Shanna Ries self-reported the incident in March and pleaded guilty to the class 6 felony in July. The incident involved a 16-year-old boy. In exchange for the guilty plea, the prosecution dropped four other charges, including three counts of sexual exploitation of a minor, and a separate charge of sexual contact with a child under 18 by a person of authority.....

Former prison employee’s conviction is a rare occurrence in South Dakota
A 42-year old former correctional officer who pressed his thumb into the neck of a strapped-down, mentally ill prison inmate was convicted by a jury of simple assault against an inmate last month. Cases like those against Joshua S. Westenkirchner, of Harrisburg, are rare in South Dakota. Few correctional officers are charged criminally for assaulting inmates, though officials with the state Department of Corrections and Division of Criminal Investigation both said they do not track charges filed against DOC staff. The former officer also faces excessive force allegations in a federal lawsuit filed by the inmate victim, Shawn Albrecht. That lawsuit names DOC Secretary Kellie Wasko and Penitentiary Warden Teresa Bittinger as additional defendants, among others....

Renee Skoglund filed a false police report that has now landed her in legal hot water.... North Dakota woman's guilty plea vacated after autopsy reveals she didn't cause her baby's death
BISMARCK — The North Dakota Supreme Court has sided with a woman who pleaded guilty to child neglect about two weeks before an autopsy showed she didn’t cause her baby’s death, but she still may have to go to trial.
The North Dakota Supreme Court ruled on Thursday, Aug. 17, that Cassandra Jo Marvella Black Elk, should have been allowed to withdraw her guilty plea in connection to the Feb. 19, 2022, death of her 3-week-old daughter, Starlight, in Bismarck. The mother received improper advice from her attorney, James Loraas, before entering a guilty plea to child neglect, a felony charge that carries a maximum punishment of five years in prison.
“The court also determined Black Elk would not have pled guilty but for this improper advice from counsel,” the opinion said....

The Fargo City Commission on Wednesday, June 28, decided unanimously to sue the state over a new law passed by the state Legislature that forbids any local control on gun and ammunition sales.... The bill was signed into law by Gov. Doug Burgum on April 12, and it seeks to limit Fargo’s home rule authority by prohibiting any zoning ordinances related to the purchase, sale, ownership, possession, transfer of ownership, registration or licensure of firearms and ammunition. Much like the bill from 2021, the new law voids city zoning ordinances that already regulate where firearms can be sold within city limits... $50,000 grants available for black North Dakota, South Dakota, and Minnesota residents

The Bush Foundation is opening up applications for part of a $50 million dollar trust called the Open Road Fund. This nonprofit organization has worked to tackle Black wealth, homeownership, and education rate gaps with grants. Nexus Community Partners Senior Director Danielle Mkali says they are helping distribute a hundred grants at random yearly over the next eight years.

Forced assimilation takes a physical toll: American Indian boarding schools used brutal methods to assimilate their students into the dominant culture...
15 chronic health conditions were statistically associated with having attended boarding school. These conditions include diabetes, hypertension, arthritis and kidney disease, among others. I found that former boarding school attendees were 44% more likely to have chronic physical health conditions, with seven out of the 15 chronic conditions statistically related to boarding school attendance.... Boarding school attendees likewise had nearly four times the risk of any type of cancer as those who were not subjected to boarding school. ...

North Dakota school district will conceal students' gender identities from parents despite state law
FARGO, N.D. (CITC) — A North Dakota school district is sparking outrage through its noncompliance with a newly signed bill prohibiting teachers from withholding a student's gender identity from their parents. Fargo Public Schools (FPS) Superintendent Dr. Rupak Gandhi announced the district's intentions earlier this month, just one day after North Dakota Gov. Doug Burgum signed the bill. HB1522 states, among other things, that school districts may not "withhold or conceal information about a student's transgender status from the student's parent or legal guardian." Gandhi told the community at a May 9 school board meeting that FPS should "double down" to advocate for students in the presence of a perceived conflict between federal and state law. "We will not openly out any student because of one law if we know that that's going to cause harm to that child," Gandhi said, who was backed by the FPS school board. Fargo Public Schools Superintendent Dr. Rupak Gandhi, along with the school board, decided that the district would not fully comply with the new bill during a May 9 meeting....

A parent alleged in federal court documents that Kenmare Public School violated his son’s civil rights when it found the then-freshman to be at fault in a Title IX complaint filed against him...
The lawsuit cites a passage from the handbook that the school doesn’t intend “to limit freedom of expression or communication of ideas, which may be protected by the First Amendment.” The school does prohibit “the wearing of potentially disruptive insignia or apparel, which may create a material and substantial disruption of school activity,” the handbook and lawsuit said.... The female student had a right to wear the flag, and the male student had a right to tell her she shouldn't wear the flag, said attorney Keith Altman, who is representing the male student's family. The comments the male student made were not sexual in nature, nor were they severe, pervasive or objectively offensive, the attorney told The Forum. "The Title IX complaint was a smear campaign," the lawsuit claimed.

