Abstract: The author tries to define the concept of "engine" in eighteenth-century French novel by means of its relationship with characters, plot and private spaces. In order to establish a classification, a difference is made between "gallant engines" and "gothic engines ". Some examples of both sorts of engines are given. The engine is for the author not only a mere object in the novel, but a narrative strategy which defines the relationships between the different elements of that novel.

I will try to make a transgendered reading of two aspects of the tale: Hortense’s lesbianism and Walbé’s transvestism.

Abstract: L'article exposa la política de bilingüisme del Canadà pel que fa a les llengües de treball de l'Administració de justícia, als drets d'accés a la justícia en la llengua oficial pròpia i com aquesta política s'ha de posar en relació amb la política de normalització del francès que practiquen des de fa dècades les autoritats quebequeses. S'analitzen en primer lloc els dispositius legislatius que han permès el reconeixement d'un seguit de drets lingüístics a les comunitats de llengua oficial en situació minoritària (anglòfons al Quebec i francòfons fora d'aquesta província) i com la jurisprudència, principalment la de la Cort Suprema del Canadà, ha anat modificant el reconeixement d'aquests drets de manera evolutiva, considerant primer que el dret a fer servir una llengua oficial o l'altra als tribunals derivava d'un compromís polític però no es reconeixia com un veritable dret lingüístic, fins a la sentència Beaulac, on es donava una interpretació àmplia i liberal d'aquests drets i es considerava l'absoluta obligatorietat per a l'Administració de fornir les millors condicions per a llur desenvolupament. D'altra banda, aquest context legislatiu i jurisprudencial s'ha de posar en relació amb la política de normalització lingüística del francès a l'Administració quebequesa, la qual ha de reconèixer, però, els drets dels anglòfons a una justícia en llur llengua en una província on el francès està declarat com a única llengua oficial.

En los primeros, se analiza el caso concreto de la lengua empleada durante los procedimientos judiciales y la consagración del empleo directo de las lenguas oficiales del país, frente a los segundos, en los que el acceso a cualquiera de los tipos de servicios públicos esenciales debe hacerse por medio de un intérprete. Para demostrar esta distinción, se analiza la jurisprudencia canadiense en materia de lengua empleada durante los juicios, así como el modo de funcionamiento de los bancos de intérpretes en Quebec.

Abstract: La llengua catalana disposa d’un corpus important d’obres sobre convencions gràfiques. La recerca s’ha centrat en el buidatge de fonts que contenen convencions relatives a l’ús de les majúscules, convencions susceptibles d’ésser emprades en l’àmbit de la redacció juridicoadministrativa. Les fonts analitzades estan en molts casos relacionades directament amb aquest tipus de redacció, però s’han estudiat igualment obres de referència general i llibres d’estil. Els resultats han estat classificats en els tipus de designacions següents: tractaments protocol·laris, càrrecs i dignitats, designació de persones fora de la documentació protocol·lària, entitats o organismes formalment constituïts, institucions, normes jurídiques i documentació administrativa. La discussió dels resultats presenta alguns elements de reflexió analitzats al corpus: l’ús de l’antonomàsia conceptual i l’aplicació del principi de singularitat semàntica com a regles d’escriptura dels noms de càrrecs, la problemàtica de la constitució formal dels organismes i entitats i les seves repercussions en l’ús de la majúscula, el paper desenvolupat per les excepcions de designació (els correferents, les designacions abreujades o incompletes i els plurals aglutinadors), l’ambigüitat del concepte d’institució i les seves conseqüències gràfiques i les diferències entre les fonts pel que fa a la denominació dels instruments jurídics.

Abstract: El concepto de territorialidad lingüística remite a la existencia, para cada una de las lenguas de Europa, de un régimen jurídico propio circunscrito a un territorio determinado. Como categoría opuesta, el concepto de desterri- torialidad implica la existencia de un no-territorio jurídico, en el que no se pueden desarrollar de manera óptima las políticas lingüísticas necesarias para hacer que una lengua se convierta en lengua pública común. El catalán puede considerarse lengua mediana de Europa desde el punto de vista demolingüístico, pero está desterritorializada, pues carece de plenitud insti- tucional al tener que compartir espacio jurídico con el francés y el caste- llano. Este fenómeno es especialmente observable en el ámbito educativo, en el que pueden analizarse hasta tres niveles diferentes de desterritorialidad: la influencia del castellano y el francés como lengua franca y lengua vehicular tradicional en Andorra (nivel 1), la dificultad de encajar el sistema de con- junción lingüística de Cataluña en el entramado constitucional español (nivel 2) y la insuficiencia de la política lingüística educativa para revertir la ruptura de la transmisión lingüística intergeneracional en el Rosellón (nivel 3).

Abstract: This article analyzes the legislation of the two territories that have the most advanced legal framework regarding language policies towards Catalan: Andorra and Catalonia. The study of the legislation in relation to contexts of social and institutional use shows how this legal framework is not sufficient to change Catalan from being a minoritized language, since the phenomenon of minoritization is innate to the ecosystem in which languages develop. This ecosystem is conditioned by the presence of Castilian as a lingua franca on both sides of the border between Andorra and Catalonia. In the case of Andorra, its status as a cross-border microstate makes it a plurilingual space with Castilian as a socially cross-cutting language; moreover, the fact that until recently there was no network of state schools hindered Catalan language normalisation efforts. Catalonia, on the other hand, is an even more complex example on account of how the implementation of llengua pròpia policy contra- dicts the constitutional control the Spanish state exercises on this.

Abstract: Il n’existe aucune disposition législative ou constitutionnelle qui oblige les juges de la Cour suprême du Canada à maîtriser le français, pourtant l’une des deux langues officielles du pays. Ceci est d’autant plus surprenant que ces juges doivent déterminer la constitutionnalité de décisions liées à des causes parfois débattues en français auprès d’instances inférieures, ou encore être capables d’interpréter la législation bilingue du Canada. Ils doivent également être capables de lire l’abondante doctrine québécoise en matière de droit civil, majoritairement publiée en français. Pour résoudre ce problème, plusieurs projets de loi ont été déposés à la Chambre des communes depuis 2008, leur but étant de rendre obligatoire le bilinguisme des juges. Ils ont été longuement débattus à la Chambre et au Sénat, produisant un vaste corpus de discours. Parallèlement, la doctrine juridique francophone s’est emparée du débat et a avancé des arguments intéressants. Ces deux sources – les débats parlementaires et la doctrine – constituent un ensemble cohérent que nous analyserons dans cet article au moyen de trois fils conducteurs : le droit à être compris par un juge comme un droit linguistique, la considération du bilinguisme comme une compétence juridique, de même que la définition du degré de bilinguisme nécessaire pour remplir les obligations de juge à la Cour suprême.

