Essential Question: How do Fair Use and Copyright laws work?
Mastery Objectives:
SWBAT identify copyright and fair use laws and apply them to various scenarios.
SWBAT use copyright and fair use terminology and argue positions on the laws.
What you need to do the first day of preparation:
Everyone - meet with your team and understand each role. The teams are: plaintiffs, defendants, jury and judge, and bailiffs.
Plaintiffs - You need to meet with your team and decide why your plaintiff is a victim. Review the copyright and fair use laws and determine loop holes in the case. Prepare your plaintiff for the types of questions you plan to ask. The plaintiff needs to practice how s/he/they will answer those questions. You might also want to discuss damages and sentencing. You need to prepare opening and closing statements. The lawyers who are cross-examining and questioning need to have some preliminary questions to ask the person on the stand. But during the trial they are free to ad-lib new questions. Their final report that they turn in should include those questions.
Defendants - You need to meet with your team and decide why your defendant is innocent. Review the copyright and fair use laws and determine loop holes in the case. Prepare your defendant for the types of questions you plan to ask. The defendant needs to practice how s/he/they will answer those questions. You need to prepare opening and closing statements. The lawyers who are cross-examining and questioning need to have some preliminary questions to ask the person on the stand. But during the trial they are free to ad-lib new questions. Their final report that they turn in should include those questions.
Bailiffs - You will create a slide show presentation with timings and each person and their roles. Follow the outline below for the way the trial will go. Make sure that you add each person's name and decide how long they will talk.
Judge and Jury - Review the video and the copyright and fair use laws. This is the evidence of the case.
What you need to turn in:
Plaintiff side - Plaintiff needs to describe their angle and work with Lawyer 2 to develop a list of questions when the plaintiff is called to the stand. Both the plaintiff and lawyer 2 need to turn in their questions. Lawyer 1 needs to turn in an outline for the opening remarks. Lawyer 4 needs to turn in an outline for closing remarks. Lawyer 3 needs to turn in questions for their cross-examination. The group needs to discuss all of these pieces together and provide feedback for each other.
Defendant side - Defendant and Lawyer 3 needs to develop a list of questions when the defendant is called to the stand. Both the defendant and Lawyer 3 need to turn in their questions. Lawyer 1 needs to turn in an outline for the opening remarks. Lawyer 4 needs to turn in an outline for closing remarks. Lawyer 2 needs to turn in questions for their cross-examination. The group needs to discuss all of these pieces together and provide feedback for each other.
Bailiffs - Create a slide show as a group. Setup the schedule for the trial. Set timers for the slide show. Each section should last 5 minutes. Research the guidelines for the trial and create a slide for the guidelines.
Judge and Jury - Research sentences for violating copyright laws. Be able to justify the sentence you choose using past cases. Write a decision and justify your decision. Describe how you felt about the points brought up in the trial. This should be at least 3 paragraphs.
