Section 23 of Prisons Act 1894 Convict Officers.—

Prisoners who have been appointed as officers of prisons shall be deemed to be public servants within the meaning of the Indian Penal Code. (45 of 1860).

CHAPTER 11 CONVICT OFFICERS

RULE 191 Grades of convict officers

There shall be three grades of convict officers, viz., convict night watchman, convict overseer and convict warder.

बंदी अधिकारियों की श्रेणियॉ

बंदी अधिकारियों की तीन को श्रेणियॉ होंगी अर्थात बंदी रात्रि प्रहरी, बंदी ओवरसीयर और बन्दी वार्डर।

RULE 192 Maximum number of convict officers in a jail

The maximum number of convict officers in a jail shall not exceed ten per cent of the daily average population thereof. If for any reason a larger number of convict officers is required the special sanction of the Director General shall be necessary.

For the purpose of this rule, convict night watchmen employed during the day on ordinary jail labour are not to be classed as convict officers.

The number of convict warders for each jail shall be fixed by the range Deputy Inspector General.

किसी जेल में बंदी अधिकारियों की अधिकतम संख्या

किसी जेल में बंदी अधिकारियों की अधिकतम संख्या उसके दैनिक औसत जनसंख्या के दस प्रतिशत से अधिक नहीं होगी। यदि किसी कारणवश इससे अधिक संख्या में बंदी अधिकारियों की आवशश्यकता हो तो महानिदेशक कारागार की विशेष स्वीकृति लेनी आवशश्यक होगी।

इस नियम के प्रयोजनार्थ दिन के दौरान साधारण जेल श्रम के लिए लगाये गये बंदी रात्रि प्रहरी को बंदी अधिकारियों के रूप में नहीं माना जाता है।

प्रत्येक जेल के लिए बंदी वार्डरों की संख्या परिक्षेत्र के उप महानिरीक्षक द्वारा निर्धारित की जायेगी।

RULE 193 Convicts not eligible for appointment as convict officers

Convicts imprisoned under the Narcotic Drugs and Psychotropic Substances Act, 1985, (Act no. 61 of 1985) for escape under section 224, of the Indian Penal Code, 1860, attempt to escape, for offences under sections 231-263-A of the Indian Penal Code, 1860 (relating to coins or Government stamps), section 328 IPC (poisoning), 377 (unnatural offence), 463, 464, 466-477-A (forgery and false documents), 489-A, 489-B, 489-C and 489-I(counterfeiting currency notes and bank notes), of the Indian Penal Code, 1860 or under offences against State and convicts imprisoned under section 109 of the Code of Criminal Procedure, 1973, who are not police registered (C.R.) shall not be appointed convict officers. If a convict is also an undertrial in another case, he shall not be appointed as convict officer.

ऐसे सिद्धदोषियों जो बंदी अधिकारियों के रूप में नियुक्ति के लिए अर्ह नहीं है

ऐसे सिद्धदोषी जो स्वापक औषधि और मनः पदार्थ अधिनियम, 1985 (अधिनियम संख्या 61, सन्‌ 1985) जेल से भाग निकलने, भारतीय दण्ड संहिता, 1860 की धारा 224 के अधीन भाग निकलने का प्रयास करने के लिए भारतीय दण्ड संहिता 1860 की धारा 231, 263-क (सिक्कों या सरकार स्टाम्प से सम्बन्धित) अपराधों के लिए आईपीसी की धारा 328 (विष प्रयोग), 337 (अप्राकृतिक अपराध) 463, 464, 466, 477-क (जालसाजी और झूठे दस्तावेज), भारतीय दण्ड संहिता 1860 की धारा 489-क, 489-ख और 489-झ (जाली मुद्रानोट और बैंक नोट बनाना) के अधीन अपराधों के लिए कारावासित है और सिद्धदोषी जो दण्ड प्रक्रिया संहिता 1973 की धारा 109 के अधीन राज्य के विरूद्ध अपराधों के अधीन कारावासित है, जो पुलिस रजिस्टर्ड (सीआर) नहीं है, को बंदी अधिकारी के रूप में नियुक्त नहीं किया जायेगा। यदि को सिद्धदोषी किसी अन्य मामले में भी परीक्षणाधीन है तो वह बंदी अधिकारी के रूप में नियुक्त नहीं किया जायेगा।

