ABSTRACT: 1985 Legal Act number 100 contains a non-religious positive lexicon and a religious Islamic lexicon governed by the principles of al-Ŝarȋ'a al-Islâmiyya or Islamic law. Having analyzed the Islamic, French, and English influences on Egyptian law, we have come to the conclusion that currently post-colonial Egyptian law is of a hybrid nature and is going through a transitional stage that has not yet been completed. The hybrid nature of Egyptian law creates, in some cases, significant contradictions. Throughout this article, we will describe the guidelines and general aspects of this peculiar language that does not cease to be a specialty within the general Arabic language. Given the scarcity of literature and studies on the analysis of Arabic legal language in general and family law in particular, we believe that the brief analysis of this study could help those interested in this field.

Secondly, the linguistic regime that characterizes these documents is analyzed so that the translator is aware of the main challenges they face. ABSTRACT: Based on a contrastive study of a corpus of French academic documents and their corresponding sworn translations into Spanish, the present article aims to analyse from a functionalist standpoint the translation techniques that have been applied in the translation process. By applying the concepts of translation “technique” and “method”, the analysis considers translational as well as methodological aspects of sworn translation. The results show the tension between adequacy and acceptability brought to bear by the translation process, and also demonstrate the important role of the source culture in determining the global translation method.

ABSTRACT: This paper aims to study the superstructure of a specific text type belonging to the genre of civil registry documents (the birth certificate), which is an unexplored field in legal translation studies. It also intends to verify if the knowledge and the analysis of the superstructure of any text type are essential to the translation process, especially when it comes to legal translation. To this end, the study stems from the compilation of a corpus consisting of texts from various French-speaking countries; the arranging and content of the information, as well as the differences and difficulties of several sections of the superstructure are analyzed; and, finally, possible equivalents in the target language (peninsular Spanish) are offered. This study has allowed us to verify the paramount importance of recognizing and knowing the superstructure of civil registry documents when it comes to the translation process.

ABSTRACT: By analyzing textual samples of “equally authentic texts”, we wish to validate the importance that these samples have in a descriptive approach to translation research, and to observe the influence that “equally authentic texts” exercise in the selection of the type of equivalence (formal equivalence – dynamic equivalence, following Nida 1964) employed in the translation of documents derived from international organizations. We will focus on a specific textual genre of the United Nations: the UNCITRAL Model Laws, their source texts in English and their translations into Spanish. We hope to identify a number of translation tendencies that would allow us to establish their positioning regarding the initial norm (adequacy – acceptability) (cf. Toury 1995) as well as to study the influence of factors such as text production and reception in the process. In this way, we will acquire a better knowledge of the translators’ job for international organizations and the intrinsic features of their job.

ABSTRACT: This study is based on the premise that comparative law is an indispensable tool for legal translation and vice versa; that is to say, the two disciplines feed on each other. In fact, translation plays a fundamental role in transferring legal terms from one legal system to another. Indeed, it is increasingly common to see binding contracts that are mere translations of originals drafted in English, thus originating what we consider to be a hybrid legal genre. In this article, we analyse how legal experts use English legal vocabulary in their comparative studies. In the process, we derive certain principles which may be applied to specialised legal translation.

ABSTRACT: This study is based on a hypothetical situation in which a sworn translation of an Irish divorce case has been commissioned for a Spanish judge. Legal translation is influenced by several factors that determine the translator's decisions. It is essential to analyze factors such as the legislative and chronological framework of the document and its translation, the recipient and, in this case, the restrictions on sworn translation in Spain. A functionalist approach is therefore necessary because of the importance given to the legal effect of the document. A textual typology will be used to establish the degree of procedural asymmetry between the two legal systems, since the document itself is considered a unit of translation, in order to establish its function and favor its correct interpretation and identification by the judge.

ABSTRACT: The global nature of economic exchanges, the structure of academic institutions, and an increasing professional demand for translation services, are all factors that have contributed to the growth of “financial translation” as a speciality within the field of Translation Studies. This paper analyses the concept of “financial translation”, according to both intratextual and extratextual parameters that are identified in Translation Studies literature. It also considers the role of annual accounts texts within the framework of a business internationalisation process, and how their translation is widely considered as being within the confines of “financial translation”. An assessment of the extent to which annual accounts validate features that define this type of translation is also presented. Conclusions are drawn in order to question the validity of both the use of “financial translation” and its object of study. This article proposes that special efforts must be made to contribute to the validation of cross-cutting factors that shed light on standards of translators’ behaviour.

