RULE 779 Steps to be taken in the event of escape or outbreak

Immediately a prisoner is found to be missing or making an attempt to escape or on any other disturbance taking place or appearing imminent, it is the duty of the officer who first notices the incident, to blow his whistle continuously and send to the gate keeper with all possible haste such information as is known to him regarding the character of the occurrence that has taken place or is about to take place. He shall continue to blow his whistle and every officer hearing the whistle shall blow his own whistle and continue blowing it until the ringing of alarm bell or the siren blowing is heard.

जेल तोड़ने या पलायन की दशा में उठाये जाने वाले कदम

जब एक बंदी लापता हो या पलायन का प्रयास कर रहा हो या अन्य कोई गड़बड़ी हो रही हो या होने वाली हो तो उस अधिकारी का कर्तव्य है, जो उस घटना को पहली बार देखता है कि वह तत्काल अपनी सीटी लगातार बजाये और जितनी जल्दी हो सके उतनी जल्दी गेटकीपर को घटना की सूचना भेजें, जो उसकी जानकारी में आयी है, और जो हुई है या होने वाली है उस घटना के चरित्र के बारे में। वह लगातार सीटी बजायेगा और प्रत्येक अधिकारी सीटी सुनेगा वह अपनी सीटी बजायेगा और तबतक बजायेगा जबतक कि अलार्म वेल या सायरन बजने की आवाज सुनाई न दे।

RULE 780 Duty of Gate-Keeper

The gate-keeper shall as soon as he hears the whistle blowing continuously or receives information of any prisoner having escaped or attempting to escape or of an outbreak or disturbance having taken place or being imminent, order the sentry to fire his rifle into the air and to sound the alarm or blow the siren, and shall send immediate information to the Jailor.

गेटकीपर के कर्तव्य

गेटकीपर जैसे ही लगातार सीटी बजने की आवाज सुनेगा या सूचना पाता है कि कोई बंदी लापता है या पलायन कर गया है या पलायन का प्रयास कर रहा है या जेल तोड़ने की घटना हुई है या कोई गड़बड़ी हुई है या होने वाली है तो वह संतरी को आदेश देगा कि वह अपनी रायफल से हवा में फायर करे और अलार्म या सायरन बजा दे और तुरन्त जेलर को सूचना भेजेगा।

RULE 1128 Gate-keeper

A head warder or warder shall be constantly on duty as a gate-keeper at the main gate of every jail by day and by night.

Another head warder or warder may be deployed for assistance of gate keeper to facilitate search and ensure security. They may also be assigned other duties by the Superintendent or the Jailor.

द्वारपाल

प्रत्येक जेल में दिन और रात सभी समयों में द्वारपाल के रूप में मुख्यद्वार पर हेडवार्डर या वार्डर निरंतर ड्‌यूटी पर रहेंगे।

एक अन्य हेडवार्डर या वार्डर द्वारपाल की सहायता वास्ते तलाशी एवं सुरक्षा सुनिश्चित करने की सुविधा हेतु तैनात किया जा सकेगा। इन्हें अन्य ड्‌यूटियां भी अधीक्षक या जेलर द्वारा सौंपी जा सकेंगी।

RULE 1129 Gate-book

(a) The gate-keeper shall maintain a gate-book in which he shall make all entries in chronological order and shall not leave any blank spaces with a view to prevent spurious entries being made subsequently.

(b) The date in the gate-book shall be changed at midnight and the hours shall be recorded from 0 to 24.

