AN ORDINANCE REORGANIZING TITLE 15 AND TITLE 17 OF THE RUTLAND MUNICIPAL CODE BY RENUMBERING AND REDESIGNATING THE SECTIONS THEREIN.
Whereas, the Rutland Municipal Code, 2020, is the official codification and publication of the general and permanent ordinances of the Village of Rutland.
Whereas, the current configuration and organization of Title 17 of the Rutland Municipal Code, 2020, is becoming inadequate for legislation heretofore enacted, and which may be further enacted, and the Village Council finds the general and permanent ordinances of the Village of Rutland therein codified and published can be better organized, reorganized, codified and recodified for the improved usage of the Municipal Code.
Therefore, Be it Ordained by the Village Council of the Village of Rutland, in the County of Meigs, State of Ohio,
That, this Ordinance shall be known as the “Improved Municipal Law Accessibility and Recodification Act”.
That, the following new chapters of the Municipal Code be and are hereby created:
(A) Under existing Chapter 150, designated, “General Provisions”, the following sections shall be organized:
(1) §§150.03 through 150.14 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing parks and recreation.
(2) §§150.17 through 150.44 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing planning and zoning.
(3) §§150.45 through 150.59 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing streets, rights-of-ways and addressing.
(4) §§150.60 through 150.75 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing the Department of Buildings.
(B) Chapter 151, designated, “Agriculture, Animals and Livestock”, and organized under Title 15 of the Municipal Code.
(C) Chapter 152, designated, “Commercial and Residential Development”, and organized under Title 15 of the Municipal Code. Under Chapter 152, the following sections shall be organized:
(1) §§152.001 through 152.024 shall be reserved for legislation heretofore enacted, and which may be further enacted, providing for general provisions.
(2) §§152.025 through 152.199 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing commercial structures.
(3) §§152.200 through 152.274 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing residential structures.
(4) §§152.275 through 152.349 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing dangerous dwellings and structures.
(5) §§152.350 through 152.424 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing manufactured homes.
(D) Chapter 153, designated, “Flood Hazard Mitigation”, and organized under Title 15 of the Municipal Code.
(A) That, existing Chapter 170 shall be and is hereby redesignated as “The Municipality and its Government”. Under Chapter 170, the following sections shall be organized:
(1) §§170.001 through 170.024 shall be reserved for legislation heretofore enacted, and which may be further enacted, governing the Municipality.
(2) §§170.025 through 170.074 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the Office of the Mayor.
(3) §§170.075 through 170.099 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the Office of the Clerk-Fiscal Officer.
(4) §§170.100 through 170.124 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the Office of the Marshal; Department of Police and Auxiliary Police.
(5) §§170.125 through 170.149 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the Office of the Street Commissioner; Department of Public Service.
(6) §§170.150 through 170.174 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the Department of Code Enforcement.
(7) §§170.175 through 170.199 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the Department of Information Technology.
(B) That, existing Chapter 171 shall be and is hereby redesignated as “Other General Regulations”. Under Chapter 170, the following sections shall be organized:
(1) §§171.001 through 171.014 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing the burial of indigent persons.
(2) §§171.015 through 171.029 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing juveniles.
(3) §§171.030 through 171.049 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing property, utility and motor vehicle taxation.
(4) §§171.050 through 171.089 shall be and are hereby reserved for legislation heretofore enacted, and which may be further enacted, governing municipal income taxation.
(A) That, the following sections of existing Title 17, Chapter 170 be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 and Section 3 of this Ordinance, as follows:
(1) Renumber and redesignate §§170.01 (170.102), 170.02 (170.103), 170.03 (170.104), 170.04 (170.105), 170.05 (170.106), 170.06 (170.107); and unreserve and remove sections 170.07 through 170.09, related to the auxiliary police unit.
(2) Renumber and redesignate §§170.10 (170.006), 170.11 (170.007), and 170.12 (170.008); and unreserve and remove §§170.13 through 170.19, related to common seals and insignia.
(3) Renumber and redesignate §§170.20 (170.0821) and 170.21 (170.0822); and unreserve and remove §§170.21 through 170.30, related to special funds.