RULE 194 Convicts eligible for appointment as convict officers

All literate convicts other than those mentioned in the rule 194 sentenced to rigorous imprisonment or to simple imprisonment, if they elect to labour throughout the term of their imprisonment, are, subject to the conditions mentioned in rules 196 and 197, eligible for appointment as convict officers.

NOTE:

Military deserters may be appointed convict night watchmen and convict overseers and employed inside barracks, but should not be permitted to work on the main wall.

बंदी अधिकारियों के रूप में नियुक्ति के लिए अर्ह सिद्धदोषी

नियम 194 में उल्लिखित उन सिद्धदोषियों से भिन्न सभी साक्षर सिद्धदोषी जो कठोर या साधारण कारावास से दण्डित है जो अपने कारावास की पूरी अवधि के लिए परिश्रम करने का चुनाव करते हैं नियम 196 और नियम 197 में उल्लिखित शर्तों के अध्याधीन बंदी अधिकारी के रूप में नियुक्त के लिए अर्ह है।

टिप्पणी :

सेना के अभित्याजकों को बंदी रात्रि प्रहरी, बंदी ओवरसीयर और बैरकों के भीतर कार्य पर नियुक्त किया जा सकता है, परन्तु उन्हें मुख्य दीवार पर कार्य करने की अनुमति नहीं दी जा सकती है।

RULE 195 A casual convict may be appointed,-

(a) A convict night watchman, if :

(i) he has completed one-eight of his sentence;

(ii) he has given proof of his good behaviour and work in industry;

(iii) he is in good health and physically fit to under-take two hours’ night duty in addition to his ordinary day labour;

(b) A convict overseer, if :

(i) he has served two months in the grade of convict night watchman;

(ii) he has served one-fourth of his sentence;

(iii) his health and conduct are good;

(i) he has served in the grade of convict overseer for at least two years;

(ii) he is a man of proven merit and intelligence;

(iii) his residence is fixed and his antecedents are of good repute.

NOTE:

In calculating the period of eligibility the period undergone during trial and remission earned shall be taken into account.

कब आकस्मिक सिद्धदोषियों को बंदी अधिकारी नियुक्त किया जा सकता है।

कोई आकस्मिक सिद्धदोषी नियुक्त किया जा सकता हैः-

(क) कोई बंदी रात्रि प्रहरी यदि-

(एक) अपनी सजा का 1/8 भाग पूरा कर चुका है।

(दो) उसने अच्छे व्यवहार और उद्यम में अपने कार्य का प्रमाणित कर दिया हो।

(तीन) उसका स्वास्थ्य अच्छा हो और दिन के अपने सामान्य श्रम के अतिरिक्त दो घण्टे की रात्रि की ड्‌युटी करने के लिए शारीरिक रूप से ठीक हो।

(ख) कोई बंदी ओवरसीयर यदि-

(एक) उसने बंदी रात्रि प्रहरी की श्रेणी में दो महीने तक काम कर लिया हो।

(दो) अपनी सजा का 1/4 भाग काट लिया हो।

(तीन) उसका स्वास्थ्य और आचरण अच्छा हो।

(ग) कोई बंदी वार्डर यदि-

(एक) उसने कम से कम दो वर्षों के लिये बंदी ओवरसीयर की श्रेणी के रूप में काम कर लिया हो।

(दो) वह सिद्ध योग्यता और बुद्धिमत्ता वाला व्यक्ति हो।

(तीन) उसका निवास स्थान नियत हो और उसका पूर्ववृत्त अच्छी खयाति का हो।

टिप्पणीः अर्हता की अवधि की गणना में विचारण के दौरान व्यतीत हुयी अवधि और अर्जित परिहार की भी गणना की जायेगी।

RULE 196 When habitual convicts may be appointed convict officers

(a) Habitual convicts with not more than two previous convictions, may be employed as convict night watchmen, if they fulfil the conditions laid down in rule 196 for casual convicts.

