Prohibited Articles

RULE 407

(a) the articles shall be examined by the Jailor before being introduced into the jail.

जेलर द्वारा जेल में लाने से पहले वस्तुओं की जांच की जाएगी।

(b) nothing that may be considered deleterious to health or unnecessary or unsuitable by the Superintendent shall be allowed. Spirituous liquors and intoxicating drugs are prohibited, unless prescribed by the Medical Officer on medical grounds.

अधीक्षक द्वारा जिसे स्वास्थ्य के लिए हानिकारक या अनावश्यक या अनुपयुक्त न माना जाय, उसकी अनुमति दी जाएगी। मादक पेय और नशीले पदार्थ निषिद्ध हैं, जब तक कि चिकित्सा अधिकारी द्वारा चिकित्सीय आधार पर अनुमति न दी गयी हो,

(c) spirituous liquor and intoxicating drugs are prohibited unless prescribed by the medical officer on medical grounds. The use of tobacco, biris and cigarettes is permitted.

मादक पेय और नशीली दवायें प्रतिबंधित हैं जब तक कि चिकित्सा अधिकारी द्वारा चिकित्सीय आधार पर लिखा गया हो। तंबाकू, बीड़ी और सिगरेट के प्रयोग की अनुमति है।

RULE 447 Gift, hire or sale of articles by civil prisoners prohibited-

No part of any food, clothing, bedding or other necessaries belonging to any civil prisoner shall be given, hired, or sold by him to any other prisoner, and any prisoner transgressing this rule shall loose the privilege of purchasing food or receiving it from private sources for such time as the Superintendent thinks proper.

सिविल बंदियों द्वारा उपहार, किराया या वस्तुओं की बिक्री का निषेध

किसी सिविल बंदी के किसी भोजन, कपड़े, बिस्तर या अन्य आवश्यक वस्तुओं के किसी भी अंश को उसके द्वारा किसी अन्य बंदी को न तो किराए पर दिया जायेगा और न ही बेचा जाएगा, यदि कोई बंदी, इस नियम का उल्लंघन करता है तो वह भोजन खरीदने या निजी स्रोतों से इसे प्राप्त करने के विशेषाधिकार को कुछ समय के लिए जैसा अधीक्षक उपयुक्तक्त समझे, खो देगा।

RULE 673 Deposit of articles or cash at interviews

Should the friends or relations interviewing a prisoner wish to make over any articles or cash for the use of prisoner either in jail or on release, they shall deposit them at the main gate, with the permission of the officer supervising the interviews under intimation to the Superintendent

The prisoner shall be permitted, while in jail, to use only such articles as he is allowed to have under the rules. The introduction of any article or cash into the jail, except in accordance with this rule or with the written sanction of the Superintendent is prohibited and declared to be an offence under section 42 of Prison’s Act 1894. मुलाकात में नकदी या वस्तुयें जमा करना

यदि किसी बंदी से मुलाकात करने वाले मित्र या रिश्तेदार जेल में या रिहा होने पर कैदी के उपयोग के लिए कोई वस्तु या नकद देना चाहते हैं, तो वे अधीक्षक को सूचित करते हुए मुलाकात का पर्यवेक्षण करने वाले अधिकारी की अनुमति से उन्हें मुख्य द्वार पर जमा करेंगे।

बंदी को, जेल में रहते हुए, केवल उन्हीं वस्तुओं का उपयोग करने की अनुमति दी जाएगी, जो उसे नियमों के तहत रखने की अनुमति है। इस नियम के अनुसार या अधीक्षक की लिखित मंजूरी के अलावा, जेल में किसी भी वस्तु या नकदी को लाना निषिद्ध है और जेल अधिनियम 1894 की धारा 42 के अधीन अपराध घोषित किया गया है। ( सन 1894 का अधिनियम संख्या 9)

RULE 702

If the Superintendent has any doubt whether any particular book is prescribed or not, he shall refer the matter to the District Magistrate. The covers and the binding, etc, of the books and periodicals received from outside be carefully examined to see that they do not contain any prohibited articles.

