We will provide some information on the status of various aspects of the development here. Since these are not the responsibility of the HOA to complete, we can only provide general information, and no firm projected dates. But we can provide information on where they currently stand and what remains to be completed. These are generally based on updates from the developers. If you have any updates please contact John Root at wildroot@gmail.com so that we can make sure this information is as accurate and complete as possible.
Any confirmed information that we have in the HOA we will try to get posted here ASAP. If you don't see it here, and it is clearly a developer issue, we probably don't have any additional info. If you have any questions about specifics, please contact the Harvest Park developer first: Blaine Turner at 801-510-1846. This will help them understand the level of resident concern about these issues.
Clubhouse/Community Center
As of late 2014 the developers have ordered exercise equipment and are working on a security/door access system. The developers and HOA board will need to coordinate to establish and operating and use agreement that allows the HOA members and residents use of the facilities.
[PRIOR] As of early June, 2012, there still remain minor items that need to be corrected to pass final inspection and get a certificate of occupancy for the building. The HOA is still waiting for word from the developer regarding plans for furnishing and finishing other interior items, as well as finishing the landscaping.
[PRIOR] As of mid-June, 2011, interior painting, electrical work, hardwood flooring, tile, and exterior railings have been completed. Exterior door installation is in progress. Some lighting has been installed, but the main lighting for the large hall is still being finalized, as are landscape plans. The developer currently has plans to rent out the clubhouse for non-Harvest Park events (e.g., receptions and meetings) as well to help offset the costs of operation. Unfortunately the clubhouse lot is not currently zoned for any type of non-community events, so the city will need to amend the zoning to enable this.
[PRIOR] As of the end of March, 2011, the interior finish work on the clubhouse is continuing (painting, to be followed by flooring). All exterior doors are on order. Bids have gone out to complete the railing for the wheelchair accessible ramp to the basement (necessary before it can be considered complete and compliant with ADA laws). Once all of the inside finish work has been completed, as well as the outside railings (and any other safety items), the city can make a final inspection in order to receive a certificate of occupancy. The date of that is still uncertain. The sales office will move over to the clubhouse, and there is some exercise equipment that will be available at the time the clubhouse opens.
City Park
The main park area is a city park. The developers have made most of the improvements, and actually deeded the property to the city back in March, 2008. The original plans apparently called for tennis courts (this has been marketed by the developers for many years now and continues to be marketed), as well as another activity area (like basketball courts or sand volleyball courts). Those plans are currently in limbo pending final decisions among developers/city (they have said they want to get resident feedback first). Tree and planter area landscaping still needs to be completed. Final plans are in place, but the sources of funding for this are also somewhat uncertain.
Pool
No start date for the pool has been scheduled and no specific plan has been provided by the developers.
Trailer Parking Area
Because trailers and other RVs can only be parked in driveways or on the streets for a short period of time the master plan has called for a separate storage area for such vehicles. The HOA has had numerous discussions with the developers and although they have presented several ideas they have never been able to identify a temporary storage area. In the past, a section of River Birch Road was being used as a trailer storage area, but the city asked that that no longer be used. An area near Slant Road has been identified, but no progress has been made recently on this (as of June 2012).
OTHER ONGOING ISSUES IN THE DEVELOPMENT (SEE END OF LIST FOR COMPLETED ITEMS)
The section below provides a list and some information (more to be added over time) regarding other problems in the development that need to be corrected or work still be completed by the developers. These are commonly asked about by homeowners in the development. Although the HOA does not have an obligation to correct these issues (they are the obligation of the master developers to fix) we will try to keep people informed regarding progress on these issues (if any). If you have any questions about specifics, please contact the Harvest Park developer first: Blaine Turner at 801-510-1846. This will help them understand the level of resident concern about these issues.
1. Major debris collection in north section & other lots [PROGRESS UPDATED]
Some concrete debris removed from other areas in the development was dumped in the north section of the development. Apparently others from outside the development were also using the area to dump debris illegally. Construction debris (primarily concrete rubble) has started to accumulate on other lots as well.
DURATION OF PROBLEM: Increasing problem since 2009.
PLANS: The developers have repeatedly indicated plans to remove the debris, but nothing has happened to this point. On these individual lots the HOA can assess fines for failure to keep the lots clear.