(b) Convict night watchmen of the habitual class with a good record and antecedents, who have completed half of their sentences including remissions, and have served for at least six months as convict night watchmen, may, if considered suitable be promoted to convict overseer’s grade.

(d) No convict of habitual class may be appointed convict warder.

कब आभ्यासिक सिद्धदोषियों को बंदी अधिकारी बनाया जा सकता है

(क) दो से अधिक पूर्व दोषसिद्ध वाले आभ्यासिक सिद्धदोषी को बंदी रात्रि प्रहरी के रूप में नियुक्ति किया जा सकेगा यदि वे नियम 196 में आकस्मिक सिद्धदोषियों के लिए निर्धारित शर्तों को पूरा करते हों।

(ख) अच्छे इतिहास और पूर्ववृत्त वाले आभ्यासिक वर्ग के बंदी रात्रि प्रहरी जिन्होंने परिहारों सहित अपनी आधी सजा पूरी कर ली हो और बन्दी रात्रि प्रहरी के रूप में कम से कम छह माह कार्य कर लिया हो, को यदि उपयुक्तक्त पाया गया, बंदी ओवरसीयर की श्रेणी में प्रोन्नत किया जा सकेगा।

(ग) न सुधर सकने वाले के रूप में वर्गीकृत सिद्धदोषियों को किसी भी श्रेणी में बंदी अधिकारी के रूप में नियुक्त के लिए अनर्ह होगा।

(घ) आभ्यासिक वर्ग के किसी भी सिद्धदोषी को बंदी वार्डर नियुक्त नहीं किया जा सकता है।

RULE 197 Appointments of female convicts as convict night watchwomen and convict overseers

Female convicts are eligible for appointment as convict night watchwomen and convict overseers in accordance with the rules contained in this Chapter. They shall, however, be ineligible for promotion to the rank of convict warder (except in Central Prison for women) and shall not be employed outside the female barrack at night.

बंदी रात्रि प्रहरी तथा बंदी ओवरसीयर के रूप में महिला सिद्धदोषियों की नियुक्ति

इस अध्याय में दिये गये नियमों के अनुसार महिला सिद्धदोषी बन्दी रात्रि प्रहरी तथा बंदी ओवरसीयर के रूप में नियुक्ति के लिए अर्ह है। यद्यपि ये सिद्धदोषी वार्डर की श्रेणी में प्रोन्नत के लिए पात्र नहीं होंगे (केन्द्रीय महिला कारागार को छोड़कर) और रात में महिला के बैरक के बाहर नियोजित नहीं की जायेंगी।

RULE 198 Superintendent’s power to make appointments

Appointments to the grades of convict night watchmen and convict overseers may be made by the Superintendent, if a convict fulfils the prescribed conditions. Special appointments of convicts who are ineligible under the preceding rules may only be made with the sanction of the range Deputy Inspector General.

Convict warders shall be appointed by the Director General from amongst convict overseers on the recommendation of the Superintendent.