Different types of corpora are characterized and an example of analysis that can be helpful for the translation process of legal texts is included. Particularly, the paper stresses the value of the use of corpora in the search of Spanish-English equivalences for birth and marriage certificates, which were analyzed regarding their internal and external elements.

ABSTRACT: Translating the French verb siéger into Spanish involves a high degree of complexity because of its fuzzy and vague semantic borders. The aim of this paper is to study the semantic potential of this unit by analysing its occurrences in a corpus made up of legal texts. The study also focuses on the equivalences offered by translations of the texts into Spanish, and addresses the question of whether the target texts simply reflect the equivalences of bilingual dictionaries or put forward new translation solutions. In both cases, our final aim is to determine if the semantic value of siéger has been fully expressed in the translation and to identify the point of view which has been privileged in the translation as a result of the interpretative act.

José Aguilera Pleguezuelo, with a very intense life in which the practice of translation and interpreting is seamlessly linked to that of research and university teaching, is a unique case in the history of Spanish Arabism. As a researcher, his numerous publications in the most diverse fields stand out, especially on Islamic Law, although we must highlight here his Cuadernos del intérprete y traductor: Léxico básico instrumental (in two volumes: Spanish-Arabic and Arabic-Spanish, published by the Universidad Autónoma between 1981 and 1982, in collaboration with Mahmoud El Sayd Ali). As a translator-interpreter he has participated in fundamental tasks for the service of Spain: from 1956 to 1958 in the General Directorate of Morocco and Colonies in Madrid; from those dates until 1970, in the Spanish Embassy in Rabat, and from then on, until 1984, in the High General Staff and the CESID.

ABSTRACT: In this article we make a comparative study of formal transactional legal document in the Common-Law and Civil-Law legal systems, as a component of the textual genre. There is a substantial discrepancy between the solemnities of these two legal systems. Thus, using the tools of comparative textual linguistics we observe the cultural marks left by both legal cultures and produce a comparison of them. To illustrate the discrepancy between the Anglo-Saxon and Spanish formalization systems, we make a comparison between Spanish “escritura pública" and the (American and English) deed. We appreciate the structure of text and discourse as a reflection of the concept of form and publicity in both legal systems. We compare the Notario Público with the Notary Public. We study the formal document in relation to its translation because we consider it to be a case of untranslatability. The legal functions of the formal document do not coincide in Common-Law and Civil-Law and these are expressed in the translation of Common-Law documents into Spanish, which is the paradigmatic case we have chosen.

ABSTRACT: This paper presents an in-depth study of the present situation regarding the appointment of Sworn Translators and/or Interpreters in Spain. Based on a comparative analysis of regulatory norms and official announcements, the novelty of the study lies in the fact that it takes into account all the legislation currently valid in Spain, and systematically analyses legal rules with respect to denomination, examination and ways of entry into the profession. In addition, the publication of two norms in the last year – one from the State Administration and another from the Basque Country Regional Administration – is used as the basis to reflect firstly, on the evolution of legal norms over the past thirty years and secondly, on the feedback between the Regional and State Administrations. The article also systematically examines the differences in criteria and the lack of coherence between the various Administrations with regard to prerequisites and accreditation.

ABSTRACT: Although Spanish law establishes the obligation to translate the vehicle purchase invoice in order to register an imported vehicle under a Spanish registration number, professional translators claim that there is little translation activity in this field. With a view to analyzing the real professional situation, a telephone survey was conducted among the local and provincial offices of the Dirección General de Tráfico (the Spanish national traffic authority). The purpose of the survey was to find out whether officials comply with the legal obligation to ask for the translation of the documents and, if this is not the case, to determine the reasons for non-compliance. The results of the survey are presented in this article. In order to try to explain these results, an in-depth analysis of the invoice is carried out based on the notion of genre, as developed by the GENTT Research Group, from the Universitat Jaume I in Spain.

