In the Last Will and Testament

I John Gilmour of Basinghall Street London Blackwall Hall London Factor being of sound mind memory and understanding for which I bless God but considering the certainty of death and the uncertainty of the time thereof do make and ordain this my last will and testament in the manner following that is to say first and principally I commend my soul into the hands of Almighty God hoping and assuredly believing that by and through the merits, death and passion of my blessed Saviour and Redeemer Jesus Christ to obtain full pardon and free remission of my sins and to inherit eternal life my body I commit to the earth to be interred by my Executors hereinafter named in as private a manner as possibly they can in the parish church of St Michael Bassishaw and as to such worldly goods and estate as it has pleased God to bless me with I give devise and bequeath in the manner and form following (that is to say) I do will order and direct that all my just debts and funeral expenses to be fully satisfied and paid and after payment thereof I give and bequeath unto my beloved wife Mary Gilmour the use of all my household goods plate and furniture for and during the term of her natural life and ( inserted forward) after her decease to give the said household goods plate and furniture to my daughter Elizabeth Gilmour and to such child or children whereof my wife is now pregnant as shall be born alive and living at the time of her death in such shares and proportions my wife by her last will and testament or any writing purporting to be her last will and testament shall direct and appoint and for want of such direction or appointment in equal shares if there shall be more than one living at the time of her decease and if but one then the whole to that one and also I give to my mother Margaret Clark the sum of twenty pounds to be paid to her within twelve months next after my decease and I direct that the residue of my personal estate of what kind soever may be turned to ready money as soon as conveniently may be after my decease ( and with what cash shall be found in my house at the time of my death) be placed out at interest in some of the publick funds or other real security in the names of my said wife and my brother Charles Gilmour upon this special Trust and to permit and suffer my said wife to receive the interests and profits thereof for and during the term of her natural life for her own maintenance and to bring up and educate my said daughter Elizabeth Gilmour and to such child or children whereof my wife is now pregnant and shall be born alive during their minority without being accountable for the surplus thereof (if any) it being my intention that my wife shall have the interest and product thereof during the term of her natural life and in case the interest and product of my said personal shall not be sufficient for the purposes aforesaid then my mind and will is and I do hereby direct that so much of the principal money shall be taken out of my personal estate as will make up the deficiency from time to time and also in the case of a son or sons my mind and will is that so much money shall be taken out of my personal estate will be sufficient to put him or them out apprentice at a proper age and from and after the death of my said wife I give the residue of my personal estate to my said daughter Elizabeth Gilmour and to such child or children as my said wife in now pregnant with and shall be living at the time of my said wife’s decease in such shares and proportions as my said wife by her last will and testament or any writing purporting to be her last will and testament shall direct and appoint and for want of such direction or appointment in equal shares if there shall be more than one living at the time of her decease and if but one then the whole to that one but I case all my children happen to depart this life unmarried or before she he or they or any of them have attained the age of twenty one years then in that case after the death of my wife Mary Gilmour I give so much of the residue of my personal estate as shall be then remaining to my brother Charles Gilmour and my brother Nathaniel Gilmour in equal shares and I do hereby revoke and make void all former wills by me heretofore made and do make publish and declare this t be my last will and testament and I do nominate constitute and appoint my said wife Mary Gilmour and my said brother Charles Gilmour joint Executors of this my last will and testament whereof I have hereunto put my hand and seal this 28th day of September in the year of our Lord 1762 John Gilmour signed sealed published and declared by the said testator John Gilmour as and for his last will and testament in the presence of us who have subscribed our names at witnesses thereto in his presence and at his request and in the presence of each other

This Will was proved at London the sixth day of November in the year of our Lord one thousand seven hundred and sixty two before the Worshipfull George Harris Doctor of Laws and Surrogate of the Right Honourable Sir Edward Simpson Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of Mary Gilmour widow the relict and Charles Gilmour the brother of the deceased and Executors named in the said will to whom administration of all and singular the goods chattels and credits of the deceased was granted having been first sworn duly to administer.