द्वार-पंजी

(क) द्वार-पाल एक द्वार-पंजी का संधारण करेगा जिसमें वह कालानुक्रमिक क्रम में समस्त प्रविष्टियां अंकित करेगा एवं बाद में खाली स्थानों पर मिथ्या प्रवृष्टियां किये जाने को रोकने के प्रयोजन से कोई खाली जगह नहीं छोड़ेगा।

(ख) द्वार-पंजी में तिथि आधी रात के समय बदली जायेगी और समय का अंकन 0 से 24 तक अभिलिखित किया जायेगा।

RULE 1130 Matters to be recorded in the gate-book

The gate-keeper shall record in the gate-book;-

(a) the names of all persons passing into or out of the jail, together with the hour and minute of their entrance and exit :

(b) the hour and minute at which any articles pass into or out of the jail, their description and number or weight, and the name of the officer or person in charge of the articles;

(d) the time should be entered in red ink, at which the bell is rung for the unlocking and the locking up or for alarm, etc.;

(e) at every relief of the gate-keeper, a note of the exact time of each relief and the number of the keys taken over, with the signatures of both the relieved and relieving officers.

द्वार-पंजी में अभिलिखित किये जाने वाले विषय

द्वार-पंजी मे द्वार-पाल अभिलिखित करेगा :

(क) जेल के अंदर जाने वाले और जेल से बाहर आने वाले समस्त व्यक्तियों के नाम, उनके प्रवेश एवं बाहर जाने का समय घण्टा और मिनट के साथ;

(ख) समय घण्टा और मिनट में, जिस पर कोई सामग्री जेल के अन्दर जाये या वहाँ से बाहर निकाली जाये, उसके विवरण एवं संख्या या भार, एवं सामग्री के प्रभारी अधिकारी या व्यक्ति के नाम के साथ;

(ग) समय जिस पर कोई धन जेल से बाहर ले जाया जाय या जेल के अन्दर लाया जाय, उसके विवरण के साथ;

(घ) समय जिस पर जेल को अनलॉकिंग या लॉकिंगअप या आलर्म इत्यादि के लिए घंटी बजायी जाय, लाल स्याही से दर्ज किया जाना चाहिए;

(ङ) द्वार-पाल की प्रत्येक भारावमुक्ति का समय, प्रत्येक भारावमुक्ति का ठीक-ठीक समय एवं प्राप्त की गयी चाभियों की संख्या की एक टिप्पणी, प्रभार देने वाले और प्रभार लेने वाले दोनों अधिकारियों के हस्ताक्षर के साथ;

RULE 1142 Gate Keeper not to admit any person without authority

The gate-keeper shall admit all jail officers on duty. He shall not admit any other person without authority from the Superintendent or the Jailor.

द्वारपाल बिना प्राधिकार के किसी व्यक्ति को प्रवेश नहीं देगा

द्वारपाल ड्‌यूटी के समस्त जेल अधिकारियों को प्रवेश देगा। वह अन्य किसी व्यक्ति को बिना अधीक्षक या जेलर के प्राधिकार के प्रवेश नहीं देगा।

RULE 1143 Gate-keeper to know all jail officers and to observe prisoners going out of the jail

The gate-keeper shall make himself thoroughly acquainted with the faces of all jail officers, and shall carefully observe the faces and appearances of all prisoners leaving the jail in order to prevent any prisoner attempting to escape in disguise.

द्वारपाल समस्त जेल अधिकारियों को जानेगा तथा जेल से बाहर जाने वाले प्रिजनर्स का निरीक्षण करेगा

द्वारपाल जेल के समस्त अधिकारियों के चेहरों से स्वयं को अच्छी तरह से परिचित रखेगा, और समस्त बंदियों जो जेल से बाहर जा रहे हैं के चेहरों एवं दिखावट का, किसी बंदी के छद्‌म वेश में पालन करने के प्रयत्न को रोकने के क्रम में सावधानीपूर्वक निरीक्षण करेगा।

RULE 1144 Personal search by the gate-keeper

1. The gate-keeper shall compulsorily search every person entering into or going out of the jail except the following persons:-

(a) all Constitutional Office Holders.

(b) chairperson and Member of the various commissions constituted under central or State Act ;

(d) the Chief Minister and member of Council of Ministers.

(e) Member of Parliament and Member of Legislative Assembly or Member of Legislative Council;

(f) District and Session Judge and all subordinate judicial officers on official visit.

(g) the Commissioner and the District Magistrate;

(h) Senior Superintendent of Police or Superintendent of Police, only at the time of joint Visit along with District Judge or District Magistrate.

