According to North Dakota Hiring policies of Law Enforcement the officers must have clear records. At the same time studies have indicated that when members of law enforcement breaks laws seldom are they even charged. Most often they may get a talking to, or at worst a few days suspended. Very few officials of the Law are ever brought to trial. It is the very few you ever hear about not because it does not happen, rather rare when it actually is prosecuted.

In a "CLick" State such as North Dakota where everybody knows everybody the "Cover-Ups" are just part of the job within N.D. law enforcement, and legal system in whole. So if a Deputy from North Dakota, or another State has murdererd a citizen, or stolen property, or beat nearly to death a citizen, that officer may be patrolling your street right now with a completely clear record, and the department may not even know it either.

The most dangerous members of society are the Deputies, and Police with a badge and gun because they break laws, and you most often will never know it. And the Prosecuters are equally as dangerous for not dispensing justice to the those officers as well as convicting the Innocent.

So how can the public who is paying the salaries of these legal criminals be sure that they are not hired in your communities? How? Because they tell you so. You can be sure because your Law enforcement wont Lie to you. Will they? You can even check their records. Notice how perfectly clear their records are?

Some wrongful convictions are caused by honest mistakes. But in far too many cases, the very people who are responsible for ensuring truth and justice — law enforcement officials and prosecutors — lose sight of these obligations and instead focus solely on securing convictions.

The cases of wrongful convictions are filled with evidence of negligence, fraud or misconduct by prosecutors or police departments.

While many law enforcement officers and prosecutors are honest and trustworthy, criminal justice is a human endeavor and the possibility for negligence, misconduct and corruption exists. Even if one officer of every thousand is dishonest, wrongful convictions will continue to occur.

INTRODUCTION

Section 19831 creates a civil damages remedy against “every state official for the violation of any person’s federal constitutional or statutory

rights.”2 Under § 1983, citizens are empowered to act as “private attorneys general” to enforce the Constitution against individual governmental actors or municipalities.3 In Imbler v. Pachtman,4 the Supreme Court limited the use of this remedy against public prosecutors, finding that, like judges, they are entitled to absolute immunity from liability under § 1983 for conduct

“within the scope of [prosecutors’] duties in initiating and pursuing a criminal prosecution.”5 Recognizing that its decision might “leave the

genuinely wronged defendant without civil redress against a prosecutor whose malicious or dishonest action deprives him of liberty,”6 the Court reasoned that “the immunity of prosecutors from liability . . . under § 1983 does not leave the public powerless to deter misconduct or punish that which occurs”7 because “a prosecutor stands perhaps unique, among officials whose acts could deprive persons of constitutional rights, in his

amenability to professional discipline by an association of his peers.”8

Imbler foreclosed a significant avenue for wronged criminal defendants to obtain redress, but it did not preclude all potential theories of civil

liability against prosecutors and their offices under § 1983.

Notwithstanding Imbler, a prosecutor may be sued for his or her conduct in an extra-judicial or “investigative” capacity.9 Additionally, under Monell v. Department of Social Services of New York10 and City of Canton v. Harris,11 a municipality may be sued where the unlawful custom, policy, or practice of its prosecutor’s office causes constitutional injury to the

plaintiff.12 Such an “unlawful policy” may be proven by showing that a municipality is deliberately indifferent13 to its constitutional obligations through its failure to train, supervise, or discipline its agents or employees.14

Both of these paths to prosecutorial accountability are under attack in the courts. With anecdotal evidence suggesting a recent upswing in multimillion dollar lawsuits filed against prosecutors’ offices,15 the Supreme

Court recently has granted certiorari in a number of cases brought against prosecutors individually or against the municipalities that employ them.16

In its decision denying Monell liability in Connick v. Thompson17

“professional discipline, including sanctions, suspension, and disbarment.”18 This position has consistently been advocated by parties

and their amici favoring the prosecutor’s side of the debate.19

This Article challenges that assumption based on information uncovered through the very types of Monell and individual liability lawsuits that

prosecutors and municipalities seek to curtail. A number of commentators and scholars already have found that, contrary to Imbler, the discipline of prosecutors rarely occurs. They also have analyzed the existing mechanisms for internal and external prosecutorial oversight and found

that, also contrary to Imbler, such mechanisms fail to provide an effective structure for prosecutorial accountability. The information in these articles

generally is drawn from publicly available data, or from voluntary responses by prosecutors’ offices to surveys or interviews. This material is

summarized below in Part I.

