Software Commercial Use Terms and Conditions
These terms and conditions govern the license and commercial use of the software products of Kawanishi Polishing Technology Special Research Laboratory (hereinafter referred to as "Party B") when you (hereinafter referred to as "Party A") use the software products included in this package, including the programs, manuals, and other documents (hereinafter collectively referred to as "the Software"). Please read each clause of these Terms and Conditions carefully and use the software only after agreeing to all of them.
Article 1 (Rights of Use Granted to Party A)
1. Party B grants Party A a non-transferable and non-exclusive right to copy and use the Software on a computer.
2. Party B grants Party A permission to commercially use the results calculated using the Software. (However, the reliability is insufficient as sufficient comparisons between experiments and simulations using the Software have not been conducted.)
Article 2 (Prohibited Acts)
The following acts are prohibited:
1. Selling the Software alone or in package with other software to a third party.
2. Adding functions to this software and selling it to a third party as new software.
3. Allowing a third party to use this software via a computer network, etc.
Article 3 (Rights Related to Software)
All patent rights, copyrights, and other intellectual property rights related to this software belong to Party B, and the license granted to Party A for the use of this software under these terms and conditions does not imply the transfer of these rights to Party A.
Article 4 (Modification and Analysis of Software)
1. Party A may not modify or alter this software under any circumstances.
2. Party A may not analyze this software using disassembly, decompilation, or other reverse engineering methods under any circumstances.
Article 5 (Warranties and Liabilities by Party B)
1. Party B makes no warranties whatsoever regarding the completeness, usefulness, etc., of this software.
2. Party B shall not be liable for any direct or indirect damages incurred by Party A due to defects in this software.
Article 6 (Support)
Party B shall provide Party A with the following technical support for one year after the acceptance of the Software:
(1) Answering inquiries via email regarding the use of the Software, etc.
(2) Providing revised versions of the Software
Article 7 (Suspension of Use)
If there is any conduct that violates these Terms and Conditions, Party B may be required to suspend the use of the Software.