(i) the Superintendent and officers of the jail department above the rank of the Superintendent.

द्वारपाल द्वारा व्यक्तिगत तलाशी

1. द्वारपाल निम्नलिखित व्यक्तियों को छोड़कर जेल के अंदर प्रवेश करने वाले और जेल से बाहर जाने वाले प्रत्येक व्यक्ति की अनिवार्य तलाशी लेगा-

(क) समस्त संवैधानिक कार्यालय धारक;

(ख) अध्यक्ष एवं सदस्य राष्ट्रीय मानवाधिकार आयोग, महिलाओं के लिए राष्ट्रीय आयोग, राज्य मानवाधिकार आयोग एवं माननीय न्यायालय द्वारा नियुक्त कमीशन;

(ग) भारत संघ के मंत्रिपरिषद के सदस्यों;

(घ) मुख्यमंत्री एवं मंत्रिपरिषद के सदस्य;

(ङ) संसद के सदस्यों एवं विधानसभा के सदस्यों या विधान परिषद के सदस्यों;

(च) जिला एवं सत्र न्यायाधीश और अधिकारिक निरीक्षण पर सभी अधीनस्थ न्यायिक अधिकारी;

(छ) मंडलायुक्त एवं जिला मजिस्ट्रेट;

(ज) वरिष्ठ पुलिस अधीक्षक या पुलिस अधीक्षक, केवल जिला जज या जिला मजिस्ट्रेट के साथ संयुक्त निरीक्षण के समय;

(झ) अधीक्षक एवं अधीक्षक रैंक से ऊपर के जेल विभाग के अधिकारियों;

(ट) केन्द्र एवं राज्य के विभिन्न अधिनियमों के अधीन गठित विभिन्न आयोगों के अध्यक्ष एवं सदस्य;

2. The State Government, the Director General/Inspector General (Prisons) or the Superintendent, in special cases or on special occasions, may by an order exempt a person from search.

राज्य सरकार, महानिरीक्षक (जेल) या अधीक्षक, विशेष मामलों में या विशेष अवसरों पर किसी व्यक्ति को एक आदेश द्वारा तलाशी से छूट प्रदान कर सकेंगे;

3. A female shall be searched only by female staff in a secluded place, not in the presence of any male person.

किसी भी महिला की तलाशी केवल महिला स्टाफ द्वारा एकांत स्थान पर ली जायेगी जो किसी पुरुष व्यक्ति की उपस्थिति में नहीं होगी।

RULE 1145 Search of jail officers and other persons

When the gate-keeper has reason to suspect that any jail officer or other person, who is exempted from search is introducing or removing prohibited and prohibited articles, he shall detain him between the gates and send notice to the Superintendent or theJailor or in their absence to the senior officer on duty, who may, if he thinks necessary, cause the person concerned to be searched or take such other action as he may consider necessary.

जेल अधिकारियों तथा अन्य व्यक्तियों की तलाशी

जब द्वारपाल को यह संदेह करने का कारण हो कि कोई जेल अधिकारी या अन्य व्यक्ति, जो तलाशी से मुक्त है अप्राधिकृत वस्तुएं जेल में प्रवेश करा रहा है या हटा रहा है, वह उस व्यक्ति को दोनों द्वार के बीच रोक लेगा एवं अधीक्षक या जेलर या उनकी अनुपस्थिति में ड्‌यूटी के वरिष्ठ अधिकारी, को सूचना देगा जो, यदि वह आवश्यक समझे तो, सम्बद्ध व्यक्ति की तलाशी करवायेगा या ऐसी अन्य कार्यवाईयाँ करेगा जैसा कि वह आवश्यक समझ सकेगा।

RULE 1146 Prevention or introduction of prohibited articles and misappropriation

The gate-keeper shall endeavour by every means in his power to prevent the misappropriation of any jail property and the admission of unauthorized or prohibited articles.

