My stance- Because research conclusively proves that Fetus’s can’t feel pain until at least after the 24th week, I would put week 24 as the cut off date to get an abortion barring any instance that would put the mother’s life and long term wellbeing at risk.
A state-by-state breakdown of abortion laws
MN has no cut off date for abortion.
The portion of the law that still remains originally read as follows: “A live child born as a result of an abortion shall be fully recognized as a human person, and accorded immediate protection under the law. All reasonable measures consistent with good medical practice, including the compilation of appropriate medical records, shall be taken to preserve the life and health of the child.”
After Walz’s revisions, this remaining provision now reads a bit differently: “An infant who is born alive shall be fully recognized as a human person, and accorded immediate protection under the law. All reasonable measures consistent with good medical practice, including the compilation of appropriate medical records, shall be taken by the responsible medical personnel to care for the infant who is born alive.”
An argument for the changed wording states that they took it out to repeal the care for an infant born, but I argue that the part that says “An infant who is born alive shall be fully recognized as a human person”

Minnesota does not appear to have any “statutory limit on abortions,” according to KFF. The Guttmacher Institute also notes “abortion is not restricted based on gestational duration” in Minnesota. Finally, FindLaw states, “abortion is legal throughout all stages of pregnancy in Minnesota.”
The majority of abortions occurred at less than nine weeks gestation, with 8,055 abortions, according to data from the Minnesota Department of Health. This data shows a total of 12,175 abortions occurred in the state between January and December 2022. Of the 12,175 individuals that obtained abortions, 10,166 were Minnesota residents, according to Table 4 from the same report.
644 abortions occurred between 13-15 weeks, while 225 abortions occurred between 21-24 weeks. Two abortions took place between 25 and 30 weeks. No abortions were reported as having taken place after 31 weeks. The clinically estimated fetal gestational age was not reported for 85 abortions.
According to American College of Obstetricians and Gynecologists- The science conclusively establishes that a human fetus does not have the capacity to experience pain until after at least 24–25 weeks. Every major medical organization that has examined this issue and peer-reviewed studies on the matter have consistently reached the conclusion that abortion before this point does not result in the perception of pain in a fetus.
