LET'S TALK
After an accommodation has been requested and the essential functions of the position have been identified, an employer and employee are required to discuss the job-related limitations and how the limitations can be effectively overcome with reasonable accommodation. The law provides that the discussion must be timely in relation to the request, interactive in that it is between both parties, and accomplished in good faith. This meeting is designed to have the employer and the employee jointly explore reasonable accommodation options. As such, a decision on the request for reasonable accommodation does not need to be made at this meeting.
