RULE 31 Method of calculating date of release

The Superintendent shall be guided by the following rules in calculating the date of release of convicts :-

(a) the day on which the sentence was passed and the day of release shall count as days of imprisonment;

(b) the term “month” or “year” means a month or a year according to the Gregorian calendar;

(c) when a sentence includes a fraction of a month, the month shall be reckoned to consist of 30 days;

(d) when a convict, who was released on bail pending appeal or had escaped, is re-admitted or re-captured, the day on which he was released or had escaped and the day on which he was re-admitted or re-captured shall both be counted as days of imprisonment ;

(e) when a convict has been committed to jail under two or more separate warrants and the first sentence is set aside on appeal or revision, the second sentence shall take effect from the date on which it was passed ;

(f) if a sentence of death is commuted to imprisonment, the sentence of imprisonment shall be deemed to commence from the date on which the sentence of death was passed.


Note:

The period of detention undergone by the accused shall be set off against the sentence of imprisonment as provided under section 428 of the Code of Criminal Procedure Code, 1973, which reads as follows :-

“section 428: Period of detention undergone by the accused to be set off against the sentence of imprisonment: Where an accused person has on conviction been sentenced to imprisonment for a term [not being imprisonment in default of payment of fine] the period of detention if any undergone by him during the investigation, inquiry or trial of the same case before the date of such conviction shall be set off against the term of imprisonment imposed on him on such conviction and the liability of such person to undergo imprisonment on such conviction shall be restricted to the remainder if any, of the term imprisonment imposed on him:


Provided that in cases referred to in section 433 A, such period of detention shall be set of against the period of fourteen years referred to in that section.’’

lIlustration (1): Convict sentenced to one day’s imprisonment must be released on the same day.

IlIustration (2): Convict sentenced to one year’s imprisonment on the15th January 2011, shall be released on the 14th January 2012


.A convict sentenced on the 1st January to one month’s imprisonment shall be released on the 31st of the same month.

IlIustration (3): A, B and C are sentenced respectively to one month’s imprisonment on the 29th, 30th and 31st January, all the sentences expire on the morning of the last day of February.

IlIustration (4): Convict is sentenced to one and half months imprisonment on the 2nd February. The date of his release will be the16th March.

IlIustration (5): D is an accused lodged in jail in more than one case at the same time. The period undergone in each case, from the date of issue of warrant of custody, shall be set off against the term of imprisonment imposed in the respective case under section 428 of the Code of Criminal Procedure. 1973.



मुक्ति के दिनांक की संगणना की रीति

अधीक्षक सिद्धदोषियों की मुक्ति के दिनांक की संगणना में निम्नलिखित नियमों द्वारा मार्गदर्शित होगाः-

(क) दण्डपारित किये जाने का दिन और मुक्त किये जाने का दिन कारावास के दिनों के रूप में जोड़े जायेंगे;

(ख) शब्द 'माह' या 'वर्ष' का तात्पर्य ग्रेगोरियन कैलेण्डर के अनुसार माह या वर्ष से है;

(ग) जब किसी दण्ड में माह का भाग सम्मिलित हो तो माह को 30 दिनों का माना जायेगा;

(घ) जब कोई सिद्धदोष, जो अपील के लम्बित रहने के कारण जमानत पर छोड़ा गया हो या भाग गया हो, को पुनः प्रवेश दिया जाता है या पुनः पकड़ा जाता है तो वह दिन जब उसे छोड़ा गया था या जब वह भाग गया था और वह दिन जब उसे पुनः प्रवेश दिया गया हो या पुनः पकड़ा गया हो; दोनों को ही कारावास के दिन के रूप में गिना जायेगा;

(ङ) जब किसी सिद्धदोष को दो या अधिक वारण्ट के अन्तर्गत जेल भेजा गया हो और प्रथम दण्ड को अपील या पुनरीक्षण में रद्‌द कर दिया जाय तो दूसरा दण्ड उस दिनांक से प्रभावी होगा जिस दिनांक को इसे पारित किया गया हो;