Abstract: In this article, we explore the emerging trends in the field of jurilinguistics in relation to legal translation research and practice. Since the term jurilinguistics was firstly used almost forty years ago, it has served as an umbrella to analyse the relationship between language and law. Although it was initially framed within legal discursive and terminological research, the globalisation of legal relations and social changes have resulted in an interest shift towards broader disciplinary limits, including forensic linguistics, pragmat- ics, anthropology and sociology, among others (Jiménez-Salcedo & Moreno-Rivero 2017). In translation studies, jurilinguistics has adopted a new meaning, far from a purely microlinguistic perspective, so it defines translation as a situated practice (Monzó-Nebot & Moreno-Rivero 2020). Under the framework of jurilin- guistics, this paper explores three main axes in legal translation: firstly, we will review current research trends on legal genres and how to translate them; secondly, we will examine the synergies between corpus linguis- tics and legal translation; and thirdly, we will suggest methodological issues in legal translation training.

Abstract: Translation and interpreting in public services is an activity often performed by practitioners with no background training in translation and interpreting. The challenges in accessing this population of research participants in a previous study (Lomeña Galiano, 2018) led us to label them a hidden population. If these groups mostly known as “non-professionals” remain in the shadows, because of social dynamics, there is a risk that the collection and production of data are biased due to the lack of representativeness of the samples, with respect to a part of the population that is in charge of a large number of translation and interpretation assignments, especially in public service settings. There is, however, a methodological gap and a lack of guidance for those researching in the area as to how to negotiate the framework for the participation “non-professional” translators and interpreters in the most efficient way. To address that issue, this paper presents some tools used in social and human sciences to improve relationships with hidden populations. Specifically, this article focuses on the interaction between researcher and participants and the relevance of the notions of reflexivity and rapport (tuning) in this interaction. The aim of this study is to identify key points in the methodology to approach the population in participatory studies in order to facilitate access and the consequent participation of hidden populations in studies on translation and interpretation in public services.

ABSTRACT: In June 2018, the Aquarius, a search and rescue vessel operating in the Mediterranean Sea, rescued 630 migrants at sea and asked to dock at the nearest port. First Italy and then Malta refused and the dramatic situation of those on board made the news and highlighted the increasingly restrictive nature of European migration policies. Progressive parties in the Valencian regional and Spanish central governments provided the conditions to offer a safe berth and to implement the regional government’s plan to assist refugees in a crisis situation. This chapter will offer an overview of the plan, focusing on its linguistic component, and analyze how translation and interpreting were approached by the policymakers responsible for its inception and development. A distance between the values protected by translation and interpreting professional codes of practice and those that policymakers desire to advance in crisis situations will be evinced as revolving around the role of translation and interpreting in mediating asymmetries.

ABSTRACT: The relevance of translation has never been greater. The challenges of the 21st century are truly glocal and societies are required to manage diversities like never before. Cultural and linguistic diversities cut across ideological systems, those carefully crafted to uphold prevailing hierarchies of power, making asymmetries inescapable. Translation Studies have left behind neutrality and have put forward challenging new approaches that provide a starting point for researching translation as a cultural and historical product in a global and asymmetrical world. This book addresses issues arising from the power vested in and arrogated by translation and interpreting either as instruments of change, or as tools to sustain dominant structures. It presents new perspectives and cutting-edge research findings on how asymmetries are fashioned, woven, upheld, experienced, confronted, resisted, and rewritten through and in translation. This volume is useful for scholars looking for tools to raise awareness as to the challenges posed by the pervasiveness of power relations in mediated communication. It will further help practitioners understand how asymmetries shape their experiences when translating and interpreting.

Como interdisciplina, los estudios de traducción e interpretación surgieron para superar las perspectivas de otras disciplinas que se habían interesado por la traducción y la interpretación. Al observar fenómenos de la vida real, indefectiblemente complejos, las perspectivas interdisciplinarias permiten contemplar lo que una disciplina no puede explicar por sí sola. Esta presentación revisa cuestiones clave del enfoque interdisciplinario de la traducción y la interpretación en los servicios públicos. Se tratan aspectos vinculados con el método científico que se relacionan con la institucionalización de este campo de estudios y que tienen implicaciones en aspectos de validez interna y externa de las investigaciones. El trabajo aboga por un esfuerzo de coordinación que permita lograr un diálogo necesario entre contribuciones y la consiguiente masa crítica de estudios para situar a la traducción e interpretación en los servicios públicos en la primera línea de las políticas sociales en las sociedades actuales.

ABSTRACT: How disciplines approach their objects of inquiry is a result of their epistemological traditions, which include decisions about what they choose to examine and what they decide to ignore. As an interdiscipline, Interpreting and Translation Studies (ITS) was born to overcome the limits of discipline-specific approaches to translation and interpreting, and when observing complex real-life phenomena, examining issues through an interdisciplinary lens can reveal things that approaches from single disciplines on their own would miss. This feature article reviews how ITS has shaped Public Service Interpreting and Translation (PSIT), focusing specifically on the advantages and vulnerabilities that its interdisciplinary nature yields as regards research methods. Three distinctive features and their impact on research methods are examined: (1) the complexity of the object of inquiry, (2) the novelty of the disciplinary field that aims to scrutinize and to explain PSIT, and (3) the changes that the social sciences in general have undergone and are currently undergoing, opening up new opportunities for research practices and methodological reflections. Contemplations of these features reveal issues identified and the efforts undertaken to tackle them in relation to the internal and external validity of research studies as well as unexplored strengths and roadblocks in the path towards achieving a critical mass of studies that can adequately represent the relevance of PSIT in contemporary societies.

