Upper Canada Land Petition of Lavinia Mabee [signed Levinah] dated at Niagara on 18 Oct 1797

Humbly shews- That your Petitioner is the widow of Frederick Mabee, a steady Loyalist who came into the Province about Six years ago with your Petitioner & Eight Children, and died soon after, having never been confirmed in any Land—That His Excellency the Lt Governor was pleased to authorise your Petitioner to settle at Long Point and with his permission she has occupied Lots No 8 & 10 in front of the Township of Charlotteville – she therefore respectfully prays your Honor would be pleased to confirm her in said Lots – also the marsh in front of No 8 – and a small slip of maple ground containing about 17 or 18 acres, lying between two of her fields – and constituting a point of Land – and that your Honor would be pleased also to indulge her with a Town Lot 0 at Turkey Point near to her present Dwelling – And your Petitioner as in Duty bound will ever pray—[Signed] Levinah Mabee” Received at the Executive Council Office on 29 Jan 1798 and read the same day. “May it please your Honor—In obedience to your Honors orders of Reference to me to report upon the petitions of Edward McMichael & Mrs Mabee – I applied to the Deputy Surveyor of the Long Point Circle, & I learn from him, “that the Quantity of marsh petitioned for by Mr McMichael in front of his lot No 14 is as p the enclosed Plan; the granting of which, he does not think would be of any detriment to the Settlement, for the following Reasons—vizt Because Mr McMichael does, by no means appear to be ever craving in this business, as being willing to relinquish a large quantity of mowing ground, actually lying in front of his Lot, as may be seen sketched on the enclosed Plan & in order to get 34 ½ Acres of good Mowing ground, is willing to include 121 ½ acres of sunken marsh, which appears to Mr Welch will never be of use to anyone—And any of the Settlers who cut hay in that vicinity have plenty of Land proper for meadow Ground; which is however not the case with all the Settlers in Charlotteville” With regard to Mrs Mabees petition, he says, he is fully of opinion “that the granting of it would be of no injury to the Settlement, or to the Public, her claim being generally understood there, & disputed by no one that he knows of” I had also reference to Mr Welch upon the petition of Mr McCall & he reports to me “that he does not learn any one has heretofore cut Grass upon the Marsh in his front, except John Troyer & Christian Troyer; The former he understands has the Marsh in his own front granted to him;” & the latter has left the Country with his family so that therefore he does not conceive that the granting of this old Gentlemans petition would be of any injury to the Public.” All which is submitted to your Honors Wisdom—[Signed] D W Smith A S Genl” [Upper Canada Land Petitions LAC “M” Bundle 4, Petition Number 259a]

“Humbly Sheweth—That your petitioners Late Husband Joined the Royal Standard last American war, and at the reduction of 1783 Settled in Novia Scotia where she Continued til the Year 1792, That from His Excellency Governor Simcoe’s promises your petitioners late Husband came to Quebec, and was recommended by His Excellency to all the Commandg Officers of the different Posts for assistance, in Order to reach Niagara – Your Petitioner likewise followed her Husband into the British Governt during the war, and has never returned to the States – your petitioner being now a widow, and nothing to depend upon but the bounty of Governt, and Conceiving herself entitled to the priviledges of a U E from her having come within the British Lines with her Husband prays your Honor would permit her to be put upon the List for the Home District and she as in duty bound will ever pray—[Signed] Levinha Mabee” Received at the Executive Council Office on 25 Jun 1798 and read in Council on 27 Jun. Mentioned in the Upper Canada Land Petition of Peter Montross – of Charlotteville dated at York (Toronto) on 19 May 1798

