REASSESSMENT AND DEVELOPMENT OF NEW IEP
A reassessment of the student shall be conducted not more frequently than once a year, unless the District and parent agree otherwise, and at least once every three years unless the District and parent agree in writing that a reassessment is not necessary. A reassessment shall be conducted more frequently if conditions warrant or if the student's parents or teacher request a new assessment. (E.C. §56381(a)(l) -(2))

Notice of Reassessment and Proposed Action
The notice of reassessment, proposed action, and assessment plan, if appropriate, must be given to the parents early enough to obtain consent and complete the assessment before the date of the IEP meeting to review the reassessment.
Once parental consent for the assessment has been obtained, the Case Manager shall distribute a copy of the signed assessment plan to all staff conducting the assessment. Parent consent is not required before reviewing existing data as part of an assessment or reassessment.
Please Note: It is not compliant to have the assessment plan presented at the IEP meeting for signature when the assessment data is being discussed. The assessment plan must completed and signed prior to completing the assessment. Parent consent to conduct a reassessment is not required if the District can demonstrate that it has taken reasonable measures to obtain consent and the parent has failed to respond. To demonstrate your attempts to obtain consent you must maintain copies of written correspondences in the student’s file.
Notice of IEP Meeting
Parents must be notified of IEP meetings early enough to ensure the opportunity for them to participate (E.C. § 56341.5)(b).
Reassessment Process
The purpose of the reassessment is to determine if the student continues to be a student with exceptional needs and if so, whether additions or modifications to the IEP are needed to enable the student to meet his/her annual goals. A triennial reevaluation must be conducted on or before the calendar date that is three years from the initial IEP meeting or previous triennial IEP meeting. Additional data obtained through full standardized testing is often not necessary for reassessment. An assessment report containing all of the required components must be completed to document the data that was reviewed and continuing eligibility.
A student must be reassessed before determining that he or she is no longer a student with a disability except when termination of eligibility is due to graduation from secondary school with a regular diploma, or to exceeding age eligibility under State law (E.C. § 6338l(h). In such cases, the LEA must provide the student with a summary of the child's academic achievement and functional performance including recommendations on how to assist the student in meeting the student's post-secondary goals (E.C. § 63381(i)(2)) .
