MARTIN NALLE

MARTIN NALLE

Martin Nalle is believed to have been born about 1675-1680, (1) probably in England. The exact location of his birth and the names of his parents have not been found. His death occurred in Essex Co, VA (2) between 9 Apr and 20 Apr 1728. (3) Martin Nalle was married to Mary Aldin, (4) probably about 1702, (5) and certainly by 5 June 1705 when Mary Naule was named in an Essex Co, VA., deed (6).

Mary (Aldin) Nalle is believed to have been born in mid 1681 and baptized 21 Aug 1681, in Christ Church Parish, Middlesex Co, VA, (7) the daughter of Robert and Ellianor (Willis) Aldin. (8) Although the given name recorded in the Christening record was "Jane", other factors indicate that she was the same person referred to in later records as "Mary".(9) No further references to a Jane Aldin were found in the parish records. There was no birth record for a Mary Aldin, although those of her brother John, in 1683 and a sister Katherine in 1685 were noted. These were the three children named by Ellianor (Willis) Aldin Kemp in a deed in 1714, "in consideration for the love I have and bear my son John Aldin…two daughters in Essex, Mary Nalle and Catherine Terbett.. (10) Mary Nalle and Katherine Turbett were named in the will of their step-father Richard Kemp, in 1714, (11) and also in a division of land dated 15 Oct 1722. (12) Mary (Aldin) Nalle was born certainly before 1685. In his will dated Jan. 1685, Matthew Bentley, step-father of Ellianor (Willis) Aldin, left to his step-daughter, "Mary Allden, a young maire. (13) In 1688 Mary Allden was bequeathed "a good cow and calfe" by the will of her uncle, John Wallis. (14) She may have been called "Mary" after the death of her grandmother, Mary Willis Bentley. Mary (Aldin) Nalle died in 1734 in Essex Co, VA.

Martin Nalle arrived in the Colony of Virginia probably a few months before March 1701/02. He was listed as one of sixty-two persons transported into the Colony by Chickeley Corbin Thacker, for which Mr. Thacker was granted 3080 acres of land lying in Pamunky Neck in King and Queen County. (15) Martin Nalle most likely came as an indentured servant, working off his indenture, and perhaps earning a tract of "tobacco ground" as his land was later referred to. He was not listed on the 1704 Quit Rent rolls (16) of the Colony of Virginia, indicating that he was not a property owner at that time.(17)

Also listed among the sixty-two persons brought to Virginia by C. C. Thacker was "Abigail Nelle". On the patent list the names Nalle and Nelle are distinctly different in the handwriting of the scriber. This may or not have been correct. (18) Nothing further has been found concerning Abigail Nelle or Nalle, so we do not know if she was a wife or sister to Martin or unrelated. Later records prove that she was not the mother of his oldest son and presumably his other children.

Martin Nalle's name first appeared in the court records of Essex Co, VA. on 2 Feb 1705/06 when he witnessed a deed from James Boughan to Richard Holt and William Holt. The name was spelled "Nall".(19)

On 5 June 1705 Martin Nalle's wife, Mary (Aldin) Nalle, was deeded land from her mother and step-father, "Richard Kemp and Elianor, his wife…for and in consideration of the sum of thirty pounds sterling… give grant…confirm unto the said Mary Naule and Katherine Turbett and heires of their bodyes and for want of such heirses of the body of either of them to the longest liver of them and her heires forever…three hundred acres of land…lying and being in the County of Essex…to be equally divided in quality and quantity into two parts and then the said Mary Naule is to have her first choice. The 300 acres of land had been conveyed to Richard and Elainor Kemp by Robert and can't read, Deputy on 10 Jul 1703. (20)

"At a court held for Essex County… the 10th day of May 1709... It is ordered by the Court that Martin Naul be summoned to appear at next Court to be sworn Constable." Martin Nalle served as constable until 10 July 1710. (21)

On 8 Jan 1713/14, Martin Nalle purchased 194 acres of land adjoining his "tobacco ground." "James Boughan of the Parish of South Farnham in the County of Essex for and in consideration of the sum of seven thousand pounds of every way well qualified sweet scented Tobacco…do grant bargain sell… and confirm to him the said Martin Nalle…parcel or tract of land containing one hundred ninety four acres…beginning at a small grumb standing in a swamp formerly called Gregory's Swamp…near the Northwest line of Joseph Baker's Land…to the main road that leadeth from Piscataway Ferry to the old mill…to a corner Hickory standing in the said Martin Nalles Tobacco Ground." (22)

The will of Richard Kemp, Mary (Aldin) Nalle's step-father, was presented for probate on 13 May 1714. In his will he bequeathed to her: "I give unto Mary Nall, Six hundred pounds of Tobacco." (11)

On 23 Jan 1715 Martin Nalle was one of four men who returned to Essex County Court an appraisal of the estate of Andrew Hardee. (23) On 21 May 1717 Martin Nalle with William Hudson and Thomas Moore gave bond of five hundred pounds sterling to administer the will of Richard Brasler. (24)

In 1722 the land which had been deeded in 1705 to Mary (Aldin) Nalle and her sister was officially divided. "Be it known…that whereas Richard Kemp and Eleanor his wife…by one deed of gift…give unto Mary and Katherine Aldyn, the said Elianors two daughters all the said tract of land containing 200 hundred [sic] acres more or less now know ye that the said Mary now the wife of Martin Nalle and her said husband and the said Katherine now the wife of James Sames all of the parish of South Farnham in the County of Essex aforesaid have by these presents by one consent agree and obligate themselves to severe the joyntennancy and by equally dividing the same the said division ling running S and E from a red oak by a swamp between Richard Gatewood and this tract to a red oak in the last line to which agreement we oblige ourselves our heirs, exors, and admrs, each and either of them firmly by these presents as witness our hands and seal this fifteenth day of October 1722.