“Humbly sheweth – That your Petitioner is a native of the late Province of New York, & lived on the north River; that at the beginning of the American war, he joined the corps of Royal Americans commanded by Colo Robinson, and at the Peace, went to Nova Scotia – that in the month of July last, he came to this Province with his Family, which consists of a wife and nine children – that his wifes name is Leah – and is Daughter of the late Simon Mabee U. E. & sister of the late Frederick Mabee, whose widow Lavinia Mabee now lives in the Settlement of Long Point, and that his wife had also a Brother called Simon, a captain in a Corps of American Loyalists who was hung by the Rebels for his attachment and services to Government. Your Petitioner has received 400 acres of Land, for which he is thankful, – but having never been admitted to the List of U. E. – (not knowing of any Commissioners sitting for that purpose) nor has his wife received any Land – He respectfully prays your Honor would be pleased to allow his name to be enrolled as a U. E. and to grant his wife 200 acres as an American Loyalist—her aforementioned Brother Frederick having received Lands as such – and your Petitioner as in Duty bound – will ever pray—” Peter Montross made his mark. “witness T. “Respectfully Sheweth That your Petitioner is the Daughter of Frederick Maybee an American Loyalist who joined the Royal Standard and adhered to the Unity of the Empire. That your Petitioner has not as yet (as such) received any land. Your Petitioner therefore most humbly prays That your Honor would be pleased to grant her such allowance as you in your wisdom shall think proper. “Humbly Sheweth That your Petitioner has resided in this Province upwards of four years, and received Two hundred acres of Land- That your Petitioners Father came to this Country at the same time your Petitioner did, and dying soon afterwards never drew any Lands, which he would have been entitled to as a U. E. The Petition of Finlay Malcom late of the Province of New Brunswick, on the part & behalf of sundry Families of the said Province, associates of Gideon Vernon—Humbly sheweth That your Petitioner, with Fifteen other Families of the above named associates came into the Province last Fall, to whom your Excellency has been pleased to grant a Lot of Land each – that upwards of Forty other Families of the above description would immediately set out for this Province, on their being assured of a Tract of Land, whereon they could settle together – Your Petitioner therefore humbly Prays your Excellency would be pleased to grant a Tract of Land, between Patersons Creek & Youngs Creek in the settlement of Long Point, or in that vicinity if vacant sufficient for the accommodation of Fifty Families & to be considered as Lands heretofore granted to Gideon Vernon & his associates, which, unforseen Events have prevented from coming sooner into this Province And your Petitioner as in Duty bound shall ever pray—Finlay Malcom” Received at the Executive Council on 11 May and read in Council on 5 Jul. Upper Canada Land Petition of Finlay Malcom dated at Niagara on 10 May 1796 [using a pre-printed form with fill-ins]

“The Petition of Finlay Malcom – who arrived last Fall with his Family from New Brunswick—which consists of a wife & Eleven Children—& has received 200 acres of Land— That your petitioner is settled on the lands of the Crown in this Province, being in a condition to cultivate and improve the same. That he has taken the usual oaths, and subscribed the declaration, that he professes the Christian Religion, and obedience to the laws, and has lived inoffensively in the country which he has left. Prays your Excellency, would be pleased to grant him & family [added?] him to the Lands they have received (at Long point) upon the terms and conditions expressed in your Excellency’s proclamation bearing date the 7th day of February, 1792. “Humbly shews – That your Petitioner served His Majesty 37 years: was in actual Service the whole of the American War and has honorable Testimonies of his Conduct—That His Excellency Lieut Governor Simcoe was pleased to signify to your Petitioner, a wish to serve him in anything he might point out and was in his Excellencys power to give which he has reason to think, the Honbe the Ag Surveyor General is not unacquainted with—that happy to avail himself of His Excellencys kind intentions, your Petitioner has discovered a mill seat on Lot No 5 in the front of the Township of Walpole on the River Nanticoke, which Lot he does not learn is reserved, unless it be on account of some Lime Stone said to be thereon – and which your Petitioner would entirely resign to the public use should he be indulged with the Lot—Wherefore he respectfully requests to your Honor would be pleased to grant it him, in order that he might erect mills thereon – (exclusive of the Compliment granted or otherwise in deducting 200 acres therefrom) him as Captain and your Petitioner as in Duty bound will ever pray—[Signed] David McFall” Received at the Executive Council Office on 4 Feb 1797 and read in Council on 4 Feb 1797. Augt 1776 He Joined His Majesty’s 8th Regiment at Niagara.—

