FREE AND APPROPRIATE PUBLIC EDUCATION (FAPE)

    1. Ensure Free and Appropriate Public Education (FAPE) is available to all children from ages three until their twenty-second birthday, including children with disabilities who have been suspended or expelled from school.

    2. Develop an individualized education program (IEP) by the child’s third birthday. If a child’s third birthday occurs during the summer, the child’s IEP team shall determine the date when services under the IEP will begin.

    3. Ensure that FAPE is available to any individual child with a disability who needs special education and related services, even though the child has not failed or been retained in a course or grade, and is advancing from grade to grade.

    4. Provide funding for a public or private residential program if placed by the school district of residence and determined necessary to provide special education and related services to a child with a disability.

    5. Provide necessary supplementary services and supports as outlined in the IEP

    6. Provide Extended School Year (ESY) services if IEP team determines services are necessary for the provision of FAPE.

    7. Provide nonacademic and extracurricular services and activities in the manner necessary to afford children with disabilities an equal opportunity for participation in those services and activities as outlined in the IEP.

    8. Ensure that children with disabilities have available to them the variety of educational programs and services available to nondisabled children as outlined in the IEP.