(च) यदि किसी मृत्यु दण्ड को कारावास में बदल दिया जाता है तो कारावास का दण्ड उस दिनांक से प्रारम्भ माना जायेगा जिस दिनांक को मृत्यु दण्ड पारित किया गया हो।

टिप्पणी :

अभियुक्त द्वारा भोगी गयी निरोध की अवधि को कारावास के दण्ड से कम कर दिया जायेगा जैसा कि दण्ड प्रक्रिया संहिता 1973 की धारा 428 में उपबंधित है जो निम्नवत हैः-

'धारा 428:-आरोपी द्वारा भोगी गयी निरोध की अवधि को कारावास के दण्ड से कम करनाः जहां किसी आरोपी व्यक्ति को दोषसिद्ध होने पर एक अवधि के कारावास से दण्डित किया गया हो (जुर्माने का भुगतान न करने पर कारावास के सिवाय हो) तो उसी मामले की परीक्षा, जांच और सुनवाई के दौरान और इस तरह के दण्ड के दिनांक से पहले की निरोध अवधि, यदि उसके द्वारा भोगी गयी हो को ऐसे दोष पर दिये गये कारावास के दण्ड से कम कर दिया जायेगा और ऐसे व्यक्ति पर ऐसे दोष पर उस पर अधिरोपि कारावास की अवधि, उसकी शेष अवधि, यदि कोई हो, तक सीमित रहेगीः

परन्तु यह कि धारा 433-क में निर्दिष्ट मामलों में ऐसे निरोध की अवधि को उसी धारा में निर्दिष्ट चौदह वर्ष की अवधि के सापेक्ष कम कर दिया जायेगा।''

दृष्टांत-(1) एक दिन के कारावास से दण्डित सिद्धदोष को उसी दिन मुक्त करना आवश्यक है।

दृष्टांत-(2) 15 जनवरी, 2011 को एक वर्ष के कारावास से दण्डित सिद्धदोष को 14 जनवरी, 2012 को मुक्त किया जायेगा।

01 जनवरी को एक माह के कारावास से दण्डित सिद्धदोष को उसी माह की 31 तारीख को मुक्त किया जायेगा।

दृष्टांत-(3) क, ख और ग को क्रमशः 29, 30 और 31 जनवरी को एक माह के कारावास से दण्डित किया गया। सभी दण्ड फरवरी के अन्तिम दिन प्रातः को समाप्त होंगे।

दृष्टांत-(4) किसी सिद्धदोष को 02 फरवरी को डेढ़ माह के कारावास से दण्डित किया जाता है। उसकी मुक्ति का दिनांक 16 मार्च होगा।

दृष्टांत-(5) 'घ' एक ही समय पर एक से अधिक मामलों में बंद एक अभियुक्त है। हिरासत का वारण्ट जारी होने के दिनांक से प्रत्येक मामले में भोगी गयी अवधि दण्ड प्रक्रिया संहिता, 1973 की धारा 428 के अधीन सम्बन्धित मामले में दिये गये कारावास की अवधि के विरुद्ध कम कर दी जायेगी।

RULE 32 Date of release when two or more sentences run consecutively

When a convict is sentenced to two or more terms of imprisonment to be served consecutively, the date of release shall be calculated as if the sum of the terms was awarded in one sentence.

IlIustration (1): Convict is sentenced on the 21st November, 2010 to two substantive terms of imprisonment for one year each, should be released on the 20th and not the 19th November, 2012.

IlIustration (2): Convict is sentenced on the 1st January to two months’ imprisonment and a fine of Rs. 200/- or in default to one month’s further imprisonment. If the fine is not paid, he should be released on 31st March, but if the fine is paid, the date of release would be the last day of February.