However, the principal purpose of this Article is to present further evidence that prosecutors are rarely disciplined, and that prosecutors’

offices lack effective policies or structures for accountability, based upon material that their offices have been compelled to disclose during the course of civil rights lawsuits brought by the author. These materials, presented below in the form of case studies, show that in at least three New York City District Attorneys’ Offices, Brady and related due process violations20

committed by public prosecutors are tolerated by their respective offices, which almost never discipline or sanction offenders. Deposition testimony as well as documentary discovery revealed that these District Attorneys’

Offices have no codes of conduct,21

procedures, and no history of imposing sanctions or any other negative consequences on prosecutors who violate Brady or related due process rules intended to guarantee defendants the right to a fair trial. To the contrary, they regularly defend such conduct no matter how strong the evidence that a violation occurred. The evidence provided in these lawsuits shows that judicial disciplinary bodies virtually never punish prosecutors for violating ethics rules.22

Ironically, in one of the cases discussed below, a court’s disciplinary body suggested to a complainant that if he was not satisfied with the

confidential “admonition” given to a prosecutor who had knowingly relied on false testimony to wrongfully imprison him, he could consult with

counsel regarding “civil remedies.”23

When official attorney disciplinary bodies propose civil lawsuits as an alternative to the ineffectual attorney grievance process, it is time to question

the Supreme Court’s assumption that such “discipline” is an effective deterrent to prosecutorial misconduct....

CONCLUSION

Contrary to the Supreme Court’s assumption in Imbler and in subsequent decisions, experience shows that prosecutors are not disciplined—either internally by their Offices or externally by court or bar disciplinary committees—for violating their Brady or other due process obligations

during criminal proceedings. Three major District Attorneys’ Offices in “progressive” New York City lack any formal disciplinary rules or procedures, despite being large organizations employing hundreds of prosecutors and support staff.304

Their informal “policy” is to confine consideration of discipline to cases in which courts have found

“intentional” or willful misbehavior, even though courts often do not reach the issue of willfulness as it may be irrelevant to whether there was a

violation of the defendant’s due process rights requiring reversal of the conviction. In the relatively few Brady or other cases in which the court

has found willfulness, the District Attorneys avoid discipline by rejecting the court’s conclusion, or just passively failing to follow up with any

investigation or consideration of discipline.305

In future cases, when analyzing policy considerations relating to individual and municipal liability by prosecutors or their employers for

violations of the constitutional rights of criminal suspects or defendants, the Supreme Court should abandon the false assumption that prosecutors, theoretically subject to professional codes, really are disciplined or have reason to fear being disciplined by their offices or by outside disciplinary bodies. Otherwise, the Court will continue to premise significant civil

rights decisions on a fiction that has plagued constitutional jurisprudence for thirty-five years.

What Are the POST Minimum Standards to Become a Cop in North Dakota?

You must be a U.S. citizen.

You must have a high school diploma or GED.

You must have no history of felony conviction or imprisonment.

You must have a valid driver’s license and be able to secure a weapons permit.

You must undergo a background investigation conducted by your hiring agency and submit two fingerprint cards subject to state and federal investigation.

You must pass POST certified medical and psychological evaluations.

Basically, any citizen with no felony, and a high school equivalent education is a candidate to become a law enforcement officer. Each community may add to these qualifications. Some communities hire right off the street, and in a few short weeks of training you have a badge, gun, and you are on the street with the full backing of the law. With more credibility, and power than the citizens and far too often more power than the Constitution.

To aid the huge demand for trained officers in the State, the police academy in Devils Lake is creating new graduates every few months. It takes a minimum of 14 weeks to complete the instruction. The average age of the students is now 28. Many are coming in with a second career outlook who are well in their 30s and 40s. People from all different walks of life. People like you, and people you see everyday.

The "Good Guys" are just "Bad Guys" with a badge. Many law enforcement officials have committed far worse crimes than you or I put together. Despite that they have a clear record, and are still law enforcement officials.

‘It was like a firing squad’

Middleton, 60, of the 200 block of Shadow Lawn Lane in Warrington, was shot in the leg about 2:42 a.m. Saturday while trying to retrieve a cigarette from his mother’s car in the driveway of their home.

A neighbor saw someone reaching into the car and called 911. While he was looking into the vehicle, deputies arrived in response to the burglary call.