BISMARCK — A tech consultant's attempt to recover a deleted email account belonging to former North Dakota Attorney General Wayne Stenehjem has come up empty.
Recently elected Attorney General Drew Wrigley told Forum News Service on Tuesday, Nov. 22, a report compiled by private firm Planet Technologies concluded that Stenehjem's deleted account cannot be recovered. Three days after Stenehjem’s death in January, state information technology officials deleted the late officeholder's state email account at the direction of Liz Brocker, a longtime assistant to the Republican attorney general. Brocker also instructed state IT officials to eliminate former Deputy Attorney General Troy Seibel’s email account after he resigned in May. Brocker stepped down from her post in July after Wrigley discovered while fulfilling a public records request that she had orchestrated the deletion of the accounts....

Over 250 rape kits await testing as North Dakota's backlog grows
BISMARCK — A backlog of testing sexual assault kits has grown over the last year in North Dakota due to a lack of staffing, with many kits more than a year old. There were 271 kits awaiting testing at the state crime lab as of last week... North Dakota does not require all sexual assault kits to be tested. With the staffing shortage, the state lab has decided to prioritize kits that prosecutors need for court cases, Wrigley said.
Testing all kits, including ones that have sat on shelves for years, has helped authorities in other jurisdictions identify serial rapists,... North Dakota Department of Health audit finds thousands of improperly-stored COVID-19 vaccinations
BISMARCK, N.D. (KXNET) — A recent audit of the North Dakota Department of Health (NDDoH) from the North Dakota State Auditor’s office has identified thousands of COVID-19 vaccines that were improperly stored or handled, which could possibly lead to ineffective responses in the immune system.
During the audit, it was noted that the NDDoH was unable to provide enough evidence that the physical count of COVID-19 vaccines and storage locations were routinely compared to records, (which is meant to be done frequently in order to confirm that inventories are correct and that vaccines are being stored properly).
In addition, the temperatures of some vaccines were also a concern. Vaccine products are temperature sensitive and must be stored and handled in appropriate temperatures to both ensure accuracy and minimize vaccine waste — with different brands of vaccines having different storage requirements. Digital temperature readings were unable to be matched to 144,988 doses of vaccines in transport. Many written temperature logs were reported to be missing entirely, or not completed correctly....

GRAND FORKS – The Grand Forks-based Community Violence Intervention Center saw a significant increase in domestic abuse clients during the COVID-19 pandemic. The increase has since slowed, but it continues a steady increase, according to local data.... In 2021 Statewide, 5,417 new victims were served in 18 crisis intervention centers...The increase is expected to continue at a slow but steady rate. “That’s a trend we’ve been seeing, really, the last few years,”...
According to CVIC’s 2021-2022 Impact Report, advocates and law enforcement report “more extreme abuse” experienced by clients in 2021. “Of the nearly 200 individuals law enforcement assessed on scene, nearly 60 percent were deemed to be in high lethality situations,” the report says. The North Dakota Attorney General’s 2021 Crime Report says romantic partners make up the highest percentage of victims in crimes against persons. There were 2,212 romantic partner victims in 2021, or 15.9% of all victims. Of those, there were 783 former romantic partners (5.6%); 714 spouses (5.1%); and 139 ex-spouses (1%). The risk of fatality is higher for those trying to leave a domestic violence situation.... North Dakota's Ethics Commission appears to be starting an investigation into seven complaints, and has appointed an outside attorney for legal advice. State government ethics law makes confidential any information "revealing the contents of a complaint" and "that reasonably may be used to identify an accused individual" -- though that information may be disclosed if the accused grants permission.... Former North Dakota tribal official pleads guilty to bribery
BISMARCK, N.D. — A former government official of the Mandan, Hidatsa and Arikara Nation accused of accepting bribes and kickbacks from a construction contractor pleaded guilty Tuesday to federal charges in North Dakota. Randall Phelan, 58, of Mandaree, North Dakota, was an elected representative of the governing body of the Three Affiliated Tribes from the end of 2012 to the middle of 2020. Investigators said Phelan used his official position to help the contractor’s business by awarding contracts, fabricating bids and managing fraudulent invoices. Phelan and two others were originally charged with receiving hundreds of thousands of dollars from the bribery scheme that lasted for eight years on the oil-rich Fort Berthold Indian Reservation. The contractor has pleaded guilty to bribery and has been cooperating with prosecutors. Prosecutors said the business received more than $17 million over the past decade for construction work on the reservation....

Audit finds discrepancies associated with building leased by ND Attorney General’s office
BISMARCK, N.D. (KFGO) – An audit requested by the Legislature’s Audit and Fiscal Review Committee has shed more light on a nearly $2 million cost overrun on a building in Bismarck leased by the North Dakota Attorney General’s Office. The audit found that Republican State Rep. Jason Dockter of Bismarck is a co-owner of the building, which was leased while Attorney General Wayne Stenehjem was still in office. He died last January. Additionally, the audit found that the leased office building did not have enough space for all the divisions of the Attorney General’s office and extensive remodeling was done by a company also co-owned by Dockter, which does not have a contractor’s license. The work was actually completed by subcontractors. The company does not have a contractor’s license and there were not invoices to support some of the payments made for the work.

