Chapter 3 Tort Law

Tuesday, 11/12

  • Introduction to Torts/Civil Law. Nature of tort law: students describe the rights they possess when they go about their daily activities in their communities. Explain that the purpose of TORT LAW is to ensure that these rights are respected. (right to exist without being harassed or harmed, right to privacy, right to one's good reputation.)

  • Tort comes from Latin term torquere, which means "twisted" or "wrong".

  • Discussion question: Consider why a simple act of carelessness might result in a legal action.

  • Show HUMAN RIGHTS VIDEO.

Wednesday, 11/13

  • Chapter 3 Test is Tuesday, 11/26

  • Begin notes on Section 3.1 power point

  • Comparison of Civil Law to Criminal Law pg. 56 in textbook. (see attachment below)

  • Complete Section 3.1 vocabulary pg. 54 in textbook. Students need to realize that there are more than 6 vocabulary words in Section 3.1. They each looked through textbook and defined an additional 10 words for Section 3.1, bringing total to 16. (Ex. pg. 58 Actual Malice) Read aloud last paragraph under Defamation pg. 58.

Thursday, 11/14

  • Chapter 3 Vocabulary quiz is Wednesday 11/20.

  • Articles: Arizona Schools-Student Stripped Searched, Commack Superintendent 100k fined for "libel" smear.

  • Do Now: On pg. 55 of textbook read "Global Law" Tort Law in Mexico. Complete pgs. 22 in workbook, relates to Global Law on pg. 55 in textbook, Discuss differences.

  • Complete pg. 23 of workbook using pgs. 54-56 textbook.

  • Discussed 3 INTENTIONAL TORT articles: Walmart-Age discrimination.

  • Give out Newsday articles "Tackling Nuisance" abandoned home in West Islip and "ATV riders". Discussion of INTENTIONAL TORT of Nuisance.

  • Critical Thinking question: What were the injuries/damages to the plaintiffs in both situations?

  • Discussion of Newsday article about East Meadow School District and student who was denied access w/dog for disability. Students must understand the "balance" of rights for all.

Friday, 11/15

  • Ch. 3 Test is Tuesday, 11/26

  • Discussion of Elements of Negligence/Unintentional Tort

  • Introduced Section 3.2, Negligence and Liability. Class took notes on PowerPoint 3.2 attached below.

  • Review Elements of Negligence PowerPoint slides.

  • Review what a plaintiff must prove in order to succeed in a lawsuit for Negligence.

  • Proximate cause Define/Review-Example: I left classroom unsupervised for a moment and student acted out.

Monday, 11/18

  • Have students work in groups to create a fictitious negligent situation. Defining the plaintiff/defendant. Description of the careless act/defining all the elements of negligence step by step.

  • To assess students understanding please complete Google form that is an assignment in our classroom and submit responses with follow up discussion tomorrow.

  • Chapter 3 Vocabulary quiz is Wednesday 11/20.

Tuesday, 11/19

  • CLASSWORK/HOMEWORK: Tort Law-Negligence Worksheet (Driver Loses Control of Car). Students had to read and answer the 5 questions.

  • Blind Golfer article. Class discussion. Intentional Tort or Negligence

  • Vocabulary quiz tomorrow.

Wednesday, 11/20

  • Remind students about Tort Law Case Scenario submissions in google classroom

  • Review Elements of Negligence (Duty of Care, Breach of Duty, Proximate Cause, Actual Harm)

  • Students will read article "Money for a Rainy Day" and attempt to describe each of the 4 Elements of Negligence. Class discussion

  • Students will read article "Slain Skateboarder Family Sues" and describe each of the 4 Elements of Negligence. Class discussion.

Thursday, 11/21

  • REMINDER: Students can complete workbook pgs. 21 and 25 from workbook with notes on test. Students can also review on their own the attachment below labeled "overhead notes NEGLIGENCE 3.2" which has notes for them to copy/read through.

  • Contributory/Comparative/Assumption of Risk

  • Give out RANGERS Hockey ticket photocopy (front/back)Discuss legalese (waiver of liability) on backside of ticket/swim contract and how it relates to Negligence "Assumption of Risk" defense.

  • Complete Section 3.1 Assessment on pg. 59 in textbook AND REVIEW ANSWERS. HINT: #3 IS A GOOD SHORT ANSWER QUESTION

  • Complete all workbook pgs. 28, 29, 30

Friday, 11/22

  • Review Chapter 3 Vocabulary quiz from 11/20/19.

  • Discussion of Newsday article "LIRR" gap in station platforms and girls' tragic death (intoxicated)

Monday, 11/25

  • Discuss Strict Liability and Product Liability pg. 64/Tort Reform pg. 65 (Survival statutes and Wrongful Death Statutes)

  • COMPLETE OPEN NOTE/TEXTBOOK QUIZ IN CLASS.