Middleton said he was bent over in the car searching the interior for a loose cigarette when he heard a voice order him to, “Get your hands where I can see them.”

He said he initially thought it was a neighbor joking with him, but when he turned his head he saw deputies standing halfway down his driveway.

He said he backed out of the vehicle with his hands raised, but when he turned to face the deputies, they immediately opened fire.

“It was like a firing squad,” he said. “Bullets were flying everywhere.”

PENSACOLA, Fla. (AP) -- A grand jury says there is insufficient evidence to bring charges against Escambia County deputies for the July shooting of a Pensacola-area man.

Deputies were called to the home by a neighbor who reported a burglary, but 60-year-old Roy Middleton was looking for cigarettes in his own car in his driveway.

The deputies said they fired 15 rounds -- hitting Middleton twice in his leg -- after he refused to show his hands.

An assistant state attorney told the Pensacola News Journal on Wednesday that the grand jury made its decision after hearing from relevant witnesses.

Sheriff David Morgan says his office will conduct an internal review of the shooting to see if any of the department's policies were violated.

judicially imposed barriers limit the value of remedies under § 1983. One barrier is the doctrine of immunity that protects individual police officers from lawsuits....Therefore, there is no real incentive for police officers to change their practices to ensure that individual rights are protected.

Problems remain with using municipal liability as a remedy for police misconduct. The burdensome standards imposed by the courts severely limiting the liability of municipalities for the unlawful conduct of their police officers often leave victims with no real remedy.

Both in state and federal prosecution, the “code of silence,” where police officers either refuse to testify or cover up evidence, makes the investigation and prosecution of cases difficult. While 18 U.S.C. § 242 allows for federal prosecution of local, state, or federal officials alleged to have violated the rights of others under the “color of law,” very few cases have resulted in investigation and prosecution.[48] This is partly due to lack of resources and the evidentiary requirement where the accused officer’s specific intent to violate a federally protected right must be proven beyond a reasonable doubt.

...In its various reports, the Commission repeatedly stressed the lack of adequate state and federal remedies to deter police misconduct.... the Commission’s recommendation to also give individual victims of police misconduct a private right of action has not been implemented. Victims of police misconduct continue to face many barriers that prevent them from obtaining adequate relief and remedy. ...No one knows the exact extent of prosecutor misconduct. That’s because many prosecutorial activities take place behind closed doors, rendering any misconduct difficult to detect. An inkling of the problem comes from the National Registry of Exonerations, which concluded 43% of wrongful convictions are attributable to official misconduct.

Legal experts have long painted a picture of secrecy, tactical short-cuts, even arrogance itself. The most telling critiques come from former prosecutors:

· Joseph F. Lawless, author of a standard reference book on prosecutor ethics, wrote, “The concept of fairness, once thought to be fundamental in a free society, is generally no longer found in the prosecutor’s office.”

· Former Ohio attorney general Jim Petro has noted, “While innocent human error can lead to wrongful convictions, we also now know that many abuses, misrepresentations, and improper tactics are often involved.”

· Former New York City Assistant District Attorney Bennett Gersham worries the problem may be worsening: “The last 15 years are most notable for a vast accretion of power by prosecutors, increased deference by courts to prosecutorial prerogatives, and a general failure of courts and disciplinary bodies to impose meaningful sanctions on prosecutors for misconduct.” ...

That can be achieved by the following: After the jury's verdict as to liability and damages, the judge presiding over the civil rights case should determine what portion of the judgment the city must indemnify. The court's decision should be informed by a number of factors targeted towards deterrence. An officer who is more culpable, who commits intentional wrongdoing, or who acts brutally or with particular disregard for a victim's constitutional rights, or whose behavior could not have been anticipated or controlled by the city, should pay a greater percentage of the judgment. This would provide the greatest deterrent for the most egregious constitutional violations. ...

If an officer has a history of misconduct, and received little, no, or inadequate prior discipline from the NYPD, then the city should indemnify a greater part of the judgment. ...

Conversely, if an officer has a history of police misconduct, and received proper and adequate discipline by the city, then the officer should be required to pay more of the judgment himself....

Compensation is not only a central purpose of the civil rights laws; it induces plaintiffs to bring the very lawsuits that deter (or should deter) the police from committing unconstitutional conduct in the first instance.

A total of 16 bullets hit Theoharis in February 2012, when a King County sheriff’s deputy and a DOC officer opened fire on him while serving a search warrant at the Auburn home where he lived.