नियुक्तियां करने के लिये अधीक्षक की शक्तियां

यदि कोई सिद्धदोषी विदित शर्तो। को पूरा करता है तो अधीक्षक द्वारा उसकी नियुक्ति बंदी रात्रि प्रहरी तथा बंदी ओवरसीयर की श्रेणी में की जा सकती है। पूर्वगामी नियमों के अधीन अपात्र सिद्धदोषियों की विशेष नियुक्तियां केवल परिक्षेत्र के उप महानिरीक्षक की स्वीकृति पर ही की जा सकेगी।

बन्दी ओवरसीयर में से बंदी वार्डर की नियुक्तियां अधीक्षक की संस्तुति पर महानिदेशक द्वारा की जायेगी।

RULE 199 Register of eligibility of convicts for various grades

The Superintendent shall maintain a register showing the probable dates of eligibility of every convict for the various grades of convict officers at the time a convict is admitted to jail. Convicts shall be considered for appointment in strict accordance with the seniority on this register.

विभिन्न श्रेणियों के लिए सिद्धदोषियों की अर्हता की पंजी

अधीक्षक एक पंजी रखेगा जिसमें बंदी अधिकारी के विभिन्न श्रेणियों के लिए पत्येक सिद्धदोषी के जेल में प्रवेश समय, अर्हता के संभाव्य दिनांक को प्रदर्शित किया जायेगा। इसी पंजी में दर्ज ज्येष्ठता के अनुसार कड़ाई से ही सिद्धदोषियों की नियुक्ति पर विचार किया जायेगा।

RULE 200 Employment of convict overseers and convict warders

A convict overseer or a convict warder may be entrusted with the charge of convicts or an enclosure or workshop containing convicts within the jail wall only. A convict overseer may also be employed outside the jail walls but within the jail precincts as an assistant to a warder.

बंदी ओवरसीयर और बंदी वार्डर का नियोजन

किसी बंदी ओवरसीयर या बंदी वार्डर को सिद्धदोषियों का प्रभार, या बाड़े का प्रभार या जेल की दीवार के भीतर सिद्धदोषियों वाली कर्मशाला का प्रभार सौंपा जा सकता है। किसी बंदी ओवरसीयर को जेल दीवारों के बाहर किन्तु जेल की परिसीमाओं के भीतर एक वार्डर के सहायक के रूप में भी नियोजित किया जा सकता है।

RULE 201 Duties of convict warders and overseers

It shall be the duty of convict warders and convict overseers :

(a) to assist the warders of their gangs in superintending the convicts at work, conducting them to parades, maintaining discipline and order and keeping them in safe custody

(b) to escort prisoners to the office or hospital or other parts of the jail, when required;

(c) to count at frequent intervals the prisoners in their charge, to see that their number is correct, to search them and to prevent them from receiving or retaining prohibited articles, to report the possession of any forbidden articles by any prisoner and to prevent all breaches of jail rules;

(d) to maintain order and discipline in the workshops in their charge, to supervise the labour of convicts in their gangs, to see that they industriously perform the allotted tasks and do not waste materials and to take care that all tools are properly used and carefully returned to the store ;

(e) to pay attention to the cleanliness of the persons and clothes of prisoners, and to see that they bathe at such hours as may be prescribed and keep their fetters, leg-rings and utensils bright and clean ;

(f) to keep watch over all property of whatever kind that may be entrusted to them from time to time;

(g) to report any signs of sickness amongst the prisoners in their charge;

(h) to keep the history tickets of the prisoners of their gangs ; and

(i) to assist in quelling any disturbance, to defend any jail officer in case of assault and to prevent escapes.

बंदी ओवरसीयर और बंदी वार्डर के कर्तव्य

बंदी वार्डर और बंदी ओवरसीयरों के निम्नलिखित कर्तव्य होंगे-

(क) अपनी टोली के वार्डरों की कार्य पर लगे सिद्धदोषियों का पर्यवेक्षण, उनकी परेड संचालित करने, अनुशासन और शांति बनाये रखने और उनकी सुरक्षित अभिरक्षा में सहायता करना,

(ख) जब आवशश्यकता हो बंदियों की कार्यालय या अस्पताल या जेल के अन्य भागों में जाते समय अनुरक्षण करना,