निषिद्ध सामग्रियों के प्रवेश का निवारण एवं दुर्विनियोग

द्वारपाल सभी साधनों द्वारा अपनी शक्ति भर किसी भी जेल संपत्ति के दुर्विनियोग को और अप्राधिकृत या निषिद्ध सामग्रियों के प्रवेश को रोकेगा।

RULE 1147 Outgang register

The gate-keeper shall maintain a register, with their photographs affixed, of all convicts, whose employment outside the jail walls has been sanctioned by the Superintendent.

द्वारपाल, सभी सिद्धदोष, जिन्हें जेल की दीवाल के बाहर नियोजन हेतु अधीक्षक द्वारा स्वीकृत दी जा चुकी है, के फोटोग्राफ चस्पा के साथ एक रजिस्टर संधारण करेगा।

RULE 1148 Passing out and in of outgangs

When convicts employed in outgangs are going into or out of the jail the following procedure shall be followed:

(a) When convicts in outgangs are passing out of the jail , the gate-keeper shall first pass the convicts through the inner wicket and admit them into the passage between the outer and the inner gates. He shall then lock the inner gate. The convicts shall then be made to sit down while the roll call is made from the out gang register mentioned in the preceding paragraph by the jail officer charged with this duty. The totals of each gang shall be signed by the officer, and the gate-keeper shall enter in words in the gate-book the number of convicts sent out in each gang and the name of the warder in charge. This entry shall be signed by the warder in charge of the gang. The gate-keeper shall then open the outer wicket and count the convicts as they pass out of the jail to verify the total. Every change in the gang shall be noted by the officer concerned in the register of out gangs and recorded by the gate-keeper in the gate-book.

(b) When the convicts in out gangs are passing into the jail, the gate-keeper shall first open the outer wicket and admit the gang into the passage between the outer and inner gates. He shall then lock the outer gate and call out the name of each convicts as recorded in the register of outgangs. When the number in the gang has been found to be correct, he shall open the inner wicket and count the convict as they pass into the jail to verify the total.

वाह्‌य गैंग रजिस्टर

वाह्‌य गैंग का बाहर जाना और अंदर आना

जब वाह्‌य टोली में नियोजित सिद्धदोष जेल से बाहर जा रहे हैं या जेल में अन्दर आ रहे हैं निम्नलिखित प्रक्रिया का अनुसरण किया जायेगा :

(क) जब वाह्‌य टोली में सिद्धदोष जेल से बाहर जा रहे हैं, द्वारपाल आंतरिक विकेट से सिद्धदोषों को निकालेगा तथा वाह्‌य एवं आंतरिक गेट के मध्य रास्ते में प्रवेश देगा। इसके पश्चात्‌ वह आंतरिक द्वार पर ताला लगाकर बंद करेगा। इसके पश्चात्‌ सिद्धदोषों को तब तक बैठा दिया जायेगा जब तक पिछले पैराग्राफ में विहित वाह्‌य टोली रजिस्टर से, इस कर्त्तव्य के भार के लिए नियत जेल अधिकारी द्वारा हाजिरी न ले ली जाय। प्रत्येक टोली के कुल पर अधिकारी द्वारा हस्ताक्षर किये जायेंगे, और द्वारपाल द्वार-पंजी में प्रत्येक टोली में बाहर भेजे गये सिद्धदोषों की संख्या शब्दों में एवं प्रभारी वार्डर का नाम दर्ज करेगा। यह प्रविष्टि प्रभारी वार्डर द्वारा हस्ताक्षरित की जायेगी इसके पश्चात्‌ द्वारपाल वाह्‌य विकेट को खोलेगा और योग को सत्यापित करने के लिए सिद्धदोषियों के जैसे ही जेल के बाहर आयेंगे उनकी गिनती करेगा।

टोली में हुए प्रत्येक परिवर्तन को सम्बन्धित अधिकारी द्वारा वाह्‌य टोलियों के रजिस्टर में लिखा जायेगा और द्वार-पंजी में द्वारपाल द्वारा अभिलिखित किया जायेगा।

