Texas Governor
There are many ways pro-choice supporters and organizers can fight for reproductive rights. We encourage individuals to support their local organizations, write to government representatives and vote for politicians that defend reproductive rights.
What's Happening in Texas?
As of right now, all people seeking an abortion must receive state-mandated counseling 24 hours before continuing with the procedure. For those who live within 100 miles of the facility, this counseling must take place in person. Private insurance companies, public insurance and insurance under the state's exchange for the Affordable Care Act will only cover abortion in cases of life endangerment or severely compromised physical health. However, there is public funding available for abortion in cases of rape or incest. Telemedicine cannot be used to administer medicated abortions, and medicated abortions cannot take place past 7 weeks of pregnancy. For minors seeking an abortion in Texas, their parents must be notified and they must give consent for the abortion to occur. Before a patient can receive an abortion, they must undergo an ultrasound where the physician describes the image to the patient. This ultrasound must happen within the 24 hours before the abortion. Abortions are not legal after 6 weeks of Pregnancy unless it is a case of life endangerment or severe physical harm. Finally, Texas requires abortion facilities to meet unnecessary burdens in regards to their clinics, staff and equipment. If Roe v. Wade is overturned by the Supreme Court, then abortions in Texas will no longer be legal.
In the Legislature
There is currently no pending legislation in Texas regarding abortion. However, the state was recently in the limelight for Senate Bill 8, which restricted abortion after 6 weeks and created room for civil lawsuits to be filed against physicians who provide abortions after this time.
In the Courts
In March, the Texas Supreme Court shut down a federal challenge to the state's ban on abortions after six weeks. The law was allowed to go into effect in the state after the Supreme Court of the United States also chose not to block the law. Read more about this case HERE.