(ग) अपने प्रभार वाले बंदियों की छोटे-छोटे अन्तराल पर गणना करना, यह देखना कि उनकी संख्या ठीक है, उनकी तलाशी करना और निषिद्ध वस्तुओं को प्राप्त करने या रखने से उन्हें रोकना, किसी बंदी द्वारा किसी वर्जित वस्तु को रखने की रिपोर्ट करना और जेल के सभी नियमों को तोड़ने के सभी प्रयासों को रोकना,

(घ) अपने प्रभार में कर्मशाला में शान्ति और अनुशासन बनाये रखना अपनी टोंली में बंदी द्वारा श्रम का पर्यवेक्षण करना, यह देखना कि वे आंवटित कार्य को श्रम साध्य पूर्वक कर रहें हैं और सामग्री का अपव्यय नहीं कर रहे हैं और यह सावधानी रखना कि सभी औजारों का उचित ढंग से उपयोग किया जा रहा है और सावधानी पूर्व स्टोर में वापस किया गया,

(ङ) व्यक्तियों की साफ-सफाई और बंदियों के वस्त्रों की स्वच्छता पर ध्यान देना और यह देखना कि वे उस समय ही स्नान करते हैं जैसा विहित किया गया हो और अपनी बेड़ियों, पैर के कड़े और बर्तनों का चमचमाता और साफ रखते हैं,

(च) किसी भी प्रकार की सभी सम्पत्ति जिन्हें समय समय पर सौंपा जाय, पर निगरानी रखना,

(छ) अपने प्रभार में बंदियों के बीच किसी भी बीमारी के लक्षण की रिपोर्ट करना,

(ज) अपनी टोली के इतिवृत्त पत्रक को रखना, और,

(झ) किसी उपद्रव को शांत करने किसी हमले के समय जेल अधिकारी रक्षा करने और कैदी के भाग निकलने को रोकने में सहायता करना।

RULE 202 Posting of convict warders and convict overseers for night duty

Convict warders and convict overseers may be posted for night duty both inside and outside the barracks.

NOTE:

For their duties in connection with night watch inside or outside the barracks or on the main walls, please refer to Chapter 30.

रात्रि ड्‌युटी के लिए बन्दी वार्डरों और बंदी ओवरसीयर की तैनाती

बंदी वार्डरों और बंदी ओवरसीयर को बैरक के भीतर और बाहर दो स्थानों पर तैनात किया जा सकेगा।

टिप्पणी-

रात की पहरेदारी, चाहे बैरक के भीतर या बाहर ही अथवा मुख्य दीवार पर हो की उनके कर्तव्यों के सम्बन्ध के लिये कृपया अध्याय 30 देखें।

RULE 203 Parade of convict officers

All convict officers shall be paraded separately from ordinary prisoners.

बंदी अधिकारियों की परेड

सभी बंदी अधिकारियों की परेड साधारण कैदियों से अलग करायी जायेगी।

RULE 204 Physical training for convict warders and convict overseers

Convict warders and convict overseers shall receive elementary instruction in physical training exercises.

बंदी वार्डरों और बंदी ओवरसीयर के लिए शारीरिक प्रशिक्षण

बंदी वार्डरों और बंदी ओवरसीयर को शारीरिक प्रशिक्षण व्यायामों में प्रारम्भिक शिक्षा प्राप्त कराया जायेगा।

RULE 205 Supply of whistles and batons to convict overseers and convict warders

Convict overseers on duty at night outside the barracks or on the main wall and convict warder shall be provided with batons, torches and whistles. Convict overseers in charge of gangs shall be provided with whistles only.

बंदी ओवरसीयर और बंदी वार्डरों के डण्डे और सीटी की आपूर्ति

बैरक के बाहर या मुख्य दीवार पर रात की ड्‌युटी पर बंदी ओवरसीयर और बंदी वार्डरों को डण्डे, टार्च और सीटियां दी जायेंगी। टोलियों के प्रभारी बंदी ओवरसीयर की केवल सीटी दी जायेगी।

RULE 206 Supply of umbrellas

All convict warders and convict overseers on duty on the main wall or elsewhere, where they are exposed to the inclemency of weather shall be provided with umbrellas to protect themselves from the sun in the hot weather and rain.