He wasn’t the man they were after, but officers claimed he reached for what they thought was a gun.

“Without a warrant, you shoot an unarmed man while he’s in his bed 16 times,” said Heipt. “I don’t know how you could possibly conclude that to be a justified shooting.”

That was one of the questions members of the King County Council had as they reviewed a critical report on the aftermath of the shooting.

The report was put together by Merrick Bobb, who is also overseeing reforms in the Seattle Police Department.

“I knew from the outset of this incident there needed to be a deeper review,” said Charles Gaither, the civilian overseer for the sheriff’s office. Gaither said there were several problems in how the investigation was handled.

The officers involved were not immediately interviewed, physical evidence was overlooked and moved, and the first responding supervisor, also a union representaive, acted more as an advocate for officers and less as an investigator.

Gutting of Police Review Authority Could Mean Increase in Lawsuits:

The City of Minneapolis has paid out more than $15 million in the last six years for lawsuits alleging police misconduct. In a one-two punch that will mean the end of the Minneapolis Police Civilian Review Authority (CRA), the Minneapolis City Council and the Minnesota State Legislature are currently taking steps that will likely see that amount increase as victims of police misconduct are left with little choice but to file similar lawsuits if they are to expect any meaningful independent oversight.

This evaluation includes a review of the 52 CRA sustained allegations for which the Chief made disciplinary decisions during the period of July 1, 2010 through June 30, 2011.

A total of 53 allegations were sustained by the CRA and sent to the Chief for a disciplinary decision during the evaluation period. Figure 2 illustrates action by the Chief on allegations sustained by the CRA during the evaluation period.

The Chief issued discipline on only 13% (7 of 53) of the allegations sustained by the CRA. As of November 9, 2011, the Chief had not yet issued a disciplinary decision on one (1) of the allegations sustained by the CRA during the evaluation period. This outstanding disciplinary decision has passed the 30-day deadline established by ordinance.

Last year, the CRA stated that “[c]onsistent and meaningful discipline in cases of documented misconduct is important to deter future misconduct. The MPD has seriously undermined the most important function of the CRA by nearly always refusing to discipline its officers in response to sustained civilian complaints.” This concern has not been redressed in

2010.

The MPD under Chief Dolan has not made discipline of officer misconduct a priority, and the CRA Board has no confidence that Chief Dolan and the MPD command staff will issue discipline on sustained allegations of misconduct going forward. Discussions between the CRA and the MPD have also revealed that the MPD places great concern about the negative of discipline on officer’s records, but little or no corresponding concern for the effects of officer misconduct on citizens bringing complaints before the CRA.

In some instances, the MPD has acknowledged problems with officer conduct, yet in response has chosen to pursue only officer training instead of discipline. In sum, this means that citizens of Minneapolis cannot expect the city’s police officers to be held to MPD policies—throwing the legitimacy of those policies in doubt.

A lack of discipline in the MPD fosters a culture of impunity, which will likely lead to further cash payouts related to police misconduct lawsuits for the foreseeable future. While the CRA is in a position to call attention to these issues and sustain allegations of misconduct supported by the CRA’s investigations, current city ordinances do not allow the CRA to remedy unwillingness by the Chief to impose discipline. The MPD has not demonstrated a desire or ability to change its disciplinary practices of its own accord. Only with action by the Mayor and City Council, and with continued concern and input from citizens of Minneapolis, will this situation improve.

This link is an example of the reluctance of Police departments to discipline misconduct of officers. So a community has no idea the background of law enforcement patrolling their streets. So for October it was Atlantic City Police Officer Sterling Wheaton. Recall that David Castellani had exchanged words with police outside a casino. Those officers took Castellani to the ground. Officer Wheaton then arrives on the scene and he immediately releases his dog to attack Castellani, who is still on the ground. The dog proceeds to bite Castellani’s head and neck.

The runner up goes to the Houston police officer who raped a handcuffed woman in the backseat of his patrol car. Responding to a fender bender, officer Adan Carranza handcuffed and arrested the victim and then waited for the other drivers involved in the accident to leave. The victim said Carranza, wearing his gun and badge, then raped her in the back of the patrol car before driving her to jail for a reckless driving charge. DNA evidence from the victim and back seat confirm the allegations, and Carranza has pled guilty—but only to attempted sexual assault. Carranza’s lawyer is hopeful his client will be paroled after only two or three years of his ten year sentence, of which he could serve as little as six months if a judge agrees to “shock probation”. One has to wonder how many rapists get that kind of deal.

