What's Happening in West Virginia?

As of now, individuals must have state-mandated counseling 24 hours prior to the procedure. Telemedicine cannot be used to administer medicated abortions. Minors who are seeking an abortion must have permission from their parent. Abortions cannot be performed after 20 weeks unless it is a case of severely compromised health. Abortions using dilation and evacuation are prohibited unless it is a case of life endangerment or severely compromised health. Public funding for abortions is available in cases of life endangerment, rape, incest, and when the procedure is needed to prevent long lasting damage to an individual's physical health. If Roe v. Wade is overturned, a trigger law banning abortions will go into effect immediately.

In the Legislature

Senate Bill 468: This bill makes it illegal to perform an abortion because of a disability except in the cases of a medical emergency.

Senate Resolution 12: This resolution established January 22nd as the "Day of Tears" in West Virginia to mourn the loss of life after the decision of Roe v. Wade.

In the Courts