(4) Renumber and redesignate §§170.30 (170.125), 170.31 (170.128); and unreserve and remove §§170.32 through 170.39, related to the Department of Public Service.
(5) Renumber and redesignate §§170.40 (170.075), 170.41 (170.077), 170.42 (170.078), 170.43 (170.079), 170.44 (170.080), 170.45 (170.081); and unreserve and remove §§170.46 through 170.50, related to the Office of the Clerk-Fiscal Officer.
(6) Renumber and redesignate §§170.51 (170.030); and unreserve and remove §§170.52 through 170.59, related to employment procedures.
(7) Renumber and redesignate §§170.60 (170.031), 170.61 (170.084), 170.62 (170.085), 170.63 (170.086), and 170.64 (170.087); and unreserve and remove §§170.65 through 170.69, related to administrative fees and The Village Record.
(8) Renumber and redesignate §§170.70 (170.176), 170.71 (170.177), 170.72 (170.178), and 170.73 (170.179); and unreserve and remove §§170.74 through 170.89, related to the Department of Information Technology.
(9) Renumber and redesignate §§170.90 (170.025), 170.901 (170.026), 170.91 (170.027), 170.92 (170.076), 170.93 (170.100), 170.931 (170.101), 170.94 (170.126), 170.941 (170.127), 170.95 (170.028), and 170.99 (170.029).
(B) That, the following sections of existing Title 17, Chapter 172 be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance, as follows:
(1) Remove §172.01; and renumber and redesignate §§172.02 (150.09), 172.03 (150.08); and unreserve and remove §§172.04 through 172.09, related to parks and recreation regulations.
(2) Renumber and redesignate §170.10 (150.04), remove section §172.11; renumber and redesignate §§172.12 (150.05) and 172.13 (150.06); remove §§172.14 and 172.15; renumber and redesignate §172.151 (150.07); and remove §172.16, related to the Department of Parks and Recreation.
(C) That, the following sections of Title 17, Chapter 173 of the Municipal Code be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance, as follows:
Renumber and redesignate §§173.01 (153.01), 173.02 (153.02), 173.03 (153.03), 173.04 (153.04), 173.05 (153.05), 173.06 (153.06), 173.07 (153.07), 173.08 (153.08), 173.09 (153.09), 173.10 (153.10), 173.11 (153.11), 173.12 (153.12), 173.13 (153.13), 173.14 (153.14), 173.15, (153.15), 173.16 (153.16), 173.17 (153.17), 173.18 (153.18), 173.19 (153.19), 173.20 (153.20), 173.21 (153.21), 173.22 (153.22), 173.23 (153.23), 173.24 (153.24), 173.25 (153.25), 173.26 (153.26), 173.27 (153.27), 173.28 (153.28), 173.29 (153.29), 173.30 (153.30), 173.31 (153.31), 173.311 (153.32), 173.32 (153.33), 173.33 (153.34), 173.34 (153.35), 173.35 (153.36), 173.36 (153.37), 173.37 (153.38), 173.38 (153.39), 173.39 (153.40), 173.40 (153.41), 173.41 (153.42), and 173.99 (153.99), related to flood hazard mitigation.
(D) That, the following sections of Title 17, Chapter 174 of the Municipal Code be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance, as follows:
(1) Renumber and redesignate §§174.01 (150.10) and 174.02 (150.451); and unreserve and remove §§174.03 through 174.09, related to public roads.
(2) Renumber and redesignate §174.10 (150.461); unreserve and remove §§174.11 through 174.18; and renumber and redesignate section 174.19 (170.461), related to parking regulation.
(E) That, the following sections of Title 17, Chapter 175 of the Municipal Code be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance, as follows:
(1) Renumber and redesignate §§175.01 (150.60), 175.02 (150.61) and unreserve and remove §§175.03 through 175.09, related to the Department of Buildings.
(2) Renumber and redesignate §§175.10 (152.001), 175.11 (152.002), 175.12 (152.003), 175.13 (152.004); unreserve and remove §§ 175.14 through 175.19, renumber and redesignate §§ 175.20 (152.010), 175.21 (152.011), 175.22 (152.012), 175.23 (152.013); unreserve and remove §§175.24 through 175.29, related to development, concrete work and fencing permits.