September He went to Montreal and entered a Cadet in Sir John Johnsons Corps.—

March 1777 He was sent with Dispatches through the wilderness to Sir William Howe in New York, on his arival in that City was made 1st Lieutenant in the Guides and Pioneers and served as a Guide to the Army in Jersey until that Province was evacuated; Embarked with the Army and on their arival at Philadelphia was appointed Chief Waggon-Master in the Provision Train.—

Decr 1779 He resigned the place of Waggon Master—

1780 Raised a Company of Loyalists and Clothed them in uniform at His own Expense, Joined Major Ward in Jersey, was thrice made Prisoner and severely treated his only Brother after served upwards of Three years as a Conductor in the Quarter Master Generals Department, was made prisoner and died after being almost a year confined in a common prison in New England.

Your memorialist came to this Province in 1788 after a Long confinement in Jersey; has a Family of Eight children, and prays that your Excellency will grant him an allotment of Land as a compensation for his services, and likewise the lands of his Deceased Brother, as he is the only surviving Heir,—His Family Lands he located in 1788 by sanction of the Land Board, but the other Lands he has not taken. Your Memorialist begs leave to refer you to William Jarvis Nathaniel Pettit, and Joshua Pell Esquires who knew him for many years before he removed to this Province. To give a Summary of his sufferings, he begs leave to State that he has been four times Wounded and Thrice made Prisoner: His only Brother after serving His Majesty Five years was wounded, and made prisoner, and after Languishing several months, in Norwich Goal he Died—As a Captain of the Loyalists your Petitioner prays for a Grant of 3000 Acres of Land, or such quantity as may be consistent with His Majestys Instructions for the Provision of Loyalists settled in Canada.—He has a wife and Ten children. That in consequence thereof your memorialist made a settlement there, built a good house thereon and remained on the Premises two Winters. —That being again called into the Kings service at Detroit, your memorialist Let the said Tenement and Premises to Isaac Smith for the Term of four years, who by his agreement who was to clear at least one Acre every year and to allow your memorialist one half the encrease of the Cattle belonging to your memorialist, then on the Farm, as is customary in the Country. That your memorialist has been lately informed, the said Land, Tenement &c are now about to be granted to a person of the name of McMichael, which your memorialist humbly begs to state would be a very considerable loss and a great misfortune to him, should he be so deprived thereof, having been entitled to His Majesty’s gracious bounty from his services since the year 1776 and confidently relying on the promises of Colonel Butler who was at that time principal member of the Land board for the District, under whose authority your memorialist made the settlement—Your memorialist is satisfied your Excellency is heretofore uninformed of these circumstances, and the great distance of his employment altogether precluded him from the Knowledge of any application having been made for the Land which your memorialist considered as his own, on the faith of Colonel Butler. “Humbly Sheweth—That your Petitioner was a Zealous and active friend of the British Government during the Rebellion in America in the adherence to which your Petitioner lost a very valuable and large Property; besides being Imprisoned a long time in the Gaol of Albany, […..] Previous to that he largely Expended in aiding assisting the Kings Friends, but more especially to the Corps commanded by Col. Butler, and the Men under Captain Brant many of whom can Testify the Truth of what Your Petitioner now asserts; Your Petitioner had large Claims on the British Government, and in the year 1784 took a Journey from this to Quebec Intrusted these Claims to the attention of Sir John Johnson but these with many others were either lost or some accident befel them, fatal to the Interest of many in this Country – Your Petitioner is Settled on the Mountain, is married to the Daughter of William Goss a Distinguished and Marked Tory in the Place he came from, has several Children, one of whom was Born before the Year 1789 as per Certificate. Upper Canada Land Petition of the Mennonists (Mennonites) of the Niagara District read in Council on 7 Apr 1819