(ख) जब वाह्‌य गैंग्स में दोषी जेल के भीतर आ रहे हो तो द्वारपाल वाह्‌य विकेट को प्रथमतः खोलेगा एवं वाह्‌य तथा आंतरिक द्वार के मध्य के रास्ते में गैंग को प्रवेश देगा। इसके पश्चात्‌ वाह्‌य गेट को ताले से बंद करेगा एवं वाह्‌य गैंग के रजिस्टर में यथा अभिलिखित प्रत्येक दोषियों के नामों को पुकारेगा।

जब गैंग की संख्या सही पायी जाय तो वह आंतरिक विकेट को खोलेगा तथा कुल योग के सत्यापन करने के लिए दोषियों के जैसे ही वे जेल के अंदर जायेंगे उनकी गिनती करेगा।

RULE 1149 Detention of prisoners not in proper custody

(a)- The gate-keeper shall not allow to pass out of the jail any prisoner who is not in the custody of a jail officer duly authorized to take him outside the jail.

(b)- If the gate-keeper has reason to believe that any prisoner is being taken out of the jail contrary to rules, he shall detain him and after making a note of it in the gate-book, at once report the matter to the Jailor.

समुचित अभिरक्षा में प्रिजनर के न होने पर परिरोध

(क) द्वारपाल किसी भी प्रिजनर को जो उसे जेल के बाहर ले जाने के लिए सम्यक रूप से प्राधिकृत किसी जेल क अधिकारी की अभिरक्षा में न हो, जेल के बाहर जाने की अनुमति नहीं देगा।

(ख) यदि द्वारपाल को विश्वास करने का कारण हो कि कोई प्रिजनर नियमों के प्रतिकूल जेल के बाहर ले जाया जा रहा है, वह उसे निरुद्ध कर लेगा और द्वार-पंजी में टिप्पणी लिखने के बाद मामले की सूचना तुरन्त जेलर को देगा।

RULE 1151 Responsibility for cleanliness and order in the gateway

The gate-keeper shall be responsible for seeing that the jail front, the main gate and the passage between the two gates is kept clear and clean. He shall keep the passage clear of any persons or prisoners who are not specially authorized to remain there and shall keep an eye on the movements of all persons employed or detained therein.

सिंहद्वार में स्वच्छता एवं व्यवस्था का उत्तरदायित्व

द्वारपाल यह निगरानी करने के लिए उत्तरदायी होगा कि जेल के सामने का हिस्सा, मुख्यद्वार एवं दोनों द्वारों के मध्य का रास्ता साफ और स्वच्छ रखा गया है। वह रास्ते को ऐसे व्यक्तियों या प्रिजनर से जो वहाँ रहने के लिए विशेष रूप से प्राधिकृत नहीं हैं, से मुक्त रखेगा एवं वहाँ पर कार्यरत समस्त व्यक्तियों या निरुद्ध व्यक्तियों के आवागमन पर नजर रखेगा।

RULE 1152 Articles in the custody of the gate-keeper

The gate-keeper shall be in charge of the following articles kept between the two gates :-

(a) the clock;

(b) the treasure chest;

(d) the key-chest;

(e) the box of night locks;

(f) the emergency rope, torches, emergency lights etc.

(g) the emergency fetters and handcuffs, which shall be kept in a place of security;

(h) the list of visitors and other persons who are authorized to enter the jail under the rules or by the orders of a competent authority ,

(i) first aid box ;

(J) any other article ordered by the Superintendent to be kept at the gate.

द्वारपाल की अभिरक्षा में सामग्रियां

द्वारपाल दोनों द्वारों के मध्य रखी गयी निम्नलिखित सामग्रियों का प्रभारी होगा :

(क) घड़ी;

(ख) कोषागार तिजोरी;

(ग) द्वारपाल की पुस्तक के लिए ताले चाभी सहित स्टैडिंग डेस्क एवं लेखन सामग्रियां;

(घ) की-चेस्ट

(ङ) रात्रिकालीन तालों का बक्सा;

(च) आपातकालीन रस्सी, टार्चें, आपातकालीन लाईट इत्यादि।

(छ) आपातकालीन बेड़िया एवं हथकड़ियां जो किसी सुरक्षित स्थान में रखी जायेंगी;

