Throughout the course two case law briefing exercises were presented for legal analysis to assess knowledge of the subject matter presented. Critical thinking skills, written organization skills and the ability to make practical application of the legal principles covered were to be demonstrated. This represents one of those two.
This very important case review regarded an actual case of potential discrimination and privacy violation at a college in Rhode Island. It concerned whether or not an overweight student could be accepted and stay in a school program when her weight may have been an issue. Soon after leaving Salve Regina College, the student filed a civil action in the United States District Court for the District of Rhode Island. She asserted, among others, claims based on (1) intentional infliction of emotional distress, (2) invasion of privacy, and (3) nonperformance by the college of its implied agreement to educate respondent. Subject matter jurisdiction in the District Court was based on diversity of citizenship. A serious application can be made to my work because I understand to respect diversity of students and help accommodate their education, even if there is no legal disability. Furthermore, invasion of privacy is a serious issue not to be violated as it can cause emotional distress. With different types of people in Adult Education, this was a very important topic for me to learn about.