“The petition of the Mennonists, (or harmless Christians) of the District of Niagara – Humbly sheweth That your petitioners confident of support from Your Excellency in everything which may concern the welfare of this Province & the interests of eeligion, beg leave to represent, that many of our persons of this persuasion, as well in the District of Niagara as in other places, being about to petition your Excellency in Council for grants of the waste lands of the Crown, your petitioners are desirous of keeping up as much as possible among them, these sentiments of morality and religion, which it has been their case to enstill into their minds. Your petitioners need not represent to your Excellency the disadvantages under which these young persons will labour, should it be required of them to locate by lot, indiscriminately with others, the Lands which they may obtain for, if scattered over a Township with persons of a different persuasion, the difficulty of their children attending their own school, which is High Dutch, the almost impossibility of settling among themselves a Minister of their own religion will in time cause a total loss of all moral obligations, a carelessness respecting the peculiar tenets of their sect, & an insensibility to the danger of their immortal souls. To prevent these fearful evils, your petitioners humbly beg your Excellency will consider, how highly advantageous it would be to them, & to the Province in general, even one half, or even any portion of one of the Townships now about to be surveyed, to be allotted for a term of eight or ten years, to be granted by Mennonists only – taking up the Lots in regular succession – at the expiration of which period should it not be entirely occupied, then the remainder to be at the disposal of the Crown to such settlers as might wish to locate thereon. Your petitioners cannot omit to mention, that although their religion forbids them taking up arms, yet they never have been backward, but on the contrary, have always cheerfully contributed to the utmost in their power to uphold the Government under which they have the happiness to live, as their conduct during the late war will [….] by – and that they have been [……..] led to this [……..] by some of the most respectable inhabitants & clergy in the District with every hope of success. “most Humbly sheweth That your Petitioner was appointed by the will of his deceased brother Jesse Millard one of his Executors. That the said Jesse at the time of his decease left two children who are since dead without issue by which your Petitioner has become the sole Heir at Law to his brothers estate. That the widow of the deceased having been joined with your Petitioner in the Administration has since refused to act after having obtained Possession of the greatest past of the personal property without paying any of the Debts, or otherwise accounting therefor, and refuses to deliver the Minutes of Council given by the order of your Excellency for the benefit of the Heirs. That your Petitioner is willing to give her the share allow’d by the will it being exactly what the Law in such cases allows. Your Petitioner therefor most humbly prays that your Excellency would be pleased to direct the grant for the Lot Number One hundred and twelve in the Township of Stamford containing One hundred Acres to Issue in his name, as well as the remaining two hundred to which his said brother was Intitled for his military services. “Sir, On the 21st Sepr last, your Honor directed me to locate a man by the name of Jacob Misner, (recommended to you by Captn Ryers,) on a farm Lot in the vicinage of Long Point. After searching the office, I discovered that a man by the name of Jacob Miesner had received an assignment on the 9 May 1795, (no 668) for 200 acres in Crowland, upon a Land board certificate of the 3d May, 1791 – Presuming this to be the same person, altho the orthography of the Sir name differed a little, I refused to locate him, upon your Honors order, & a warrant, which he had lodged the day before (the 20th Sepr) no 276 for 200 acres – until he gave me a Certificate, conjointly with some other person, that he was not the Jacob Misner, who claimed the Lands in Crowland—In consequence of which he with one John Misner Senr gave me the annexed certificate—Upon which, 200 Acres were described in Woodhouse (no 2125) on the warrant—After this the Land board Certificate was sent to me to be described; still conceiving there was another Jacob Misner; & it was accordingly described (no 2149) but there being some instrument in writing on the back of it, I could not divest myself of suspicion; I therefore wrote on the 21st feby last, to Jacob Misner of Woodhouse, & to Jacob Misener of Crowland, to know how they were distinguished – but receiving no answer I began to make inquirys of several persons as to the unity of Jacob Misner & Miesner, & I have reason to believe He is one & the same Person, particularly from the information of one Peter Mathews, who says he has given him a valuable consideration for his land in Crowland—In the hope, however, that this may not affect a second Person, should there be another Jacob Misner, I am your Honors most obed Servant [Signed D W Smith ASG [To] His Honor The Administrator” [Upper Canada Land Petitions LAC “S” Bundle 3, Petition Number 123]

