Virginia Governor
There are many ways pro-choice supporters and organizers can fight for reproductive rights. We encourage individuals to support their local organizations, write to government representatives and vote for politicians that defend reproductive rights.
What's Happening in Virginia?
As of now in Virginia, public insurance covers abortions in cases of life endangerment, rape or incest. Minors who are seeking an abortion must have permission from their parents or guardians before moving forward with the procedure. Public funding is available for abortions if it is a case of rape, incest or life endangerment. An abortion can be performed in the third trimester if the patient's life or health is in danger. In 2020, Virginia passed the Reproductive Health Protection Act which repealed several laws regarding abortion restrictions in the state. Although Virginia is currently making strides to protect reproductive rights, the state could still be subject to laws that greatly diminish an individual's right to choose in the future.
In the Legislature
House Bill 212: This bill required that physicians and nurse practitioners follow certain procedures to gain a woman's written consent prior to performing an abortion. This bill did not pass.
House Bill 304: This bill required that physicians who attempt to perform an abortion exercise the same professional care and skill as they would with a infant who had been born alive. This bill did not pass.
House Bill 983: This bill prohibited abortions on the basis of race, sex, ethnicity and genetic disorder. It also added several stipulations to the procedures and process of abortions such as who could perform the abortion, ultrasound requirements and written consent. This act did not pass.
Senate Bill 710: This act prohibited abortions after 20 weeks unless a medical professional ruled that the mother's condition necessitated an abortion. This act did not pass.
In the Courts
There are no current court cases regarding abortion in Virginia. This state has recently passed legislation to protect reproductive rights, as explained above. Please click HERE to tell about any information you may have.