BISMARCK — Six months after the January deletion of former Attorney General Wayne Stenehjem’s email account, North Dakota information technology officials assured state leaders there was no way the erased messages could be recovered....That changed Thursday, Sept. 29, when ITD Chief Technology Officer Duane Schell said the department has begun the process of hiring private consulting firm Planet Technologies to help with email salvage efforts.... the state’s sluggish search for the lost emails suggests a deliberate attempt to conceal information. Three days after Stenehjem’s death in January, ITD officials deleted his state email account at the direction of Liz Brocker, a longtime assistant to the Republican attorney general. Brocker also instructed ITD to eliminate former Deputy Attorney General Troy Seibel’s email account after he resigned in May. Brocker stepped down from her post in July after new Attorney General Drew Wrigley discovered while fulfilling a records request that she had orchestrated the deletion of the accounts. Wrigley, who was appointed in February, denounced Brocker’s actions and said he wanted to exhaust all options for retrieving the emails, which could shine light on a $1.7 million cost overrun racked up by the office under Stenehjem.... several of the Republican auditor’s findings indicate that ITD did not take every opportunity to recover the deleted emails.... The stay will last until the case is decided in district court.

Fatal shooting by officers in North Dakota ruled justified
FARGO, N.D. (AP) — North Dakota’s attorney general says officers were justified in their use of deadly force against a man police say was having a mental health crisis.
Attorney General Drew Wrigley, Cass County Sheriff Jesse Jahner and other officials held a news conference Monday to provide additional information on the fatal shooting of 35-year-old Andrew Martinez in Mapleton on Aug. 1.
Wrigley says four officers fired their weapons when Martinez, armed with a semi-automatic rifle, appeared in the doorway of a residence and pointed the weapon at them following a four-hour standoff.
Negotiators urged Martinez to come out of the house without his weapon.
Wrigley says 20 to 25 rounds were fired by the officers and five gunshots struck Martinez, who died at the scene after life-saving measures were attempted.
Jahner says no shots were fired at officers.
Neighbors were told to stay indoors during the standoff.

Wrigley says Officer Adam O’Brien fired his gun at 28-year-old Shane Netterville after Netterville ignored police commands and sped out of a garage in a stolen van, narrowly avoiding officers. Netterville suffered a chest wound and died at a hospital several hours later. (CNN)A state judge in North Dakota on Thursday blocked the state's so-called trigger abortion ban, which was set to go into effect on Friday.
Judge Bruce Romanick of the South Central Judicial District in Burleigh County said he was issuing the preliminary injunction to maintain the status quo in the state while the challenge to the law unfolded in court.
His order said he was persuaded by the arguments put forward by the abortion clinic challenging the ban that there would be "significant" harm if the law took effect. His order said that he was not making any conclusions about which side was more likely to succeed on the merits of the case over whether the law violates the state's constitution.
North Dakota currently allows abortion up until 20 weeks or more post-fertilization. The abortion ban that was set to take effect Friday would make it a felony to perform an abortion in the state with exceptions for the life of the mother or in cases of rape or incest...

Also, a report released by the North Dakota Highway Patrol on Wednesday, Aug. 17, said a guard who was tasked with checking on Isaak at the State Penitentiary failed to follow proper procedures, though its unknown whether Isaak's death could have been prevented.... The report also said Sgt. Andre Adams, a correctional officer, did not do proper cell checks when he walked by Isaak's cell at 4:53 p.m. and 5:28 p.m. that day.

BISMARCK — The North Dakota Department of Human Services has routinely failed to perform timely checkups on suspected victims of child abuse and neglect, according to a state audit....Gallion's report reveals the agency has not followed its own policy to make prompt face-to-face contact with children suspected to be abused or neglected.
The department's policy dictates social services employees, law enforcement, court staff or medical personnel are supposed to meet with children after a report of possible abuse or neglect has been filed. The required response time for these meetings varies from 1-14 days depending on the severity of the suspected mistreatment. Of the 60 cases reviewed by auditors, DHS failed to check in with more than two-thirds of the children on time. "The types of cases (reviewed by auditors) included physical injuries such as welts or cuts, educational neglect, illegal substances used during pregnancy or in front of children, children who are suicidal, and sexual abuse," according to the audit....

The proposed ballot measure called for term limits on the governor and legislators. Secretary of State Al Jaeger in March rejected about 29,000 of the measure's 46,315 signatures, citing numerous alleged irregularities including likely forgeries and offers or payments of bonuses to circulators. Jaeger turned the matter over to Attorney General Drew Wrigley, who last month referred the case to the Ward County State's Attorney's Office. The measure group's chairman has sued to compel a public vote on the rejected measure.... Petition circulators told BCI they were offered or received bonus pay based on signatures obtained at the State Fair last year, according to the warrant's affidavit.
State law prohibits paying or offering to pay circulators "on a basis related to the number of signatures obtained for circulating an initiative, referendum, or recall petition."
Tuttle in statements to the Tribune denied paying bonuses to circulators, saying "We paid on ... an hourly scale. If you reached a certain amount, you got paid a higher hourly rate.".