मुक्ति का दिनांक जब दो या अधिक दण्ड क्रमशः चलते हैं

जब किसी सिद्धदोष को क्रमशः भुगतने के लिये दो या अधिक अवधियों के कारावास से दण्डित किया गया हो तो मुक्ति के दिनांक की गणना इस प्रकार की जायेगी मानो कारावास की कुल अवधि एक ही दण्ड में दी गयी हो।

दृष्टांत-(1) सिद्धदोष जिसे 21 नवम्बर, 2010 को एक-एक वर्ष के दो मौलिक अवधियों के कारावास से दण्डित किया गया हो तो उसे 20 नवम्बर, 2012 को मुक्त किया जाना चाहिए और 19 नवम्बर, 2012 को नहीं।

दृष्टांत-(2) सिद्धदोष को एक जनवरी को दो माह के कारावास और 200 रूपये के जुर्माने से या चूक करने पर एक माह के अग्रतर कारावास से दण्डित किया जाता है। यदि जुर्माना जमा नहीं किया जाता है तो उसे 31 मार्च को मुक्त किया जाना चाहिए किन्तु यदि जुर्माना जमा किया जाता है तो मुक्ति का दिनांक फरवरी का अन्तिम दिनांक होगा।

RULE 33 Period on bail not to count towards sentence

The period during which a convict has been out of jail on bail pending appeal or revision, shall not count as sentence served. This also applies to the convicts committed to or detained in prison under the terms of an order passed under section 122 of the Code of Criminal Procedure, 1973, and the convicts who have been released from jail on bail pending appeal or revision and surrender after the dismissal of such appeal or revision.



जमानत की अवधि को दण्ड के लिए न गिना जाना

ऐसी अवधि को, जिसमें सिद्धदोष अपील या पुनरीक्षण के लम्बित रहने के कारण जमानत पर जेल से बाहर रहा हो, भोगे गये दण्ड के रूप में नहीं गिना जायेगा। यह उन सिद्धदोषियों पर भी लागू होता है जो दण्ड प्रक्रिया संहिता, 1973 की धारा 122 के अधीन पारित आदेश की शर्तों के अधीन कारागार को सुपुर्द या उसमें निरुद्ध किये गये हों तथा जो अपील या पुनरीक्षण के लम्बित रहने के दौरान जमानत पर जेल से मुक्त कर दिये गये हों और ऐसी अपील या पुनरीक्षण के खारिज होने के पश्चात उन्होंने समर्पण किये हो।

RULE 34 Period on bail under section 106 or 117 of Code of Criminal Procedure,1973 to count towards sentence

The period spent out of jail, by a convict ordered to give security under sections 106 or 117 of the Code of Criminal Procedure, 1973, on giving such security shall be counted towards the period of his bond. If his security is subsequently cancelled and he is committed to prison, he shall undergo imprisonment only for the remaining period of his bond.



दण्ड प्रक्रिया संहिता, 1973 की धारा 106 या 117 के अधीन जमानत की अवधि को दण्ड के लिए गिनना

दण्ड प्रक्रिया संहिता, 1973 की धारा 106 या 117 के अधीन प्रत्याभूति देने के लिए आदेशित बंदी द्वारा जेल से बाहर बितायी गयी अवधि, ऐसी प्रत्याभूति देने पर,उसके बाण्ड की अवधि में गिनी जायेगी। यदि कालान्तर में उसकी प्रत्याभूति निरस्त कर दी जाती है और जेल के सुपुर्द कर दिया जाता है तो वह अपने बाण्ड की अवशेष अवधि तक के लिए ही कारावास भुगतेगा।

RULE 35 Period spent in hospital to count towards sentence

The period spent by a prisoner in a hospital, including mental hospital, shall count towards period as spent in prison.



अस्पताल में बितायी गयी अवधि को दण्ड में गिनना

किसी बंदी द्वारा अस्पताल में बितायी गयी अवधि, मानसिक अस्पताल सहित, जेल में बितायी गयी अवधि में गिनी जायेगी।

CIVIL PRISONER

RULE 453 Rules for fixing dates of release-

When a civil prisoner is admitted to the jail in execution of a decree and his subsistence allowance is payable by the decree-holder, two dates of release shall be fixed and recorded on his warrant and in the release register according to the following rules :-

1-The date of expiry of the period of detention.

This shall be fixed in accordance with instructions contained in paragraph 32. If the prisoner has not been released earlier he shall be released on the date on which the period of detention ordered by the court expires.

2- The date of release according to the date up to which the subsistence allowance has been paid.

