(A) There is hereby established the Village of Rutland Service Department, the head of which shall be the Village Street Commissioner, who shall be appointed and serve as provided pursuant to § 31.080 of the Municipal Code, and who shall report to and be accountable to the Mayor.
(B) Under the direction of the Village Street Commissioner, subject to any general orders or rules prescribed by the Mayor:
(1) The Service Department shall be responsible for the improvement, maintenance, repair and servicing of streets, avenues, alleys, lands, lanes, squares, wards, landings, market houses, bridges, viaducts, sidewalks, sewers, drains, ditches, culverts, ship channels, streams, and water courses.
(2) The Service Department shall be responsible for the improvement, maintenance, repair and servicing of all public buildings and spaces owned by the Village of Rutland; and shall likewise be responsible for the maintenance of lighting, sprinkling and cleaning of all public places.
(3) The Service Department, when ordered by the Mayor, upon completion of the procedure set forth in Chapter 93 and Chapter 95 of the Municipal Code, shall be responsible to, on private property and places, destroy noxious weeds and high grass, remove abandoned vehicles and junked motor vehicles and litter in violation of Chapter 93 and Chapter 95 of the Municipal Code.
(C) Notwithstanding §31.082 of the Municipal Code, the Village Street Commissioner may appoint or employ assistants and general laborers, subject to the approval of the Village Council. In the absence of such assistants and general laborers, the Village Street Commissioner shall perform and carry out the duties prescribed of the Service Department.
(D) The salary of the Village Street Commissioner and of his assistants and general laborers shall be fixed by resolution of the Village Council upon appointment or employment.
(E) The Village Street Commissioner need not be a resident of the Village at the time of appointment, nor during his term of service.

The salary of the Village Street Commissioner shall be and is hereby fixed at fifteen dollars and 0/100 hourly. The Mayor shall, by executive order, annually prescribe the hours of service to be fulfilled by the Village Street Commissioner subject to the maximum public funds appropriated for the compensation thereof.

The salary of assistants, deputies or general laborers under the supervision of the Village Street Commissioner shall be and is hereby fixed at thirteen dollars and 00/100 hourly. The Mayor shall, by executive order, annually prescribe the hours of service to be fulfilled by the Village Street Commissioner subject to the maximum public funds appropriated for the compensation thereof.

(A) Subject to division (A)(1) through (A)(4) and division (B) of this section, the Village Clerk-Fiscal Officer shall annually encumber one thousand, two hundred dollars from the street construction, maintenance and repair fund of the municipality, one hundred dollars of which to be apportioned to each calendar month to be made payable to the Village Street Commissioner as a vehicle maintenance allowance, Provided:
(1) The Village Street Commissioner has filed with the Village Clerk-Fiscal Officer a copy of the registration of his personally owned vehicle utilized for the purpose of the fulfillment of his prescribed duties;
(2) The Village Street Commissioner has filed with the Village Clerk-Fiscal Officer a current, up-to-date address of residence.
(3) The Village Street Commissioner has utilized his personally owned vehicle for the purpose of the fulfillment of his prescribed duties for a minimum of seventy five percent of the calendar days in the calendar month during which the Village Street Commissioner fulfilled his or her prescribed duties;
(4) The Village Street Commissioner has maintained a daily log recording the utilization of his or her personally owned vehicle for the purpose of the fulfillment of his or her prescribed duties, such log including the following:
(a) The date, time, starting mileage and ending mileage of the vehicle personally owned by the Village Street Commissioner utilized for traveling from his or her current place of residence to the municipal building or maintenance garage, and from the municipal building or municipal maintenance garage to his or her current place of residence.
(b) The date, time, starting mileage and ending mileage of the vehicle personally owned by the Village Street Commissioner upon traveling from the municipal building or municipal maintenance garage for the purpose of completing a work order or series of work orders; and from the location of such work order or series of work orders to the municipal building or municipal maintenance garage, and to and from the various locations of such work orders or series of work orders.
(c) The date, time, starting mileage and ending mileage of the vehicle personally owned by the Village Street Commissioner upon traveling from the municipality for the purpose of gathering equipment, tools or materials; the location at which such equipment, tools or materials were obtained; and from such location to the municipality.
(B) Not later than the first Friday of each month, the Village Street Commissioner shall file the log for the preceding month required pursuant to division (A) of this section with the Village Clerk-Fiscal Officer. Upon receiving the same, the Village Clerk-Fiscal Officer shall examine for completeness and compliance with division (A) of this section. If the log is found to be complete and in compliance with division (A) of this section, the Village Clerk-Fiscal Officer shall approve the log and issue a treasury warrant in the amount of one hundred dollars in favor of the Village Street Commissioner and record the same upon the statement of accounts of the municipality.
(C) The Village Street Commissioner shall file with the Village Clerk-Fiscal Officer all receipts documenting expenses incurred in the maintenance or servicing of the personally owned vehicle utilized for the purpose of the fulfillment of his duties. Upon receipt, the Village Clerk-Fiscal Officer shall maintain a record of the same, which shall be subject to public inspection.
(D) Notwithstanding division (B) of this section, the Village Clerk-Fiscal Officer shall withhold a treasury warrant in the amount of one hundred dollars in favor of the Village Street Commissioner if the Village Clerk-Fiscal Officer reasonably believes the information provided on the daily log is inaccurate or incomplete. In such case, the Village Street Commissioner may appeal the decision of the Village Clerk-Fiscal Officer to the Village Council during the next regular meeting of the same and the Village Council shall, by majority vote, pass a motion or resolution upholding the decision of the Village Clerk-Fiscal Officer or revoking the decision of the Village Clerk-Fiscal Officer. If the motion or resolution passed revokes the decision of the Village Clerk-Fiscal Officer, the Village Clerk-Fiscal Officer shall issue the treasury warrant in accordance with division (B) of this section.