Name of North Dakota man who died in western Minnesota jail released
BENSON — The Swift County Sheriff's Office has released the name of the man who died Aug. 2 while in custody. William Delmore, 45, of Bismarck, North Dakota, died in the early morning hours of Aug. 2, according to a news release. Delmore was arrested by the Benson Police Department on Aug. 1 for driving while impaired. According to the release, an autopsy was performed by the Midwest Medical Examiner in Anoka County, and the cause and manner of death is still pending. Up against a Dec. 30 deadline to finish spending the pandemic stimulus money it got from the federal CARES Act, North Dakota plans to give $16 million in grant to oil companies for fracking. An all-Republican state energy commission voted last week to reallocate the funds, and lawmakers will cast a final vote on it this week. The Forum reports that critics are aghast, calling it a gift to the oil business.
“This money is supposed to help North Dakotans recover from the pandemic and support working families, not serve as another handout to an industry that is already at full workforce,” Sen. Tim Mathern said in a statement. “This is more of the same insider spending that gave us the world-leading COVID-19 outbreak. It’s a misuse of taxpayer dollars in the middle of a crisis.” The vote comes as North Dakota sets records for new COVID-19 cases.

While responding to Forum News Service's records request about a budget overrun in the office, Wrigley said he learned earlier this month that Stenehjem's email account was deleted on Jan. 31 — three days after his death. Wrigley said he also found that Seibel's email account was deleted on May 23, about two months after his resignation. Wrigley, who took office in February, said the unnamed employee eliminated Seibel's account without Wrigley's knowledge or approval.... BISMARCK — North Dakota Attorney General Drew Wrigley told lawmakers Tuesday, June 28, his predecessors racked up $1.8 million in unanticipated costs while making specifications to a leased building and waited six months to tell their office's budgeting wing about the problem. A former deputy attorney general disputes the way Wrigley characterized the aftermath of the cost overrun and said the office did nothing wrong.
Legislators voted Tuesday to investigate the overrun and how officials handled it.
Wrigley told the Legislature's Budget Section that former Attorney General Wayne Stenehjem and former Deputy Attorney General Troy Seibel learned in January 2021 they had to pay for $1.8 million in unexpected costs tied to specifications for a south Bismarck office building.... A Fargo police officer shot a person Friday morning after authorities responded to a call about two people slumped over in a van that turned out to be stolen, officials said.
The driver of the vehicle was shot by an officer after driving out of a garage at an apartment complex and is hospitalized in critical but stable condition, Fargo Police Chief Dave Zibloski said. A man was arrested at the scene. Zibloski said a third person who was in the van fled the area and police are searching for him. The officer was not injured. It's not known whether any of the three people in the van were armed.

BISMARCK — Abortion is set to become illegal in North Dakota after the U.S. Supreme Court overturned the landmark 1973 Roe v. Wade decision on Friday, June 24. The justices of the nation’s highest court ruled in a long-expected 6-3 decision that abortion is not a constitutional right and states can prohibit procedures that deliberately aim to end pregnancies before they are brought to term.
The North Dakota Legislature passed a "trigger" law in 2007 that would ban abortion in the state within 30 days if the Supreme Court ever changed direction on the controversial procedure. To start the 30-day countdown, Attorney General Drew Wrigley must certify that the Supreme Court has allowed states to ban abortion.
Once officially implemented, the state law will make it a Class C felony for anyone to perform an abortion, unless a pregnant female performs an abortion on herself. A Class C felony is punishable by up to five years in prison and a $10,000 fine....

On Tuesday, two months after the South Dakota House of Representatives voted to impeach Attorney General Jason Ravnsborg (R) for fatally running over a man and leaving the scene because he thought he had hit a deer, the state Senate convicted him on two impeachment charges in connection with the 2020 incident. City Poised to Settle Former Officer's Defamation Lawsuit
BISMARCK, N.D. (AP) — The Bismarck City Council will consider paying a former police officer $190,000 to settle her discrimination lawsuit.... Robyn Krile. The deal also would remove two letters of reprimand from her personnel file. Krile was fired in 2017 after then-Assistant Burleigh County State’s Attorney Julie Lawyer decided that Krile wasn’t a credible witness in court. Krile filed the lawsuit in 2019 alleging the department devalued her and kept her from advancing from sergeant to lieutenant. Krile, who is now police chief in Lincoln, North Dakota, was seeking more than $100,000 in damages. The city and Krile's attorney, Chris Redmann, agreed to settlement terms last month. No State Charge for Billionaire Sanford in Child Porn Probe
SIOUX FALLS, S.D. (AP) — The South Dakota attorney general's office has declined to file charges against billionaire T. Denny Sanford following an investigation into possible possession of child pornography, saying it found no “prosecutable offenses” within the state's jurisdiction, according to a court document filed Friday.
Sanford, a banker turned philanthropist, is the state’s richest man and has donated billions to hospitals, universities and charities. South Dakota investigators in 2019 began searching his email account, as well as his cellular and internet service providers, for possible possession of child pornography after his accounts were flagged by a technology firm.
The attorney general's office said in Friday's court filing that the “South Dakota Division of Criminal Investigation has completed its investigation ... and has determined that there are no prosecutable offenses within the jurisdiction of the State of South Dakota.”
The attorney general's office had no comment beyond the court filing.