This shall be altered from time to time and the prisoner shall be released on the morning following the last day for which subsistence allowance has been paid.


रिहाई का दिनांक नियत करने का नियम

जब कोई सिविल बंदी किसी डिक्री के निष्पादन में जेल जेल में निरूद्ध होता है और निर्वाह भत्ता डिक्री धारक द्वारा दिया जाता है, तो उसकी रिहाई का दोदिनांक नियत किया जायेगा और उसके वारण्ट और रिहाई रजिस्टर में निम्नलिखित नियमों केअनुसार अभिलिखित किया जायेगाः-

1 - निरूद्धि की अवधि की समाप्ति का दिनांक। यह प्रस्तर-32 में निहित निर्देशों के अनुसार निर्धारित किया जाएगा। यदि बंदी को पहले रिहा नहीं किया जाता है, तो उसे न्यायालय द्वारा आदेशित निरूद्धि की अवधि की समाप्ति पर रिहा किया जायेगा।

2- रिहाई का दिनांक वह होगा जिस दिनांक तक के निर्वाह भत्ता का भुगतान कर दिया गया हो। यह समय-समय पर परिवर्तित भी किया जा सकता और जिस दिन तक के सिविल बंदी द्वारा निर्वाह भत्ते का भुगतान पूरा कर दिया गया हो, उसके अगले दिन सुबह उसे रिहा कर दिया जायेगा।


RULE 454 When a civil prisoner is to be released

The Superintendent shall release a civil prisoner –

(a) on the amount mentioned in the warrant for his detention being paid by the prisoner to the Superintendent

(b)  on the omission by the person, on whose application the prisoner has been detained, to pay the subsistence allowance ;

(c)  on receipt of an order of release from the court ;

(d)  on the expiry of the term of the sentence prescribed in the warrant.


सिविल बंदी को रिहा किया जाना

अधीक्षक किसी सिविल बंदी को रिहा करेगा -

(क) जब बंदी द्वारा उसके निरूद्धि के वारण्ट में उल्लिखित राशि का भुगतान अधीक्षक को कर दिया गया हो।

(ख) उस व्यक्ति द्वारा निर्वाह भत्ता का भुगतान करने में चूक किये जाने पर, जिसके आवेदन पर बंदी निरूद्ध किया गया हो।

(ग) अदालत से रिहाई के आदेश की प्राप्ति पर।

(घ) वारण्ट में विहित कारावास की अवधि की समाप्ति पर।

Release Orders

RULE 92 Release orders to be duly authenticated

The Superintendent shall not release any prisoner on the authority of any informal document. Release order duly signed by the Presiding Officer of the Court and impressed with the Court’s seal shall alone be acted upon. Such orders shall contain full particulars with regard to the prisoner to be released and shall be sent by courts as far as possible, through Court peons after having been duly entered in the dak-book.


All orders of release before being acted upon should be carefully scrutinized by the Jailor and the officer in-charge, in order to see that the seal of the Court and the signature of the Presiding Officer are genuine and there is no discrepancy between particulars entered in the custody warrant and the release order. In case of doubt a reference should be made to the Court concerned before the order is carried out.



मुक्ति आदेश का अधि प्रमाणित करना

अधीक्षक किसी बंदी को किसी प्राधिकारी के अनौपचारिक दस्तावेज पर मुक्त नहीं करेगा। न्यायालय के पीठासीन अधिकारी द्वारा सम्य्‌क हस्ताक्षरित और न्यायालय की मुहर लगे मुक्ति आदेश पर ही केवल कार्यवाही की जायेगी। ऐसे आदेशों में मुक्त किये जाने वाले बंदियों के सम्बन्ध में पूर्ण विवरण दिया जायेगा और न्यायालयों द्वारा यथा संभव न्यायालय के अनुसेवक के माध्यम से डाक पुस्तिका में सम्य्‌क रूप से अंकित करने भेजा जायेगा।

मुक्ति के सभी आदेश को कार्यवाही करने के पूर्व जेलर और प्रभारी अधिकारी द्वारा यह देखने के लिए सावधानी पूर्वक संवीक्षा की जायेगी कि न्यायालय की मुहर और पीठासीन अधिकारी के हस्ताक्षर वास्तविक है और अभिरक्षा वारण्ट तथा मुक्ति आदेश में अंकित विवरणों में कोई अंतर तो नहीं है। संदेह होने पर आदेश का अनुपालन के पूर्व सम्बन्धित न्यायालय को निर्दिष्ट कर देना चाहिए।



RULE 92-A All orders of Hon'ble Supreme Court and documents received through FASTER SYSTEM

All orders of Hon'ble Supreme Court and documents received through FASTER SYSTEM shall be deemed as e-authenticated and complied with.


