When MBTA is responsible for the selection of scholarship recipients, the selection shall be solely based on the objective eligibility requirements and purpose of the scholarship as determined by the donor. The eligibility requirements cannot be based on a protected class (i.e., race, color, national origin, ancestry, sex, gender identity, sexual orientation, age, disability, and religion). If the requirements are based on a protected class, the school cannot select the recipient. Rather, the selection must be done solely by the donor with no assistance from the school.