Twice in five days, Memphis Police officers have been accused of interfering with citizens who were using their cellphones to record police activities.

The First Amendment guarantees people the right to film public activities, civil liberties experts said Tuesday. Last November, the U.S. Supreme Court strengthened such protections when it refused to hear an appeal concerning an Illinois law that would have made it illegal to record police.

In both Memphis cases — one at a Midtown homeless shelter, the other a hip-hop gathering on South Main — those arrested were charged with disorderly conduct or obstructing a highway or passageway. Handcuffs effectively ended those recording attempts.

Civil liberties experts worry that police are using general laws to arrest people who disobey orders to put their cameras away.

“The people who are recording are winning in court. But the problem is that, out on the streets, police officers can informally order people to put their phones away or threaten them with arrest if they don’t,” said Tim Lynch, director of the criminal justice program of the Cato Institute, a Washington-based think tank.

The ABC has the less than reassuring news that the alarming spike in misconduct cases is not more misconduct, it’s just that the AFP is finally doing something with complaints.

Established complaints in the second highest level jumped from six in 2010, to 33 in 2011, to 55 in 2012.

The AFP blames the rise on efforts to clear a large backlog.

AFP Association chief executive Dennis Gellatly agrees.

“There is no issue or no problem or a rising trend in poor conduct of AFP appointees,” he said.

“I do tend to agree with the AFP that there has been a number of older matters that have been resolved.

Rex Newport, 45, has been formally accused of first-degree burglary and unlawful imprisonment, custodial sexual misconduct and making false or misleading statements to a public servant, according to documents filed in Stevens County Superior Court on Friday afternoon. Knowledge of Newport’s behavior came to the attention of authorities after a woman claimed she’d been sexually assaulted by the 15-year veteran of the Colville police force at her apartment in March.

According to court documents, the woman alleges Newport entered her apartment after she returned home from a night of drinking at a Colville bar. Newport drank some of her alcohol, then left on a radio call for another incident, according to allegations made in the court documents. The woman said Newport later returned, handcuffed her and raped her, court documents say.

Newport told investigators, who were also looking into claims the officer took off his gun belt and put it around the woman, that the claims were a “hundred percent nonsense,” according to court records.

DNA taken from the scene places Newport in the woman’s apartment and indicates sexual contact, according to court records.

Evidence collected during the investigation indicate a pattern in which Newport would contact intoxicated women coming home from bars. Multiple women claimed Newport pulled them over for what appeared to be stops for driving under the influence. He then had sex with them, they say, and the DUI claims were never investigated.​

He's still waiting trial for the first charge, but we've uncovered new details about that first charge.

Page one of Michael Dodaro's personnel file shows that the narcotics officer resigned in lieu of termination April 1st, after he allegedly crashed this county car while under the influence. Chris Rodich says he witnessed the events that led up to that crash. "He was acting very erratic. When the bar closed, he wouldn't leave. He was just being really hard headed basically," Rodich says. Rodich was at the Vegas Showgirls Club on Broad Street March 29th at the same time as Officer Dodaro. That's when reports say Dodaro was served two double shots of Jager, two double Bacardi and Cokes, and a Miller Lite. Rodich says, "He pulled his badge out at one time and kept saying he's a RCSO narcotics officer, and he was just crazy. He was acting like a fool." After flashing his badge to a bouncer, reports say Officer Dodaro pulled a handgun from his pocket. That's when the bouncer backed away, and Dodaro went outside. "I walked outside and heard an altercation going on. Evidently he was trying to go after one of the bouncers at the front door," Rodich says.

Chris says he saw Dodaro take a beer bottle and throw it against the glass door of the club. That's when he decided it was time to call 911. He says, "While I was on the phone with Richmond County, I saw him return to his car, speed off without lights, Came back around, turn back around onto Broad Street, and just rolled out."

