These Terms and Conditions (hereinafter referred to as the "Terms") define the conditions for using the translation services (hereinafter referred to as the "Service") provided by the translator (hereinafter referred to as the "Translator"). Agreement to these Terms is required upon placing an order.
The copyright of the translated deliverables (including the right of adaptation) shall be transferred to the Client upon full payment of the fees.
The transferred translation data may be used within the specific project and in other projects by the same developer.
Prohibited Matters: The transfer, resale, or secondary distribution of the translation data itself to a third party is strictly prohibited. In the event of a violation, all subsequent transactions will be terminated immediately, and legal action may be taken depending on the situation.
The restrictions in the preceding paragraph do not apply to the transfer of rights associated with the sale, promotion, or platform expansion of the game itself.
In principle, the settlement currency shall be US Dollars (USD).
All transaction fees related to payment shall, in principle, be borne by the Client.
PayPal: The price will include an amount equivalent to the transaction fees.
Wise: Payments can be made at a fair price without additional fees.
Prices may be revised due to exchange rate fluctuations; however, revised prices will only apply to new projects accepted after the revision.
In principle, work will be conducted through designated files (Excel, Google Sheets, etc.).
To maintain context accuracy and manage word counts, fragmented translation requests via chat or email will not be accepted in principle.
However, the Translator will respond flexibly via chat for consultations on proper nouns, fine-tuning of existing parts, and other short texts deemed necessary by the Translator.
Areas that cannot be imported from files due to system constraints, or parts requiring manual input/translation, will be handled on a case-by-case basis.
Upon request, the Translator may suggest fonts suitable for the game's world-building (providing names, source URLs, etc.). However, the Translator assumes no responsibility for the terms of use, licensing, commercial availability, or any troubles arising from the use of said fonts. The final decision regarding font selection and implementation shall be made at the Client's own risk.
In the event of a conflict between these Terms and a separately concluded individual contract (such as an NDA or a contract provided by the Client), these Terms shall prevail unless otherwise specifically agreed. The Translator will prioritize the conclusion of NDAs and similar agreements.
The translated deliverables may be used freely within the specific project and other projects involving the same developer.
Prohibited Matters: Transferring or reselling the translation data itself to other developers is considered a serious breach of contract.
If a violation is confirmed, the Translator will no longer accept requests from both the transferring developer and the receiving developer. In malicious cases, legal action may be taken.
This article does not prevent the legitimate transfer of rights associated with the sale, promotion, or change of publisher/platform expansion of the game itself. Prohibitions are limited to the "secondary resale or transfer of the translation data itself."
As the Translator operates as a small-scale entity, the MTPE (Machine Translation Post-Editing) method is adopted to prevent careless errors and improve accuracy.
While translation memory tools or AI may be utilized, the Translator guarantees a "living language" translation optimized for context and character personality, with every single word reviewed and entered by the Translator.
Unauthorized alteration of the Japanese text after delivery is prohibited in principle for management reasons.
However, if adjustments are necessary for the development process (e.g., UI fitting, line break adjustments), they are permitted provided that a report is made before or after the change.
If unauthorized alterations are discovered, the Translator will not provide further support, such as consistency checks (re-inspection). Furthermore, if test play time is extended due to identifying altered parts or checking consistency, additional fees may apply.
The delivery date can only be specified as a period (e.g., "within X days after payment confirmation"). Specific dates (e.g., "by Month/Day") are not accepted in principle to avoid pressure on actual work time due to payment waiting periods.
The estimated delivery date is a guideline and does not guarantee a firm deadline. While the Translator will make every effort to meet the deadline, delivery may vary due to illness, disaster, unforeseen circumstances, or the simultaneous operation of multiple projects. The Translator assumes no responsibility for any damages incurred by the Client due to delivery delays.
When multiple projects run concurrently, the priority of work will be determined comprehensively by the Translator, considering not only the deadline but also project scale, contract plan, and progress status.
Final deliverables will, in principle, be delivered after payment confirmation.
During the work period, screenshots or a portion of the text (approximately 10% of the total) will be presented as a progress report and proof of work.
To protect data, no full data or samples will be provided before payment confirmation.
If immediate data provision is desired, the text for that specific scope will be provided promptly upon the condition of advance payment.
Switching from deferred payment to advance payment is possible at any time.
However, a work scope agreed upon as advance payment cannot be changed to deferred payment.
It is possible to return to deferred payment for the next step (next scope) after the completion of an advance payment.