छाता की आपूर्ति

मुख्य दीवार या अन्यत्र कहीं ड्‌युटी पर सभी बंदी वार्डरों और ओवरसीयरों को जहां उन्हें मौसम को प्रचण्डता का सामना करना है, गर्मी में धूप और वारिश के समय वारिश से अपना बचाव करने के लिए छाता दिये जायेंगे।

RULE 207 Privilege for convict overseers

Convict overseers are allowed the following privileges :

(i) to have 20 percent more coupons for canteen amenities than provided for other prisoners;

(ii) to have an extra interview and to write and to receive an extra letter once a month.

NOTE:

Convict overseers may, with the permission of the Superintendent, substitute a letter with Reply for an interview, or vice versa.

ओवरसीयरों को विशेषाधिकार

बंदी ओवरसीयरों को निम्नलिखित विशेषाधिकार की अनुमति दी जाती है-

(एक) अन्य बंदियों को दिये गये सुविधाओं से उन्हें 20 प्रतिशत अधिक कैण्टीन सुविधा कूपन,

(दो) महीने में एक बार के अतिरिक्त रूप से मिलना और एक अतिरिक्त पत्र लिखना या प्राप्त करना, और प्राप्त करना।

टिप्पणी :

बंदी ओवरसीयर अधीक्षक की अनुमति से मिलने के बदले एक अतिरिक्त पत्र लिखने या इसके विपरित सुविधा ले सकते है।

RULE 208 Privileges for convict warders

Convict warders are allowed the following privileges:-

(i) to have 20 percent more coupons for canteen amenities than provided for other prisoners;

(ii) to have an extra interview and to write and to receive an extra letter once a month;

(iii) to live and sleep separately from ordinary prisoners;

(iv) to cook their own food;

(v) ordinary shoes at Government expense, renewable every year;

NOTE:

Convict warders may with the permission of the Superintendent, substitute a letter with Reply for an interview, or vice versa.

बंदी वार्डरों को विशेषाधिकार

बंदी वार्डरों को निम्नलिखित सुविधाओं की अनुमति दी जाती है -

(एक) अन्य बंदियों को दिये जा रहे सुविधा की बजाय कैण्टीन सुविधाओं के 20 प्रतिशत अतिरिक्त कूपन।

(दो) महीने में एक बार के अतिरिक्त रूप से मिलने और एक अतिरिक्त पत्र लिखना या प्राप्त करना।

(तीन) साधारण बंदियों से अलग रहना और सोना

(चार) अपना भोजन स्वयं पकाना।

(पांच) प्रत्येक वर्ष बदले जाने साधारण जूते सरकारी खर्च पर।

टिप्पणीः

बंदी वार्डर मिलने के बदले एक पत्र लिखने और प्राप्त करने की सुविधा या इसके विपरित सुविधा पा सकेंगे।

RULE 209 Incentive to convict overseer and convict warders

Convict overseer and convict warder shall receive incentive at the rate of semi-skilled and skilled prisoners’ incentive, respectively.

बंदी ओवरसीयर और बंदी वार्डरों को प्रोत्साहन

बंदी ओवरसीयर और बंदी वार्डर क्रमशः अर्द्धकुशल और कुशल बंदियों को प्रोत्साहन की दर से प्रोत्साहन प्राप्त करेंगे।

RULE 210 Removal of convict officer when he becomes permanently incapacitated

When any convict officer becomes permanently incapacitated to perform all or any of the duties required of him, the Superintendent may revert him to the position of an ordinary convict.