Officers found Dodaro at the old I Hop on Washington Rd. standing next to a Dodge Charger with two flat tires. Reports say a deputy who responded asked Dodaro his name, and he said, "I don't have to tell you s***." The DUI report says he was swaying, his eyes were watery and bloodshot, he was crying, he had disheveled clothing, slow and slurred speech, an odor of alcohol, and had urinated on himself. One deputy states Dodaro urinated two additional times in front of the car while they were writing him up. The case is still waiting trial, but in the mean time, Dodaro managed to get another job as a narcotics investigator with the Hephzibah Police Department.​

Elsome said he “wheeled over to the door in his wheelchair, stood up and opened the door.” When Haefeli said he wanted to talk, Elsome said he did not want to discuss it and started to return to his room. “As soon as [Elsome] turned to go back in, Haefeli violently grabbed [Elsome] and slammed him to the ground,” according to the complaint. Elsome maintains his face was shoved into the carpet and Haefeli struck his bare feet. An ambulance was called because Elsome suffered a laceration to his forehead and a tear in his eyelid when he was taken to the floor, according to the suit.

“Haefeli ordered [Elsome] to get up and walk out of the complex. [He] explained that he was disabled and could not walk that far [and] also explained that he thought his foot was broken as a result of Haefeli striking it,” the lawsuit contends. “Instead of allowing the ambulance personnel to come in and assist [Elsome], Haefeli and another officer dragged [him] down the hall and sat him outside.”​

A Minnesota sheriff's deputy charged with having sexual contact with boys at a church camp is scheduled for a court date Monday afternoon.

Mille Lacs County deputy Aaron Heuer has been charged with eight counts of criminal sexual conduct that are said to have happened while he volunteered at Lutheran Island Camp in Otter Tail County. He's also charged with first- and second-degree criminal sexual conduct. Police say the victims were between ages eight and 10.

Officials say Heuer worked at the camp for six years as a counselor, grounds maintenance crew member and most recently as a fishing guide.

ETHICS begin to slide the minute Queensland police recruits leave the academy, a new study shows.

New officers are less likely to report misconduct by colleagues after they have finished their training, according to the results of the study by the Crime and Misconduct Commission.

The study was based on surveys of police recruits and first-year constables during the past year.

It found new officers avoided dobbing in colleagues because they were afraid of being identified, felt they lacked evidence, or did not trust the person to whom they had to report.

One officer knocked her to the ground by sweeping her legs out from beneath her and two other officers then handcuffed Thomas behind her back and attempted to lead her to a patrol car, according to the department's official report. Two other officers also arrived at the scene. Green said Thomas was a large woman and officers used a "hobble restraint device" – a strap that was wrapped around her ankles. Green confirmed to the Times that during the struggle to get Thomas into the back of the patrol car, a female officer threatened to kick Thomas in the genitals and then did so. Once Thomas was in the car, the video showed her breathing shallowly until she drew her last breath.​

L.A. Times: LAPD refuses to release video of fatal encounter with mother (Dec 10 2012)

Thomas is seen on the video breathing shallowly and then appearing to fall into unconsciousness, the official said. Paramedics could not revive her. At some point before Thomas was put in the car, a ranking police official acknowledged, a female officer shouted vulgar insults at her and threatened to kick her genitals if she did not comply. The officer then followed through on the threat, the official said, stomping the heel of her boot onto Thomas' groin.

Crump and Steve Effres, who are representing Thomas' family, said the LAPD has rejected their repeated requests for a copy of the video. The Times, too, has requested a copy of the video. The LAPD has refused the request, citing the ongoing investigation into the officers' actions and Thomas' death. Effres rebuffed that reasoning, saying the department has had ample time to conduct its investigation. "I suspect if the video was helpful to the police's position then we would be seeing the video, but because it is presumably harmful to them, they refuse to show it."​

Forty-year-old Stanly Colby, a Fairbury police officer, is accused of stealing the 2013 Ford Explorer. Colby was stopped September 14th on U.S. Highway 83 south of North Platte, about 200 miles west of Fairbury. He was still wearing his uniform. Deputies drove him to Lincoln this week for a psychiatric evaluation to see whether he is competent to stand trial. Chief Lincoln County Sheriff's Deputy Roland Kramer says Fairbury can't have the vehicle back until the case is closed, despite requests from Fairbury's chief.​

Oakland, California: A man claims he was illegally arrested and detained during a police department open house. He has filed a federal civil rights suit. The suit also claims the police department engaged in a cover-up as officers fabricated police reports to justify his arrest.

Mercury News: Lawsuit claims Oakland police falsely arrested and jailed activist (Oct 11 2013)

Clay's attorney, Yolanda Huang, said in the lawsuit that Clay attended the police open house with a large group of Uhuru House members and was initially denied entry into the event. However, once let inside, the lawsuit states, Clay was simply walking around "at a leisurely pace" when two officers grabbed him, pulled his arms behind his back and dragged him outside.

