual PARA 186. Entry of special remission on history tickets
An award of special remission shall be entered on the history ticket of the convict as soon as possible after it is made, and when such remission has been awarded by the Superintendent, brief reason for such award shall also be recorded thereon.
Jail Manual PARA 187. Limit of total remission
The total remission awarded to a convict under these rules shall not, without the special sanction of the State Government, exceed one third part of the sentence undergone.
Jail Manual PARA 188. Method of converting days of remission into months and days in calculating date of release
In calculating the date of release of a convict the number of days of remission earned shall be converted into month and days at a rate of thirty days to a month.
Jail Manual PARA 189. Release of convicts on earning remissions
When a convict other than a life convict, has earned such remission as entitles him to release, the Superintendent shall release him unconditionally, provided that when the premature release of a convict has been ordered by the State Government, whether on recommendation of the revising board or under the fourteen year rule or otherwise, such conditions as may have been imposed by the State Government shall be complied with.
Jail Manual PARA 190. No life convicts to be released without orders of the State Government
No life convict and no convict, in whose case the State Government may have passed an order forbidding his release without reference to it, shall be released conditionally or unconditionally without the special orders of the State Government and all such cases shall be reported at the proper time by the Superintendent for the orders of the State Government through the Inspector General.
Jail Manual PARA 191. Total remissions to be endorsed on warrant on release
When a convict is released without reference to the State Government, the total amount of remissions earned by him shall be endorsed on his warrant and the endorsement shall be signed by the Superintendent.
Jail Manual PARA 192. Remissions to be entered on history tickets and warrant of prisoners on transfer
When a convict is transferred to another jail, the total amount of remission earned by him upto the end of previous month shall be endorsed on his warrant and entered on his history ticket, the entries being signed by the Superintendent and the remission sheet shall be sent with the convict along with other documents.
The receiving jail shall be responsible for seeing the above information is duly obtained.
