As the arrest warrant above shows the kidnapping case started on September 3, 2012. But as shown above in Amanda's criminal case, her charges actually occurred on August 13, 2012! So, what's going on here??
The State would simply argue it's nothing more than typographical error. Hummm.
Under further examination I will demonstrate my allegation, the State created the date discrepancy intentionally.
If the State put in September 3, 2012 as the correct arrest date, and the the plea date being September 12, 2012, then the record would show only 9 days passed from the arrest date to plea date!
That's a big problem! Why? Because anyone arrested is entitled to due process. Within 72 hours of an arrest, a suspect must appear before a judge then a probable cause/preliminary/plea hearing is scheduled. That usually takes about a month. And that would be consistent with an August 13, 2012 to September 12, 2012 time frame.
But following the true timeline, as shown, was between September 3, 2012 to September 12, 2012 is only 9 days. That would indicate due process was clearly violated, and is known as a "structural" error.
Such error could reverse the plea on that 9 day time frame alone. No statue of limitations.
So, the question remains why 9 days?
It's simple, the State wanted Amanda processed as quickly as possible, and focus their investigation on me. And I allege they realized Amanda was not going to make any statements against me.
And I allege Amanda could care less about any "due process" on her part, and wanted out of juvenile detention as soon as possible.
So, no problem, both parties agreed. And who's watching? Especially because her record is sealed.
Well, I am watching and found this alleged falsification of Amanda's criminal record.