ABSTRACT: This is the guest editors’ introductory paper to the special issue “Situating jurilinguistics across cultures using translation and discourse approaches.” The introduction showcases the interdisciplinary vocation of jurilinguistics from its conception almost forty years ago. It is argued that jurilinguistics has achieved its current maturity by diversifying the disciplinary lenses of the originally contributing disciplines of legal translation and legal studies while keeping faithful to its original principles—facing practical problems with a rigorous outlook, venturing into any new domains that may prove enlightening, and combining professional and academic perspectives. The authors highlight how the series of conferences “Jurilinguistics: Interdisciplinary Approaches to the Study of Language and Law” have been instrumental in enhancing the scope of jurilinguistics. Finally, the articles gathered in this special issue are presented and their contributions in advancing the knowledge available for practitioners and scholars meeting at the interface between law and language are underscored.

ABSTRACT: This paper works on the notion of transgenre (Monzó-Nebot 2001a, 2002a, b), its uses and possibilities in the study of translation as mediating intercultural cooperation. Transgenres are discursi- ve patterns that develop in recurring intercultural situations and are recognized and used by a commu- nity. Based on the reiteration of communicative purposes and individuals’ roles in translated situations, interactions are conventionalized to streamline cooperation between cultural and social groups, thereby engendering a distinctive set of taken-for-granted assumptions and meaning-making mechanisms and signs which are particular to a translated event. The paper will first argue how this concept takes a step beyond the existing proposals from cultural, social, and linguistic approaches, especially the third spa- ce, the models of norms and laws of translation, and universals and the language of translation (transla- tionese), by focusing on the situatedness of textual, interactional, and cultural patterns and providing a means to model and measure the development of translation as a discursive practice, as such influenced by historical, cultural, social, cognitive, ideologic, and linguistic issues. Then existing applications of the concept and new possibilities will be identified and discussed. The results of existing studies show translations build a third space of intercultural discursive practices showing tensions with both source and target systems. The legal translator is at home in this third space, resulting from their own cultural practices, which are linked to translators’ specific function in a broader multicultural system.

From a commitment to the systematic and transparent creation of knowledge, scientists in human and social sciences have historically demonstrated a strong innovative spirit to adapt the forms of knowledge and develop perspectives that give us reliable and productive information about the human condition and about the human being as an individual in connection with others and with their environment, without abandoning rigor. The chapter emphasizes the capacity required by researchers in these sciences to simultaneously manage different ways of knowing and to constantly reflect on one's own involvement, as an individual, in the creation of knowledge, from the selection of problems to the possible biases in inference. ABSTRACT: The myth of the Tower of Babel has been used in Western thought to equate diversity with chaos but also to cherish the world’s enriching differences. By dealing with multilingualism as a curse that needs handling to prevent chaos or a blessing requiring adequate management policies to harness difference, societies privilege two different approaches to intergroup relations – assimilationism or multiculturalism – and two different views on translators and interpreters, as friends or foes. This chapter addresses how assimilationist and multiculturalist approaches to otherness may impact intergroup relations in globalized societies. To do so, the chapter explores how the idea of translation and interpreting is inextricably tied to societies’ conception of otherness; how justice is construed in a dialogic relation to the others; how we organize social spaces in groups of wedoms and theydoms; how a group’s ethical stance and cultural heritage impact its relations with other groups; how cognitive biases and rationalization of injustice enacted upon others may lead a group to act against its own ethical positions in pursuing group- and elite-specific interests; how such pursuit may impact a society’s prospects to thrive; and how translation and interpreting may encourage a postmonolingual stance that furthers democracy and resilience in a globalized world. In a context where monolingual and monocultural societies are no longer realistic options due to the speed and volume of demographic flows, this chapter advances a postmonolingual idea of social justice and of the role translators and interpreters play.

ABSTRACT: This chapter reviews how culture has been understood and integrated into the contributions dealing with legal interpreting and translation (LIT) studies referring to disciplines related to language and law. It critically reviews the evolution of central notions, addresses key issues, discusses the methods employed in the study of LIT, and identifies open questions for future research. The review highlights different conceptions of what it means to practice and study LIT and the location of these differences on the basis of the developments of the notion and application of culture in different schools in legal and translation studies. Notions, paradigms, and methods are linked to the conceptions of LIT and culture that underlie the studies and ways of engaging in a dialogue between the different perspectives are suggested in order to further advance the understanding of LIT from an integrative perspective. It is argued that the conceptualization of culture is at the root of long-standing positions in the field of LIT, including the professional profile of practitioners, which is understood in dichotomous terms (translators or law experts, regardless of other external factors) or contextualized (in localized trade-offs of priorities and constraints correlated with competencies). The dual character of LIT, symbolic and communicative, is analyzed as the basis of different translation policies in institutional settings and also of disciplinary discrepancies in advocating for different translation methods (on a continuum between free and literal), which has remained a major debate in LIT studies but also in the struggles between legal and translation studies to establish their jurisdiction over LIT. This debate is linked to another major issue in LIT studies, that of the role of those who practice, and it is argued that the definition of that role is closely linked to how legal systems, as cultural systems, define and organize justice and embrace the myths of law (such as the universality of norms or authorlessness) that affect key notions such as translatability and equivalence. The latter concept is reviewed as a mechanism of cross-cultural transfer from the perspective of the evolution of law, which is presented as an ontological network. The contributions that have studied this evolution in legal studies are articulated in two schools: one that looks at transfers as a form of communication between networks while maintaining the integrity of the links between existing nodes, and another that focuses on transplants or irritants, whereby these links are altered by the entry of new nodes in unforeseen ways due to a mismatch between the new node and the ontological network that hosts it. It is argued that the study of these alterations, of how translation between legal cultures affects legal systems is a field yet to be explored, as well as the historical and intercultural revision of the translation method and the norms of translation in LIT through a description of the genres of translation or transgenres, of the roles and habitus of translators and interpreters, and of the symbolic value of LIT in legal-political systems. Along with these, other more frequent topics in the current research landscape, such as textual and terminological studies, require reiteration due to the evolution of law and society. The article concludes that the constant evolution of notions, methods, and perspectives offers a positive diagnosis of LIT studies and their capacity for adaptation. In sum, the chapter reviews how the notion of culture underlies the major debates in LIT studies, problematizes key assumptions, and articulates the current and future discussion on the cross-cultural communication of law, thus laying the groundwork for an integrative view of the different approaches that coexist in this interdisciplinary field.

