Each of these companies has faced lawsuits (including class actions) under the Fair Credit Reporting Act (“FCRA”). Although Congress passed the FCRA way back in 1970 and litigation has focused on credit reporting agencies’ duties under the law, class action plaintiff firms have recently focused on the FCRA’s employer-related provisions. Several large settlements (such as Publix’s $6.8 million class action settlement, Dollar General’s $4 million, and K-Mart’s $ 3 million) have spurred further litigation. While some of the alleged FCRA violations may appear minor or technical in nature, these “technical violations” still result in costly lawsuits. Employers should re-familiarize themselves with the FCRA to avoid becoming class action defendants.

A Nevada group backed by Everytown for Gun Safety announced Friday that it has added several key players – including billionaire casino mogul Elaine Wynn – to help pass a gun control initiative in the state. Wynn, co-founder of Wynn Reports, will chair the Nevadans for Background Checks advisory board to help pass an expanded background check initiative that qualified for the 2016 ballot last month, the group said. “Keeping guns out of the hands of criminals, domestic abusers and the dangerously mentally ill isn’t a political issue; it’s common sense,” Wynn said in a statement. Wynn also cited a poll that found 86 percent of voters supported background checks for all gun sales. Included in the initiative is language seeking to revise state law requiring a federally-licensed firearms dealer conduct a background check through the National Instant Criminal Background Check System, where currently it is optional to do so through the state repository.

The competition for Massachusetts' final casino license, reserved for the state's southeast region, is slowly coming into focus, as state regulators announced on Friday that Mass Gaming & Entertainment had met the application deadline. The company, an affiliate of Chicago-based Rush Street Gaming, joins New York-based KG Urban Enterprises, as potential rivals for the license. The Massachusetts Gaming Commission said Friday that it also is evaluating application extension requests from Somerset On The Move, Crossroads Massachusetts and the Seafan Trust. All five groups will be invited to address the commission at its next meeting on Feb. 5.

The Mississippi Gaming Commission is in the midst of conducting routine extensive background checks for stakeholders in the Magnolia Bluffs Casino in preparation for the final approval before the casino opens in December. Gaming Commission Deputy Director Eddie Williams said the commission is conducting suitability investigations, which he said are standard procedure for casino owners, general managers, investors or significant shareholders. Findings of suitability are granted, Williams said, in preparation for licensing. Williams said all of the casino’s funding documents were submitted on time in June. The documents, including the city’s lease with the casino and finalized letters of commitments from funding sources, were originally due Feb. 24. The gaming commission gave casino developers a 120-day extension on Feb. 23.