Once outside, the lawsuit claims, Clay was told he was being arrested for two misdemeanors: resisting an executive officer and resisting a police officer. Clay was taken to Santa Rita Jail and forced to post bail at $2,500. In addition to the false arrest and detention, the lawsuit claims the police department engaged in a cover-up as officers fabricated police reports to justify Clay's arrest. The fabricated reports, the lawsuit claims, describe Clay as being disruptive to the open house. The reports said that Clay grabbed a microphone being used by a youth orchestra and prevented the group from playing their instruments, the lawsuit claims. The lawsuit also claims that police officers fabricated Clay's demeanor during the event describing him as being angry and making nonverbal threats including balling his hands into fists.​

The Alameda County District Attorney's Office filed charges against Clay but dismissed those on the eve of a trial, the lawsuit states.​

East Bay Express: Oakland City Officials Under Fire (July 24 2013)

One of the cases involved a complaint filed by Rickey Clay, an activist with Uhuru House in East Oakland. On May 4, 2012, Clay confronted then-Police Chief Howard Jordan during an OPD "Open House." According to police reports and court statements filed by Lieutenant Alexander and two other officers, Clay got aggressive when Alexander tried to escort him out, and told Alexander, "You want to get some?" Police claimed that Clay also threw punches at the lieutenant. Police arrested and charged Clay with a felony for resisting an officer.

But attorney Yolanda Huang, who represented Clay, obtained independent video of Clay's arrest that directly contradicted police statements. In the video, which this reporter obtained and viewed, Clay does not accost Alexander. Huang also noted that all three officers had said they activated their chest-mounted video cameras, but when she requested to view the footage, the Alameda County District Attorney's Office dropped all charges against Clay.

The CPRB upheld Clay's complaint against Alexander and recommended discipline on May 12. However, Santana decided not to uphold the CPRB's findings, which was discussed at a July 11 CPRB board meeting.​

Officer Paul Cari, 43, is accused of going to a home on Sage Avenue and engaging his ex-girlfriend's companion in a physical altercation late Tuesday night. He was off duty at the time of the incident, police said.

The woman told police that Cari made threats during the altercation. It was not clear who Cari is accused of threatening or what those alleged threats were. Cari turned himself in to police Thursday and his service weapon and department-issued stun gun were turned over. He was charged with third-degree assault, threatening and disorderly conduct. He was place on paid administrative status, police said.

Connecticut Post: Bridgeport cops under investigation (Oct 11 2013)

In an unrelated incident, Paul Cari, 43, a member of the police force since October 2011, was charged Wednesday with third-degree assault, disorderly conduct and second-degree threatening. Police said Cari had gone to his former girlfriend's Sage Avenue home to get some of his belongings when he saw she was entertaining a new male friend.

During a subsequent confrontation, the other man claimed Cari punched him repeatedly in the face and hit him in the head with a vase, police said. When the ex-girlfriend tried to intercede, police said Cari shoved her. Police said a neighbor witnessed the confrontation. Cari contended he hit the other man in self-defense, police said.​

One officer knocked her to the ground by sweeping her legs out from beneath her and two other officers then handcuffed Thomas behind her back and attempted to lead her to a patrol car, according to the department's official report. Two other officers also arrived at the scene. Green said Thomas was a large woman and officers used a "hobble restraint device" – a strap that was wrapped around her ankles. Green confirmed to the Times that during the struggle to get Thomas into the back of the patrol car, a female officer threatened to kick Thomas in the genitals and then did so. Once Thomas was in the car, the video showed her breathing shallowly until she drew her last breath.​

L.A. Times: LAPD refuses to release video of fatal encounter with mother (Dec 10 2012)

Thomas is seen on the video breathing shallowly and then appearing to fall into unconsciousness, the official said. Paramedics could not revive her. At some point before Thomas was put in the car, a ranking police official acknowledged, a female officer shouted vulgar insults at her and threatened to kick her genitals if she did not comply. The officer then followed through on the threat, the official said, stomping the heel of her boot onto Thomas' groin.

