(Andrew Craig) On behalf of a real estate development client seeking to acquire property, we negotiated and closed a complex real estate transaction involving significant environmental issues in New Jersey that allowed the transaction to proceed on schedule despite considerable environmental hurdles. Also able to secure on behalf of the client continued cleanup responsibility by the predecessor in title and also to protect the buyer/client from environmental exposure in the future. This permitted the client to ultimately develop the property to its highest and best use.
(Andrew Craig) On behalf of a municipality, we assisted in evaluating, negotiating and closing the purchase of an environmentally challenged property from a Fortune 100 company that had owned and operated the facility for 50+ years. Also assisted the municipality in evaluating the risk factors associated with the environmental issues at the property and the attendant ownership obligations to, then, negotiate environmental and contract terms with the seller to minimize the client’s risk in taking title. In addition, we assisted the client in evaluating and purchasing environmental insurance to further protect it and its constituents as owners of this desirable piece of open space property.