मा0 उच्चतम न्यायालय के समस्त आदेश और 'फास्टर सिस्टम' के माध्यम से प्राप्त दस्तावेज

मा0 उच्चतम न्यायालय के समस्त आदेश और 'फास्टर सिस्टम' के माध्यम से प्राप्त दस्तावेज, अधिप्रमाणित किये गये समझे जायेंगे और उनका अनुपालन किया गया समझा जायेगा।



RULE 93 Order by Radiogram

The Superintendent shall not release any prisoner on the authority of a radiogram alone, such orders should be confirmed by post or vice-versa.


रडियोग्राम द्वारा आदेश

अधीक्षक केवल रेडियोग्राम के प्राधिकार पर ही किसी बंदी को मुक्त नहीं करेगा ऐसे आदेशों की पुष्टि डाक द्वारा या एक दूसरे के बदले की जानी चाहिए।


RULE 96 Responsibility for the correct release of prisoners

The Superintendent, the Jailor and the concerned officer in-charge shall be responsible for the correct release of prisoners.


बंदी की सही मुक्ति का उत्तरदायित्व

अधीक्षक, जेलर और सम्बन्धित प्रभारी अधिकारी बंदियों की सही मुक्ति के लिए उत्तरदायी होंगे।


RULE 97 Steps to be taken by the Jailor before a convict is released

Before a convict is released from jail, the Jailor shall-

(a) check the conditions of sentence given in the warrant and registers and satisfy himself of the title ofthe prisoner to release;

(b) compare the marks of identification as given on the warrant and in the jail registers with the convict and match his photograph, biometric data etc. if any, thumb-impression, his signature and compare these with those taken on the day of his admission so as to ensure beyond all doubt the convict’s identity;

(c) produce the convict with his clothing and other property, history ticket, warrant and the jail registers of admission and release before the Superintendent.

(d) ensure that the warrants and release orders issued have been complied with the High Court’s circular letter no. 123/VIIh- 16 dated 25.09.1975 and circular no. 114/VIIb-47 Admn.(G) dated 07.10.1979.


Note:-

(i)Allahabad High Court C.L. No. 123/VIIh-16 dated 25th September, 1975:

The Court has noticed that generally the Judicial Magistrates do not take proper care in issuing warrants, while remanding a person to jail custody, with the result that sometimes persons are ordered to be released because of defective warrants, which either do not bear the seal of the Court or are not on proper form or do not even contain full particulars. With a view to avoid such occasions, it is necessary that the Judicial Magistrates should take proper care in issuing warrants while remanding a person to jail custody. It is also impressed upon them that all provisions of law in this respect should also be observed strictly.

(ii) Allahabad High Court C.L. No. 114/VIIb-47 Admn.(G) dated 7th October, 1979:

The Court has noticed that very often warrants of intermediate custody and release orders sent by the subordinate, courts do not contain all the necessary details.

They generally do not contain case number, name of Police Station, father‘s name, age and residential address of the prisoner. They also do not contain description of offences, crime number and section of Indian Penal Code and other Acts and the date of conviction.

All the Presiding Officers are directed to clearly fill in all the aforesaid details in the warrants of intermediate custody and release orders issued by them.