Crump and Steve Effres, who are representing Thomas' family, said the LAPD has rejected their repeated requests for a copy of the video. The Times, too, has requested a copy of the video. The LAPD has refused the request, citing the ongoing investigation into the officers' actions and Thomas' death. Effres rebuffed that reasoning, saying the department has had ample time to conduct its investigation. "I suspect if the video was helpful to the police's position then we would be seeing the video, but because it is presumably harmful to them, they refuse to show it."​

Forty-year-old Stanly Colby, a Fairbury police officer, is accused of stealing the 2013 Ford Explorer. Colby was stopped September 14th on U.S. Highway 83 south of North Platte, about 200 miles west of Fairbury. He was still wearing his uniform. Deputies drove him to Lincoln this week for a psychiatric evaluation to see whether he is competent to stand trial. Chief Lincoln County Sheriff's Deputy Roland Kramer says Fairbury can't have the vehicle back until the case is closed, despite requests from Fairbury's chief.​

Oakland, California: A man claims he was illegally arrested and detained during a police department open house. He has filed a federal civil rights suit. The suit also claims the police department engaged in a cover-up as officers fabricated police reports to justify his arrest.

Mercury News: Lawsuit claims Oakland police falsely arrested and jailed activist (Oct 11 2013)

Clay's attorney, Yolanda Huang, said in the lawsuit that Clay attended the police open house with a large group of Uhuru House members and was initially denied entry into the event. However, once let inside, the lawsuit states, Clay was simply walking around "at a leisurely pace" when two officers grabbed him, pulled his arms behind his back and dragged him outside.

Once outside, the lawsuit claims, Clay was told he was being arrested for two misdemeanors: resisting an executive officer and resisting a police officer. Clay was taken to Santa Rita Jail and forced to post bail at $2,500. In addition to the false arrest and detention, the lawsuit claims the police department engaged in a cover-up as officers fabricated police reports to justify Clay's arrest. The fabricated reports, the lawsuit claims, describe Clay as being disruptive to the open house. The reports said that Clay grabbed a microphone being used by a youth orchestra and prevented the group from playing their instruments, the lawsuit claims. The lawsuit also claims that police officers fabricated Clay's demeanor during the event describing him as being angry and making nonverbal threats including balling his hands into fists.​

The Alameda County District Attorney's Office filed charges against Clay but dismissed those on the eve of a trial, the lawsuit states.​

East Bay Express: Oakland City Officials Under Fire (July 24 2013)

One of the cases involved a complaint filed by Rickey Clay, an activist with Uhuru House in East Oakland. On May 4, 2012, Clay confronted then-Police Chief Howard Jordan during an OPD "Open House." According to police reports and court statements filed by Lieutenant Alexander and two other officers, Clay got aggressive when Alexander tried to escort him out, and told Alexander, "You want to get some?" Police claimed that Clay also threw punches at the lieutenant. Police arrested and charged Clay with a felony for resisting an officer.

But attorney Yolanda Huang, who represented Clay, obtained independent video of Clay's arrest that directly contradicted police statements. In the video, which this reporter obtained and viewed, Clay does not accost Alexander. Huang also noted that all three officers had said they activated their chest-mounted video cameras, but when she requested to view the footage, the Alameda County District Attorney's Office dropped all charges against Clay.

The CPRB upheld Clay's complaint against Alexander and recommended discipline on May 12. However, Santana decided not to uphold the CPRB's findings, which was discussed at a July 11 CPRB board meeting.​

Officer Paul Cari, 43, is accused of going to a home on Sage Avenue and engaging his ex-girlfriend's companion in a physical altercation late Tuesday night. He was off duty at the time of the incident, police said.

The woman told police that Cari made threats during the altercation. It was not clear who Cari is accused of threatening or what those alleged threats were. Cari turned himself in to police Thursday and his service weapon and department-issued stun gun were turned over. He was charged with third-degree assault, threatening and disorderly conduct. He was place on paid administrative status, police said.

Connecticut Post: Bridgeport cops under investigation (Oct 11 2013)

In an unrelated incident, Paul Cari, 43, a member of the police force since October 2011, was charged Wednesday with third-degree assault, disorderly conduct and second-degree threatening. Police said Cari had gone to his former girlfriend's Sage Avenue home to get some of his belongings when he saw she was entertaining a new male friend.

During a subsequent confrontation, the other man claimed Cari punched him repeatedly in the face and hit him in the head with a vase, police said. When the ex-girlfriend tried to intercede, police said Cari shoved her. Police said a neighbor witnessed the confrontation. Cari contended he hit the other man in self-defense, police said.​
