Rule 702.

AMENITIES सुविधाएं

1- Ordinary class prisoners may receive from the relatives, the following articles in reasonable quantities of a sum, for a month, to be fixed by the Director General to supplement amenities of life in jail: cigarettes, biris, chewing tobacco and snuff (limited to ten packet of cigarettes, six bundles of biris, and 50 gm. tobacco.) per week; Gur, soap, tooth powder or paste, tooth brush, newspapers and periodicals provided they are not on the prohibited list; cheap musical instruments (such as flute or mouthorgan) talcum powder, boot polish, bags, articles of indoor games, sugar, pickles, honey, ghee, packed bakery items, dry and fresh fruits etc.

Note - If the Superintendent has any doubt whether any particular book is prescribed or not, he shall refer the matter to the District Magistrate. The covers and the binding, etc, of the books and periodicals received from outside be carefully examined to see that they do not contain any prohibited articles.

एक सामान्य श्रेणी का बंदी, अधीक्षक की पूर्व मंजूरी से मित्रों, रिश्तेदारों और किसी अन्य वैध स्रोत से उचित धनराशि प्राप्त कर सकता है, जैसा कि अधीक्षक किसी भी कैलेंडर माह में नियत करे ऐसा धन बंदी के खाते में जमा किया जाएगा और उसे पैराग्राफ 705 में उल्लिखित वस्तुओं या बंदियों के कल्याण कैंटीन से अनुमन्य, किसी भी वस्तु की खरीद पर खर्च किया जा सकता है।

नोट - यदि अधीक्षक को कोई संदेह है कि कोई विशेष पुस्तक विहित है या नहीं, तो वह मामले को जिला मजिस्ट्रेट को सन्दर्भित करेगा। बाहर से प्राप्त पुस्तकों और पत्रिकाओं के कवर और बाइंडिंग आदि की सावधानीपूर्वक जांच की जानी चाहिए कि उनमें कोई प्रतिबंधित वस्तु तो नहीं है।

2- An ordinary class prisoner may, with the previous sanction of the Superintendent receive from friends, relatives and any other legitimate source a reasonable amount of money as the Superintendent may fix in any calendar month. Such money shall be deposited in the prisoner’s account and may be spent on the purchase of articles mentioned in paragraph 705 or any such article as allowed from the prisoners' welfare canteen.

एक सामान्य श्रेणी का बंदी, अधीक्षक की पूर्व मंजूरी से मित्रों, रिश्तेदारों और किसी अन्य वैध स्रोत से उचित धनराशि प्राप्त कर सकता है, जैसा कि अधीक्षक किसी भी कैलेंडर माह में नियत करे ऐसा धन बंदी के खाते में जमा किया जाएगा और उसे पैराग्राफ 705 में उल्लिखित वस्तुओं या बंदियों के कल्याण कैंटीन से अनुमन्य, किसी भी वस्तु की खरीद पर खर्च किया जा सकता है।

3- Prisoners under the age of 21 years detained in any jail shall not be allowed to purchase or use biris, cigarettes, chewing tobacco and snuff.

जेल में बंद 21 वर्ष से कम आयु के किसी भी बंदी को बीड़ी, सिगरेट, चबाने वाली तंबाकू और सूंघनी की अनुमति नहीं होगी।

Rule 703.

Prisoner’s welfare canteen and welfare fund बंदी कल्याण कैन्टीन और कल्याण कोष

There shall be a prisoners’ welfare canteen and prisoners’ welfare fund in every jail. The rules for functioning of such canteen and fund are contained in Appendix-C.

प्रत्येक जेल में एक बंदी कल्याण कैंटीन तथा बंदी कल्याण कोष होगा। ऐसी कैंटीन और निधि के संचालन के नियम परिशिष्ट-सी में दिए गए हैं।

Appendix C

1- (A) There shall be a canteen in every jail to provide goods for daily use and eatables to the prisoners on purchase.

(B) There shall be a "Prisoners' Welfare Fund" at every jail for providing improved environment for the prisoners, called "The Fund" hereafter.

(C) A “Prisoners’ Welfare Board” shall be constituted at the Headquarter for the welfare of the prisoners, called “The Board” hereafter.

2- CANTEEN

A committee shall be constituted for management of canteen for prisoners with following as members:

(a) Superintendent - Chairperson

(b) A Jailor nominated by the Superintendent - Secretary

(c) A Medical Officer - Member

(d) A Deputy Jailor nominated by the Superintendent - Member

(e) A Head Warder nominated by the Superintendent - Member

(f) An accountant nominated by the Superintendent - Member Treasurer

(g) Three to five prisoners nominated by the Superintendent - Members

Note: The prisoners nominated under the proviso 2(g) shall have tenure of not more than one year. Only such prisoners shall be eligible who have had good conduct till the date of nomination. Convicts shall be given priority. 