(3) Renumber and redesignate §§175.30 (152.350), 175.31 (152.351), 175.32 (152.352), 175.33 (152.353); unreserve and remove §§175.34 through 175.40, related to manufactured homes.
(4) Renumber and redesignate §§175.41 (150.47), 175.42 (150.48) and 175.43 (150.49), related to street addressing.
(F) That, the following sections of Title 17, Chapter 176 of the Municipal Code be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance, as follows:
(1) Renumber and redesignate §§176.01 (171.001), 176.02 (171.002), 176.03 (171.003), 176.04 (171.004), 176.05 (171.005), 176.06 (171.006), 176.07 (171.007); and unreserve and remove §§176.08 through 176.09, related to burial of indigent persons.
(2) Renumber and redesignate §§176.10 (152.275), 176.101 (150.30), 176.102 (152.276), 176.103 (152.277), 176.11 (152.278), 176.12 (152.279), 176.13 (152.280), 176.14 (152.281), 176.15 (152.282), 176.16 (152.283), 176.17 (152.284) and unreserve and remove §§176.18 through 176.19, related to public nuisances.
(3) Renumber and redesignate §§176.20 (151.60) and 176.21 (151.61) and unreserve and remove §§176.22 through 176.29, related to animals and livestock.
(4) Renumber and redesignate §§175.43 (150.49) and unreserve and remove §§176.31 through 176.49, related to property standards.
(5) Renumber and redesignate §§176.50 (171.015) and unreserve and remove §§176.51 through 176.59, related to curfew.
(G) That, the following sections of Title 17, Chapter 177 of the Municipal Code be and are hereby renumbered and redesignated to the new Code section set forth opposite thereto in parenthesis, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance, as follows:

(H) That, §179.01 of the Municipal Code be and is hereby renumbered and redesignated to §171.090 of the Municipal Code, and accordingly reorganized under the appropriate chapter of the Municipal Code pursuant to Section 2 of this Ordinance.
That, §176.60; 176.601, 176.602, 176.61, 176.611, 176.612, 176.62, 176.62, 176.622, 176.623, 176.624, 176.63, 176.64 and 176.65, related to cannabis control, are hereby found to be in conflict with §138.02 of the Municipal Code, and that the same shall be and is hereby repealed.
The Mayor shall cause the Municipal Code sections herein set forth, and as renumbered and redesignated, to be recodified in the Municipal Code as so renumbered and redesignated, not later than thirty days from the date of the passage of this Ordinance.
The Mayor shall cause the publication of the Rutland Municipal Code, 2020, as amended, as recodified in accordance with this Ordinance and in accordance with division (A) through (E) of this section not later than sixty days from the date of the passage of this Ordinance.
(A) An official book publication of the American Legal Publishing Corporation’s Ohio Basic Code, most recent edition, therein comprising the provisions of Title 1, Title 3, Title 9, Title 11 and Title 13 of the Rutland Municipal Code, 2020, as amended, shall be kept under the custodianship of the Village Clerk-Fiscal Officer, and may be accessed upon request of any person during regular municipal hours of operation.
(B) An official book publication of Title 5, Title 15 and Title 17 of the Rutland Municipal Code, 2020, as amended, shall be kept under the custodianship of the Village Clerk-Fiscal Officer, and may be accessed upon request of any person during regular municipal hours of operation.
(C) An electronic publication of the American Legal Publishing Corporation’s Ohio Basic Code, most recent edition, therein comprising the provisions of Title 1, Title 3, Title 9, Title 11 and Title 13 of the Rutland Municipal Code, 2020, as amended, shall be published via the internet.
(D) An electronic publication of Title 5, Title 15 and Title 17 of the Rutland Municipal Code, 2020, as amended, shall be published via the internet.
The Village Council, by vote of at least three fourths of the members elected or appointed thereto, a quorum of which being present, hereby waives the three readings of this Ordinance as authorized pursuant to section 731.17(A)(2) of the Ohio Revised Code, to facilitate the immediate preservation of the health, safety and welfare through the expedient reorganization of Title 15 and Title 17 of the Rutland Municipal Code to include legislation heretofore enacted, and which may be further enacted, providing for such preservation, and for the same to be rendered more easily accessible.