यदि अधीक्षक को कोई संदेह है कि कोई विशेष पुस्तक विहित है या नहीं, तो वह मामले को जिला मजिस्ट्रेट को सन्दर्भित करेगा। बाहर से प्राप्त पुस्तकों और पत्रिकाओं के कवर और बाइंडिंग आदि की सावधानीपूर्वक जांच की जानी चाहिए कि उनमें कोई प्रतिबंधित वस्तु तो नहीं है।

RULE 1044 Detection and prevention of entry of prohibited articles

All jail officers shall keep a careful watch in order to detect and prevent any person from securing or hiding prohibited articles for any prisoner and shall immediately report any such occurrence. They shall immediately apprehend any suspicious person found loitering and bring him before the Superintendent or the Jailor.

निषिद्ध वस्तुओं की संसूचना और जेल में प्रवेश पर रोक

किसी व्यक्ति को किसी बंदी के लिए निषिद्ध वस्तुएं रखने और छिपाने से रोकने के लिए सभी जेल अधिकारी एक सतर्क दृष्टि रखेगें और ऐसी किसी घटना को तुरन्त रिपोर्ट करेंगे। वे किसी भी संदेहजनक व्यक्ति को तुरन्त गिरफ्तार करेंगे और उसे जेलर या अधीक्षक के समक्ष लायेगें।

RULE 1052 Prohibited articles

The State Government under clause (13) of section 59 read with clause (9) of section 3, of the Prisons Act 1894 (Act no. 9 of 1894) declares the articles specified below as prohibited articles, and whoever contrary to any rule introduces or removes, or attempts to introduce or remove, any such article into or from any prison, or supplies or attempts to supply any such article to any prisoner outside the boundary of a prison is liable to be punished under section 42 of the said Act. All jail officers shall make every effort to prevent the introduction, removal or supply of such articles, as are listed below:-

(a) spirituous or fermented liquors of any kind;

(b) opium, preparations of opium or intoxicating drugs;

(d) all explosive or poisonous articles or materials for making fire or materials which would cause disfiguration;

(e) bullion, metal, money, currency notes, valuable securities, jewellery or ornaments of any kind and articles of value of every description;

(f) printed or written matter, letters and materials and appliances of whatever description for printing or writing other than permitted by the Superintendent.

(g) except for those permitted for use in prison routine and discipline, knives, arms, ropes, string, bamboos, ladders, sticks, all materials of whatever description which are capable of being converted into string or rope or chain, any article likely to facilitate escape or implements of any kind:

Provided that the restrictions about carrying arms inside the jail shall not apply in the case of shadows accompanying Minister, Ministers of State and S.P.G. Protectee persons at the time of their inspection of jails.

(h) any wireless or electronic means of communications like mobile phones, pagers, internet, etc and any photographic or recording equipment, except those permitted for the official use by the Superintendent;

(i) Obtaining or possessing or attempting to obtain or possess such article / equipment by use of which an injury may be caused to a prisoner, jail employee or any other person;

(J) any other article not expressly provided by the State Government for the health, discipline, clothing, dieting and use of prisoners or not allowed for the use of prison officers or of persons other than prisoners or prison officers employed in connection with a prison.

प्रतिषिद्ध वस्तुएं

कारागार अधिनियम 1894 (1894 या अधिनियम संख्या-नौ) की धारा, 59 के उपवाक्य (13) और धारा, 03 के उपवाक्य(9) के अधीन राज्य सरकार नीचे विशेषीकृत वस्तुओं को प्रतिषिद्ध वस्तुएं घोषित करती है और जो कोई भी इस नियम के विरूद्ध ऐसी वस्तुओं को जेल में ले जाता है या जेल से ले जाता है या ऐसी वस्तुओं की आपूर्ति जेल की सीमाओं के बाहर किसी बंदी को करता है तो वह अधिनियम की धारा 42 के अधीन दण्ड का भागी होगा। सभी जेल अधिकारी ऐसी किसी वस्तु, जो निम्नवत्‌ हैं, के प्रवेश, निकासी या आपूर्ति को रोकने के सभी प्रयास करेंगेः-

(क) किसी भी प्रकार का मादक या खमीर चढ़ा आसव;

(ख) अफीम, अफीम की तैयारियां या नशीली औषधियां;

(ग) धूम्रपान के उपकरण जैसे चिलम आदि;

(घ) सभी प्रकार के विस्फोटक या जहरीली वस्तुएं या ज्वलनशील वस्तुएं या विरूपता पैदा करने वाली वस्तुएं;

