b. The words “rebate” or “cash rebate” may be used only if the advertising clearly identifies the source of the rebate as either factory or finance in the body of the advertisement or in the disclaimer (e.g., Kia Motors America or Kia Motors Finance Company, Factory Rebate, Manufacturer Rebate). Advertising may not refer to undefined discounts through phrases like “rebate,” “cash rebate” or “cash.”
d. Dealers must not run advertising that conveys or implies distress or which contains claims that cannot be substantiated:

Advertising must not state or imply that Dealer (i) has some special affiliation or relationship with KMA that gives it a favored or preferential status or other advantage over another Kia dealer, or (ii) has received special pricing or some other exclusive benefit from KMA. KMA has identified certain terms that violate this prohibition and/or otherwise are inconsistent with the Kia brand image:
Factory Authorized • Factory outlet • Special allocation / allotment / acquisition • We have been authorized • Kia Factory or Kia Headquarters • Liquidation • Public Notice or Public Sale • Authorized Distribution Center • Special Purchase or Special Pricing • Buying from the Factory • Supplier or Employee pricing for everyone • Will not be undersolde. The word “Clearance” is prohibited except (i) where expressly approved in advance by KMA, and (ii) during timeframes specified in advance by KMA, and referenced in creative provided by KMA. (e.g. special clearance events, etc.). In periods during which KMA has authorized the use of “Clearance”, any advertisement that includes the word “clearance,” such as “model year end clearance,” must clearly identify the vehicles (by proper description and model year identified) that are the subject of the sales event.
a. Minimum Allowable Advertised Price (“MAAP”) Restrictions Current Year Vehicles. Dealers must not advertise a retail sales price that is below both of the following:
1. The price calculated as follows: Dealer Invoice (as published in the KMA pricing document), adjusted for destination and handling charges, less available customer cash including bonus cash (as set forth in the KMA incentive bulletin) and less fixed dealer cash (i.e., dealer cash that does not depend on the Dealer’s satisfaction of a monthly sales objective or some other condition(s)). For this purpose, Dealer may not reduce the advertised price based on (i) variable Dealer Cash incentives such as MSO, KTB or other similar program, (ii) test drive incentives, or (iii) any incentives other than those specified in the preceding sentence.2. The price that is 10% below the vehicle’s MSRP.c. Kia provides a variety of cash incentive offers.
• Unrestricted: If promoting unrestricted cash offers, dealers are allowed to stack and advertise a combined total.• Limited: If promoting a limited cash offer that is model, trim or package specific, dealers must call out the specific vehicle to which it applies. | Always utilize “up to” in the total (Sorento example)• Qualified: If a program is not available to the general public, dealers must separately itemize all qualified rebates and clearly disclose any/all program qualification requirements (e.g. Military, College, First Time Buyer, etc.) | Incorporate clarifying detail in the main section of the offer and VO. | Include in Disclaimer the detail about who qualifies for the owner loyalty bonus. | Qualified rebates or discounts should never be included in a calculated Total Cash or Total Bonus | Always include “for qualified buyers” or similar language.04f. LEASE ADVERSTISING:
When advertising a vehicle as a lease, the following information must appear in the body of the advertisement unless otherwise noted:
• "Lease" must be stated and Term of Lease• Year and model of the advertised vehicle(s)*• Monthly payment amount & Total amount due at signing• Total mileage allowance (per year/total contract)*• Whether a security deposit is required or not*• Whether applicable taxes and fees are included or not*• Expiration date of the offer*• Disclosure requirements must be clear, conspicuous and legible• Lease terms cannot require min mile allow per year to be below 10,000• The maximum amount due at signing cannot exceed 15% of total MSRP (including destination and handling) OR up to $3,500, whichever is greater.• The intent of these requirements is to cap the total due at signing before any lease cash is applied.04h. APR ADVERTISING:
APR advertising must include:
• Rate percentage• Term / total number of payments (if radio, can be in disclaimer)• Cost per $1,000 borrowed (if radio, can be in disclaimer)• Vehicles that qualify for the offer with model year• Offer expiration date in disclaimer• Qualifier in disclaimer that “not all buyers will qualify” or equivalent• Identified financing source (e.g. Kia Motors Finance)• Any state or local requirements beyond the items listed aboveTahoma