North Dakota getting the most Federal assistance after 2021 drought
(Bismarck, ND) -- North Dakota croppers should be expecting federal assistance next month. The more than 900-million dollars in Emergency Relief Program funds is being spread across the state to those affected by last year's drought. That is the most money going to any state in the nation. “We worked to secure this assistance to help our producers recover from the historic drought that impacted much of North Dakota, and it comes at a time when farmers really need help due to rapidly rising input costs,” said North Dakota Seantor John Hoeven. “We worked to ensure this program works for our farmers and that signup can go quickly. Producers will begin receiving their pre-filled applications in the next couple of weeks, which they can sign and return to their local FSA county offices. Assistance will then start going out in June.” Producers should be receiving applications for the funds in the coming weeks. In all, over $9.25 billion is being given to states across the country for drought assistance.

The chairman of North Dakota's Democratic-NPL Party is criticizing Republican Gov. Doug Burgum for wanting "to buy his own government" through donations to a political group that has targeted GOP races. Theft charge filed against former South Dakota officer
PIERRE, S.D. (KELO) — A former Rapid City police officer faces a criminal charge related to his time as a school resource officer earlier this year. The South Dakota attorney general office announced Thursday that a complaint of aggregated second-degree petty theft has been filed against Matthew R. Hower, 41, of Rapid City.
According to a release, the case stems from incidents in April through May while he was acting as a Rapid City police officer and school resource officer for the Rapid City school district....On May 13th, the Rapid City Police Department was made aware of money missing from a petty cash box at Central High School. FARGO – North Dakota has been poised for years to outlaw abortions if the U.S. Supreme Court overturns its landmark 1973 ruling that legalized the procedure.
A 2007 state law makes it a felony to perform an abortion unless necessary to prevent the woman’s death or in cases of rape or incest. Violations are punishable by up to five years in prison and a $5,000 fine. The law is to take effect when the legislative council approves a motion recommended by the attorney general that it is “reasonably probable” the law would be upheld as constitutional....

BISMARCK, N.D. — Police and federal agents in Grand Forks seized video discs and other items from the home of North Dakota's longest-serving state senator after he had traded scores of text messages with a man jailed on child pornography charges....a Grand Forks police detective and two Homeland Security special agents searched Ray Holmberg's condominium on Nov. 17. ...Holmberg, a Republican who rose to become one of the state's most powerful lawmakers in a career that spanned 46 years, announced last month that he would resign June 1. His term was scheduled to end on Nov. 30 and he already had announced in March that it would be his last, citing stress and "a weakened ability to concentrate on the matters at hand and effectively recall events." The police report did not give a reason for the issuance of a search warrant. It came about three months after Holmberg exchanged 72 text messages with Nicholas James Morgan-Derosier as Morgan-Derosier was held in the Grand Forks County Jail. Prosecutors allege Morgan-Derosier possessed several thousand images and videos depicting sexually abused children. He also is accused of taking two children under the age of 10 from Minnesota to his Grand Forks home, with the intent of sexually abusing them. The state charges against Morgan-Derosier have been superseded by federal charges that include possession and distribution of child pornography and travel with intent to engage in illicit sexual conduct....In addition to seizing CDRs and DVDRs in a nightstand drawer in a bedroom in Holmberg's condo, "multiple other items were seized by officers and placed into evidence," the report said. The report did not identify the additional items. The newspaper reported that the two federal agents and the Grand Forks police detective who searched Holmberg's home also investigated Morgan-Derosier.

Deputy kills man in altercation inside North Dakota school
MOTT, N.D. — A sheriff’s deputy killed a man inside a North Dakota public school after the man refused orders to leave the building, officials said Friday.
The Hettinger County Sheriff’s Office said the deputy was responding to a report of a disturbance at Mott-Regent school about 3 p.m. Thursday when a man identified as Jeffrie Ray Glover Jr. attacked him. The sheriff’s office said in a release it was a “lethal force scenario” but did not state how Glover was killed.