No refunds will be provided after work has commenced, regardless of the reason, including breach of contract or cancellation of development for the Client's convenience.
In the unlikely event that continuation becomes difficult due to the Translator's circumstances, the rights to the parts completed up to that point will be transferred, and a refund will be issued for the uncompleted portion.
The Client shall inspect the content within 10 days of delivery. If this period passes, the inspection shall be deemed complete.
Defects within this period (discrepancies from the original text, significant typos, etc.) will be corrected promptly and free of charge.
Requests made after the period, revisions due to changes in the original text, or changes in nuance not included in the original instructions may incur additional fees.
The Translator assumes no responsibility for any business damages (loss of sales, legal trouble, etc.) arising from the translation results.
The following payment cycles shall apply based on the project scale:
Under 3,000 words: Lump-sum payment.
Under 12,000 words: 2 installments (50% each).
Under 40,000 words: 4 installments (25% each).
40,000 words or more: Every 10,000 words, or adjustment at the end.
Ongoing/Active Development projects: Every 3,000 words.
Word counts are calculated based on the external tool "WordCounter - Count Words & Correct Writing"
Words contained within tags such as < > or { } will also be counted as one word. This accounts for the workload involved in checking tag spelling, positioning, and maintaining consistency.
The word count is based on the source text (English).
Handling of duplicate text:
If excluded by the Client in advance: Deducted from the count.
If context verification and integration are performed by the Translator: Standard unit price applies.
Periods where work is suspended while waiting for payment confirmation are not included in the original estimated delivery schedule.
If the volume of text increases beyond the original plan's limit, the pricing structure of the higher-tier plan will automatically apply. In such cases, the Translator shall notify the Client in advance and obtain agreement. No additional charges will be applied retroactively to work completed before the migration.
For any published deliverables, the name designated by the Translator shall be included in the credits.
The Translator reserves the right to post the results of this work as a portfolio on websites, etc. The scope of disclosure depends on the development status:
Unreleased: Completely private.
After Demo Release: Within the scope of already public information.
Early Access and beyond: Within the scope of already implemented content.
With NDA: Subject to the terms of the specific agreement.
If the Client does not wish for partial disclosure of game screens or text, the Translator will respond flexibly upon prior consultation.

The Client and the Translator represent and warrant that they do not currently fall under, and will not in the future fall under, anti-social forces (organized crime groups, members thereof, or equivalent entities).
If the other party is found to be in violation of the preceding paragraph, the non-violating party may immediately terminate all contracts related to this Service without any notice. In this case, the terminating party shall not be held liable for any damages incurred by the other party.
As stipulated in Article 6, while the Translator makes every effort using the MTPE (Machine Translation Post-Editing) method, the Translator does not guarantee, expressly or implicitly, the completeness, accuracy, or fitness for a particular purpose of the deliverables due to the nature of machine translation.
If the Client incurs damages due to reasons attributable to the Translator, the scope of the Translator's liability for compensation shall be limited to direct and ordinary damages. The Translator shall not be liable for any lost profits, business interruption, loss of data, or any other indirect, special, incidental, or consequential damages, regardless of whether such damages were foreseeable.
In any event, the total amount of damages the Translator shall owe to the Client shall be capped at the actual amount of compensation received from the Client for the specific project that caused the damage.
Notifications from the Translator to the Client regarding this Service shall be made by methods deemed appropriate by the Translator, such as email, chat tools, or posting on the Translator's website.
Notifications via email or chat tools shall be deemed to have reached the Client at the time the Translator sends them to the contact information designated by the Client.
The Japanese version of these Terms shall be the original text. If a translated version of these Terms is created and there is a discrepancy in interpretation between the Japanese version and the translated version, the Japanese version shall always prevail.
These Terms shall be governed by and construed in accordance with the laws of Japan.
If a dispute arises between the Client and the Translator regarding these Terms or this Service, the district court or summary court having jurisdiction over the Translator's place of residence shall be the exclusive agreed jurisdiction of the first instance.
If the Client violates any provision of these Terms, or if contact with the Client is lost for 14 days or more, the Translator may immediately suspend work or terminate the individual contract without prior notice.
In the case of the preceding paragraph, the Translator reserves the right to charge the Client for work costs incurred up to that point, and any payments already received will not be refunded.
Even if any provision or part of these Terms is determined to be invalid or unenforceable under consumer protection laws or other regulations, the remaining provisions of these Terms shall continue to be in full force and effect.