(ज) विजिटरों की सूची एवं अन्य व्यक्तियों की सूची जो नियमों के अंतर्गत जेल में प्रवेश हेतु प्राधिकृत हैं या सक्षम प्राधिकारी के आदेशों से प्राधिकृत हैं;

(झ) प्राथमिक उपचार बाक्स; और

(ञ) अधीक्षक द्वारा आदेशित अन्य कोई सामग्री जो द्वार पर रखी जानी हो;

RULE 1153 Light

The gate-keeper shall ensure proper light in the passage between the gates throughout the night.

रोशनी

द्वारपाल द्वारों के बीच के रास्ते में, सम्पूर्ण रात्रि, समुचित रोशनी सुनिश्चित करेगा।

RULE 1172 Change of shift

The change of the sentry shall be noted by the gate keeper in the gate book with hour and minute and shall be signed by the relieved and relieving sentry.

पारी परिवर्तन

संतरी में परिवर्तन द्वारपाल द्वारा द्वार-पंजी में घण्टा एवं मिनट के साथ नोट किया जायेगा एवं मुक्त तथा मुक्त करने वाले संतरी द्वारा हस्ताक्षरित किया जायेगा।

जेल मैनुअल पैरा 1216—मुख्या दरवाजे पर गेट कीपर द्वारा व्यक्तिगत तलाश{ उत्तर प्रदेश जेल नियम – संग्रह (प्रथम संशोधन) नियमावाली, 2002}– –

गेट कीपर निम्न व्यक्तियों के सिवाय प्रत्येक व्यक्ति के जेल के अन्दर प्रवेश करने और बाहर जाने पर उनकी अनिवार्यतः तलाश करेगा -

(1) (क) माननीय उच्चतम न्यायालय और उच्च न्यायालय के न्यायमूर्ति;

(ख) राष्ट्रीय मानवाधिकार आयोग, राष्ट्रीय महिला आयोग के सदस्य और माननीय न्यायालय द्वारा नियुक्त किसी आयोग या राज्य मानव अधिकार आयोग के सदस्य;

(ग) संसद के सदस्य और विधान सभा के सदस्य या विधान परिषद के सदस्य;

(घ) जिला एवं सत्र न्यायाधीश या उनके द्वारा शासकीय प्रयोजन के लिये नामनिर्दिष्ट अधिकारी;

(ड.) आयुक्त और जिला मजिस्ट्रेट;

(च) वरिष्ठ पुलिस अधीक्षक/पुलिस अधीक्षक (जिला जज या जिला मजिस्ट्रेट के साथ केवल सयुंक्त निरिक्षण के समय)

(2) राज्य सरकार विशेष मामलों में या विशेष अवसरों पर आदेश द्वारा किसी व्यक्ति को लोक हित में अनिवार्य तलाशी से छूट प्रदान कर सकेगी |

(3) महिलाओं की तलाश एकान्त स्थान में केवल मैट्रन द्वारा या महिला वार्डर द्वारा की जायेगी और किसी पुरुष व्यक्ति की उपस्थिति में नहीं |

जेल मैनुअल पैरा 1217{ उत्तर प्रदेश जेल नियम – संग्रह (प्रथम संशोधन) नियमावाली, 2002}– — यदि कोई व्यक्ति तलाश के प्रति आक्षेप करता है या तलाश के दौरान उसके पास से अप्राधिकृत चीजें प्राप्त होती हैं, तो तलाश के लिये प्राधिकृत व्यक्ति/कर्मचारी और गेट कीपर ऐसे व्यक्ति को तलाश के स्थान पर रोकेगें और जेलर या उसकी अनुपस्थिति में कर्ताव्यारूढ़ ज्येष्ठतम अधिकारी को सूचित किया जायेगा जो ऐसी व्यक्ति की तलाश का संचालन करायेगा और नियमों के अधीन ऐसी कार्यवाही करेगा जो आवश्यक और उचित समझी जाय |