Ray Holmberg, a powerful Grand Forks Republican, was among those 34-year-old Nicholas James Morgan-Derosier texted in flurries of communication on Aug. 23 and 24 when Morgan-Derosier was incarcerated last year at the Grand Forks County Jail.... The 77-year-old man, who was not identified by prosecutors in the transcript, asked or told Morgan-Derosier that “he wants him to bring (Morgan-Derosier’s boyfriend) over to his house to give him a massage,” Puhl said in the transcript. The boyfriend was 19 or 20 years old at the time, according to the transcript. ...
In March 2021, roughly five months before the text exchanges between Morgan-Derosier and Holmberg, the Grand Forks Herald wrote a story about 10 child porn charges filed against Morgan-Derosier in Grand Forks County District Court....
Holmberg told a reporter he no longer had the text messages. Ravnsborg’s 11th-hour letter ‘pushed me to a yes’ on impeachment, Koth says, despite first leaning no
PIERRE, S.D. — The South Dakota Attorney General's letter to lawmakers ahead of an impeachment vote did, in fact, provide a push. It pushed a Mitchell legislator to vote for the impeachment of Jason Ravnsborg.... At 9:42 p.m. Monday, Ravnsborg wrote a letter to the House of Representatives, claiming justice had already been served, referring to two traffic offenses he was convicted of in relation to the Sep. 12, 2020, crash that killed Joe Boever, a pedestrian walking along a highway at night. The letter, which was not written with the official letterhead of Ravnsborg’s office, attempted to dispel many already-proven facts of the case through word play.
“Jason was distracted at the time of impact,” one statement that the letter attempts to argue reads. “False. … At no time has any investigator articulated or explained how Jason was distracted. Claiming Jason was distracted was released to influence the public and taint a potential jury pool without proof or even a theory of distraction.” However, in January testimony from crash reconstruction expert John Daily, his investigation pointed to distraction by a cell phone.... It’s proven, based on a forensic phone search conducted by the North Dakota Bureau of Criminal Investigation, that Ravnsborg’s phones were not on at the time of impact — as his letter suggests. However, phone data had proven Ravnsborg was on his phone for a majority of the drive, including the minutes leading up to the crash....
Ravnsborg wasn’t being forthright surrounding the facts of the case... the impeachment was approved... Ravnsborg will be tried on articles of impeachment alleging both crimes and malfeasance in office in a special session of the South Dakota Senate on June 21-22, 2022....

Battle continues over North Dakota ballot measure on term limits
A battle continues over a ballot measure that would allow North Dakota voters to decide if they want term limits for some state office holders. The proposed constitutional amendment would limit state representatives, senators and the governor to serve no more than eight years. A group called U.S. Term Limits turned in their petitions last month, only to have the majority of the signatures disqualified. Secretary of State Alvin Jaeger disqualified 29,101 of the 46,366 signatures. The group needed 31,164 valid signatures to get the issue on the November ballot....
Meanwhile the group sent a letter to Jaeger calling his rejection of signatures "unlawful and unconstitutional."... The group alleges in the letter that 8,000 signatures were “unconstitutionally and unlawfully” thrown out on the mistaken basis that they were collected before the group was approved to start circulating petitions. It also challenged the disqualification of all signatures notarized by a person identified as Zeph Toe for “likely forgery” based on “inexpert opinion regarding a few circulator signatures was unconstitutional and improper.” The letter went on to accuse Jaeger’s team of coming up with new criteria for evaluating the petitions exclusively for this instance and therefore led to the dismissal of thousands of signatures on minor technicalities even when the team knew the signatures matched voter records, according to the letter.
“No expense was spared in attempting to disqualify this petition, and the full scope of the use of taxpayer resources to frustrate the will of the electors is only beginning to come into focus. The state’s validation process here should be subject to a full inquiry,” the group said in the letter. The group called on Jaeger to reconsider, saying there are at least 40,020 valid signatures among those tossed, well over 8,000 more required by law.

GWINNER, N.D. — Fire department officials in a rural, eastern North Dakota town spent thousands of dollars on alcohol, groceries and golf outings, according to findings by the Office of the State Auditor. Between 2015 and 2020, the Gwinner Rural Fire Protection District spent more than $28,000 on alcohol, groceries and golf expenses for staff and volunteers, according to findings released by the auditor's office Thursday, April 7. Such purchases violate North Dakota laws governing the use of public funds. The audit also found that the Gwinner Fire District was not able to provide any documentation for 12 of 32 tested expenditures from 2018. That left almost $26,500 unaccounted for, and the auditor's office projected that undocumented purchases could total more than $300,000....

BISMARCK — A North Dakota judge Thursday, March 31, offered more of an explanation on why he rejected a plea deal for a former high-ranking member of the North Dakota Highway Patrol. Steven Johnson, a former lieutenant who oversaw patrols in southwest North Dakota and was part of the governor's security detail, is charged with misdemeanor sexual assault. He was fired in November 2021 after the charge was filed. Johnson is accused of groping a woman's breasts under her clothes as she slept on a couch at his home during a hot tub party with other troopers and their wives, according to court documents. Under the plea deal, prosecutors would have reduced the charge to disorderly conduct after the woman changed her story. The deal would have allowed Johnson to avoid jail time and his record would have eventually been wiped clean....