किसी सिद्धदोषी को मुक्त करने से पूर्व जेलर द्वारा की जाने वाली कार्यवाही

किसी सिद्धदोषी को जेल से मुक्त करने से पूर्व जेलरः-

(क) वारण्ट और रजिस्टर में दी गयी दण्ड की द्यार्तो की जांच करेगा और मुक्ति किये जाने के बंदी के हक के प्रति अपना समाधान करेगा।

(ख) वारण्ट और जेल के रजिस्टर में दिये गये पहचान चिन्हों का सिद्धदोष के चिन्हों से मिलान करेगा और उसकी फोटो बायोमेट्रिक डाटा आदि, यदि कोई हो अंगूठे के निशान तथा उसके हस्ताक्षर का मिलान करेगा और उसके प्रत्येक दिन लिये गये निशानों से मिलान करेगा जिससे सिद्धदोष की पहचान बिना किसी संदेह के निश्चित हो सके।

(ग) सिद्धदोषी को उसके वस्त्रों और अन्य सम्पत्ति, इतिवृत्तक, वारण्ट और प्रवेश तथा मुक्ति के जेलर रजिस्टर के साथ अधीक्षक के समक्ष प्रस्तुत करेगा।

(घ) यह सुनिश्चित करेगा कि जारी किये गये वारण्ट और मुक्ति के आदेश उच्च न्यायालय के परिपत्र संख्या'123/सात-एच-16, दिनांक-25.09.1975 के अनुपालन में है।


टिप्पणी :-

इलाहाबाद उच्च न्यायालय सी एल संख्या-123/सात-एच-16, दिनांक-25 सितम्बर, 1975 :

न्यायालय ने टिप्पणी की है कि आमतौर पर न्यायिक मजिस्ट्रेट किसी व्यक्ति को जेल की अभिरक्षा में वापस करते समय वारण्ट जारी करने में उचित ध्यान नहीं रखते और इसके परिणामस्वारूप दोषपूर्ण वारण्ट जिस पर या तो न्यायालय की मुहर नहीं होती है या उचित फार्म पर नहीं होता है या उससे पूरा आदेश ही नहीं होता है, होने के कारण व्यक्तियों को मुक्त करने के आदेश दे दिये जाते हैं। ऐसे अवसरों से बचने के लिए आवश्यक है कि जेल की अभिरक्षा में जाते समय वारण्ट जारी करने में न्यायिक मजिस्ट्रेट को समुचित ध्याना देना चाहिए। उनके मस्तिヤक में यह बात भलीभांति होनी चाहिए कि इस सम्बन्ध में कानून से सभी उपबंधों का भी अनुपालन सखती से किया जाना चाहिए।

(दो) इलाहाबाद उच्च न्यायालय सी0एल0 संख्या-114/सात बी-47-प्रशा0(जी), दिनांक-7.10.1979 :-

न्यायालय ने टिप्पणी की है कि बहुधा अधीनस्थ न्यायालयों द्वारा भेजे गये मध्यांतरिक अभिरक्षा के वारण्ट और मुक्ति के आदेश में आवश्यक सभी जानकारियों नहीं दी जाती है।

उनमें आमतौर पर वाद संख्या, पुलिस थाना का नाम, पिता का नाम, आयु और बंदी का निवास का पता नहीं होता है। उनमें अपराधियों का विवरण अपराध संख्या, भारतीय दण्ड संहिता और अन्य अधिनियमों की धारायें भी नहीं दी गयी होती है।

सभी पीठासीन अधिकारियों को निर्देशित किया जाता है कि उनके द्वारा जारी किये जाने वाले मध्यांतरिक अभिरक्षा के वारण्ट और मुक्ति के आदेश में सभी पूर्वोक्त विवरण स्पष्टतः भरे जांय।

HIGH COURT'S CIRCULAR LETTERS

C.L. No. 42/VIIb-47 , dated 28th April, 1978

All the presiding officers should put their signatures on the release or remand orders quite legibly as required under rules 9 and 66 of the G.R.(Criminal). A rubber seal indicating the name and designation of the presiding officer and also the name of the district should invariably be affixed to such orders below their signatures and they should ensure that the remand or release orders are dispatched punctually so as to reach the jail authority latest by 4.00 P.M. in winter and 5.00 P.M. in summer.

