The episode prompted wider scrutiny of the ride-hailing service that is now banned in some parts of the country. The company started operating in the Delhi region of India in late 2013, but has not screened those drivers, according to local Uber executives. Previously, Uber accepted new drivers if they presented proof of insurance, a driver’s license and a commercial permit to drive a taxi.

Ban the box refers to the check box on employment applications asking whether the candidate has ever been convicted of a crime. Ban-the-box laws often require hiring managers to put off asking about a candidate’s criminal history until after an interview has been conducted or a provisional job offer has been extended. “In the past few years there has been a huge increase in ban-the-box legislation at the state and local level,” said Pamela Q. Devata, a partner in the labor and employment practice group at Seyfarth Shaw. “Given that this trend likely will continue, I believe many employers nationwide will either stop asking about criminal history altogether or ask about it much later in the hiring process.”

However, that Uber is only now checking drivers with an increased level of scrutiny is of scant consequence to the victim, who has since filed a lawsuit in the U.S..