ABSTRACT: This chapter explores how face-work strategies serve the purpose of rationalizing injustice in legal discourse, more especifically in the sentencing remarks pronounced for a rape case. Due to its links to primal human cognitive biases, face-work can be used as an ideological instrument to influence behaviour. By minimizing the effects of injustice on the general public’s perception, face-work can go beyond social interactions to impact social relations, reverse the effects of a justice threat – that is, lenient or no punishment for criminal acts – and reinforce the social order, that is, the hierarchies of power between dominated and dominating social categories and the institutions organizing those hierarchies and regulating behaviour.

ABSTRACT: This chapter focuses on how binomials and multinomials structure our social experience and crystallize a specific world view through their use and reproduction in legal documents. Through the study of these types of phrasemes in the International Bill of Human Rights (IBHR), this contribution explores what divisions are operated by the international community to organize our shared social experience. The study builds on Sinclair’s stress on the relation between meaning and choice (1998: 2), his focus on the mutual influence of form and meaning (1998: 12), and the distinction between phrasemes’ phraseological and terminological tendencies. By scrutinizing how fixed the divisions by which the international community organizes the world behave, I will explore whether the prevailing social divisions crystalized in binomials and multinomials are dichotomous by studying whether references to underprivileged groups have been lexicalized and are together understood as the specific set of humans which requires protection or whether these groups are considered individually in discourse.

ABSTRACT: The Research Group on Translation and Postmonolingualism (TRAP) focuses on linguistic management policies that use translation and interpreting in societies featuring increasing diversity to pursue the political representation of diversity. The group stresses the importance of intergroup competences for translators and interpreters, that are required to manage intercultural differences, but also the cognitive biases activated by the recognition of intergroup differences and that influence the ability to understand identities with the necessary depth to translate and interpret. Based on the theory of social identity and on the work developed in the field of intergroup relations, this contribution presents a proposal that works on the extended contact hypothesis, which postulates that narratives about positive experiences of intergroup contact improve affectivity between individuals with different social identities. A movie forum was designed with films depicting post-monolingual societies in asylum and refugee contexts. With the reflective viewing of the selected proposals, the attendees' knowledge of the nuances and details that influence intergroup communication in post-monolingual contexts was improved. It is argued that similar efforts are needed to provide translation and interpreting trainees with essential skills to communicate in diverse societies, such as knowledge about the cognitive biases of intergroup hostility and intragroup affinity and the benefits of direct and indirect contact.

ABSTRACT: The paper aims to contribute data to the subservient habitus hypothesis explored in Interpreting and Translation Studies, where interpreters and translators are said to be especially sensitive and keen to reproduce social and textual norms, usually dictated by other agents in the field. After exploring the use of this hypothesis in the field, the case study is preceded by a brief account of special features of translation in international organizations and the key elements of the use of legal translation at the World Trade Organization (WTO). The selection of the corpus of study and the target-oriented approach are justified before briefly comparing the traditions in the study of phraseology in English and Spanish. A method drawing from both traditions is explained and then applied to two subcorpora of legal texts in order to establish patterns that can help us see how subservient or subversive translators’ behavior can be.

ABSTRACT: This article is the guest editor’s introduction to the special issue of The Interpreter and Translator Trainer on ‘Legal Interpreting and Translation’ (LIT). Monzó examines what fluctuations and advances are affecting the contents and methods proposed for training future legal interpreters and translators and argues that the changing legal, social and economic conditions, including an evolving linguascape and law reforms pertaining to LIT, demand professionals who can constantly adapt the services they offer to new settings and new conditions. Trainers need to be aware of the changing nature of the profession to adapt their own roles, and to set learning outcomes for a variety of learning contexts that allow future professionals to thrive in a changing society. As much as translators and trainers need to adapt, so do the curricula themselves. Recent reforms in higher education have introduced substantial changes, purportedly to better correspond to market and States’ needs. As new frameworks and methodologies are enforced and introduced in higher education, several mismatches and inadequacies regarding societal and market needs have to be redressed. Trainers across regions enjoy different policy space regarding planning and delivery but they all face a new genera- tion of citizens, a global citizenship which has been said to be the most qualified generation in history and yet faces unprecedented unemployment rates. Against this background, Monzó questions the ownership of the curricula and examines how trainers themselves struggle with changes impacting their professional discretion and identities.

ABSTRACT: This contribution draws on the different models developed to assess and predict technology acceptance (particularly the Unified Theory, UTAUT) and discusses the factors considered and their applicability to CAT tools and professional translators. It further draws on translator studies to discuss how the current research on the translators’ habitus can support and enhance the existing models. The model suggested comprises five categories (performance and effort expectancy, social norms, perceived playfulness and self-determination), whose relevance is tested empirically with a cohort of professional translators. The survey is carried out through a questionnaire where translators working in different language combina- tions and different institutions and companies, with different status (free-lancers and permanent in-house professionals), report their adherence to specific statements pertaining to the five constructs analyzed. The analysis highlights the importance of one of the two innovative factors contained in this proposal, self-determination, across the professional characteristics of the participants.

In the second part of the article, I will discuss two particular conflicts, both of which involve Spanish certified (or “sworn” in European Spanish) translators and interpreters (TIs). The first is a jurisdictional struggle between certified TIs and notaries public (a legal occupation) and the other, a struggle between certified TIs and court TIs. These struggles illustrate how the jurisdiction, the segment of the labor market formerly occupied by certified TIs, has been progressively claimed by notaries public and court TIs through various strategies and processes, and how certified TIs have in turn reacted by pursuing strategies of their own. These examples show how and why a particular group may lose ground to other groups using di- verse strategies and investing different types of capital (in Bourdieu’s sense of the term). Moreover, these cases exemplify how some professionalization processes and projects have worked in the Spanish context and how certain occupational groups are developing professionalization strategies of their own.