That your Excellency and Honours were Graciously pleased on the 31st Day of May 1794 to grant leave to Hannah Mitchell mother to the said Mary Welch to locate for and in the name of said Hannah Mitchell Two hundred Acres of Land lying and being with the Township of then Sugar Loaf East now Humberstone, as by the Minutes or order of your Excellency and Honours together with the Acting Surveyor Generals Assignment for 190 Acres part of the 200 Acres aforesaid herewith Exhibitted will appear. And whereas the said Hannah Mitchell is since that time To Wit. in September 1794 Departed this life. “Sir I hope that your goodness of Heart will pardon the liberty I have taken in writing to you, seeing I am not honoured with an acquaintance with you sufficient altogether to warrant such a liberty. “Humbly sheweth – That your Petitioner is a native of the late Province of New York, & lived on the north River; that at the beginning of the American war, he joined the corps of Royal Americans commanded by Colo Robinson, and at the Peace, went to Nova Scotia – that in the month of July last, he came to this Province with his Family, which consists of a wife and nine children – that his wifes name is Leah – and is Daughter of the late Simon Mabee U. E. & sister of the late Frederick Mabee, whose widow Lavinia Mabee now lives in the Settlement of Long Point, and that his wife had also a Brother called Simon, a captain in a Corps of American Loyalists who was hung by the Rebels for his attachment and services to Government. Your Petitioner has received 400 acres of Land, for which he is thankful, – but having never been admitted to the List of U. “Most Humbly sheweth That your memorialist applied near five years ago to Colonel Butler, then at the head of the Land board for the District of Nassau, now the home District, for vacant Lands of the Crown, whereon he might settle, and was informed by him in the presence of Major Powell, to take four hundred Acres at or near a Creek called trading house Creek but since known by the name of Murphy’s Creek near Long Point, until the same could be surveyed when your memorialist should have a grant thereof. That in consequence thereof your memorialist made a settlement there, built a good house thereon and remained on the Premises two Winters. —That being again called into the Kings service at Detroit, your memorialist Let the said Tenement and Premises to Isaac Smith for the Term of four years, who by his agreement who was to clear at least one Acre every year and to allow your memorialist one half the encrease of the Cattle belonging to your memorialist, then on the Farm, as is customary in the Country. That your memorialist has been lately informed, the said Land, Tenement &c are now about to be granted to a person of the name of McMichael, which your memorialist humbly begs to state would be a very considerable loss and a great misfortune to him, should he be so deprived thereof, having been entitled to His Majesty’s gracious bounty from his services since the year 1776 and confidently relying on the promises of Colonel Butler who was at that time principal member of the Land board for the District, under whose authority you memorialist made the settlement—Your memorialist is satisfied your Excellency is heretofore uninformed of these circumstances, and the great distance of his employment altogether precluded him from the Knowledge of any application having been made for the Land which your memorialist considered as his own, on the faith of Colonel Butler. Upper Canada Land Petition of Timothy Murphy dated at Sandwich (Windsor) on 26 Aug 1797

“Timothy Murphy, Blacksmith to the Indian Departmt begs leave to represent to your Honor, that when the Land board Existed at Niagara; your Memorialist obtained permission to settle himself at Long Point. —previous to the survey of the same, and did therefore build a House, and make Considerable improvements, and resided for some time on the lands. That about four years ago, your Memorialist was called to Detroit, by Colonel McKee, and leased the Premises to Isaac Smith, who was residing on the Same—when Mr McMichael obtained from your Honor a grant of the identical land, your Memorialist had settled upon. —and as your Memorialist is informed is about to obtain a Deed for the same—and in Consequence thereof has ousted the Tennant of your Memorialist who always looked forward to the Confirmation of the said Land by the Government to your Memorialist, who humbly prays that your Honor in Council will be pleased to Consider the case of Your Memorialist and grant him redress by Confirming the said land to your Memorialist. Colonel Powell can certify as to the authority given your Petitioner for Locating the land & the Services and Character of your Memorialist [So] Annexed to a former Memorial signed by Colonel McKee—And your Petitioner as in duty bound will for Ever pray—[Signed] Timothy Murphy” Received at the Executive Council Office on 20 Mar 1797 and read in Council on 26 Feb 1798.