(ङ) बहुमूल्य धातुएं, धन, करेंसी नोट, मूल्यवान प्रतिभूतियां, किसी प्रकार के गहने और आभूषण तथा किसी भी प्रकार की मूल्यवान वस्तुएं;

(च) अधीक्षक द्वारा दी गयी अनुमति के अतिरिक्त छपी या लिखी हुई वस्तुएं, पत्र और लिखने और छापने का कोई भी उपकरण;

(छ) जेल के अनुशासन और रूटीन में प्रयोग की अनुमति को छोड़कर चाकू, हथियार, रस्सी, डोरी, बॉस, सीढ़ी, छड़ी और सभी प्रकार की अन्य वस्तुएं जो रस्सी, डोरी या जंजीर में बदली जा सकती हैं और पलायन या किसी भी प्रकार के उपकरण बनाने में सहायक हो सकती हैं;

परन्तु यह कि जेल में हथियारों के प्रवेश पर प्रतिबन्ध, मंत्रियों, राज्य मंत्रियों, एस0पी0जी0 के सुरक्षा घेरे वाले व्यक्ति के साथ जेल के निरीक्षण पर आने वाले शैडो के मामलों में लागू नहीं होगा;

(ज) कोई वायरलेस या संवाद की कोई इलेक्ट्रानिक युक्ति जैसे-मोबाइल फोन, पेजर, इण्टरनेट आदि तथा फोटोग्राफिक और रिकार्डिंग उपकरण उन्हें छोड़कर जिनके आधिकारिक उपयोग की अधीक्षक द्वारा अनुमति प्राप्त हो;

(झ) ऐसी वस्तुओं/औजारों को प्राप्त करना या रखना अथवा प्राप्त करने या रखने का प्रयास करना जिनका प्रयोग कैदियों, जेल अधिकारियों या अन्य व्यक्तियों को चोट पहुॅचाने में हो सकता है;

(ञ) कोई अन्य वस्तुएं जो स्पष्ट रूप से राज्य सरकार द्वारा कैदियों के प्रयोग, स्वास्थ्य, अनुशासन, कपड़े और भोजन के लिए उपलब्ध न करायी गयी हों अथवा ऐसी वस्तुएं जिनके प्रयोग की जेल अधिकारियों या बंदियों के अलावा अन्य व्यक्तियों या कारागार के सम्बन्ध में कार्यरत जेल आधिकारियों को अनुमति न हो।

Disposal

RULE 50 Confiscation of money and prohibited articles in a convict’s possession

सिद्धदोष के पास पाये गये धन और निषिद्ध वस्तुओं की जब्ती

(i) Any money or other prohibited article as specified in paragraph 1052 found in a prisoner’s possession after admission to the jail shall be confiscated and the money so confiscated as well as the money that may be realized from the sale of any articles so confiscated shall be credited in full to the State head”0056”.

जेल में प्रवेश के पश्चात किसी बंदी के पास पाया गया धन और अन्य निषिद्ध वस्तुयें, जैसा प्रस्तर 1052 में निर्दिष्ट हैं, जब्त कर ली जायेगी और इस प्रकार जब्त किया गया धन और इस प्रकार जब्त की गयी वस्तुओं की बिक्री से प्राप्त पूर्ण धनराशि राज्य शीर्ष क ''0056'' में जमा कर दी जायेगी।

(ii) The Superintendent may award any sum, not exceeding an amount equal to one-third of the value, of the cash or the money realized from the sale of the property, to any person concerned in the finding or the discovery of such cash or property. The amount required for making such payment shall be debited to the budget of “2056-Jails-101-jail” under the head "05-other Allowances”.

अधीक्षक, ऐसी नकदी या सम्पत्ति को खोजने या ढूढने में सम्बद्ध किसी व्यक्ति को, ऐसी धनराशि जो नकदी या सम्पत्ति की बिक्री से प्राप्त धनराशि के एक तिहाई से अनधिक हो, इनाम में दे सकता है। ऐसा भुगतान करने के लिये अपेक्षित धनराशि को ''2056-जेल-101-जेल'' के बजट के अन्तर्गत शीर्ष क ''05-अन्य भत्ते'' के नाम डाला जायेगा।

RULE 51 Disposal of prohibited articles and articles which cannot be stored

The Superintendent shall cause all prohibited articles, such as poisonous or intoxicating substances, etc., found on a prisoner after admission to be destroyed. Articles of a perishable nature such as flour, etc. or articles of a bulky nature such as charpoys, etc. shall not be stored but shall unless they are, with the consent of the prisoner, made over to a relative or friend, be sold and the proceeds placed at the credit of the prisoner.

