§170.025 SALARY OF THE MAYOR.

The salary of the Mayor of the municipality shall be and is hereby fixed at six thousand dollars and 00/100 annually, which shall be equally apportioned to each biweekly pay period. The Mayor shall afford not less than eight hours of administrative service to the municipality each biweekly pay period. Each cumulative period of two hours of administrative service in which the Mayor fails to fulfill in a biweekly pay period shall result in a deduction from the salary fixed herein in the amount of twenty-five percent.

§170.026 SALARY OF THE ASSISTANT TO THE MAYOR - CLERK OF COURT.

The salary of the Assistant to the Mayor and Clerk of Court shall be and is hereby fixed at thirteen dollars hourly. The Mayor shall, by executive order, annually prescribe the hours of service to be fulfilled by the Assistant to the Mayor and Clerk of Court subject to the maximum public funds appropriated for the compensation thereof.

§170.027 SALARY OF A MEMBER OF VILLAGE COUNCIL.

The salary of a Member of the Village Council of the municipality shall be and is hereby fixed at six hundred dollars and 0/100 annually, which shall be equally apportioned to each calendar month. If a Member of the Village Council of the municipality is absent during any meeting held in a calendar month, the Village Clerk-Fiscal Officer shall withhold the monthly compensation for such member.

§170.028 FORFEITURE OF SALARY.

(A) The Mayor and any Member of Village Council may declare forfeiture, in whole or in part, of the salary set forth in §170.90 and §170.91 of the Municipal Code, respectively. Such forfeiture shall be declared in writing, shall not extend beyond the thirty-first day of December of the fiscal year during which it is forfeited, and shall be filed with the Village Clerk-Fiscal Officer. Upon receipt of a written declaration of forfeiture of salary, the Village Clerk-Fiscal Officer shall abstain from fulfilling the compensation and salary requirements set forth in §170.90 and §170.91 of the Municipal Code.

(B) The declaration of the forfeiture authorized pursuant to division (A) of this section, in whole or in part, may be revoked by the declarant at any time following the declaration by communicating notice of the same in writing and filed with the Village Clerk-Officer. Upon receipt of notice of the same, the Village Clerk-Fiscal Officer shall fulfill the compensation of the salary requirements set forth in §§170.90 and 170.91 of the Municipal Code beginning the compensation period next after the date of receipt of notice of the same.

§170.029 APPROPRIATION OF PUBLIC FUNDS FOR SALARIES.

The Village Council shall annually promulgate in the annual appropriations ordinance of the Municipality the total amount of public funds to be appropriated for the salaries and hourly wages set forth in §§170.90 through 170.98 of the Municipal Code.

§ 170.030 CRIMINAL BACKGROUND CHECK REQUIRED FOR EMPLOYMENT.

(A) In addition to the requirements set forth in §§30.12, 31.015, 31.044(B)(4)(a), 31.080, 32.004, 32.005, 34.02, 34.03, 34.04, 34.05, 170.03, 170.43 of the Municipal Code, and any other substantially equivalent municipal ordinance, prior to the appointment of an applicant to the office of the Mayor, or member of Village Council, when in the case of filling a vacancy; or for Village Clerk-Fiscal Officer, Village Marshal, deputy marshal or auxiliary deputy marshal; Village Street Commissioner, deputy street commissioner, assistant or laborer; or Director of Parks and Recreation, or any other employment position, the Mayor, or in the case of the appointment of the Mayor, the president pro tempore of Village Council, shall require the candidate to complete a criminal background check administered by the Ohio Bureau of Criminal Investigation and Identification through the County Sheriff. The County Sheriff shall transmit the results of the same to the Mayor, who shall file with the Village Marshal.

(B) If the criminal background check completed pursuant to division (A) of this section finds that an applicant has been convicted of a felony, or theft, or a violent crime; or if such applicant is found to have issued against them in the name of a state, county, or municipal corporation a warrant for their arrest, such applicant shall be ineligible for appointment to the office of the Mayor, or member of Village Council, when in the case of filling a vacancy; or for Village Clerk-Fiscal Officer, Village Marshal, deputy marshal or auxiliary deputy marshal; Village Street Commissioner, deputy street commissioner, assistant or laborer; or Director of Parks and Recreation, or any other employment position.

(C) Each applicant for Mayor or member of Village Council, when in the case of filling a vacancy; or for Village Clerk-Fiscal Officer, Village Marshal, deputy marshal or auxiliary deputy marshal; Village Street Commissioner, deputy street commissioner, assistant or laborer; or Director of Parks and Recreation, or any other employment position shall, prior to completing a criminal background check pursuant to division (C) of this section, remit payment to the Village Clerk-Fiscal Officer in the sum of seventy dollars, to be deposited into the general fund of the Municipality, and withdrawn therefrom to the reimbursement to the applicant, if the same is found, through a criminal background check, to have no conviction of a felony, or theft, or a violent crime; and to have no warrant issued against them for their arrest.

(D) As used in this section, “employment position” means a position filled by a person to complete prescribed duties, a scope of work, or render services and be compensated for the same.

§ 170.031 FEES FOR CERTIFICATES, LICENSES AND PERMITS.

When, in the Municipal Code, any section provides for the issuance of certificate, license or permit, and for which a fee is not fixed, a general fee in the sum of $25.00 shall be assessed at the time of application for such certificate, license or permit.