बन्दी अधिकारी को हटाना जब वह पूर्णरूपेण असमर्थ हो

जब कोई बंदी अधिकारी स्थायी रूप से असमर्थ हो जाय, जिससे वह सभी या कोई ड्‌युटी जिसकी उससे अपेक्षा हो न कर सके तो अधीक्षक उसे साधारण कैदी की स्थिति में प्रत्यावर्तित कर सकते हैं।

RULE 211 Appointment of female convict overseers

One or more female convict overseers shall be appointed in every prison where female prisoners are confined.

महिला बंदी ओवरसीयरों की नियुक्ति

प्रत्येक कारागार में जहॉ महिला बंदियों को निरूद्ध किया जाय, एक या अधिक महिला बंदी ओवरसीयर नियुक्त किये जायेंगे।

RULE 212 Rules for female convict officers

The rules for convict officers shall mutatis mutandis be applicable to female convict officers.

महिला बंदी अधिकारी के लिए नियम

बंदी अधिकारियों के लिए लागू नियम यथावश्यक परिवर्तनों सहित महिला बंदी अधिकारियों पर लागू होंगे।

Convicts imprisoned under the Uttar Pradesh Excise Act,1910 or for escape (section 224 IPC) or for attempt to escape pr for offences under sections 231-263A(relating to coins or Government stamps), 328(poisoning), 377(unnatural offence), 463, 454, 466-477A (forgery and false documents), 489A, 489B, 489C and 489-I (counterfeiting state currency notes and bank notes) of the Indian Penal Code and convicts imprisoned under section 109 of the CrPC, who are not P.R., shall not be appointed convict officer.

211. Convicts eligible for appointment as convict officer

All convicts, other than those mentioned in the preceding paragraph, sentenced to rigorous imprisonment or to simple imprisonment, if they elect to labour throughout the term of their imprisonment, are, subject to the conditions mentioned in paragraphs 212 and 213, eligible for appointment as convict officers.

Note - Military deserters may be appointed convict night watchmen and convict overseers and employed inside barracks, but should not be permitted to work on the main wall.

212. When casual convicts may be appointed convict officers

A casual convict may be appointed –

(a) a convict night watchman, if

(i) he has completed one-eighth of his sentence,

(ii) he has given proof of his good behavior and industry,

(iii) he is in good health and physically fit to undertake two hours night duty in addition to his ordinary day labour;

(b) a convict overseer, if

(i) he has served two months in the grade of convict night watchman,

(ii) he has served one-fourth of his sentence,

(iii) his health and conduct are good;

(i) he has served in the grade of convict overseer for at least six months,

(ii) he is a man of proved merit and intelligence,

(iii) his residence is fixed and his antecedents are of good repute.

Note – In calculating the period of eligibility the remission earned shall be taken into account.

213. When habitual convicts may be appointed convict officers

(a) Habitual convicts, with not more than two previous convictions, may employed as convict night watchmen in barracks reserved for habitual convicts if they fulfill the conditions laid down in the preceding paragraph for casual convicts.

(b) Convict night watchmen of the habitual class, with a good record and antecedents, who have completed half of their sentences including remissions, and have served for at least six months as convict night watchmen, may, if considered suitable, be promoted to convict overseer’s grade for employment in habitual barracks in the jails reserved for habitual.

214. Appointments of female convicts as convict night watch-women and convict overseers

Female convicts are eligible for appointment as convict night watch women and convict overseers in accordance with the rules contained in this Chapter.

215. Superintendent’s power to make appointments

(a) Appointments to the grades of convict night watchmen and convict overseers may be made by the Superintendent if a convict fulfills the prescribed conditions. Special appointments of convicts who are ineligible under the preceding paragraphs may only be made with the sanction of the Inspector General.

(b) Convict warders shall be appointed by the Inspector General from amongst convict overseers on the recommendation of the Superintendent.