SIOUX FALLS, S.D. (AP) — South Dakota Attorney General Jason Ravnsborg's errant driving in 2020 twice caused police officers to hit their brakes to avoid collisions... The Highway Patrol records showed that a week before the Republican attorney general hit a man, Joseph Boever, walking on the shoulder of state Highway 14, he had been pulled over on the same highway for illegally pulling in front of a police car at an intersection in the city of Huron, roughly 70 miles from where the fatal accident happened.... As the attorney general has recounted the fatal crash to the public and criminal investigators, he has been unable to explain how his car came to hit Boever on the shoulder of Highway 14,... Ravnsborg had also been issued a warning for making an improper lane change less than two months before the crash. Highway Patrol Trooper Nathan Moore wrote in an account of a July traffic stop that Ravnsborg drove out of his lane on a road in Sioux Falls, nearly causing a collision.... Ravnsborg racked up eight traffic stops, mostly for speeding, between taking office in 2019 and the crash, but had only been issued warnings. In five of those stops, Ravnsborg either identified himself as the attorney general or displayed his badge, the Highway Patrol found. Those traffic stops came on top of a long history of driving violations. Ravnsborg had been pulled over more than 25 times, crash investigators found. However, he was in no danger of having his license suspended in South Dakota, where accumulated speeding tickets do not count against a driver's record.

Former North Dakota prison guard pleads guilty to delivering drugs to inmate
BISMARCK, N.D. (AP) — A former North Dakota State Penitentiary guard pleaded guilty Tuesday (March 1, 2022) to delivering a cellphone and methamphetamine to an inmate in return for money. Thirty-nine-year-old Matthew Taylor, of Mandan, faces the possibility of 20 years in prison on a charge of delivering drugs at a correctional facility, the most serious of the two counts against him. The North Dakota Highway Patrol began an investigation in November 2020. Taylor was working as a correctional officer at the penitentiary in Bismarck from March to November of that year. The Department of Corrections and Rehabilitation says Taylor was fired after the investigation was completed.

Police then went to canvas the neighbors in Mindy's building — and get DNA samples to rule people out. That's when they discovered that a corrections officer from the Barnes County Jail, Moe Gibbs, was also a neighbor. He told police he spent the morning at home after his shift, had lunch with his pregnant wife, and then packed and put boxes to the car, as the family was moving soon. The only thing he said was out of the ordinary was the very strong scent of Pine-Sol in the hallway after he'd returned from lunch....
Other suspects were considered, including a man Mindy's restaurant coworkers said made her uncomfortable and an ex-boyfriend's father. But s week after the murder, DNA results came back on the material found under Mindy's fingernails: It was a match for DNA collected after a brutal, still-unsolved sexual assault in Fargo that occurred two years before her murder — and to 34-year-old Moe Gibbs' DNA.
“I knew him personally,” Swenson told producers. “It really caught me off guard that somebody in the law enforcement community would’ve done something life this.”
They learned Gibbs had changed his name and his legal name before 2005 had been Glen Dale Morgan Jr. And, despite the background check he'd passed to join the corrections staff, "We found out that he was involved in a drive-by shooting and he had served five years in prison,” Swenson said. (Gibbs, then known as Morgan, was convicted in military court of attempted premeditated murder and served his sentence from Jan. 1994 until April 1998 at Fort Leavenworth prison. His personnel file with Barnes County said he'd served in the Navy from 1990-1999.) Gibbs was then invited into the station to speak with police, where they observed healing scratches on his hands. He admitted to having briefly been in Mindy's apartment prior to the murder, claiming she had been trying to carry a laundry basket and some other things, so he’d helped her out....
After he was arrested, several female inmates from the local jail came forward and said that Gibbs had sexually assaulted them when he was working. One women in particular told police — though it was excluded at his murder trial as overly prejudicial — that he'd digitally assaulted her around 6 a.m. on the morning of Mindy's murder before his shift ended at 7. He was eventually charged with six counts of sexual assault for his actions at the jail, one count of sexual assault for the rape in Fargo, and one count of first-degree murder in Mindy's death. He eventually pleaded guilty in the rape and sexual assault cases....
After 27 hours of deliberations, a jury found Gibbs guilty of murder on Nov. 20, 2007, with Mindy's family and Gibbs' new fiancée, Amy, in the courtroom. He was sentenced to life without the possibility of parole...

Race data to yield clearer picture of potential bias in North Dakota justice system
North Dakota court officials are hopeful about a nearly year-old effort to collect race data on defendants -- what one community activist calls an encouraging step toward addressing potential bias in the justice system. A court rule for race data collection took effect in March 2021. When filing criminal complaints, prosecutors include adult defendants' race perceived by law enforcement in officers' reports and citations.
The judiciary's Minority Justice Implementation Committee will look at the data this spring and identify any issues or disparities.
"The ultimate goal remains to be to identify any types of racial prejudice that we may have in our justice system in an effort to make sure that everybody's entitled to equal justice under the law, and so make sure that everybody is obtaining equal justice and that there's no disparities based on race or ethnicity," said Bottineau-based Northeast District Judge Anthony Swain Benson, who chairs the 15-member panel of judges, prosecutors and attorneys. State Court Administrator Sally Holewa said the initial goal is to form a starting point: "Can we even get enough data to make a useful analysis?"...
The first look will determine how well race data is being collected and what any related issues are, she said. Other states that log defendants' race data opt for self-reported race, but North Dakota is recording race as perceived by law enforcement, she said. "We thought it might be more meaningful to get perceived race if you’re looking for bias," Holewa said. "If at some point we're able to do some data analysis, what we would be looking at is there a wide difference between perception and then self-reporting by the defendant," she added. Race data can be corrected in the system....