ACTION/STATUS: This section has now been platted and improved, so the streets and utilities are in. This helped resolve many of the debris issues, although there are still pockets of debri on lots, especially in the section toward Slant Road. (as of 2014)
2. Incomplete landscaping in townhomes and no trees in street frontage of some townhomes [PROGRESS UPDATED]
ACTION: Many of these locations have now been completed by the builders (with coordination and some involvement from the HOA), although several homes are still missing trees. The developer has indicated that they will resolve this at some point in the future. (as of Oct. 2014)
3. Drainage problems in alleyway behind townhomes
There were a number of townhomes with unfinished or incomplete landscaping. These are primarily planter areas, and trees along the street. Dubois Enterprises claims that when Harvest Park, LLC took over the remaining townhome lots they were supposed to take responsibility for finishing the landscaping.
The grade is not correct in some sections behind the townhomes, leading to water accumulation.
DURATION OF PROBLEM: Problem since initial completion of the road and gutter behind townhomes.
PLANS: Unaware of any plans to address this by Dubois Enterprises.
ACTION: Dubois Enterprises did put in a catch basin in one section, but it has apparently not prevented all flooding.
4. No mailboxes in other sections as homes built
Currently the majority of mailboxes are located over near the future clubhouse. The plan is to have mailboxes located throughout the development as homes are built. The Ladybug Park mailbox was moved in 2010 when the majority if the construction work was completed on that (still one minor finish item there), however no other mailbox adjustments have been made.
DURATION OF PROBLEM: Increasing problem since 2008.
PLANS: The HOA has requested copies of the master mailbox plan for the development. Still waiting to receive these. The HOA could assist with this item by having residents coordinate with the postal service and postmaster in Springville.
ACTION: No action by developers as of 2011. The HOA attempted to coordinate completion of mailbox pads in spring of 2012 using bond funds held by the city, but city indicated that there were no funds remaining that could be used for this (they had all been used for the asphalt overlay).
5. Incomplete Trail from Ladybug Park [PROGRESS UPDATED]
The trail between the Ladybug Park and the townhomes has a sidewalk and some trees now, but the planter areas close to the park still need to have the rock work completed.
PLANS: Unaware of specific plans by the developer to finish the work that was started.
ACTION: Trees were planted in 2010, and the sprinkler system was started however, however work has not continued in 2011. In June 2012 homeowners started doing the work to finish the trail, and the HOA has been covering the cash-flow needs (to be reimbursed by the developers). The stone planter boxes still need to be finished with the cap stones. A bid was obtained by the HOA in 2014 to complete this work (and bill back to the developer or add to the note as well).
6. Incomplete trail in west section of townhomes
Planter boxes were installed at the location where the trail from townhomes crosses crescent way to the southwest. No additional work has been done.
PLANS: Unaware of specific plans by the developer to finish the work that was started. The HOA has requested that the developer at least fill the boxes with dirt so that they are not a safety hazard and so that trash does not accumulate.
ACTION: None recently. In July Blaine Turner indicated that they (the developer) would look into installing a water meter in this section.
7. Incomplete landscape areas between townhomes and future clubhouse [PROGRESS UPDATED]
DURATION OF PROBLEM: Work started on the trail in 2007 or early 2008, and it has been in some state of partial completion ever since.

The walkway from the townhomes to the city park and clubhouse area is incomplete. Stonework on the townhome side of the street in incomplete and falling apart in areas. On the opposite side of the street the sidewalk and landscaping are not complete.
DURATION OF PROBLEM: This has been in some state of partial completion ever since started (in 2007 or earlier)
PLANS: The section on the north side of the street is not part of the clubhouse project according to the developers (it is city land). They have said that they need to talk with the city to see what bond funds may be available for release once the sidewalk on that side is completed.
ACTION: In 2014 significant progress was made on the clubhouse side of the street, although it is still incomplete. The work in the median and on the townhome side also still needs to be completed by the developers.
8. Storm drain pipe collapsed location
A storm water collection area at the T-intersection on River Birch road was collapsing with dirt falling into the stormwater collection system because the underground vault or pipes were not fully connected and enclosed.
PLANS: Not aware of any.
ACTION: The ground was graded, filling in the sinkhole area where the soil was collapsing, but there is no evidence that the underlying problem was corrected.
9. Townhomes not aligned with property lines [PROGRESS UPDATED]
DURATION OF PROBLEM: Since installation (2007 or earlier?)
A number of townhomes on the north side facing the city park were built across property lines. Apparently when the foundations were poured the did not line up with the lines, and the townhomes were completed this way. The developers have not stated exactly which townhomes fall into this problem. If you have questions you should contact Blaine Turner with Harvest Park or Mike Dubois with Dubois Enterprises.