 C.L. No. 114/VIIb-47 Admn.(G) dated 7th October, 1978

The Court has noticed that very often warrants of intermediate custody and release orders sent by the subordinate, courts do not contain all the necessary details. They generally do not contain case number, name of Police Station, father‘s name, age and residential address of the prisoner. All the Presiding Officers are directed to clearly fill in all the aforesaid details in the warrants of intermediate custody and release orders issued by them.

C.L. No. 124/VIIb-47, dated 24th October, 1979

In order to rule out the possibility of a prisoner securing his release from jail on the basis of a forged release order, the Court has issued following instruction, which should be strictly and faithfully followed by the presiding officers and the officials concerned in issuing and scrutinizing release orders.

(a) The release orders must contain the full name of the Presiding officer of the issuing court below his signature and bear  the seal of the court invariably in a distinct manner;

(b) When an order for the release of a prisoner, who has already been transferred to another jail outside the district, is received and returned by the Superintendent of  Jail to the issuing court, with a report indicating the date of transfer and the name of the jail to which the prisoner was transferred, the court shall then send the release order by post to the jail concerned and at the same time follow the procedure laid down in para (c) below;

(c) When a release order is issued by post to a jail outside the district, the Presiding Officer of the court shall immediately give an intimation about its dispatch by radiogram to the Superintendent of that jail.

(d) In addition to supplying a list containing the names and specimen signatures of all Presiding Officers of courts to the Superintendent of local district jail (and also to any other jail or similar institution that functions in the district), changes in the post of Presiding Officer should also be intimated from time to time as they occur.

 

C.L. No. 73/VIII-47 , dated 18th November, 1982

To avoid release of convicts on forged bail orders more than ordinary care should henceforth be taken before convicts are released on the basis of orders which purport to have been passed by the Supreme Court of India. The concerned authority should also satisfy himself carefully whether the bail orders in fact have been passed by the Supreme Court and the convicts should be released upon such satisfaction. Convicts ought not to be released mechanically without a close scrutiny of the bail orders and satisfaction in regard to the authenticity thereof.

All the presiding officers should ensure that henceforth release orders are prepared by the court clerks only and not by the court moharrirs (police constables); and all the papers concerning any case, viz., F.I.R., remand papers, final reports, bail bonds, etc., are kept by the court clerk in his custody and not by the court moharrirs (police constables).

Detention of convicted prisoners on robkars in Jails.

I have been directed to inform you that no convicted person should be committed to Jail by the trial courts or Chief Judicial Magistrates/Judicial Magistrates for detention on the basis of robkars and they must be committed to Jail by the trial court in accordance with Section 418 Cr.P.C. and Rules 96 to 99 of General Rules (Criminal) to serve out the sentence alongwith conviction/sentence warrants prepared on the proforma attached herewith mentioning details of sentence awarded by the trial court or appellate court against him.

I am, therefore to request you kindly to bring the contents of this Circular Letter in the notice of all the Judicial Officers working under your administrative control to make strict compliance.

METHOD OF CALCULATING DATE OF RELEASE

Jail Manual PARA 31. Method of calculating date of release

The Superintendent shall be guided by the following rules in calculating the date of release of convicts-

(a)- the day on which the sentence was passed and the day of release shall count as days of imprisonment;

(b)- the term “month” or “year” means a month or year according to the British calendar;

(c)- when a sentence include a fraction of a month, the month shall be reckoned to consists of 30 days;

(d)- when a convict who was released on bail pending appeal or had escaped, is readmitted or recaptured, the day on which he was readmitted or recaptured shall both be counted as days of imprisonment;

(e)- when a convict, has been committed to jail under two or more separate warrants and the first sentence is set aside on appeal or revision, the second sentence shall take effect from the date on which it was passed;

(f)- if a sentence of death is commuted to one of transportation or imprisonment the sentence of transportation or imprisonment shall be deemed to commence from the date on which the sentence of death was passed;

(g)- if the sentence imposed by the court in lieu of whipping in the case of a convict sentenced to whipping only is one of imprisonment, the period spent by the accused in jail shall count towards the sentence of imprisonment .

Illustration 1- A convict, sentenced to one day’s imprisonment, must be released on the same day.