ABSTRACT: The aim of this monographic issue is to bring together several sociological glimpses of the field of Translation Studies. To stress this fact, we have entitled it ‘Sociology Applied to Translation' (SAT). This label was chosen because we sought to highlight the opportunity to attract resources, methods and tools from other epistemological areas (those of the social sciences) and perform a selective appropriation of them for our disciplinary field. Indeed, SAT could be constructed by integrating and interpreting selected theories and methodologies. We could build the structure upon the social ontology by Pierre Bourdieu, use the lights provided by the Sociology of Professions to illuminate the reasons, versions and effects of evolution and involution of occupational groups such as ours, establish paths between the plots by following the action-research of Kurt Lewin, adapting and linking theories, methods and applications to get involved in the world and improve it, or to sit down and listen to it and listen to ourselves with a dramaturgical perspective in the style of Erving Goffman or with Garfinkel's Ethnomethodology… It would definitely be an attractive technique for building a theoretical and methodological body that would be applicable to the phenomena of translation and interpretation where the leading characters are the agents and their coexistence.

It is also common to emphasise that this is not a unitary science, but rather a way of dealing with the collective side of human phenomena. This circumstance becomes especially apparent in the wide range of topics that could be addressed, as well as the number of approaches and applicable methods. Thus, if you look at the list of thematic areas covered by the committees of the International Sociological Association, you can expect to find areas such as the Sociology of Religion, the Sociology of Health or the Sociology of Education, alongside others such as the Sociology of Science, the Sociology of the Arts, and Sociocybernetics, Social Psychology or Social Indicators. In fact, its current list of 55 subject areas is not intended to be closed and conclusive and, therefore, you may want to add on the Sociology of Knowledge, Ethnomethodology, Sociobiology or even the Sociology of Sociology, among many other possibilities. Some scholars suggest that, properly speaking, it would be more appropriate to consider Sociology as a bundle of disciplines. At the end of the day, it is very common to refer to a sociological glimpse, which can be diverse, focus on the most varied dimensions of human activity and, indeed, it is easily seen to pervade several other disciplines.

ABSTRACT: Driven by increasingly demanding and competitive market pressures, translation professionals have turned to computer- assisted tools and other specialized electronic resources to improve their productivity without compromising the quality of their output. This paper discusses the usefulness of corpus-driven activities and electronic corpus-based tools for the purposes of legal translator training. It begins with an overview of legal translation as an idiosyncratic field of specialized mediation and a survey of previ- ous corpus-based approaches to translator training. A number of discourse effects which characterize legal texts are then defined – universalization, neutralization and defamiliarization. Drawing on relevant examples, the author argues that corpus-based legal translator training is particularly helpful for trainees to identify the textual manifestations of these effects and to decide how they should be transferred across languages and legal systems. Within this framework, a range of specific corpus-driven activities are proposed and this pedagogical approach is shown to foster the students’ active involvement in the management of their own learning. Whilst the activities outlined here are restricted to the domain of legal texts, this paper aims to inspire fellow trainers to explore the advantages of corpus-based teaching across different translation fields and trainee backgrounds.

ABSTRACT: Translation is not a profession. That was the conclusion of a study carried out by the author among Spanish legal translators. However, there are strategies which may be used by researchers in order to promote the social, cultural and economic interests of these professionals, mainly by applying Lewin's methodology of action-research. This paper presents a research project currently being carried out by the ACTIVE team, which seeks to describe and explain a small part of the translation and interpreting field - that devoted to the intersystemic communication of law. By exploring and promoting the interests and strategies of certified translators and interpreters in the Spanish context we aim to improve their professional practice conditions.

ABSTRACT: A series of activities for English-Catalan legal translation trainees are presented. The goal of the program of activities is to improve students’ training in English-Catalan and English-Spanish legal translation courses. The difficulty and density of the subject matter, together with the lack of familiarity with legal matters on the part of undergradute students, imposed severe difficulties to prepare trainees to face the demands of the legal and sworn translation job market. The paper exposes the details of the course (students’ and trainer’s profiles, hours available for training, previous training and courses taken simultaneously by students), the shortcomings identified, and the solutions suggested. I further outline the main characteristics of the activities conducted in three interdependent seminars. The assessment of the activity in 2000-2001 focuses on the improvement in students’ translation performance and attitudes towards the course.

ABSTRACT: Legal translation requires a very wide range of knowledge. Professional translators face texts from any branch of law and, further, concepts from many other disciplines may appear, all all the various fields of human experience are continually regulated, and increasingly translated in an interconnected world. This makes it impossible for legal translation trainees to acquire all the knowledge on concepts, terminology, and textual conventions for translated texts they will require, even for a limited set of languages. This paper presents an initiate to ease up the acquisition of the relevant knowledge by focusing on the translations of translation experts as cultural artifacts. There are still many very different reasons that make it difficult for translators and trainees to access translations from expert legal translators. We set out to build a parallel corpus of original documents with the respective translations so that students would have a place to go to in search of models of textual behavior. The system offers a query tool that allows them to compare two, three, or four versions of the same translation. The system succeeded in training a group of students in aspects of textual classification. They developed high autonomy in the documentation process and learned the most effective steps and knowledge from their peers.

ABSTRACT: Based on the concept of socialization, we argue that the use of real translations in the legal translation classroom can contribute to strengthening the identity of translators as a professional group through the identification of the different individuals with a textual cultural artifact, a function in human communication, and a social role. To this end, knowledge of translations as an autonomous discursive product, with their own determining factors, is as necessary a tool in the training of translators as mastering the concepts, textual conventions, and social practices related to the original texts. Therefore, contrastive issues, community-based translation strategies, and translation-specific interactions should be used to structure and develop legal translation training.

ABSTRACT: The initiative I am presenting here was introduced as part of legal translation training (English-Spanish/Catalan) at the Universitat Jaume I (Spain) in the academic years 2001-2002 and 2002-2003. The project was aimed at improving the training of future legal translators studying for their Degree in Translation and Interpreting. We wanted to foster a certain degree of autonomy in the documentation tasks on the part of the translator-to-be by developing a textual information resource consisting of an on-line database fed with original and translated legal documents and a search engine through which the retrieval of documents was based on textual classification criteria. In what follows I will deal with basic questions related to why this tool was needed in the classroom, why we chose to mix original and translated texts and why we chose to offer our own textual classification system. Moreover, I will suggest that this tool may also be used in professional translation practice by real translators in order to improve their efficiency.