DURATION OF PROBLEM: Since construction of the affected townhomes.
PLANS: According to Blaine Turner with Harvest Park this action can be rectified relatively easily by adjusting the plat (the record of the lot locations) so that it matches up with the actual locations of the townhomes as built.
ACTION: Dubois Enterprises has been working with Harvest Park (Jerry Robinson) to get this addressed [as of May 2012]. A new plat has been completed to correct the property lines, however the final approval is being held up by the county because they want additional signatures from all property owners in the HOA. We are discussing ways to avoid that and get this approved. (as of November 2014)
10. Silverleaf home driveway cutting into other private property/utility access improperly placed
When constructing lot L48 and L49 the developers poured the driveway and parking strip across the property line into the backyard of an adjacent lot (L42). Utility connection pedestals were also placed on the wrong side of the property line so that they are also now in this backyard space.
DURATION OF PROBLEM: Since construction in 2007 or earlier?
PLANS: Not aware of any.
ACTION: None.
11. Improper electrical connections for sprinkler system for common areas
Rather than properly establishing an electrical meter connection for some of the sprinkler timer systems that water parks or large common areas (such as the townhomes) the developers simply attached timers and valve control boxes to the nearest home. (This does not apply to Silver Leaf homes which should all have a separate timer on each home.)
DURATION OF PROBLEM: Since construction (varies, most back to 2007)
PLANS: The HOA is working to identify locations for alternate connections and will switch these over wherever possible.
ACTION: The HOA has reimbursed homeowners in this situation and John Root has made contacts to Rocky Mountain Power to see about adding meters in June, 2011. Spring 2012: Work has continued on solving this problem at the townhomes.
12. Electrical meter & connection for round-about not made permanent
There is a temporary electrical access pedestal in the main city park near the playground that is apparently the power meter for the roundabout. This needs to be made a permanent meter at some location on the HOA property.
DURATION OF PROBLEM: Since construction.
PLANS: Not aware of any.
ACTION: None.
13. Many street frontage trees not installed by builders
A number of homes were completed and sold without installing street frontage trees which are required by the original master development agreement. These include homes sold by Harvest Park, as well as homes build by a number of other developers (including some that went through foreclosure). The city should not have released construction/landscape bonds on these homes, but in almost all cases they did release these funds.
DURATION OF PROBLEM: Since construction (primarily homes finished since 2007)
PLANS: The HOA is now making sure that the requirement is followed on all new homes. The city has offered to send notices to all homes not in compliance, and the HOA is considering ways to help facilitate the planting of these trees. Ultimately it would likely be the responsibility of the original builder, or the homeowner if the builder is unwilling to help, to correct these issues.
ACTION: No recent action.
14. Unfinished garages on homes
There are several units that were originally model homes that still do not have garages (they are currently office or storage space). Those will eventually need to be corrected.
DURATION OF PROBLEM: Since change of homes from model status to occupied residential units (2008/2009).
PLANS: Not aware of any plans by the original developers who built these homes to go back and correct these issues.
ACTION: One home was completed in 2013, but one home remains.
15. Water shares currently assigned to individual lots
When the land was purchased, apparently the irrigation water shares (Strawberry Water Shares) were allocated to each of the lots, rather than transferred to another entity that could actually use the irrigation water. No irrigation water is being delivered to lots. There may have been a plan to transfer the shares to another party. In 2011 people started receiving administrative bills from the water users association, but we were told not to pay these pending transfer plans. No updates from Blaine Turner or other Harvest Park contacts. There are also some questions regarding whether it would make sense to sell or retain our individual shares (rather than just transfer them).
PLANS: No details regarding plans.
ACTION: Not aware of specific actions.
16. Trail flooding on K-lot trail
The sidewalk trail between lots K10 and K11 was graded and installed so that the sidewalk is the low point and all water drains to the sidewalk. The developers (Blaine and Jerry) have acknowledged the problem and responsibility for correcting the situation. Several proposals have been considered, but no work has been started. The HOA manager has been pumping water on an intermittent basis, and attempted to manage the sprinkler runoff, but that does not completely resolve the problem (flooding occurs even with rain runoff).
DURATION OF PROBLEM: Since sidewalk installed, although flooding has been a problem since homes have been built adjacent to the trails (2012 in particular).
PLANS: No details regarding plans.
ACTION: No attempts to correct.
DURATION OF PROBLEM: Since platting of the property (some sections back to 2005?)
