TERMS OF SERVICE AND USER AGREEMENT

Section 1: ACCEPTANCE OF TERMS

By downloading, installing, or using BestFrame AI (the App), you agree to these Terms. If you do not agree, do not use the App.

Section 2: LICENSE

BestFrame AI is licensed, not sold. You receive a limited, non-exclusive, revocable, non-transferable license to use the App for lawful photo-management use on devices you own or are authorized to control.

Section 3: PHOTO CLEANUP, USER CONFIRMATION, AND DISCLAIMER

BestFrame AI functions as a photo-management assistance tool. Its grouping and best-shot selections are produced by on-device machine learning and are suggestions, not guarantees. You acknowledge that automated scoring may be imperfect and that you are responsible for reviewing each group before confirming cleanup.

Review before cleanup: The App does not remove any photo without your explicit confirmation for that group.

Android system Trash, never a permanent delete: When you confirm cleanup, the App uses Android's built-in system Trash (MediaStore.createTrashRequest) rather than deleting files itself. Trashed photos remain recoverable through your device's own Trash/Recycle Bin for the retention period your device provides. After that device-controlled period expires, your device — not BestFrame AI — removes them permanently.

Your responsibility for backups: You are responsible for maintaining your own backups of photos you wish to keep.

Section 4: DATA, PERMISSIONS, AND TRANSPARENCY

Permissions are used only for declared app features (photo library access, notifications, and network access).

All photo processing is local by default. Scanning your library, detecting bursts and near-duplicates, scoring photos, and selecting the best shot in each group happen entirely on your device using on-device machine learning (Google ML Kit). BestFrame AI has no backend server of its own, and your photos and their contents are never uploaded to the developer.

No account is required. The App does not ask for your name or email address, and no sign-up or login is needed for any core feature.

Optional Cloud Backup (Premium/Pro, off by default): If you choose to enable Cloud Backup and connect your Google account, the App uploads the single best photo from each cleaned-up group directly to your own Google Photos library using Google's official Photos Library API with a narrow, upload-only permission scope. The developer never sees, stores, or has access to that photo. You may disconnect at any time in the App or by revoking access in your Google Account settings.

Advertising: The free tier displays ads through Google AdMob, which may access an advertising identifier to serve and measure ads, subject to Google's own privacy practices and the consent choices you make through Google's User Messaging Platform.

Analytics and crash reporting: This release does not include analytics or crash-reporting SDKs. If a future version adds Firebase Analytics or Firebase Crashlytics, the Privacy Policy will be updated before that version is released.

BestFrame AI does not sell personal and sensitive user data. Because the developer stores none of your data on any server, uninstalling the App removes all of its on-device data. Photos you backed up via the optional Cloud Backup feature are managed and deleted directly by you in your own Google Photos account.

Full privacy details are provided in the app Privacy Policy, available in-app and at https://sites.google.com/view/krish-innov-labs/bestframe-priv. If there is any conflict, the stricter privacy disclosure applies.

Section 5: PREMIUM AND BILLING

This release offers in-app Premium and Pro subscriptions through Google Play Billing. Purchases are processed and billed by Google Play under its billing terms and applicable regional law. The developer never receives or stores your payment card details.

Section 6: ADS

The free tier displays ads through Google AdMob. Premium and Pro remove ads. Ads are never shown in a way that obstructs your review of a photo group or the cleanup confirmation step.

Section 7: NO WARRANTY

THE APP IS PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. The developer does not warrant that best-shot selections will match your preferences or that burst and duplicate detection will identify every relevant photo.

Section 8: LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PHOTOS OR DATA. Total liability will not exceed the amount paid for a Premium or Pro subscription (if any).

Section 9: GOVERNING LAW AND DISPUTE RESOLUTION

BestFrame AI is developed and operated by an individual developer trading as Krish Innovation Labs (a sole proprietorship, not a separate registered company).

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, subject to any mandatory consumer protection rights you have under the law of your own place of residence that cannot be waived by contract.

If a dispute arises, you agree to first contact the developer at krishinnovationlabs@gmail.com and engage in good-faith resolution for 30 days. Any dispute not resolved within that period shall be subject to arbitration seated in Pune, Maharashtra, India, or the exclusive jurisdiction of the courts of Pune, Maharashtra, India.

Section 10: CHANGES AND TERMINATION

The developer may update these Terms to reflect legal, policy, or product changes. Continued use after updates means acceptance. The developer may suspend or terminate access for policy or legal violations.