Illustration 2- A convict, sentenced to one year’s imprisonment on the 15th January, 1941, shall be released on the 14th January, 1942.

            A convict sentenced on the 1st January to one month’s imprisonment shall be released on the 31st of the same month.

Illustration 3- A, B, and C are sentenced, respectively, to one month’s imprisonment, on 29th, 30th, and 31st January. All sentences shall expire on the morning of the last day of February.

Illustration 4- A convict is sentenced to one and half months imprisonment on the 2nd February. The date of release will be the 16th march.   

Jail Manual PARA 32. Date of release when two or more sentences run consecutively

When a convict, is sentenced to two or more terms of imprisonment to be served consecutively, the date of release shall be calculated as if the sum of the terms was awarded in one sentence.

Illustration 1- A convict is sentenced on the 21st November, 1940 to two substantive terms of imprisonment for one year each, should be released on the 20th, and not on the 19th November, 1942.

Illustration 2- A convict is sentenced on the 1st January to two months imprisonment and a fine of Rs 20 or in default to one month’s further imprisonment. If the fine is not paid, he should be released on 31st March, but if the fine is paid, the date of release would be the last day of February.

Jail Manual PARA 33. Period on bail not to count towards sentence

The period during which a convict has been out of jail on bail pending appeal or revision, shall not count as sentence served. This applies also to convicts committed to or detained in prison under the terms of an order passed under section 123 of Code of Criminal Procedure 1898122 of Cr.P.C. 1973 .    

Jail Manual PARA 34. Period on bail under Section 106 or 118 Cr.P.C. to count towards sentence

The period spent out of jail by a convict ordered to give security under section 106 or 118 of the Code of Criminal Procedure 1898106 or 117 of the Cr.P.C. 1973 on giving such security counts towards the period of his bond.

If his security is subsequently cancelled and he is committed to prison, he shall undergo imprisonment only for the remaining period of his bond.

Jail Manual PARA 35. Period spent on parole or in hospital to count towards sentence

The period spent by a prisoner in a civil hospital shall count towards his sentence.

Jail Manual PARA 478.        Rules for fixing date of release of     CIVIL PRISONER

When a civil prisoner is admitted to the jail in execution of a decree and his subsistence allowance is payable by the decree holder, two dates of release shall be fixed and recorded on his warrant and in the release register according to the following rules –

(1)- The date of expiry of the period of detention

This shall be fixed in accordance with instructions contained in para 31. If the prisoner has not been released earlier he shall be released on the date on which the period of detention ordered by the court expires.

(2)- The date of releases according to the date up to which the subsistence allowance has been paid

This shall be altered from time to time and the prisoner shall be released on the morning following the last day for which subsistence allowance has been paid.

 Release Orders

Jail Manual PARA 99 - Release orders to be duly authenticated

The Superintendent shall not release any prisoner on the authority of any informal document. Release orders duly signed by the presiding officer of the court and impressed with the court’s seal alone be acted upon. Such orders shall contain full particulars in regard to the prisoner to be release and shall be sent by courts as far as possible, through court peons after having been duly entered in the dak-book. All orders of release before being acted upon should be carefully scrutinized by the jailor in order to see that seal of the court and the signature of the presiding officer are genuine. In case of doubt a reference should be made to the court concerned before the order is carried out.

Jail Manual PARA 100 -  Order by telegram

The Superintendent shall not release any prisoner on the authority of the telegram save in the case of telegram dispatched by the Home Secretary to the State Government or by the Registrar of the High Court. Such telegram should invariably be acknowledged by telegram. 

Jail Manual PARA 104 -

104.Step to be taken by the Jailor before a convict is release

Before a convict is release from jail the Jailor shall –

(a) check the conditions of sentence given in the warrant and registers and satisfy himself of the title of the prisoner to release;

(b) compare the marks of identification as given on the warrant and in the jail registers with the convict and take his thumb impression or at the discretion of the Superintendent, in the case of  a literate prisoner, his signature and compare it with that taken on the day of his admission to as to ensure beyond all doubt the convict’s identity; and

(c) produce the convict with his clothing and other property, history ticket, warrant and the jail register of admission and release before the Superintendent.
