Per The Home Depot legal counsel Lionel Legagneur, "Disclaimers aren't used to clarify an offer, only to limit what's not included in the offer. Always keep in mind, 'Does this make sense to the consumer?'" In other words, try to keep it simple while still making it clear what product types/categories are not part of the promotion.
If an offer lists out the product categories that are included, as it normally should, there is no need to duplicate this information in the disclaimer. However, if the offer is something like "20% Off Bath Essentials," it is necessary to list the exact categories in the disclaimer, because there can be confusion about what is considered a "bath essential." Product categories match the structure of the website; if there's a PLP (product listing page) for it, it's a product category.
All disclaimers must have a start and end date. The start date can be "now" but the end date must be an exact date.
If the offer is buy one item, get another item free, the exact specifications (e.g., size) of both items and the value of the free item must be included in the disclaimer. The cost can be a range, but the upper and lower bounds must be accurate to the selection of products that are included. An example:
The free 1'8"x2'8" to 2'3"x3'x10" outdoor rug (valued between $15 - $79) offer is valid with the purchase of select 5'x7' or larger outdoor rugs.
