Flood Hazard Mitigation
The Village of Rutland is a participating community of the National Flood Insurance Program (NFIP), a program which offers federal assistance to cities, towns and villages impacted by natural flood disasters. Because the Village of Rutland is a participating community of the NFIP, the Village of Rutland is eligible for federal funding should a major flooding event recur and residents have the eligibility to acquire flood insurance through NFIP. However; NFIP participation requires the Village of Rutland Government to work very diligently in the enforcement of associated regulations and standards.
In 2002, the Rutland Village Council passed the Special Purpose Flood Damage Prevention Ordinance of 2002 which established regulations for development in a flood hazard area. This Ordinance was later repealed and superseded by an act of the Rutland Village Council in 2014, namely Municipal Ordinance 06-19-14, titled the “Special Purpose Flood Damage Reduction Ordinance”. The provisions of Muni. Ord. 06-19-14 only apply to flood hazard areas.
Summarily, as required by Muni. Ord. 06-19-14, no development of any kind may commence in or directly near a flood hazard area unless a Floodplain Development Permit is obtained by the Floodplain Administrator. By default, the Mayor is ex-officio Floodplain Administrator, unless the position and all duties and powers thereof are delegated by the Mayor to another employee under his direction and supervision.
Construction and development in areas designated as special flood hazards is regulated by the Village of Rutland Floodplain Regulations, which are codified under Chapter 153 of the Rutland Municipal Code. The regulations require a special permit and designate specific requirements to be met before and during construction and development.
The Federal Emergency Management Agency in conjunction with the Village of Rutland maintains maps indicative of areas of special flood hazards based on flood data.