खण्ड (1) में निर्दिष्ट कैंटीन के प्रबंधन के लिए एक प्रबंध समिति होगा। निम्नलिखित सदस्यों के रूप में एक समिति होगी :-

(क) अधीक्षक - अध्यक्ष

(ख) अधीक्षक द्वारा नाम निर्दिष्ट एक जेलर - सचिव

(ग) एक चिकित्सा अधिकारी - सदस्य

(घ) अधीक्षक द्वारा नाम निर्दिष्ट एक डिप्टी जेलर - सदस्य

(ङ) अधीक्षक द्वारा नाम निर्दिष्ट हेड वार्डर - सदस्य

(च) अधीक्षक द्वारा नाम निर्दिष्ट एक लेखाकार - सदस्य कोषाध्यक्ष

(छ) अधीक्षक द्वारा नाम निर्दिष्ट तीन से पॉच बन्दी - सदस्य

टिप्पणी : उपरोक्त खण्ड (छ) के अधीन नाम निर्दिष्ट बन्दियों का कार्यकाल एक वर्ष का केवल ऐसे बन्दी नामांकन लिए अर्ह होंगे, जिनका आचारण अच्छा पाया गया हो। सिद्धदोषियों को प्राथमिकता दी जाएगी।

3- The purchase from canteen by the prisoners can be made either directly from their Havalat Prisoners' Deposit account or Prisoners' Cash Deposit account or from the coupons or any other mode prescribed by the Inspector General. Such purchases shall be limited to the amount fixed by the Inspector General. The cash purchase from the canteen is prohibited.

बन्दियों द्वारा कैंटीन से खरीदारी या तो सीधे उनके हवालात बन्दियों के जमा खाते या बन्दियों के नकद जमा खाते से या कूपन या महानिरीक्षक द्वारा निर्धारित किसी अन्य विधि से की जा सकती है। ऐसी खरीददारी महानिरीक्षक द्वारा नियत की गई धनराशि तक ही समिति होगी। 

4- The place and time of sale from the canteen shall be fixed by the Superintendent and displayed at a place which is easily accessible to the prisoners.

कैंटीन से बिक्री का स्थान और समय अधीक्षक द्वारा तक किये जाएंगे और एक स्थान पर जो बन्दियों को आसानी से सुलभ हो, प्रदर्शित किये जाएंगे। 

5- The meetings of the committee shall ordinarily be held at least once a month. The Chairperson however can call the meetings as and when required otherwise also. The proceedings of all such meetings shall be recorded. The arrangements for sale and purchase of goods for canteen shall be made by the committee. The member Deputy Jailor shall be in-charge of the canteen store and shall be responsible for sale of goods from canteen through member prisoners.

समिति की बैठकें सामान्यतः महीने में कम से कम एक बार आयोजित की जाएंगी। यद्यपि अध्यक्ष और जब आवश्यकता हो बैठक बुला सकता है। प्रबंध समिति की बैठकों की कार्यवाही अभिलिखित की जाएगी। प्रबंध समिति के क्रय में नाम निर्दिष्ट किये गये उप जेलर कैंटीन भण्डारण का प्रभारी होगा और कैंटीन से माल की खरीद और बिक्री भी तैयारी हेतु उत्तरायी होगा। 

6- The goods and eatables sold to the prisoners through the canteen shall be selected by the committee in such a way that they do not affect adversely on the health of the prisoners and the general environment of the prison. They shall ordinarily include, packed milk, Gur, sugar, ghee, honey, pickles, biscuit, butter, fresh fruits, fresh salad vegetables, non-intoxicating cold-drinks, cold milk, namkeen, dalmoth, toffees, prepared tea, samosa, poori-sabzi, sweets, bakery products, boiled eggs, tooth brush, tooth powder/toothpaste, boot polish, hair oil, body oil, undergarments, innerwear, socks, chappals, cartridge shaving razor, etc. Goods having more shelf life shall be prepared. Sale of tobacco and tobacco products is prohibited.

कैंटीन से बन्दियों को बेचा जाने वाला माल और खाद्य सामग्रियों इस तरह समिति द्वारा चयनित की जाऍगी कि वे बन्दियों के स्वास्थ्य और जेल के सामान्य पर्यावरण पर प्रतिकूल प्रभाव न डाले। उनमें आमतौर पर मैनुअल के प्रस्तर-740-बी में वर्णित वस्तुऍ और टूथ ब्रश, टूथ पाउडर/टूथपेस्ट, बूट पॉलिश, हेयर ऑयल, द्यारीर का तेल, जघियां, इनरवियर, मोजे, चप्पल, कारटिज द्योविंग रेजर, पैक दूध, चीनी, बिस्कुट, मक्खन, ताजे फल, सलाद-सब्जियॉ, गैर नशीली कोल्ड ड्रिंक्स, ठंडा दूध, नमकीन, दालमोठ, टॉफी तैयार चाय, समोसा, पूरी-सब्जी, मिठाई, बेकरी उत्पाद, उबले अंडे, आदि शामिल होंगे। अधिक शेल्फ मियाद वाले सामान तैयार किये जाएंगें। 

7- The price of the goods available in the canteen shall be sold with maximum 10% profit margin over the purchase or preparation value. 60% share of such profit shall be kept for running expenses of the canteen and 40% share shall be carried towards the "Prisoners' Welfare Fund".