At a court held for Essex County on Tuesday the 16th day of October 1722, this division of land between Martin Nalle and James Sam's was produced in Court by the said Nalle and Sam's which on their motion is admitted to records." (12)

Martin Nalle is believed to have died after 9 Apr and by 20 Aug 1728. His will was dated 9 Apr, but no year was noted. The will was proven on 20 Aug 1728 in Essex Co. VA. Court. The inventory and appraisement of his estate was recorded 19 Nov 1728 (25)

LAST WILL OF MARTIN NALLE

In the mane of God, Amen, the ninth day of April, I Martin Nall of the County of Essex and Parish of South Farnham, being very sick and weak but in perfect sence and memory, Praise be given to the Almighty God for the same, knowing the uncertainty of the life on earth, do make and appoint this to be my last will and Testament, revoking all other wills by me formerly made and do make and appoint this to be my last will and Testament in manner and form following that is to say: First and principally I commend my soul to God my Creator and Redeemer hoping that I shall be saved by the Precious death and merrits of Christ and my body to be decently buried as md Execr. Hereafter named shall think fitt and for my worldly estate as the Lord in his mercy bestowed on me. My will is that it shall be bestowed as this my will is exprest. Item: I give to my beloved wife Mary Nall, a negro man named Bristol during her natural life. Item: I give to my beloved son John Naul ten acres of my land and the remainder part of my land, I give to my beloved son Martin Naul to them and their heirs forever. Item: I give all the remainder of my estate and personal to be equally divided among my eight children. Only my wife to have an equal part of the personal estate for her life and the eight head of cattle I lent to my son John and my daughter Winnifred to be in part of their portion and I do appoint my beloved wife and my cousin Thomas Burke and Thomas Dillard, my whole and sole execrs. of this my last will and testament.

At a court held for Essex County on the 18th day of September 1728, the within last will of Martin Nall, deced, was proved by the oath of Mary Nalle, Executrix therein named. (2)

At a court held for Essex County at Tappahanneck on Tuesday the 19th day of November 1728, this inventory and appraisement of the estate of Martin Nalle, dec'd being returned and admitted to record (25)

On 11 Jul 1729, receipts for "nine pounds fourteen shillons and one penny," their part of Martin Nalle's estate were signed by John Ennis and Betty Ennis, Thomas Dillard and Winifred Dillard. The signature on a similar receipt dated 14 Jul 1729 appears to be Ame William Frazer. All three receipts were presented to the Essex County Court by Mary Nalle on 15 July 1729 (26) (Long list of his inventory Estate followed)

Mary (Aldin) Nalle died after 22 Mar and before 1 Apr 1734, when her nuncupative will was sworn to by Joseph Burnett and Winifred Dillard (27)

NUNCUPATIVE WILL OF MARY NALLE

Memorandum that Joseph Burnett, aged about twenty three years, made oath that Mary Nall on the twenty second day of March desired him to take notis that she give to his son Nathan Nall one negro boy called Jeme Atkinson and she give a fether bed that she purchased sence hir husband dyed to hir daughter Agness and she give all her wearing cloathes to her daughter Amey Frazer, and she give to his son Richd' Nall, two pewter basons, three dishes and five plates and further saith not given under my hand this first day of April, 1734.

At a court held for Essex County on the 22nd day of May Ano.Dom. 1734, Joseph Burnett made oath to this, his deposition as the Nuncupative will of Mary Nalle, decd. Which was ordered to be recorded.

Memorandum that Winefrett Dillard, aged about twenty nine years made oath to she heard Mary Nalle desire Joseph Burnett to take notis that she give to her son Nathan Nalle a negro boy called James Atkinsson. And she likewise gave a fether bed that she bought since hir husband dyed to hir daughter Angess Nall, and all hir wearing clothes she give to hir daughter Amey Frazer and further saith not given under my hand this first day of April 1834.

At a court for Essex Co, on the 22 day of May Ano.Dom, 1734, Winifred Dillard made oath to this her deposition as the Nuncupative will of Mary Nalle, decd, which was ordered to be recorded (27)

Martin Nalle and Mary (Aldin) Nalle were buried on their Essex Co, VA. property. When the land was sold by their son, John Nalle, he reserved the burial plot; "Excepting a piece of forty square foot for a burying place where Martin Nalle and Mary, his wife lies buried." (28,29)

On 22 May 1734, John Nalle, Thomas Dillard, Joseph Burnett and Martin Nalle, Jr. gave bond of two hundred pounds sterling to make an inventory of the personal property of Mary (Aldin) Nalle. This inventory and appraisement were returned to Essex County Court on 23 Jun 1734. (30)

From 27 May 1734 through 24 Jul 1734, the sale of the personal estate of Mary (Aldin) Nalle took place. The account of the buyers were recorded on 16 Mar 1741. (31)