ABSTRACT: The GENTT research team of the Department of Translation and Communication at the Universitat Jaume I is carrying out a research project aimed at providing professional translators in three fields of expertise (legal, medical, and technical translators) with a tool that will enable them to considerably reduce the time spent on documentation tasks. Our efforts have been focused on demonstrating the usefulness of the concept of genre in its application to the work of professional translators and, from the first results, we have seen the need to provide the group with a tool in which not only can specialty texts in the working languages be consulted, but also the most relevant information for the professional can be accessed, conveniently treated, and presented. In this paper we present the theoretical and methodological bases of our project, give an account of the current status of our project, and outline the new challenges that lie ahead in order to produce an encyclopedia of genres in which real instances of the documents to be translated can be found together with data on their cultural and situational contexts, their semantic and textual development, the real use given to them by regular users and the relationship of the genre in question with others available in the corpus, whether original or translated.

ABSTRACT: Genre is emerging as one of the most useful concepts in translator training. This is even more evident in specialized areas where the conventions established by a professional community are key indicators of the quality of a textual (re)production. The special type of communication entrusted to the legal translator involves mediation between two different cultures and legal systems (British and Spanish, for example), so the result of the translation activity includes these two realities even if it cannot be considered a sum of both. I argue that the translation accepted by the receiving community is a third space, a transgenre that constitutes an essential tool for legal translators to acquire their own culture and situation-specific conventions, that is, for socializing legal translators.

ABSTRACT: This doctoral thesis deals with the concepts of discursive gender and profession from a theoretical point of view and in its application to certified legal translators (CLT). The initial hypothesis is that the degree of conventionalization of translators (as cultural artifacts) is indicative of the degree of professionalization of the activity. That is, if the profession has been established in the market of occupations, the solution is provides will have undergone a standardization process leading to the fixation of certain features found in translations as cultural artifacts of the community of translators which are exclusive to translations. A critical approach to the relevant notions in the sociology of professions and social practice, on the one hand, and genre studies and systemic functional linguistics, on the other, builds an analysis framework that is applied to real certified legal translations from English into both Spanish and Catalan. The resulting analyses are examined against the obtained from a survey among Spanish-English and Catalan-English certified legal translators. Both axes lead to a diagnosis of the professional state of the CLT as not established.

ABSTRACT: The use of legal texts, those written by lawyers provides translation trainees with an opportunity to become acquainted with the legal culture. Indeed, texts are cultural artifacts and, as such, are pervaded with values, attitudes, and knowledge. Studying legal texts, legal translators and translation trainees can become familiar with the discourse and culture of the consumers of their texts, as an integral part of the skills they apply to introduce their texts in the target system. Working with legal texts is indeed a widespread practice. Not so usual is to work with those artifacts attesting to the legal translators' own culture, the translations that have been successfully introduced in the target system. This article seeks to illustrate the relationship between the texts and the communities that produce them, in order to highlight the opportunities to work with translated texts in developing the legal translator as a cultural group. An emphasis is placed on the importance of and the demands placed on the text in the legal community and how both also affect translations. Attention is drawn to the fact that specialized texts are essential elements of specialized communities and that the legal translator, as a mediator between two different legal cultures, has textual demands of their own that are not derived from the original texts, but from the function of the translator in their society. Consequently, the use of translations in training translators is a necessary development in order to provide future translators with access to the textual behavior of their own community and its own patterns of conduct.

ABSTRACT: In the region of Valencia, legal translation is intense due to its official bilingualism, where both Catalan and Spanish are the languages of the Administration and its citizens. However, most officials have been trained in an era where no education was available in Catalan, resulting in their preference for Spanish as a means of written expression. As a result, Catalan texts are translated texts which means that translated texts in this system have the same authority as original texts. In this paper, we follow Toury’s tenets to determine whether translation norms lead to the acceptability of the legal texts published in Catalan in the official journal of the Valencian Government. The analyses focused on three genres: service notices, writs, and resolutions.

ABSTRACT: The paper describes the legal genre of court judgment and compares its features in Catalan and English, highlighting translation problems. The situation of Catalan in the Valencian administration is far from optimal. This is the main reason for the low production of legal, original, and translated texts in Catalan. Catalan is in a better position in other administrations, such as Andorra, where it is the official language. In addition, proposals are currently being made to extend the areas of use of co-official languages of the Spanish State to the central administration. These reasons may open a brighter future for the use of legal Catalan. This paper reflects on this understudied subject and analyzed an English legal genre, judgments, to propose its translation into legal Catalan. The genres and terminology in both English and Catalan are explored to argue for translation solutions.

Abstract: In this article, we explore the emerging trends in the field of jurilinguistics in relation to legal translation research and practice. Since the term jurilinguistics was firstly used almost forty years ago, it has served as an umbrella to analyse the relationship between language and law. Although it was initially framed within legal discursive and terminological research, the globalisation of legal relations and social changes have resulted in an interest shift towards broader disciplinary limits, including forensic linguistics, pragmat- ics, anthropology and sociology, among others (Jiménez-Salcedo & Moreno-Rivero 2017). In translation studies, jurilinguistics has adopted a new meaning, far from a purely microlinguistic perspective, so it defines translation as a situated practice (Monzó-Nebot & Moreno-Rivero 2020). Under the framework of jurilin- guistics, this paper explores three main axes in legal translation: firstly, we will review current research trends on legal genres and how to translate them; secondly, we will examine the synergies between corpus linguis- tics and legal translation; and thirdly, we will suggest methodological issues in legal translation training.

Abstract: This is the guest editors’ introductory paper to the special issue “Situating jurilin- guistics across cultures using translation and discourse approaches.” The introduc- tion showcases the interdisciplinary vocation of jurilinguistics from its conception almost forty years ago. It is argued that jurilinguistics has achieved its current matu- rity by diversifying the disciplinary lenses of the originally contributing disciplines of legal translation and legal studies while keeping faithful to its original princi- ples—facing practical problems with a rigorous outlook, venturing into any new domains that may prove enlightening, and combining professional and academic perspectives. The authors highlight how the series of conferences “Jurilinguistics: Interdisciplinary Approaches to the Study of Language and Law” have been instru- mental in enhancing the scope of jurilinguistics. Finally, the articles gathered in this special issue are presented and their contributions in advancing the knowledge available for practitioners and scholars meeting at the interface between law and lan- guage are underscored.