In the eld of international trade, Chinese-Spanish commercial correspondence genres are amongst the most translated. A translator’s ignorance of the characteristics of these genres may lead to misunderstandings and even to breakdowns in communication. The aim of this research is to study and compare the politeness strategies used in Chinese and Spanish commercial correspondence and to use the results to provide guidelines for the translation of these genres from Chinese into Spanish and from Spanish into Chinese.

ABSTRACT: This paper focuses on the assessment of the current state of interpreting in different fields throughout all the asylum process in Spain. Here we share the results of a field research based on quantitative and qualitative surveys delivered to the agents involved in interpreting for refugees: asylum seekers and refugees, service providers and relevant officials, and the interpreters themselves. In our research we have verified the lack of attention paid to this area of interpreting, both from public services and from the academic and scientific community. The results show that, in general, the service is considered necessary, and that more funds and training for interpreters is needed. Taking into account that movement of refugees is a current topic, this area should receive far more attention.

ABSTRACT: Quite often the media has reflected the supposed lack of quality in the provision of legal interpreting services in Spain. And it is precisely that quest for quality and efficiency that has led the authorities to outsource such services through public tenders to private companies, some of which may indeed have been certified in compliance with certain quality standards. Therefore, it is of utmost importance to analyze whether there is an explicit mandate in those tenders as to the quality of the interpreting service to be rendered. This article analyzes how the specifications of 16 calls for tenders launched between 2006 and 2012 address issues which would facilitate the adequate provision of legal interpreting services, such as the professional qualifications and continuous professional development of interpreters, adherence to code of ethics and good practice, or the implementation of quality control systems that monitor the service provided.

ABSTRACT: Comparative law and legal translation have much in common. On the one hand, both disciplines have a common goal, which is the understanding of another culture by means of comparison in order to facilitate communication. On the other hand, both disciplines share a very similar methodological orientation. The comparatist, like the translator, is confronted with legal notions that exist in one legal system but do not exist in another system, and is therefore compelled to investigate the function that this notion fulfills in the source system in order to find a comparable notion that fulfills the same function in the target system. This idea of functionality, as a methodological principle of comparative law, recalls the idea of "functional equivalence" used in legal translation. These similarities in purpose and methodology between the two disciplines lead to the conclusion that comparative law and legal translation should acknowledge each other, since both disciplines have much to gain by learning from each other.

The impact of automatic extraction on the translator’s documentation process is explored using three sets of study data: a) the multilingual macrocorpus Turicor; b) a multilingual automatic extraction system available free-of-charge on the web, called SweSum; and c) a webpage pertaining to the Spanish company Pullmantur. After analysing an example in Spanish of automatically extracted terms and conditions of package tours, specifically cruises, we highlight the advantages of automatic webpage summarisation in legal and tourist translation between Spanish and English, from the point of view of terminology, subject content, syntax and documentation.

A saber: un sujeto que no es jurista y que se está formando en Traducción. ABSTRACT: This article explores, from a critical point of view, if the current training given to court interpreters and translators in Spain is sufficient in preparing them to do an adequate job in the courtroom and presents the opinions of legal professionals who work with interpreters and translators on a daily basis. We aim to present a new perspective, one that has not been sufficiently covered in existing curricula: that of the users of courtroom interpreting and translation services. Data comes from personal interviews and an anonymous survey of judicial legal professionals to know their views on the work carried out by interpreters and translators as well as their suggestions for improving the quality of the interpreting and translation services. This is a preliminary and partial analysis that requires a deeper study which we hope to undertake in the future.

ABSTRACT: In this analysis, we set out possible functional equivalences into English of Spanish verbal elements found in legal texts, with approaches based on both our teaching and professional experience. With this in mind, we have examined severa! real texts from different areas (texts from the Civil Registry, academic and notarial texts), and compared them with English-language parallel texts. ABSTRACT: Since 1996, the holders of the Spanish degree in Translation and Interpreting have been exempted from the Sworn Translator-Interpreter exam set by the Ministry of Foreign Affairs, as long as they provide evidence that they have received specific training in both legal and/or economic translation and interpreting. However, there are no accurate data available on this professional activity, and it is still a rather unknown profession not only for the general public but also for some members of the academia. This paper presents the results of a study based on one focus group with graduates from the University of Granada who have qualified as Sworn Translators-Interpreters following the abovementioned procedure, in order to provide a panorama of sworn translating and interpreting (English-Spanish) from the statements made by the participants in our study.
