There are several types of criminal background records or proof of good behavior an individual can obtain. It all depends on the purpose of the background check. In general terms, we could say there are 3 types:

1. LOCAL BACKGROUND CHECK (USUALLY COVERS A CITY/COUNTY AREA)

From a Police Station. Certain city and/or county police stations provide with this service. For instance, the San Francisco Police Department provides with a Letter of Good Conduct (Clearance Letter). A person can request this letter by mail or in person. Click here for details: Clearance letter for San Francisco County only. The limitation of this type of letter is that it may only contain the information from that local area and may not be sufficient for an individual to proof good behavior. If an individual has lived in different cities/counties, running a statewide or nationwide background check is more useful. Check the next types of background check which are more comprehensive.

2. STATEWIDE BACKGROUND CHECK (CALLED LIVE SCAN APPLICATION IN CALIFORNIA).

For an individual who had lived in different cities/counties within a state, getting a statewide background check is more useful. In California, for instance, the Department of Justice of the state offers a background check named Live Scan (http://oag.ca.gov/fingerprints). A Live Scan application requires the individual to go to a Live Scan location (http://ag.ca.gov/fingerprints/publications/contact.php) to be fingerprinted. After the fingerprints and information of the individual are submitted electronically, the results are sent directly to the individual or to the requesting agency (the entity requesting the individual to do a background check). Here at FNL, we provide Live Scan fingerprint services in downtown San Francisco and, optionally, to cities in the Bay Area via our mobile services. (Click here for more information on our website). We are a private Live Scan provider authorized by the state of California.

Do you need a California Apostille on your California Criminal History Background Check? If you are planning to move, start a new job, get married, adopt, obtain dual citizenship, or continue education in another country, you will be required to obtain an apostille on your California Criminal History Background Check. In most cases, you will also be asked to obtain an apostille on your FBI Background check too. More information here: FBI Apostille During the past few months, we have noticed many countries who are not members of the Hague Apostille Convention request individuals to obtain their background check from the State and Federal Government. It’s important to know what documents are being requested in order to avoid any delays.

Law enforcement agencies around the country are increasingly embracing biometric technology, which uses intrinsic physical or behavioral characteristics—such as fingerprints, facial features, irises, tattoos, or DNA—to identify people, sometimes even instantly. Just as the technology that powers your cell phone has shrunk both in size and cost, mobile biometric technologies are now being deployed more widely and cheaply than ever before—and with less oversight. EFF and MuckRock News teamed up in August to reveal how state and local law enforcement agencies are using mobile biometric technology in the field by filing public records requests around the country. With the help of members of the public who nominated jurisdictions for investigation, we have now obtained thousands of pages of documents from more than 30 agencies.

The purpose of this report is to provide the reader with a comprehensive understanding of available background checks, and to then examine the types of checks in use to vet for-hire drivers in a variety of jurisdictions. Since there are differing standards for the types of checks in use by jurisdictions, there are legitimate concerns as to how these varying standards put the riding public at risk. Based on our review of the litigation and legal questions that have been raised concerning current practices for examining the criminal histories of driver-applicants, as well as the potential for disparate reporting of arrests of licensees, we seek to determine the “best practices” for ensuring that those who drive the public meet basic requirements in the local jurisdictions.