कैंटीन में उपलब्ध माल की मूल्य खरीद या तैयारी मूल्य पर अधिकतम 10 : लाभ मार्जिन के साथ बेचा जाएगा। ऐसे लाभ का 60 : भाग कैंटीन का खर्च चलाने के लिए रखा जाएगा और 40 : भाग 'बन्दियों के कल्याण कोष' की ओर दिया जाएगा। 

8- PRISONERS’ WELFARE FUND

The "Prisoners' Welfare Fund" shall be managed by the committee.

बन्दियों का कल्याण कोष

बन्दियों का कल्याण कोष खंड 4 में उल्लिखित समिति द्वारा प्रबंधित किया जाएगा।

9- Fund shall be used for general welfare and entertainment of prisoners and to make arrangement for items for recreation and welfare, for fans and their repairs etc., distribution of fruits, sweets etc. on special occasions or to arrange for healthy entertainment or any such activities which are for the welfare of the prisoners in general.

कोष का उपयोग बन्दियों के सामान्य कल्याण और मनोरंजन के लिए और मनोविनोद और कल्याण के लिए मदों की व्यवस्था करने के लिए पंखों और उनकी मरम्मत आदि के लिए विशेष अवसरों पर फलों, मिठाईयों आदि के वितरण या स्वस्थ मनोरंजन या ऐसी किसी भी अन्य गतिविधियों की व्यवस्था करने के लिए जो सामान्य बन्दियों के कल्याण के लिए हो। 

10- Donations from Non-government organisations or reputed persons may be accepted towards the Fund. Receipts shall be issued for all such funds.

गैर-सरकारी संगठनों या प्रतिष्ठित व्यक्तियों से दान कोष के लिए स्वीकार किया जा सकता है। ऐसे सभी कोषों के लिए रसीदें जारी की जाएंगी। 

11- कोष को कुछ राशि, बन्दियों की सहकारी समितियों से भी, ऐसी समितियों के उपनियमों में तय अनुसार प्राप्त होगी। 

12- There shall be a separate cash-book for the Fund maintained by the member treasurer, and audited annually by a chartered accountant. Such audit shall be recorded in the register for the proceedings of the meetings.

कोष के लिए एक अलग कैश बुक होगी जिसे सदस्य कोषाध्यक्ष द्वारा बनाए रखा जाएगा और उसकी चार्टर्ड एकाउटेंट द्वारा प्रतिवर्ष लेखा परीक्षा की जाएगी। ऐसे लेखा परीक्षओं को बैठकों के कार्यवाही रजिस्ट में अभिलिखित किया जाएगा। 

13- The management of the canteen and Fund shall be under the directions issued by the Inspector General from time to time.

कैंटीन और कोष का प्रबंधन महानिरीक्षक द्वारा समय पर जारी किए गये निर्देशों के अधीन किया जाएगा। 

14- PRISONERS’ WELFARE BOARD

The prisoner welfare board shall consist of the Inspector General, Deputy Inspector General (HQ), Accounts Officer and Research Officer (HQ).

(i) 25% of Prisoners' Welfare Fund shall be remitted to the Headquarter, every three months, to constitute a prisoner welfare fund at the Headquarters.

(ii) The Prisoner Welfare Board may evolve such schemes and programmes to generate funds and may take up such activities for the collective welfare of prisoners for the care and assistance of individual prisoners or their families in distress.

बन्दियों को कल्याण बोर्ड

महानिरीक्षक, उप महानिरीक्षक (मुख्यालय), लेखा अधिकारी और अनुसंधान अधिकारी (मुख्यालय) बंदी कल्याण बोर्ड के सदस्य होंगे।

(क) हर तीन महीने में बन्दियों के कल्याण कोष का 25 प्रतिशत, मुख्यालय स्तर पर बंदी कल्याण कोष के लिए मुख्यालय प्रेषित किया जाएगा।

(ख) बंदी कल्याण बोर्ड धन उत्पन्न करने के लिए ऐसी योजनाओं और कार्यक्रमों को विकसित कर सकता है और बंदियों के सामूहिक कल्याण और किसी विशिﾔट बंदी की सहायता या संकट में उसके परिवार के लिए ऐसी गतिविधियों कर सकता है।
