Statements from educators involved in testing irregularities
Obtain separate, typed, signed, and dated statements from all individuals who were involved in or may have information about the incident.
Verify that each KTX Irregularity Report Form statement includes:
name, title, contact information, and role during testing;
how individual was responsible for or involved in incident;
description of incident from individual’s perspective;
individual’s signature; and
date the statement was signed.
Individuals implicated in a serious violation should be informed of the allegations being made and asked to respond directly to all accusations.
Statements from students involved in testing irregularities
Obtain statements from any students who were involved in or may have information about the incident.
Students' statements may be handwritten or recorded and transcribed.
If the district records a student’s statement (video or audio), written consent from the student’s parent must be obtained as required under the TEC §26.009.
Contact information for each student should be maintained at the local level in case TEA requests it for a hearing.
District coordinators must notify the TEA Student Assessment Division as soon as they are made aware of any alleged or suspected incidents that fall under the category of a serious testing violation.
The nature of serious testing violations requires a prompt investigation by the district coordinator in conjunction with the CTC/School Leader so that all necessary evidence is gathered while the individuals involved in the incident are still available to be interviewed and able to recall details. Depending on the nature and severity of the issue, TEA may request that district coordinators/CTCs take certain actions, such as interviewing students or reviewing test materials.
The investigation of a serious testing violation must include the following:
the name of the campus where the incident occurred and which test administration (month, year, program, grade level, subject area or course, etc.) was affected;
confirmation that state-mandated testing procedures were violated;
a description of exactly what happened, why it happened, and how it was discovered;
a timeline establishing when events occurred;
notification to educators implicated in a serious testing violation of the allegations being made and a request that they respond directly in writing to all allegations;
information on other possible scenarios that might have caused the incident;
separate typed, signed, and dated statements from each individual who was involved in or may have information about the incident;
verification that each statement includes:
name, title, contact information, and role during testing,
how the individual was responsible for or involved in the incident,
a description of the incident from the individual’s perspective,
the individual’s signature, and
the date the statement was signed;
statements from all students who were involved in or may have information about the incident. Student statements should be handwritten or recorded and transcribed. Parents should be notified if their child is questioned about a testing incident, and written consent from a parent must be obtained if district testing personnel record a student's statement, as required under Texas Education Code (TEC) §26.009. Contact information for each student must be maintained at the local level, as the TEA Student Assessment Division may require it at a later date;
resolution of any discrepancies that may exist in the information provided by the individuals involved;
a determination of who is responsible for the serious testing violation; and
a determination of whether the incident compromised the validity of the students’ assessments. If so, the students’ assessments must be invalidated.
To fulfill the state’s requirements for reporting a serious testing violation, the district coordinator must submit the following supporting documentation:
documentation of the district coordinator’s decision to score or invalidate students’ assessments (if the incident compromised the validity of the students’ assessments, the students’ assessments must be invalidated);
a typed, signed, and dated statement from each individual involved;
documentation showing that the accused educator was trained (e.g., training session sign-in sheet);
a copy of a signed Oath of Test Security and Confidentiality from each accused educator;
documentation of any disciplinary action that was taken locally against each accused educator;
contact information for each accused educator; and
the last four digits of the social security number for each accused educator.
For assistance and tampering violations, districts also need to submit:
• Class rosters with Texas Student Data System (TSDS) identification numbers
• Seating charts
• Materials Control Forms
Students:
If a student duplicates, records, electronically captures (e.g., screenshots or photographs), posts on social media, transmits, or disseminates secure test content, the TEA Student Assessment Division must be contacted immediately. Any duplicated or captured secure test content must be destroyed upon completion of the district coordinator’s investigation. In addition, any test content posted on social media must be removed.
Students cheating or attempting to cheat on state assessments, either by providing or receiving assistance, requires action by the district or campus coordinator.
After investigating the incident, if the district or campus coordinator determines that a student has been involved in cheating or attempting to cheat on a state assessment, the district or campus coordinator must:
invalidate the student’s assessment as required by TAC §101.3031(a)(4) by marking the score code “O” for “Other” and indicating “Cheating” in TIDE for the corresponding assessment; and
complete the Locally Determined Disciplinary Action Form to report any disciplinary action taken against students who participated in the cheating incident.
Any disciplinary action taken on students during a TEA State Assessment (TELPAS, STAAR, STAAR Alt 2, TELPAS Alt) is at the discretion of the School Leaders, SLM, and RS

The KTX Assessment Team proposes that the following steps be taken when a testing irregularity happens during an official testing window. Irregularities that occur during Interim Assessments are learning opportunities and used to update campus procedures.
Procedural irregularities during official testing windows are handled at the campus level by the CTC and SL. SLs should always include HR in all employee consequences and follow KTX policy.
Procedural irregularities fall into 5 categories
Accommodation errors
Accounting errors
Eligibility errors
Monitoring errors
Training errors
Consequences are based on repeated irregularities in the same category during the same SY in official testing windows:
We recommend that the first procedural irregularity should result in a meeting with CTC/SL and a testing action plan (this is already part of the irregularity report process). The SL will issue a verbal warning.
For the second procedural irregularity of the same category the consequence should be a written warning in addition to the testing action plan and meeting.
For the third procedural irregularity of the same category, the consequence is a formal write up in addition to the testing action plan and meeting.
For serious irregularities only - the SL will work in conjunction with HR to determine if the irregularity warrants a final warning or termination.
Protocol for Request for Testing Date Change:
KIPP Texas has established testing windows and dates for all assessments. This document is to be utilized if your campus is requesting to administer any assessment outside of the designated testing window or date. You are not required to complete this form for any emergencies that occur during testing as the RAC will provide guidance on how to handle emergencies.
