Strata Titled Property Fire Insurance 



The Building and Public Property (Maintenance and Management) Act 2007 (hereinafter referred to as the "Act" 663) came into force on April 12, 2007 in Peninsular Malaysia.

 

Article 8 of the Act, which stipulates the powers and duties of JMB

 

8. The 

(1) (c) Maintaining and insuring The Building and Fire from Risk Management Agencies On  OTHER Replacement The value of the Determine The Building;


8. (1) (d) Renovation and restoration of buildings, buildings, and constructions received by the insurance management agency;


8. (3) The regulatory body should be considered

(a) the purpose (c) affecting any insurance under subparagraph (1) is equal to its replacement value or the value management agency decides to construct an insurance interest;

(b) For the purpose of insuring any insurance under subsection (1)(d), the subject matter of the insurance has an insurable interest.


Explanation:

The joint management agency must ensure that they insure the following insurance:

 

1. Fire and all hazard insurance (minimum danger, collapse and landslides, riots against malicious injuries and ruptured spills)

 

Building - For all units are separate themselves, including all common property.

In this case, the buyer and the bank loan, the buyer needs to purchase additional insurance, and can use a separate "insurance certificate" issued from the main policy.

2. Public liability insurance

Legal liability pays compensation for the joint property of the building used for accidental or accidental damage to the property.

 

Establish a joint governing body in section 4.

(2) Section (1) establishes that the governing body shall be a body corporate with permanent inheritance and seals.

(3) The governing body may sue and be sued in its name.

(4) The management organization should include developers and buyers.

 

Interpretation:

1. Pursuant to Paragraph 4(1) of Schedule 9 of the Financial Services Act 2013, if You are applying for this Insurance for a purpose related to Your trade, business or profession, You have a duty to disclose any matter that You know to be relevant to Our decision in accepting the risks and determining the rates and terms to be applied and any matter a reasonable person in the circumstances could be expected to know to be relevant, otherwise it may result in avoidance of Your contract of insurance, refusal or reduction of Your claim(s), change of terms or termination of Your contract of insurance. The above duty of disclosure shall continue until the time Your contract of insurance is entered into, varied or renewed with Us. You also have a duty to tell Us immediately if at any time after Your contract of insurance has been entered into, varied or renewed with Us any of the information given in the Proposal Form (or when You applied for this insurance) is inaccurate or has changed. 

2. Your attention is drawn to the 60 days premium warranty attached to the Policy. 

3. The personal data submitted by and collected from You may be used by Us and/or any company within the The Insurer Group of companies and/or any of its associated companies, within or outside Malaysia, for administration or direct marketing purposes and in this connection, We may transfer or disclose that information to any of those other companies. We will cease to use the Personal Data for direct marketing purposes if You request Us to do so. For further details, please refer to Our “Data Privacy Notice” stipulated in Our website. 

4. By this warranty, the insurance Policy is automatically cancelled unless the full premium is paid to the insurer within 60 days from the commencement date of cover. Please note that if this insurance is transacted through Your insurance broker, the broker is acting on Your behalf for the purpose of formation of this contract of insurance. It is important that You make full payment of the premium to Your broker as soon as possible and in any case within the 60 days period of the premium warranty so as to enable Your broker to remit the premiums early to Your insurer. You are advised to request Your broker to furnish You with the broker’s and insurer’s receipt on the premium that You paid. 

5. Premium charged for this Policy exclude applicable tax(es) that would be imposed in the future and from time to time, We will be entitled to recover from You any taxes that We are required by law to collect. SPECIAL NOTIFICATION: The Proposer is hereby notified that the Company has appointed Intermediaries/Representatives who have the authority to solicit or negotiate Contracts of Insurance on behalf of the Company. All authorised Intermediaries/Representatives are issued with authorisation cards.

1. Menurut Perenggan 4(1) Jadual 9 Akta Perkhidmatan Kewangan 2013, jika Anda memohon Insurans ini untuk tujuan yang berkaitan dengan perdagangan, perniagaan atau profesion Anda, Anda mempunyai kewajipan untuk mendedahkan apa-apa perkara yang Anda ketahui untuk relevan dengan keputusan Kami dalam menerima risiko dan menentukan kadar dan terma yang akan digunakan dan apa-apa perkara yang mungkin diketahui oleh orang yang munasabah dalam keadaan itu sebagai relevan, jika tidak, ia boleh mengakibatkan pengelakan kontrak insurans Anda, keengganan atau pengurangan tuntutan Anda, perubahan terma atau penamatan kontrak insurans Anda. 2. Perhatian anda tertumpu kepada waranti premium 60 hari yang dilampirkan pada Polisi.

Data peribadi yang dikemukakan oleh dan dikumpul daripada Anda boleh digunakan oleh Kami dan/atau mana-mana syarikat dalam Kumpulan Syarikat Insurans syarikat dan/atau mana-mana syarikat bersekutunya, di dalam atau di luar Malaysia, untuk tujuan pentadbiran atau pemasaran langsung dan dalam sambungan ini, Kami mungkin memindahkan atau mendedahkan maklumat tersebut kepada mana-mana syarikat lain tersebut. Kami akan berhenti menggunakan Data Peribadi untuk tujuan pemasaran langsung jika Anda meminta Kami berbuat demikian. Untuk butiran lanjut, sila rujuk "Notis Privasi Data" Kami yang ditetapkan dalam laman web Kami.

4. Melalui waranti ini, Polisi insurans dibatalkan secara automatik melainkan premium penuh dibayar kepada penanggung insurans dalam tempoh 60 hari dari tarikh permulaan perlindungan.