निषिद्ध वस्तुओं और भण्डार न की जा सकने वाली वस्तुओं का निस्तारण

अधीक्षक किसी बंदी के पास प्रवेश के बाद पाये गये सभी निषिद्ध वस्तुओं जैसे विषैले या मादक पदार्थों आदि को नष्ट करवायेगा। नश्य प्रकृति की वस्तुयें जैसे आटा आदि अथवा भारी प्रकृति की जैसे चारपाई आदि को भण्डार में नहीं रखा जायेगा परन्तु जब तक कि उन्हें किसी नातेदार या मित्र को बंदी की सहमति से न दे दिया जाय, इन वस्तुओं को बेच दिया जायेगा और प्राप्त आय को बंदी के नामे डाल दिया जायेगा।

(पुराना प्रस्तर ) जेल मैनुअल पैरा 1117—निषिद्ध चीजें { उत्तर प्रदेश जेल नियम – संग्रह (प्रथम संशोधन) नियमावाली, 2002}–

राज्य सरकार ने कारागार अधिनियम, 1894 (अधिनियम संख्या 9 सन 1894) की धारा 3 के खण्ड (9) के साथ पढ़ी जाने वाली धारा 59 खण्ड(3) के अधीन निषिद्ध चीजों के लिये विशिष्ट चीजें घोषित किया है और जो कोई भी इन नियमों के विरूद्ध ऐसी चीजें कारागार की सीमा के बाहर प्रस्तुत करेगा या हटायेगा इस अधिनियम की धारा 42 ले अधीन दण्डित किया जायेगा | सभी जेल अधिकारी ऐसी चीजों का प्रस्तुत किया जाना, हटाया जाना या पूर्ति किया जाना रोकेगें --

(1) किसी प्रकार की स्प्रिट युक्त या खमीर चढ़ा आसव;

(2) अफीम, अफीम से तैयार वस्तु या नशीली दवाएं;

(3) धूम्रपान के उपकरण जैसे पाइप, चिलम आदि;

(4) सभी विस्फोटक या जहरीली चीजें या आग बनाने वाले तत्व या विरूपिता की चीजें;

(5) सोना, चांदी, धातु, धन, मुद्राएँ, नोट, मूल्यवान प्रतिभूति, ज्वेलरी अन्य प्रकार के गहने और किसी प्रकार की मूल्यवान चीजें;

(6) किताबें, प्रिंटेड या लिखित पदार्थ, किसी भी प्रकार के लिखने या छपाई के अक्षर और पदार्थ और साधन;

(7) चाकू, हथियार, रोप्स, स्ट्रिंग, बांस, लैडर, स्टिक्स और किसी भी प्रकार की चीजें जो स्ट्रिंग या रोप में या चेन में परिवर्तित की जा सकें या किसी प्रकार के औजार जो निकल भागने में सहायक हो, यह कि जेल के निरिक्षण के समय जेल के भीतर हथियारों के ले जाने के बारे में रोक, मंत्री, राज्य के मंत्रियों, उप मंत्रियों, पार्लियामेंट के सचिवों के साथ जा रहे अंगरक्षकों के मामले में लागू नहीं होगा;

(8) (क) ऐसी वस्तुओं/उपस्करों को, जिनके प्रयोग से किसी कैदी, जेल कर्मचारी या किसी अन्य व्यक्ति को क्षति हो सकती हो, प्राप्त करना या रखना या प्राप्त करने या रखने का प्रयास करना;

(ख) कोई अन्य चीजें जो राज्य सरकार द्वारा अभिव्यक्त रूप से कैदियों के स्वास्थ्य, अनुशासन, कपड़ों, भोजन और प्रयोग के लिये उपबंधित नहीं है अथवा जेल अधिकारियों या कारागार के संपृक्त कैदियों या जेल के अधिकारियों से भिन्न जेल में नियोजित व्यक्तियों के लिये अनुज्ञात नहीं है |
