謝煜偉  HSIEH, Yu-Wei

謝煜偉教授現任國立臺灣大學法律學院教授，目前並於加拿大英屬哥倫比亞大學（University of British Columbia）Peter A. Allard 法學院擔任訪問學者（Visiting Faculty Member）。謝教授於國立臺灣大學取得法學士及法學碩士學位，並於2011年取得日本京都大學法學博士學位。在2013年8月加入臺大法律學院之前，曾任京都大學法學研究科助教及國立清華大學科技法律研究所助理教授，2017年亦曾赴日本早稻田大學法務研究科擔任訪問學者。

謝教授的主要研究領域包括刑法、刑事政策、少年司法及量刑理論。其研究以刑法釋義學為基礎，並重視比較法研究，尤其著重日本及德國刑法理論與制度，同時逐步引入跨領域的刑事法研究。歷年研究主題涵蓋危險犯、死刑量刑、刑事再審與冤罪案件、少年刑事責任與量刑、性犯罪、HIV入罪化，以及AI生成性影像之刑事規制等。近期研究亦進一步探討刑事處遇與社會復歸的理論基礎，以及刑事強制治療的憲法正當性。

在臺大法律學院，謝教授主要講授刑法、刑事政策及刑事學等課程，並開設刑事法學與刑事政策相關專題課程。其教學與研究密切結合，特別重視比較法、法律實務裁判及刑事法政策最新發展的分析與討論。

謝教授長期於臺灣主要法學期刊發表研究成果，包括《國立臺灣大學法學論叢》、《中研院法學期刊》、《政大法學評論》及《臺北大學法學論叢》等，並著有日文專書《抽象的危険犯論の新展開》。其研究成果曾獲中研院法學期刊論文獎、霖澤法學研究獎及蔡萬才法學研究獎；在教學、導師工作及學術服務方面，亦曾多次獲得國立臺灣大學相關獎項肯定。

Professor Yu-Wei Hsieh is a professor of Law at the College of Law, National Taiwan University (NTU), and currently serves as a Visiting Faculty Member at the Peter A. Allard School of Law, University of British Columbia. He received his LL.B. and LL.M. from NTU and his Ph.D. in Law from Kyoto University, Japan. Before joining NTU, he served as a Research Associate at Kyoto University and an Assistant Professor at the Institute of Law for Science and Technology, National Tsing Hua University. He was also a Visiting Scholar at Waseda Law School.

Professor Hsieh’s primary research fields are criminal law, criminal justice policy, juvenile justice, and sentencing. His scholarship combines doctrinal analysis with comparative perspectives, particularly drawing on Japanese and German criminal law, while increasingly engaging with interdisciplinary approaches to criminal justice. His research has addressed a broad range of issues, including endangerment offenses, capital sentencing, criminal retrial and wrongful convictions, juvenile criminal responsibility and sentencing, sexual offenses, HIV criminalization, and the criminal regulation of AI-generated sexual images. His recent work has also examined the theoretical foundations of rehabilitation and the constitutional justification of compulsory treatment.

At NTU, Professor Hsieh teaches courses in Criminal Law, Criminal Policy, as well as seminars on contemporary issues in criminal law and criminal justice. His teaching closely engages with his research, incorporating comparative law, judicial decisions, and developments in criminal justice policy.

Professor Hsieh has published extensively in leading Taiwanese law journals, including the National Taiwan University Law Journal, Academia Sinica Law Journal, Chengchi Law Review, and Taipei University Law Review. He is also the author of the Japanese-language monograph New Developments in the Theory of Abstract Endangerment Offenses. His scholarship has received the Academia Sinica Law Journal Award, the Lin Zhe Legal Research Award, and the Tsai Wan Tsai Legal Research Award. He has also received multiple NTU awards for excellence in teaching, academic advising, and service.
