The Office of State Planning Coordination works closely with and staffs the Cabinet Committee on State Planning Issues. The Office of State Planning Coordination's mission is the continuous improvement of the coordination and effectiveness of land use decisions made by state, county, and municipal governments while building and maintaining a high quality of life in the State of Delaware.
Strategies for State Policies and Spending
OSPC releases the Strategies for State Policies and Spending every 5 years, signed by the Governor, and the last one was signed in July 2020. This is heard a lot by the applicants' lawyers referring to the Investment Level (1-4, or Out-of-Play).
Preliminary Land Use Service (PLUS)
When a land use application meets a certain criteria, the applicant has to apply for a PLUS review: https://stateplanning.delaware.gov/plus/
The review meetings, usually held once a month, are open to the public to observe, but not to give input. At these meetings various departments - such as DelDOT, DNREC (Delaware Department of Natural Resources and Environmental Control), DE State Fire Marshal's Office, etc. - get together and review the land use application and produce PLUS comments. We have noticed that P&Z and the County Council often ignore the PLUS comments, such as the land being not buildable due to hydric (wet) soil or the land being in the Investment Level of 4.
We have been told that the PLUS comments do not have enforcing power.