216. Register of eligibility of convicts for various grades

The Superintendent shall maintain a register in the jail form No. 9 showing the probable dates of eligibility of every convict for the various grades of convict officers at the time a convict is admitted to jail. Convicts shall be considered for appointment in strict accordance with the seniority on this register.

217. Employment of convicts overseers and convict warders

A convict overseer or a convict warder may be entrusted with the charge of convicts of an enclosure or workshop containing convicts within the jail wall only. Convicts shall be considered for appointment in strict accordance with the seniority on this register.

218. Duties of convict warders and overseers

It shall be the duty of convict warders and convict overseers:

(a) to assist the warders of their gangs in superintending the convicts at work, conducting them to parades, maintaining discipline and order and keeping them in safe custody;

(b) to escort prisoners to the office or hospital or other parts of the jail, when required;

(e) to pay attention to the cleanliness of the persons and clothes of prisoners, and to see that they bathe at such hours as may be prescribed and keep their fetters, legrings and utensils bright and clean;

(f) to keep watch over all property of whatever kind that may be entrusted to them from time to time;

(g) to report any signs of sickness amongst the prisoner in their charge;

(h) to keep the history-tickets of the prisoners of their gangs; and

(i) to assists in quelling any disturbance to defend any jail officer in case of assault and to prevent escapes.

219. Posting of convict warders and convict overseers for night duty

Convict warders and convict overseers may be posted for night duty both inside and outside the barracks.

Note.- For their duties in connection with night watch inside or outside the barracks or on the main walls, please refer to Chapter XXVIII.

220. Parade of convict officers

All convict officers shall be paraded separately from ordinary prisoners.

221. Physical training for convict warders and convict overseers

Convict warders and convict overseers shall receive elementary instruction in physical training exercises.

222. No fetters for convict officers

Convict warders and convict overseers shall not be punished by the imposition of fetters.

223. Supply of whistles and batons to convict overseers

Convict overseers on duty at night outside the barracks or on the main wall shall be provided with batons and whistles. Convict overseers incharge of gangs shall be provided with whistles only.

224. Supply of umbrellas

All convict warders and convict overseers on duty on the main wall or elsewhere, where they are exposed to the inclemency of weather, shall be provided with umbrellas to protect themselves from the sun in the hot weather and rain.

225. Privilege for convict overseers

Convict overseers are allowed the following privileges –

(a) to wear at their own expense shoes of the pattern approved by the Superintendent; and

(b) to have an interview and to write and to receive a letter once a month.

Note- Convict overseers may, with the permission of the Superintendent, substitute a letter with reply for an interview or vice-versa.

226. Supply of batons and whistles to convict warder

Convict warders shall be provided with the ordinary warder’s baton and a whistle.

227. Privilege for convict warders

Convict warders are allowed the following privileges:

(i) to live and sleep separately from ordinary prisoners;

(ii) to cook their own food;

(iii) country shoes at Government expense, renewable every year;

(iv) to smoke tobacco provided at their own expense during fixed hours at such place as the Superintendent may appoint;

and

(v) to have an interview and to write and receive a letter once a month.

Note- Convict warders may, with the permission of the Superintendent, substitute a letter with reply for an interview or vice-versa.

228. Gratuity to convict warders

Convict warders shall receive pay in the form of gratuity at the rate of Rs. 2 per month. This gratuity shall not be liable to forfeiture as a punishment and may be utilized at the option of the as a family remittance, or be allowed to accumulate till his release or may be expended on any articles which he may wish to purchase with the approval of the Superintendent.

229. Account book of convict warders

A convict warder’s account book shall be maintained, balanced monthly, checked and signed by the Superintendent of jail.

230. If any convict officer become permanently incapacitated to perform all or any of the duties required of him, the

Superintendent may revert him to the position of an ordinary convict.

231. One or female convict overseers shall be appointed in every prison where female prisoners are confined.

232. The rules for convict night watchmen and convict overseers shall mutatis mutandis be applicable to female convicts.