Abstract: In this study we present the results of a survey conducted with sign language interpreters on their perception of their role as professional interpreters in the courts of the Autonomous Community of Valencia. The study highlights the imbalance of social and personal power which is generated in the courtroom between agents of the court and other agents well- versed in courtroom communication and culture, and members of the deaf community who frequently have no knowledge of such matters. Within this framework, we describe the expectations of interpreter users with regard to sign language interpreting. Having explained the problem of the broad array of perspectives on the limits of the interpreter’s role, the article explains the methodology employed for the design and administration of the questionnaires and presents the results thereof. From the starting point of the dissonance between what different interpreter users demand of their interpreters, we present solutions adopted by the interpreters themselves and argue for the need to define a congruent set of values for public service interpreting that can guide professional interpreters in their work as well as offer the flexibility they need to adapt their role according to the different contexts in which they work.

Abstract: When a sign language interpreter enters a courtroom, her function is to ensure that one or more deaf or hard of hearing individuals have effective access to information and communication. Such general statement offers a wide range of possibilities for interpreting the actual nature of her role in an interpreted-mediated situation, which is determined by a series of imbalances impacting the communication process. In the courtroom, hearing and deaf people, who may be living in the same country and who may share a common culture, use different languages and have different sociological backgrounds. These differences, however, are generally unknown to hearing conversational partners, even those with the highest power in the communicative interactions. The resulting imbalance is intensified by two important factors: the information in the courtroom is usually conveyed by audio-visual media to which the deaf community have access difficulties, and the courtroom has its own norms and specific languages which are generally unknown to citizens, both hearing and deaf. In this work, and based on my own professional experience as a court sign-language interpreter in the Valencian Community, I examine the differences between the minorized sign language and the dominant spoken visual-gestural language which are not taken into account by any court agents and the challenges and hindrances that this unawareness poses on communication in judicial settings. I will particularly focus on the power imbalances that have been described for court settings, which are intensified for sign-language users.

Abstract: El grup de recerca Traducció i Postmonolingüisme (TRAP) vol acostar, als programes de formació de traductores i intèrprets, les polítiques de gestió del multilingüisme que utilitzen la traducció i la interpretació per oferir en les societats modernes, caracteritzades per una diversitat creixent, una representació igualitària de les diversitats que satisfaça els requisits dels sistemes democràtics. La pretensió és desenvolupar competències específiques per a la gestió de les diferències interculturals, però també per a la gestió dels biaixos cognitius que s’activen en acarar diferències intergrupals i que influeixen en la capacitat de comunicar-nos, de comprendre les identitats amb la profunditat necessària per a traduir-les. Per fer-ho, el grup es basa en la teoria de la identitat social i en els treballs desenvolupats en l’àmbit de les relacions intergrupals. En concret, aquesta contribució presenta una proposta elaborada des de la hipòtesi del contacte ampliat, que postula que les narratives sobre experiències positives de contactes entre grups milloren l’afectivitat entre individus amb identitats socials diferents. Amb un cinefòrum amb films que representen societats postmonolingües en contextos d’asil i refugi, amb poblacions vulnerables, aquesta iniciativa va acostar a les persones participants competències essencials per comunicar-se en les societats actuals, com són els coneixements sobre els biaixos cognitius de l’hostilitat intergrupal i l’afinitat intragrupal i les millores que es deriven del contacte, directe i indirecte (a través de narratives). Amb el visionat reflexiu de les propostes seleccionades, es va millorar el coneixement dels assistents sobre els matisos i els detalls que influeixen en la comunicació entre grups en contextos postmonolingües.

Abstract: Bibliometrics started as a fundamentally quantitative approach which has now begun to integrate qualitative aspects. In this chapter, I present a mixed-methods approach which brings together bibliometrics and Philip Mayring’s qualitative content analysis. With this methodology I tackle the issue of how interculturality has been incorporated into research on legal interpreting, positing that, in accordance with the cultural shift that has taken place in Translation and Interpreting Studies, the latest studies will incorporate the intercultural dimension in new and more diverse ways. After building a corpus made up of articles on legal interpreting, I applied Mayring’s summarising content analysis and inductive category formation. I identified twenty different ways in which interculturality is brought into research on legal interpreting. It appears in relation to different sub-topics of sorts, such as the issue of cross-cultural equivalence, among others, as well as in different parts of the research (as part of the research question or the theoretical considerations, for instance). Close analysis of the results showed that the main issue related to this topic seems to be that of the interpreter’s role: mere conduit or active broker? The results also show that further clarification is needed on what is culture and what are cross-cultural issues. Finally, while the initial hypothesis was only partially confirmed, the insights gained further prove the usefulness and potential of the mixed-methods approach presented in this chapter.

Abstract: Los modos en que las distintas disciplinas se aproximan a sus objetos de estudio son resultado de sus tradiciones epistemológicas, las cuales incluyen decisiones sobre lo que estudian y lo que dejan de estudiar. Como interdisciplina, los estudios de traducción e interpretación surgieron para superar las perspectivas de otras disciplinas que se habían interesado por la traducción y la interpretación. Al observar fenómenos de la vida real, indefectiblemente complejos, las perspectivas interdisciplinarias permiten contemplar lo que una disciplina no puede explicar por sí sola. Esta presentación revisa cuestiones clave del enfoque interdisciplinario de la traducción y la interpretación en los servicios públicos. Se tratan aspectos vinculados con el método científico que se relacionan con la institucionalización de este campo de estudios y que tienen implicaciones en aspectos de validez interna y externa de las investigaciones. El trabajo aboga por un esfuerzo de coordinación que permita lograr un diálogo necesario entre contribuciones y la consiguiente masa crítica de estudios para situar a la traducción e interpretación en los servicios públicos en la primera línea de las políticas sociales en las sociedades actuales.

