Overview of Family and Medical Leave Act (FMLA)
FMLA entitles eligible employees to take unpaid, job-protected leave for specified family and medical reasons with continuation of the employee’s group healthcare coverage at current contribution rates. Eligible employees are entitled to 12 workweeks of leave in a rolling 12 month period for:
the birth of a child and to care for the newborn child within one year of birth;
the placement with the employee of a child for adoption or foster care and to care for the newly placed child within one year of placement;
to care for the employee’s spouse, child, or parent who has a serious health condition;
a serious health condition that makes the employee unable to perform the essential functions of his or her job;
any qualifying exigency arising out of the fact that the employee’s spouse, son, daughter, or parent is a covered military member on “covered active duty;”
Eligibility for FMLA
An employee who works for Half Hollow Hills CSD must meet both criteria in order to be eligible for FMLA leave. The employee must:
Have worked for the employer for at least 12 months; and
Have at least 1,250 hours of service during the 12 months before the leave begins.
Protection for the Employee under FMLA
While employees are on leave covered by FMLA, employers must continue paying the employer's portion of the healthcare premiums as though there were no interruption in the employee’s working status.
Upon return from FMLA protected leave, employees must be restored to the same job or one nearly identical to it with equivalent pay, benefits, and other employment terms and conditions.
An employer may not interfere with an individual’s FMLA rights or retaliate against someone for using or trying to use FMLA leave.