South Dakota lawmakers voted on Wednesday to broaden their examination of the state attorney general's killing of a man in a fatal collision last year. Attorney General Jason Ravnsborg killed a pedestrian while driving in September 2020. Ravnsborg initially told police he had hit a deer but discovered 55-year-old Joseph Boever's body the following morning after returning to the scene of the crash. The House Select Committee on Investigation is considering whether to recommend Ravnsborg be impeached following the fatal car crash. The articles alleging corrupt conduct were initially filed in February.... In August, Ravnsborg pleaded no contest to two misdemeanors in connection with the fatal crash. He was ordered to pay a $500 fine for each of the misdemeanors...
Among the more powerful pieces of evidence that have come to light since the incident has been investigators saying they found Boever's broken glasses in Ravnsborg's car and that the victim's face had gone through the attorney general's windshield.
The South Dakota Department of Public Safety released the evidence in February that included a two-part interview in which investigators had questioned Ravnsborg about a pair of broken glasses found inside his vehicle....
Under the state constitution, officials including the attorney general "shall be liable to impeachment for drunkenness, crimes, corrupt conduct, or malfeasance or misdemeanor in office."...

AG opinion gives clarification to North Dakota ethics panel
Earlier this year, the ethics panel asked the attorney general to weigh in on the section of the ethics amendment, citing concerns that "if we basically eliminated the ability of contributions to quasi-judicial candidates, we would run afoul of federal law, the (U.S.) Constitution, the First Amendment," Ethics Commission Executive Director Dave Thiele said. Stenehjem wrote that courts would likely find the section to be constitutional under the First Amendment, but an analysis would need specific facts.
"Because (the section) does not limit political speech on its face, this issue would only be addressed upon request after it arises in a specific factual circumstance," he wrote. "Provisions of law limiting political speech are subject to varying levels of scrutiny which are highly fact dependent." Thiele said the board "just wanted clarification as to what the left and right boundaries would be" in light of a major U.S. Supreme Court ruling about campaign finance restrictions and free speech.
"The language ... according to the opinion is constitutional on its face, but depending upon how we draft the rules, we could run into issues because then you get into the 'as-applied' language in the opinion," Thiele said. "That's where any time you're looking at restricting campaign contributions or putting limits, we've got to look at the facts."
The ethics panel meets Jan. 26. Thiele said the board's likely path forward is to create two separate rules, one for campaign contributions to "quasi-judicial" decision-makers and one for "just general conflicts of interest."

These are the highest paid public employees in North Dakota
The highest paid public employee in the state remains Dr. Joshua Wynne, who serves as the vice president for health affairs and dean of the School of Medicine and Health Sciences at the University of North Dakota. Wynne made more than $695,000 through the first 11 months of the year, according to records obtained by Forum News Service.
Amid another successful season in Grand Forks, UND Hockey Coach Brad Berry ranked second on the payrolls at public universities, earning nearly $580,000 through November. Two of Berry's assistants, Dane Jackson and Karl Goehring, each made more than $200,000.
North Dakota State University Football Coach Matt Entz pulled in close to $400,000 through November, while UND Football Coach Bubba Schweigert earned nearly $250,000.
Despite the six-figure salaries, North Dakota is one of only a few states where the best-compensated public employee is not a college sports coach.
In all, the university system and public higher education institutions paid out $419.3 million in wages and $1.7 million in overtime and bonuses to about 6,900 workers through November.
State government agencies paid about 14,500 workers a total of $557.9 million in base wages this year, an increase of 7% over 2020. The State Mill and Elevator, a public agency that does not take taxpayer funds, paid out $12.8 million in wages.
The state also dispensed $15.8 million in overtime, a slight drop over last year, and $8.5 million in bonuses, a 140% increase over last year.
Of the bonuses given to employees, about $2.8 million rewarded employees for good performance, $1.8 million went out as incentive pay to health care employees and $3.8 million served as recruitment or retention bonuses for in-demand workers....
Dr. Eduardo Yabut, a physician with the Department of Human Services, was the top-earning employee at a state agency, making $606,000 in 2021. Former Bank of North Dakota CEO Eric Hardmeyer earned the most among non-physicians.
Attorney General Wayne Stenehjem took home the most among executive officeholders, earning $164,000. Salaries for elected officials are set in state law.
Among lawmakers, the four party leaders — Sens. Rich Wardner and Joan Heckaman and Reps. Chet Pollert and Josh Boschee — as well as longtime Sen. Ray Holmberg, earned the most, each getting around $40,000.

PIERRE, S.D. — South Dakota Gov. Kristi Noem said Tuesday she would propose a bill to ban transgender women and girls from participation in female school sports leagues....
She described them as an effort to ensure “an equal playing field” for women. “Common sense tells us that males have an unfair physical advantage over females in athletic competition,”... But advocates for transgender people said it was an attack on transgender women and girls and did nothing to address the challenges like underfunding, a lack of media coverage and sexist stereotypes that girls and women actually face.
