North Carolina has had legislation regarding gifted education since 1961. Article 9B, passed into state law in 1996, clearly defines the term gifted as used to identify students for services. Article 9B clearly acknowledges gifted students perform consistently at a higher level than their peers. This higher level of performance requires that services beyond that of the regular classroom teacher be provided for students. Article 9B also establishes that students may be academically or intellectually gifted. The mandate also notes there are gifted students from all racial, cultural, and economic backgrounds. This line in the document requires that all those involved in the identification process actively seek out those who may be underserved within the respective district.
Additionally, the legislation requires school districts to develop their own plans for AIG services and evaluate the program with fidelity. Three year goals, reviewed annually, are created for approval by the Durham County Board of Education to strengthen individualized instruction for students. The document also requires the individual districts to address the six (6) components program development addressed in the DPS Local Plan.