Abstract: How disciplines approach their objects of inquiry is a result of their epistemological traditions, which include decisions about what they choose to examine and what they decide to ignore. As an interdiscipline, Interpreting and Translation Studies (ITS) was born to overcome the limits of discipline-specific approaches to translation and interpreting, and when observing complex real-life phenomena, examining issues through an interdisciplinary lens can reveal things that approaches from single disciplines on their own would miss. This feature article reviews how ITS has shaped Public Service Interpreting and Translation (PSIT), focusing specifically on the advantages and vulnerabilities that its interdisciplinary nature yields as regards research methods. Three distinctive features and their impact on research methods are examined: (1) the complexity of the object of inquiry, (2) the novelty of the disciplinary field that aims to scrutinize and to explain PSIT, and (3) the changes that the social sciences in general have undergone and are currently undergoing, opening up new opportunities for research practices and methodological reflections. Contemplations of these features reveal issues identified and the efforts undertaken to tackle them in relation to the internal and external validity of research studies as well as unexplored strengths and roadblocks in the path towards achieving a critical mass of studies that can adequately represent the relevance of PSIT in contemporary societies.

Taking a critical and empirical stance, the papers provide data and reflections on how language access is critical to fulfilling fundamental rights and ensuring the ability of institutions to implement their mandates effectively. The introductory article reviews the role of public services in present-day multilingual societies and of translation and interpreting in relation to the policies governing language access. It goes on to review conflicting implicit theories of translation and interpreting by providing a brief discussion of the roles prescribed and described for translators and interpreters. Abstract: This monographic section of the Revista de Llengua i Dret, Journal of Language and Law presents the findings of six critical perspectives on translation and interpreting policies and practices in modern societies that pose challenges for public institutions. Taking a critical and empirical stance, the papers provide data and reflections on how language access is critical to fulfilling fundamental rights and ensuring the ability of institutions to implement their mandates effectively. The introductory article reviews the role of public services in present-day multilingual societies and of translation and interpreting in relation to the policies governing language access. It goes on to review conflicting implicit theories of translation and interpreting by providing a brief discussion of the roles prescribed and described for translators and interpreters. Abstract: Extreme gang violence in El Salvador, Guatemala, and Honduras has prompted thousands of mothers and children to seek refuge in the United States. In response to the 2014 migrant crisis, the United States’ use of family detention centers represents one of the most controversial aspects of the Obama administration’s political response. For-profit detention centers located in Karnes, Texas and Dilley, Texas, are currently housing thousands of asylum-seeking mothers and children beyond capacity (García-Ditta 2015: n.p.). The gravity of the current refugee crisis is only exacerbated by language barriers – one of the direst obstacles to avoiding swift removal processes. A crucial step in the asylum-seeking process is the credible fear interview (CFI), an immigration proceeding in which a person must demonstrate credible fear of returning to his or her home country or be subject to deportation. This article directly locates language mediation in non-criminal immigration proceedings as a human right to which institutional compliance is still unresponsive and ineffectual. The authors aim to offer a descriptive analysis of US immigration proceedings with a brief final discussion which contemplates the unexplored aspects of the legal and ethical grey zone of language access in borderland detention centers.

Abstract: This article aims to describe the current state of affairs as regards national registers of legal interpreters and translators (LITs) in the United States and the European Union. After a brief overview of what translation and interpreting studies researchers and EU work group participants recommend about their construction and utilization, a case will be made for the use of national registers as essential tools in two important struggles: professionalizing legal translation and interpreting and building public trust. Based on current models and recommendations by researchers, a proposal will be put forth for minimum characteristics of a national register of LITs. Rather than an afterthought, the interpreter register merits scrutiny and careful elaboration precisely because of an ever more ubiquitous need for states and countries to implement measures which are fair, transparent, cost-effective, which guarantee due process, and which provide users with ways to make an objective value judgment regarding the competence of the interpreters they commission.

Abstract: Court interpreting certifying bodies face a plethora of challenges in their quest to identify competent judicial interpreters so that speakers of all languages might be assured of due process under the law and equal access to justice. For the entities which develop and administer the oral certification exams which act as gateways to the profession of court interpreting, two such dilemmas are of particular interest: the first is high rates of exam failure, with a frustrating number of candidates not meeting minimum levels of qualification to practice in court. The second is an increasing need for qualified interpreters of languages of lesser diffusion. In the face of ubiquitous budget constraints, this article explores an abbreviated testing model as a mitigator of extreme exam failure at the same time as it reveals the results of a recent pilot project which focused on centralizing interpreting services protocols while prioritizing interpreter quality.

Abstract: This article gathers research from three studies conducted by industry stakeholders in US court interpreting – research which provides a blueprint for prioritising quality in courtroom language access and which concretely links court interpreter training to policy decisions in the areas of language access and interpreter certification testing. The first study examines training experiences of Spanish/English court interpreters in one US state (Wisconsin); the second surveys practising court interpreters in the same state to demarcate specific skill domains and content in which court interpreters wish to receive training; and the third study examines failure rates on the state-level oral court interpreting exams on a national level over a 15-year period, suggesting some key strategies to mitigate such failure. In light of the aforementioned studies, as well as in response to the National Center for State Court’s recent publication entitled A National Call to Action, this article represents a further call to action, beseeching educators and policymakers to create meaningful training opportunities, to acknowl- edge the relationship between lack of training and widespread oral exam failure, and to reward and incentivise training and credentialing through proactive policy decisions.

Abstract: In the United States, with 44 out of 50 states holding membership in the Consortium for Language Access in the Courts, the court interpreting certification exam administered by this entity holds absolute primacy and is the most important gatekeeper to the profession. This study explores whether or not success in one mode of interpreting on the Consortium’s oral certification exam could potentially predict successful performance in the other two modes; likewise, the viability of utilizing an abbreviated testing model, positing the mode that appears to predict overall success as a screening exercise, is contemplated. In order to isolate a potential predictor mode, this chapter explores precedents for the use of abbreviated testing models with Consortium exams and recreates a small study on a vastly larger scale, contributing an evidence-based analysis of some 6,000 raw exam scores spanning over a decade. With substantial data supporting the relationship between success in the simultaneous mode and overall success on the Consortium certification exam, the implementation of a bifurcated model could have a potentially very real impact on the way the Con- sortium exam is administered.
